U.P GOVT ORDERS . PROSECUTION OF USV


On 25 June, Government of Uttar Pradesh issued order to file prosecution cases against USV Limited for enforcing mobile reporting on sales promotion employees without giving notice under section 9A of I. D. Act.
Additional Labour Commissioner of U. P. Pradeep Srivastva issued order no. 153438/I.R.D.-12 dated 25 June, 2012 giving permission to FMRAIs Uttar Pradesh state unit UPMSRA to file prosecution cases before chief judicial magistrates in districts against S. Bhutani, president- sales; R. Balgi, senior VP- HR and Hemant Surve, assistant general manager-HR of USV Limited under Section 29 of Industrial Disputes Act for changing the conditions of service of the sales promotion employees of the Company by enforcing mobile reporting without giving notice as required under section 9A of the Act. The section provides upto six months imprisonment as penalty. On 4 July, 2011, on behalf of UPMSRA, its joint secretary Arvind Tiwari registered complaint against USV Limited of breach of settlements / agreements, signed with FMRAIs negotiating committee / grievance committee on behalf of all sales promotion employees of the Company, in respect of service conditions including daily field work reporting system. Management imposed mobile reporting system without issuing notice for intended change as required under Section 9A of I.D. Act and coerced, threatened and victimized the field workers including wage cuts on alleged ground of non-compliance of managements illegal and unjust order. The Additional Labour Commissioner verified the facts and documents, particularly managements circulars of 27 June, 2011 that reporting through mobile phone was mandatory from 15 July, 2011 onwards; and passed an order for maintaining status quo as far as reporting system was concerned. But, the management of USV not only ignored the Governments order but also issued another circular dated 11 June, 2012 directing all field workers to send reports through mobile only otherwise their field working would not be taken into cognizance and their wages would be cut and their expense statements would not be reimbursed. UPMSRA moved an application on 5 June, 2012 requesting the Government authorities to prosecute or grant permission to prosecute the USV management. After hearing both the parties and seeing the relevant documents, Additional Labour Commissioner passed order granting permission to UPMSRA to file prosecution cases against named persons in USV management.

DNA, Mumbai in its 7 June edition published that KEM Hospital, Mumbai banned the entry of medical representatives in the hospital following a sting operation by Zee Business showing a doctor accepting cash /cash card from a medical representative of Mumbai based drug company, Macleod Pharma. After the episode of Satyamev Jayate by Amir Khan in Star Plus and now the KEM scandal, attempt is being made to bring Medical Representatives under public scrutiny as if they are carrying huge cash in their bags to pay to doctors and turn a blind eye on the huge corporate corruptions perpetrated by the pharma companies by way of pay for prescription and pay for trade. FMRAI has taken immediate public stand on these two issues through FMRAI News in June, 2012 issue and a press statement issued by its joint general secretary, K.B. Kadam on 7 June. The secretariat of FMRAI in its meeting held at Kolkata during 17-18 June identified the issues involved are corruption by drug companies, Central governments policies responsible for high price of medicines and concerted attack on the right to work through

Torrent Paid Deducted Wages


On 31 May, Garhwal region assistant labour commissioner at Dehradun, directed Torrent Pharmaceuticals to pay the deducted wages to Dehradun based sales promotion employee of the Company, Ashok Kumar Verma, on the dispute raised by him. On resuming duties after availing ten days leave in January this year, Ashok Kumar Verma found his electronic reporting portal was blocked by management. Contention of the management was that despite he was on leave, he is supposed to report every day on leave, as per norms of the Company, which he did not. Despite repeated request, management did not open his reporting portal and, thereby imposed lock out on his work and deducted ten days wage from his salary against which Ashok Kumar Verma raised dispute for recovery of his deducted wages. Conciliation meetings took place on 19 and 31 May.

