First Cause of Action (Susan MeNeece) - (Personal Injury) Plaintiff SUSAN MCNEECE complains of the defendants, and each of them, and for a daxvd First Cause of Action alleges that: 1 Plaintiff SUSAN MCNEECE is an individual, and a resident of the City of Oakland, County of Alameda. 2. Plaintiff ANGELA SIMMONS is an individual, and a resident of the City of Oakland, County of Alameda. 3. Defendant SERIGNE GUBYE is an individual, Plaintiff is informed and believes and on that basis alleges that SERIGNE GUEYE resides in the City and County of Sacramento, 4, Atalll times herein mentioned, defendants UBER TECHNOLOGIES, INC., RASIER LLC and RASIER-CA LLC were business organizations, the nature and form of which COMPLAINT FOR DAMAGEN- CASENO. 1]| are unknown to plaintiffs at this time, and plaintiffs pray leave to amend this complaint when the same is finally ascertained. At all times herein mentioned, the aforesaid defendants conduct business in the State of California and have their principal place of business in San Francisco, California, 5. The true names or capacities, whether individual, corporate, governmental or associate, of the defendants named herein as DOE are unknown to plaintiff, who therefore sues said defendants by such fictitious names. Plaintiff prays leave to amend this Complaint to show their true names, capacities, or basis of liability when the same have finally been determined. 6. Onor about July 26, 2014, at or around 1:30 AM of said day, plaintiff SUSAN 26 || MCNEECE and plaintiff ANGELA SIMMONS were passengers lawfully riding in the above- 27)| described Nissan Altima as it travelled up the freeway onramp onto southbound Interstate 880 near 28 || its intersection with Washington Street in the City of Oakland, County of Alameda, State of eer 2 i ‘COMPLAINT FOR DAMAGES CASE NO, » California. 11. Atsaid time and place, defendants, and each of them, so carelessly and negligently drove, operated, owned, entrusted, and controlled the above-described Nissan Altima so as to cause it to accelerate backwards and collide with a concrete barrier. 12. Asa direct and legal result of the negligence of the defendants, and each of them, plaintiff SUSAN MCNEECE sustained the injuries and damages hereinafter set forth: injuries to her neck, back, and head, including vertigo and balance problems as well as other injuries presently undiagnosed. Plaintiff is informed and believes, and therefore alleges upon such information and belief, that certain of said injuries will be permanent in nature, the extent of said permanent injuries being at this time unknown to plaintiff. 13, By reason of the premises, it became necessary for plaintiff SUSAN MCNEECE to inur expenses for medical cave and treatment and related costs and expenses required in the care and treatment of said injuries, and plaintiff's damage in this respect is ongoing and presently unascertained. Plaintiff prays leave to insert the elements of damage in this respect when the same are fully determined. 14, By reason of the premises, plaintiff SUSAN MCNEECE has been unable at times to follow her regular employment, to her special damage in a presently unascertained sum as said Joss is not yet finally determined, and plaintiff prays leave to amend this complaint and insert the elements of damage in this respect when the same are finally determined, 15.
