This directory replaces the Directory of Arbitrators/Adjudicators issued in May 2011 by the Institution of Engineers, Sri Lanka.

PREFACE
The Institution of Engineers, Sri Lanka (IESL), notes that in the recently published documents on Conditions of Contracts, a new dispute dissolution mechanism has been introduced. According to this mechanism, in addition to the Engineer, who is the Administrator of the contract, a Dispute Adjudication Board has been introduced so that parties could refer their disputes to the Dispute Adjudication Board if one of the parties disagrees with the decision of the Engineer. There is a further provision in the Conditions of Contract, to the effect that when a party if dissatisfied with the decision of the Adjudication Board, that party could refer the same matter to an Arbitrator or to an Arbitral Tribunal with a view to obtaining a final decision. The Arbitration Act, identified as the Arbitration Act No. 11 of 1995, was passed by the Parliament of the Democratic Socialist Republic of Sri Lanka in the year 1995 to provide for the conduct of arbitration proceedings in Sri Lanka and to give effect to the New York Convention of recognition and enforcement of foreign arbitral awards. With the introduction of the Arbitration Act, arbitration has taken a new turn in the commercial field, where parties could resolve their disputes by referring to arbitration. Therefore IESL has identified the need for a directory of members qualified to sit as Adjudicators and/or Arbitrators. At the same time there had been many requests made by parties involved in the construction industry to nominate Adjudicators and/or Arbitrators to resolve their disputes. In pursuance of this, a Directory of Adjudicators and Arbitrators has been compiled to fulfill this need. Accordingly, the IESL has shortlisted from among its members, those who are having a reasonable knowledge, experience and have followed pertinent courses in adjudication and/or arbitration to be included in this Directory. Those who are in the construction industry may select Adjudicators and/or Arbitrators from this Directory if and when their services are required. The members whose names have been listed in this Directory are all Members of the IESL at the time of the release of this Directory. In the qualifications of members who are listed here, the fields of their specialties are also given under their names after verification of those qualifications. Other than the information listed in the said Directory, the IESL is not in a position to provide any additional information about the members listed. The additional information required will have to be obtained and verified by the party who selects the Adjudicator and/or Arbitrator.

However, some of the members listed here may have obtained further qualifications from Institutions which have limited recognition and the IESL is not in a position to evaluate these qualifications as to whether they are acceptable in Sri Lanka as educational qualifications or professional qualifications. The IESL also wishes to state that it will not take any responsibility or entertain any claim or liability for any acts of commissions or omissions made by any of the members whose names are listed in this Directory, when they take part in Adjudication and/or Arbitration. Therefore, the selection of an Adjudicator/s and/or Arbitrator/s has to be made by the selecting party at its own risk by evaluating the past performance of the member concerned and the experience he/she has gained in a similar capacity. As the IESL does not have a standard fee structure for Adjudicators and/or Arbitrators, the remuneration that has to be paid to the Adjudicators and/or Arbitrators as the daily fee or as the retainer fee or as both has to be agreed before they are appointed by the parties who require their services.