Resist attack on right to work of field workers


In recent times, Medical Representative as a profession is increasingly coming under attacks from hospital administrations, government, media and a section in the society. Medical Representatives entry in hospitals are being banned / restricted by CGHS and several state governments and corporations orders. The 27 May episode of Styameva Jayate programme of Star Plus by actor-turned-anchor Amir Khan, branded Medical Representatives as agents of drug companies and main persons to bribe the doctors for prescription on behalf of the companies. He also advocated, in the same episode, that high prices of medicines are due to branded products and generic version will reduce prices automatically. Encouraged by this, sting operation by Zee Business exposed recently in KEM hospital, Mumbai, found doctor receiving cash / cash card for prescription from pharma company. After Satyameva Jayate and KEM scandal, Medical Representatives have come under public scrutiny as if they are carrying huge cash in their bags to pay to doctors. But, all are silent or choose to remain mute spectator in respect of huge corporate corruptions perpetrated by the drug companies by way of pay for prescription and pay for trade and on the governments policy to allow increase of drug prices, not because of generic or brand issues. Therefore, instead of banning or putting restriction on the entry of Medical Representative, there is a need to examine the issues objectively. In the name of sales closing every month, most of the well known drug companies, including big multinationals, are raising false invoices in the name of hospitals / institutions /nursing homes without their knowledge and offload these goods in the market through hawkers, creating parallel black market. Despite FMRAIs raising demand of investigation of records of the company, central and state drug control administration and ministries of health are reluctant to find out facts for obvious reasons and pay for trade by the companies, as their business policy, continued unabated. Banning /restricting the entry of Medical Representatives in the hospitals / institutions is not the solution of the widespread corruption in drug business. Every year, drug companies are spending huge amount of money in the name of CMEs, seminars, foreign trip to doctors and their family members, in fun and frolics etc. let lone costly compliments in older days like cars, air conditioners, now added cash cards, in gross violation of Drugs & Cosmetics Act, 1940, Magic Remedies (Objectionable Advertisement) Act and despite the so called Code of Ethics of some of the companies. Medical representatives and their organization, FMRAI, have been in forefront in exposing the menace of pay for prescription indulged in by drug companies. Yet, the government is reluctant to take any action against the bribe giver companies. As far as spiraling prices of medicines are concerned, FMRAI has been demanding to bring all items in the National List of Essential Medicines (NLEM) under cost-based price control as applicable to the list of essential drugs under DPCO, 1995 ensuring their availability through compulsory manufacturing and through PSUs and resorted to agitations including strike in pursuance of that. Why not the same criterion of bringing price control as that of 74 bulk drugs and their formulations as under DPCO, 1995 be urgently applied to all 354 medicines in NLEM? It is not brand or generic, responsible for high price of medicines, it is the governments policy responsible for high price. A smoke screen is sought to be created projecting generics as panacea against high price of medicines. Section 15 of Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 was enforced by Central Government by gazette notification on 29 May, 1967 states, Medical Literatures distributed by medical detailers appointed by manufacturers, importers or distributors of drugs, duly licensed under Drugs and Cosmetics Act, 1940 (23 0f 1940) and the Rules thereunder. And that The distribution of such literature is confined only to the registered medical practitioners, hospitals, dispensaries, medical and research institutions, and Chemists and Druggists or pharmacies duly licensed under the provisions of Drugs and Cosmetics Rules. Medical detailers as mention above, have to be appointed in prescribed form under Section 5 of the Sales Promotion Employees (Conditions of Service) Act, 1976 and the Rules made thereunder. Only a sales promotion employee having legally valid appointment letter in Form-A of SPE Act is entitled to undertake sales promotion work. Banning or restricting the entry of Medical Representatives, therefore, tantamount to attack on their right to work which will be opposed by 1.5 lakh field workers of the country and their organization, FMRAI. Under this background, the Secretariat of FMRAI decided to launch public campaign, observe 10 July as countrywide protest day and strike in future against attack on the Medical Representatives on their right to work. 2

On 8 June, the deputy commissioner of labour-I, Hyderabad issued notice (no. B/990/2010) to Zydus Cadila to produce five statutory records within ten days from receipt of the notice including that of Appointment letters in Form-A, register of sales promotion employee in Form-B, service book in Form-C, register of service books in Form-D and leave record in Form-E, as required under Sales Promotion Employees(Conditions of Service)Act, 1976 and its Rules failing which it will be deemed that the management has no information to furnish in this regard

compelling further legal action as per law. Earlier, in 2010, additional chief metropolitan magistrate, Nampally, Hyderabad prosecuted the management (STC No. 818 of 2010) for non-production of the record and the Company had to pay the penalty and was further directed to produce the records subsequently for verification. A notice was again sent to management on 31 December, 2011. Instead of producing the relevant records, management sent some information through e-mail which was insufficient and, hence, this notice of 8 June.

Himalaya Drug in Cyber Crime !


