In supersession of DGQA/Adm-7B letter No. A/96995/JCM/DGQA/ADM-7B dated 10 May 1993 in so far as it relates to transfer on compassionate grounds, revised guidelines on the subject are laid down in succeeding paragraphs for strict compliance by all concerned with immediate effect. General 2. The competent authority for finally accepting or rejecting the request of an individual for transfer on compassionate ground will be ADG of the Technical Dte concerned in respect of technical, scientific, drawing and industrial staff and ADG (Adm) in respect of non-technical/ ministerial staff. However, in exceptional cases where such transfer is to establishment not under control of ADG concerned or any of the laid down norms have to be relaxed, prior approval of Spi DGQA/DGQA will be obtained 3. An individual seeking transfer on compassionate grounds will submit the application ‘as per proforma given at Appendix ‘A’ to this letter along with relevant documents in support of the grounds. In the case of application on medical grounds of self or a family member, a medical certificate from a competent medical authority enumerating the medical conditions and circumstances warranting the posting to a particular station should invariably be attached with the application 4. The Head of Establishment (HOE) will thoroughly scrutinize the application submitted by an individual in the light of guidelines/conditions enumerated in this letter. He will verify the grounds on which transfer has been sought and will furnish a certificate to this effect as per Appendix ‘B' to this letter. Application complete in all respects will be forwarded to the Tech Dte/Adm Dte as the case may be for consideration of the ADG. concerned. No application will be forwarded by the Estt with any stipulation/pre-condition, such as provision of prior replacement. Applications forwarded with such stipulations will not be considered. The approach should be to address genuine hardship of the employees as far 2s possible within the constraints of organizational requirement and feasibility, 5. An application for compassionate transfer should be accepted by HOE only on completion of two years service in the present estt. However, ADGQA concemed may consider cases before completion of two years, where there are sufficient grounds for making an exception. In the case of directly recruited Technical and Scientific personnel Covered by Rotational Transfer Policy, application can be considered only on completion of the minimum period on initial posting prescribed under RTP. 6. Travelmovement on compassionate transfers will be at own expenses and the applicant will give an undertaking to this effect as per Appendix ‘C’ to this letter. Where Seniority or promotion of the individual is likely to be adversely affected, an undertaking 8 per Appendix ‘D’ from the individual is to be submitted alongwith the application. 7. Application for transfer within the same station normally will not be considered. However, if such a transfer is sought by an individual due to compelling circumstances/reasons (eg. The applicant is a woman/ person with disability and office is situated at considerable distance from her/his residence) the same will be highlighted by him/her in the application and adequately justified by the HOE. 8. Applications received in the Dte concemed at DGQA HQ will be scrutinized and if found to be complete in all respects will be registered and assigned ‘seniority from the date of receipt in the Die. The registration number allotted should be intimated to the individual through the estt concerned. Applications accompanied by documents required to verify the grounds and undertakings as required in this letter should not be withheld by the estt Incase of applications received on the same date for same station, the one having a higher degree of compassion as decided by ADG will be registered first 9.__ In case an individual makes an application for change in the choice station for compassionate posting, the seniority will be reckoned from the date of such application for the new station, 10. | Posting orders with regard to transfers on compassionate ground will be issued strictly in the order and seniority in the register for the particular station after ascertaining availability of vacancy in the receiving establishment and with the written approval of concemed ADGQA on file. Under no circumstances orders will be issued on verbal directions in this regard. On receipt of the posting order, the applicant will be relieved within seven days and completion report will be forwarded to all concerned within fifteen days 11. Posting order once issued will not normally be cancelled, However, where there are unforeseen change in circumstances, proposal for cancellation of posting order with full facts and justification will be forwarded by the HOE for consideration of the ADGQA concerned. 12. As per GOI MOD letter No. 8(1)/89/D(Appts) dated 02 Feb 1989, the following categories of employees will be given priority over others for compassionate posting to their choice stations:- (@) Where an employee seeks compassionate posting because his/her Parent(s) or wife/husband or children is/are seriously ill, .e., suffering from fatal diseases like cancer, open heart surgery, kidney and liver transplant or a virulent skin disease, where specialist treatment is required but is not available in the station where the applicant is posted, or the like, and asks for compassionate posting on these grounds to a place where medical treatment would be available or better care would be possible. (b) Where the applicant is a widow/single parent and does not have anybody to look after her/the child at the station where she/he is serving. (c) Where the applicant's wife has expired leaving behind one or more small child/children (of less than 12 years) and nobody is available to look after the child/children. Posting of Govt Employees who have Mentally Challenged Children 13. As per DOP&T OM No. AB 14017/41/90-Estt(RR) dated 15 Feb 1991, since the facilities for medical help and education of mentally challenged children may not be available at all stations and a choice in the place of posting is likely to be of some help to the parent in taking care of such a child. Ministries/Departments should take a sympathetic view on the merits of each case and accommodate such requests for posting to the extent possible. While examining and forwarding the requests of such employees for compassionate posting the HOE will keep this aspect in mind and make a specific recommendation to this effect in the application. Posting of Husband and Wife at the Same Station 14. DOP&T OM No, 28034/7/86-Estt (A) dated 03.04.86 and 30.09.2009 provide that as far as possible and within the constraints of administrative feasibility, the husband and wife should be posted at the same station to enable them to lead a normal family life and to ensure the education and welfare of their children. Further it has been reiterated in the DOP&T OM No. 28034/2/97-Estt (A) dated 12 Jun 1997 that the guidelines laid down in OM dated 03.04.86 should be strictly adhered to while deciding on the requests for posting of husband and wife at the same station and ensure that such posting is invariably done, especially till their children are 10 years of age, if posts at the appropriate level exist in the organization at the same station and if no administrative problems are expected to result as a consequence. It has also been stated therein that in cases where only the wife is a government servant, the ibid concession would also be admissible to the government servant. The application of such employees will be examined in the light of these provisions, 15, Notwithstanding, the DGQA may grant relaxation or any overriding priority in any exceptional case whose grounds for compassionate posting warrant such priority over other pending cases. Approval of the DGQA in such cases should be obtained on file. 16. All orders relating to transfers on promotion will be issued only after effecting transfer ‘on compassionate grounds. After that, if a vacancy is available at the station, the individuals on promotion are to be adjusted in-situ strictly as per the seniority in the promotion panel. Under no circumstances a senior individual will be posted out to accommodate retention of his junior in the same station 17.
