In the case where a member is repeatedly absent or unable oF ‘unwilling to participate as a member of the Community Garden Commission, the ‘Chairperson of the Commission may recommend tothe Mayor that the member appointment tothe Commission be terminated. Should the Mayor accept recommendation the Mayor shall terminate the appointment ofthe member and then appoint a new member Section 2-553: Organization ‘The members of the Community Garden Committee shall annually, tthe first meeting in (November), by a majority vote of the committe, elect a Csixperson from arnong its ‘membership, and shall similaly elect « Vice-Caieperson. The Chaitperson shall conduct the meetings of the Community Garden Commission, and the Vice-Chairperson shall act inhis or her absence. For good cause, the Chairperson or a majority of the members of the Commission shall have the power to call emergeney meetings so long there is compliance with the provisions ofthe Massachusetts Open Meeting Law. Seotion 2-554: Regulations After public notice and public hearing, the Commission shall promulgate mules and regulations to effectuate the purposes o this ordinance. The regulation shall be effective ‘when voted and filed atthe office ofthe City Clerk of the City of Medford, Failure by the ‘Commission to promulgate such rules and regulations ora legal declaration oftheir invalidity by court of law shall not aet to suspend or invalidate the effec ofthis ordinance. Ata minimum, any regulations promulgated shall define key terms set forth in this ordinance and shall not be inconsistent with is terms. The regulations may gover, among other things, the amount and purpose of fees Seotion 2-585: Applications and Fees “The Commission may approve annual fes fo allocated garden plots to cover necessary garden expenses, The fees are to be reasonable and reflect necessary garden expenses and costs. The Commission may aceept recommendation from the participants of each garden sto proposed fees to insure equitable and fair treatment ofall community garden members.