On the basis of complaint of KMSRA to commissioner of police, Ernakulam town north police registered an FIR (no. 765) on 1 May under Section 154 Cr.PC for violation of Section 66 A ( c ) of the Information Technology Act, 2000. Vipindas C, a field worker of Himalaya Drug, based at Pallakad, received a letter from the Company reported to have called on doctors on 15 August, being a national holiday. Vipindas was taken aback and replied that he did not report any doctor but reported independence day, as per his record and management closed the issue. Being skeptical on the development, while scrutinizing past reports, he found that his reports

of 4, 5 and 15 July were also edited and 15 July was shown as independence day and all these editing was done on 17 August which is not possible for Vipindas as per the software for e-reporting. KMSRA lodged a complaint on 10 November, 2011 before commissioner of police, Ernakulam for referring the matter to Cyber Cell for investigation. Cyber Cell, after investigation of the matter found that the reporting site of Vipindas was illegaly accessed twice, outside Kerala and, accordingly, asked the Ernakulam Town North police to register the case for confiscation of the particular computers from where it was accessed illegally and arrest of the culprit / culprits.

Prosecute drug companies; Government control all drug prices


The Federation of Medical & Sales Representatives Associations of India (FMRAI) and its affiliated state union Maharashtra Sales & Medical Representatives Association (MSMRA) condemns the drug companies who are bribing the medical practitioners by pay for prescription, by sponsoring foreign trips and by organizing lavish parties in the name of scientific sessions (CMEs). In fact, FMRAI is one of the foremost organizations which is exposing and fighting against these misdeeds of drug companies. Its monthly journal FMRAI News is exposing these regularly through documentation and evidence. FMRAI also submitted petition before the Lok Sabha Committee of Petitions to institute enquiry on corrupt practices of drug companies and assured their members evidences in respect of unfair marketing and trade practices of drug companies. FMRAI also demanded CBI enquiry in these malpractices. Sales promotion employees of drug industry, generally known as Medical Representatives, come under special labour law known as Sales Promotion Employees (Conditions of Service) Act and also under other labour laws. Yet drug companies refused to implement the provisions of the Act to keep them out of unions protection and misuse their services as was exposed by Zee Business in a string operation. In the tripartite meeting called by the Maharashtra State Labour Minister, FMRAI demanded strict enforcement of law and till compliance, to order suspension of sales promotion by drug companies. The matter has been referred to the department of law for opinion. The matter has become serious and government must act urgently to enforce law and ensure legal protection to the medical representatives against their misuse and exploitation by drug companies. Banning the entry of Medical Representatives from entering KEM hospital is not the solution of the widespread corruption in drug business. On the contrary, it tars the image of about 1.5 lakhs medical representatives in the country, who are recognized as workers in law, and prevents their normal work and livelihood as workers with the registered medical practitioner, hospitals and medical institutions as permitted under section 16(2)(b) read with 14(c) of Drugs and Magic Remedies (Objectionable Advertisements) Act. The policy of the central government itself is responsible for escalating and differential prices of same medicines with higher tax with each increase in retail prices. It has nothing to do with branded or generic medicines. As Parliamentary Standing Committee on Health in their report pointed out, conversion from brand to generic medicines may lead to choice to select from doctors to traders. The Government virtually made Drug Prices (Control) Order under Essential Commodities Act redundant allowing drug companies to hugely increase drug prices with super profits which they use in bribing the doctors and trade. Medical Representatives as workers are crying for legal protection of job and normal work.

Dharna at Nagpur

141 members from Ratlam, Mandasaur and Neemuch attended 22 nd annual general body meeting of MPMSRUs Ratlam unit on 13 May. State general secretary Shailendra Sharma and treasurer Anurag Saxena addressed the participants. Secretarys and treasurers reports were adopted unanimously after discussion and replies. The meeting elected Ashwini Sharma as president, G. S. Rawat as vice president, Manish Dixit as secretary, Utsav Dubey and Mithun Solaki as joint secretaries and Pankaj Mehta as treasurer and 8 committee members. 100 members of MPMSRUs Jabalpur unit participated in the unit conference at Shri Radha hotel on 3 June inaugurated by CITUs district secretary G N Kumar who hailed the role of MPMSRU and FMRAI and stressed the need of developing united workers movement. The conference unanimously elected Sanjay Tiwari as president, Bhanu Soni as secretary and Asish Moitra as treasurer of the unit. TNMSRAs foundation day was observed by its Salem unit in a special meeting on 8 May attended by 90 members. On this occasion, CITUs district secretary Uday Kumar distributed unions photo ID card.

