Plaintiff Town of Hammond by and through its attomey, Frederick E, Paddock, Esq. for
its Complaint, state and allege as follows:
1. This is an action seeking injunctive relief, enjoining the defendants from
occupying the premises described below and an Order compelling the defendants
‘o comply with the Compliance Orders issued by the Town of Hammond: this
Action seeks @ Declaratory Judgment, declaring thatthe defendants are obligated,
as residents of New York State and the Town of Hammond, to abide by the New
York State Uniform Fire Prevention and Building Code, (hereinafter Uniform
Code) and Town of Hammond Local Law No. 2 of 2006,
2. That at all times hereinafter mentioned, the Town of Hammond is a municipal
corporation, existing under the laws of the State of New York.
3. That defendants Joseph Swartzeninuber and Henry Mast own/occupy
premises located at 175 CR 1, tax parcel ID# 141.003-4-1 and 563 State Highway
37,tax parcel ID# 141.003-2-1
