ofdefenceisfullyempoweredtoremoveencroachmentsarounddefenceestablishmentsin
GurgaonandFaridabadandthestatewouldprovideallkindofassistanceinthisregard.These
submissionsweremadebythestateinresponsetotheissuerelatedtoencroachmentsin
restrictedzonesoftheAirForcestationinGurgaonandFaridabad.
OnOctober6,thehighcourthadmadeitclearthatitwouldaccepttheproposalofreducing
restrictedzonearoundIndianAirForce(IAF)ammunitiondepotinGurgaonfrom900to300
metres,onlyifthestategovernmentundertakestovacatetheencroachmentswithin300metre
area.
RespondingtoHCquery,thestategovernmentsubmittedbeforethecourtonTuesdaythatitis
readytoextendallkindofassistanceandhelptocentralgovernmentorthedefenceauthorities
inremovingencroachmentswithinthereducedareaof300metresaroundtheIAFstationin
GurgaonandFaridabad.
OnapleaofsomeresidentslivingaroundairforcestationinGurgaonseekingdirectionsto
providepowerconnections,theHCrefusedtopassanyorderandadjournedthematterfor
December22forfurtherhearing.
OnSeptember7,thecentralgovernmenthadsubmittedbeforetheHCthattherestrictedzone
aroundammunitiondepotofIndianAirForceinGurgaonhasbeendecidedtobedecreased
from900to300metres.TheCentre,however,hadmadeitclearthattheareaofrestrictedzone
aroundairforcestationinFaridabadshallremain100metresonly.
ThematterispendingbeforetheHCinthewakeofapetitionfiledagainsttheencroachment
aroundprohibitedzonesoftheAirForcestationsinbothGurgaonandFaridabad.
ThematterhadreachedbeforethePunjabandHaryanahighcourtthroughapublicinterest
litigation(PIL)filedbySureshGoyalofFaridabadseekingremovalofconstructionsfrom100

restrictedzonearoundtheIAFammunitiondepotatGurgaonfrom900to300metrescouldbe
permittedonlyifthestategovernmentundertookremovalofencroachmentswithinthe300
meterarea.Takingupthematter,aDivisionBenchofJusticeSatishKumarMittalandJustice
MahavirSinghChauhanalsogaveHaryanatimetillNovember17tofileadetailedreply.
Thedevelopmenttookplaceduringtheresumedhearingoftheongoingpetitionfiledinpublic
interestagainstencroachmentsinprohibitedzonesaroundtheIAFstationsinGurgaonand
Faridabad.Almostayearafterrecommendationsweremadeforreducingtherestrictedzone
from900metersto500metersaroundtheGurgaon,theHighCourtonapreviousdateof
hearingwastoldthattheareawould,infact,bedecreasedto300meters.Astatementtothis
effectwasmadebeforetheDivisionBenchbytheCentralGovernment.Theassertioncamejust
abouttwomonthsaftertheHighCourthadaskedtheUnionMinistryofDefence(MOD)to
takeadecisioninthematter.Nearly8,000structureswithintherestrictedzoneof900meters
aroundtheammunitiondepotweretobesavedfrompossibledemolitionifthe
recommendationofreducingthezoneto500meterswasaccepted.Butnow,withafurther
reductioninthearea,thenumberofstructuressavedwillbefargreater.Thematterhad
reachedtheHighCourtafterapublicinterestlitigationwasfiledbySuershGoyalof
Faridabad.Hewasseekingtheremovalofconstructionsfromthe100metreareaaroundthe
AirForceStation,Dabua,inFaridabad,asitwasaprotectedzoneundertheWorkofDefence
Act.TheHighCourthadalsotakencognizanceofasimilarmatterontheconstruction
activitieswithintherestricted900metrezoneinGurgaon.

depotfailedtogetanyrelieffromthePunjabandHaryanahighcourtonMonday.Thecourt
postponedthematterforhearingonJuly17.
Accordingtotheareacouncillorwhowaspresentinthecourt,GajeSinghKablana,thejudge
deferredthematterafterthecounselrepresentingtheCentreinformedthecourtthatthe
decisionontheissueisyettobetakenbytheCabinet,andsoughtthreemonthstime.
Residentscomplainedthatdespiteassurancesfromthechiefminister,thecaseisyettobe
resolved.Thechiefminister,localMLAsandtheMPkeeptalkingaboutthepossibilityof
reachingadecisionfavourabletoresidents,butthecourthasstillnotgivenitsfinalverdict.
Thecourtkeepspostponingthehearingasthegovernmenthasfailedtomakeitsstandclear.It
appearsthatboththestateandthecentralgovernmentwanttokeeplingeringsincethis900
metreissuecanbeusedinfuturetogarnervotesashasbeendoneinthepastaswell,said
MukeshKumar,aPalamViharextensionresident.