With better offer, re-negotiated settlement in Drakt International


Finally, tripartite wage settlement between Drakt International and FMRAI and a field staff union was signed for about 62 field workers on 11 June in presence of A K Bhattacharya, additional labour commissioner, West Bengal. Drakt International is a small scale sector pharmaceutical company in Kolkata having marketing operation in east zone. After bipartite negotiation and signing settlement with FMRAI for all field workers of the company; management wrote to the additional labour commissioner for signing a separate settlement with the minority field staff association with better offer. FMRAI protested against this attempt of the management and demanded re negotiation and settlement with higher benefits as offered through the labour commissioner in writing. Ultimately, at the intervention of the labour commissioner, all parties were called and settlement was signed, again with FMRAI, with better financial offer. It may be recalled that first wage settlement was signed between the company and FMRAI in 2005 and identical settlement was signed with field staff association also. However, this time management wanted to give better offer to minority union by involving additional labour commissioner which they could not succeed as FMRAI pursued for re negotiation and settlement with equal benefits. Biswaroop Banerjee, N. S. Lamba, Sandeep Chaturvedi, K. Subramanian, Benny M. Verghese Sanjeev Mishra signed the agreement. Earlier, German Remedies All India council meeting, held at Delhi on 9 May, approved the understanding arrived at. Separately, an understanding on day to day work input was also signed on the same day.

Workshop on Council & Related Movement at Delhi
In order to develop uniform understanding based on common features of each group with emphasis on council networking and expansion of council, 240 all India council committee members of 36 councils, in two days separately, participated workshop on council and related movements at BTR Bhawan, Delhi on 6 and 8 May. Following the workshop, some of the councils hold their all India meetings on the following days. On both the days, A. K. Banerjee, all India council sub-committee convener placed the note on which leaders of each council contributed and shared their experiences. The first day workshop was concluded by FMRAI secretary Santanu Chatterjee and the worksop of 8 May was concluded by president R. Viswanathan. Nine councils, participated the workshop on 6 May, where charter of demands are pending since long suggested to pursue legally and to resort to one day strike in future in pursuance of their pending charter of demands. Yusuf Tarigami , while inaugurating the conference at Comrade M K Pandhe Nagar(Maharana Pratap Bhawan) and Comrade Sunil Kumar Jha Manch, called upon the sales promotion employees for preparing themselves to fight against all anti people- anti labour and pro American policies of the central government, against price rise and corruption. He also explained in details the prevailing situation in J&K and repressive policies of the communal and capitalist forces against common people of the state vis--vis struggle and movement against the same by the workers and people in general. Manjul Kumar Das, placing of secretarys report by Deepak Bhattacharya and the treasurers report by Kalyan Acharya. Both the reports were unanimously adopted after discussion by 68 delegates out of 447 attending the conference from all 29 units of the union and replies given by the general secretary and the treasurer. The conference adopted resolutions on membership, for enforcement of Rs.10,000 as minimum wages for the sales promotion employees, demanding enforcement of 8 hours work in the states of Bihar and Jharkhand, against rise of petrol prices and for making silver jubilee conference of FMRAI a grand success. The conference unanimously elected a 49 member executive committee with Sanjay Chatterjee as the president, Deepak Bhattacharya as general secretary, Anirban Bose and Anupam Kumar as joint secretaries and Kalyan Acharya as treasurer of the union. The conference also elected 56 delegates for the FMRAI conference.

Meyer Organics, Ozone, Ind Swift, Bharat Serum, Hetero Genx and Ranbaxy Respiratory who are grouped together to establish trade union, collective bargaining and legal rights attended the workshop. Out of these 18 councils, charter of demands are pending in Alembic, Alkem, Micro, IPCA, Indoco-Warren, Intas, AFD, ICPA and Macleods. In rest of the companies, charter of demands will be submitted soon, the meeting further decided. The workshop of 8 May was attended by the committee members of 18 all India councils where three rights are already established namely Albert David, BSN, Biochem, Deys, Elder, Franco Indian, Geno, TTK, Lupin, Khandelwal, German Remedies, Johnson & Johnson, Ranbaxy, Svizera, Stadmed, USV, Wallace and Win Medicare.

Wage Agreement in German Remedies
