SECTION1.SHORTTITLE

ThisactmaybecitedastheAmmunitionModerationActof2015.

SECTION2.FINDINGS

Congressherebyfindsanddeclaresthat,
1)TheAR15weaponplatformutilizesthesamedraftstandardizationagreement,orSTANAG,magazinetypein
most,ifnotall,ofitsvariants.
2)TheuseofSTANAGmagazinesamongmanyweaponplatformsmakestheadoptionofnewmagazinecapacities
easiertoadoptandproduce,ifmanufacturersaregiventheincentivetodoso.
3)Thereiscurrentlynostandardizationforwhatconstitutesalargecapacitymagazine,withlimitsrangingfromten
roundspermagazine,uptounlimited.
4)Acommonexceptiontomagazinelimitationsineventhemostrestrictivestatesisthetubefed.22caliberrifle.
5)From2007to2011,42.8percentoffirearmvictimseitherofferednoresistance,orwereunabletotake
selfdefensivemeasuresofanytype.
6)

From1995to2011,themajorityofnonfatalviolencewithfirearmswasdonewithhandguns.
7)

NATOintermediatecaliberfirearmstypicallyusethe5.56NATOM855cartridge,withaveragecapacityof30
roundspermagazine.
8)

NATOspecifiesthecaliberofmanymilitarygradebattleriflesandpistols,the7.62x51mmand9x19mm
cartridges,respectively.
9)Victimsoffirearmshavefallenfromapproximately563,000in2001to467,000in2011.
10)92percentofgangviolenceusesfirearms,asof2008.
11)Glocksarecurrentlyusedby65percentoflawenforcementintheUnitedStates
12)Commonsemiautomatichandguncalibersinclude9x19mm,40S&W,45Auto,.380Auto,and.357SIG.
13)Averagelawenforcementofficerswillmiss70to80percentofshotsfiredduringsituationsrequiringtheuseofa
firearm,eitherduetoimpropertrainingorsubstandardequipment.
14)Whilehandguncalibersdocausepermanentcavitationwhenimpactingtissue,theydonotcauseanysignificant
temporarycavitation,heavilylimitingtheeffectivenessofaroundwhencomparedtocommonriflecalibers.
15)Revolvercalibercartridgesinclude.357magnum,.44magnum,.38special,.44special,and.500magnum,allof
whichoffersignificantlymorepower,butatthecostofamuchlowerammocapacitycomparedtomodern
semiautomaticpistolsduetothedesignofarevolver,withreliesonatypicalintegralcylinderwithafixedcapacity,
typicallyrangingfrom5to8rounds.

SECTION3.STATUTORYLANGUAGE
A)TheAmmunitionModerationActof2015shallreplacethepreexistingremovablemagazinecapacitylawsofall
States,settingthelegallimitofallsold,transferred,andownedremovablemagazinesattwentyrounds.Thisdoesnot
affectcurrentlawsregardingintegraltubularmagazines
B)Currentlyunsoldmagazinesexceedingthetwentyroundlimitmustbedestroyedwithintwoyearsofthebills
enactmentbytheBureauofAlcohol,Tobacco,Firearms,andExplosives.Magazinesofthiscategorycurrentlyowned
byacitizenoftheUnitedStatesofAmericamaybekept,butmustberegisteredashighcapacitymagazines,and
cannotbetransferredorsoldtoanotherperson.Uponthedeathoftheowner,magazinespreviouslyintheir
possessionmustbedestroyed.
C)Allremovablemagazineswithacapacityexceedingtwentyrounds,aswellasallpartsintendedforuseinsuch
magazines,shallbeillegalforpurchasefromanysuppliers.
D)ThisbillshallbeenactedonJanuary1,2016.Thereisnoexpirationdateforthisbill.
