We write to propose # resolution to the Department of Justice’s pattem or practice civil
rights investigation of officer-involved shootings by the City of Miami Police Department
(MPD"). As you know, on September 30, 2013 we sent the City of Miami a proposed consent
deoree to resolve our finding of a pattern and practice of civil rights violations, On February 6,
2014, we had our first of numerous face-to-face negotiation sessions in Miami, Our most recent
negotiation session was on January 22, 2015. Since then, our repeated phone calls and emails to
your office have gone unanswered. From this unwillingness to communicate on your part, we
‘can conclude only that the City no Longer wishes to negotiate an agreement to amicably resolve
our investigative findings,
We are prepared to take all necessary steps to bring about a resolution of this matter. We
request that you reply within one week of thie date of this letter with a timetable for resuming
negotiations in April and concluding them by May 2015,
Ifthe City of Miami does not wish to resume and conclude negotiations, we request that
you provide dates in April and May 2015 duriag which we and our expert consultants can
‘conduct a supplemental investigatory site inspection. For this visit, we request thet you provide
the following documents within the next two weeks, in eleetronie format:
1. Complete files forall police-involved shootings occurring on or efter Fuly 9, 2013;
2. Copies of all MPD policies und procedures, including policies and procedures to
‘which changes haye been made since July 9, 2013;
3. Copies of all training curricula, schedules, and attendance records for all use of force
training given to MPD officers since July 9, 2013;4, Copies ofall complaints alleging officer misconduct in officer-invoived shootings,
including investigations and resolution of these complaints, and
5, Description of MPD's current systems for risk management.
