JUDGMENT

Based on the foregoing Memorandum Ruling,

IT IS ORDERED that the Rule 12(b)(1) Motion to Dismiss (Record Document 21)

filed by Defendants be and is hereby GRANTED. Plaintiffs’ complaint is hereby

DISMISSED WITHOUT PREJUDICE and may be reurged once there is a “final

determination” as contemplated by the National Flood Insurance Act, 42 U.S.C. § 4104(g).

IT IS FURTHER ORDERED that the Rule 12(b)(6) Motion to Dismiss (Record

Document 21); the Motion for Protective Order (Record Document 23); and the Motion for

Preliminary Injunction (Record Document 10) be and hereby DENIED AS MOOT, as the

Court has no subject matter jurisdiction over the instant matter at this time.
