ZONING HEARING BOARD


PUBLIC HEARING

NOTICE is hereby given that the Zoning Hearing Board will meet in
Council Chambers, Room #118, City Hall, 435 Hamilton Street, Allentown, PA on
Monday, March 16, 2009, at 7:00 p.m. for the purpose of hearing the following appeal.

APPELLANT MUST APPEAR AT MEETING

1. A-62314 301 S. St. Elmo Street Appeal of Artemis Management,


LLC to construct 103-BED DRUG AND ALCOHOL REHABILITATION FACILITY (78′ x
336.67′), 3 story, and attached MULTI-PURPOSE BUILDING (63.67′ x 162.46′), 2 story,
and erect 2 FREESTANDING SIGNS (4′ x 4′ each), interior illuminated, 1 at front and 1
at Fairview Street entrance, being a change in use verbally granted by the Zoning
Hearing Board under Application No. 62202 on January 26, 2009 , exceeding maximum
allowable number of residents (30 permitted; 103 proposed), having insuff. off-street
parking (111 spaces req.; 71 spaces proposed), not having required off-street loading
spaces (5 req.; 0 proposed), or parking lot landscaping (10% req.; 0% proposed), or
parking area trees (8 req.; 0 proposed), or planting strip or street trees along St. Elmo
Street (8 req.; 0 proposed), located in a Parks (P) District. The Applicant seeks a use or
validity variance. Applicant believes the proposed facility would serve a “protected
class” of persons and the requirements of the City of Allentown Zoning Ordinance
constitute a governmental burden which is impermissible under applicable statutes.
Applicant files a challenge to the substantive validity of the Allentown City Zoning
Ordinance on the basis that it is exclusionary with respect to the proposed use under
Section 909.1 (a) (1) of the Municipalities Planning Code.

All persons interested or those desiring to protest against the allowance of the above
appeal may appear and be heard. The appeal listed above may be reviewed at the
Zoning Office, 4th Floor, City Hall, 435 Hamilton Street, Allentown, Pennsylvania.
