Pachim KTanim from Rabbi Yudin : In honor of this weeks Parsha Shoftim Among the 41 mitzvos found in this weeks

parsha is the 529th mitzvah to the chinuch of the prohibition to destroy and cut down fruit bearing trees. While the context Devorim (20:19) is talking during wartime, the Rambam expands this law to all times. Not all negative prohibitions are alike. The Sifri rules that if one cuts down a fruit bearing tree, they violate both an aseh a positive commandment and a lo-taseh negative commandments. In addition, the Talmud Bava Kama (91B) attributes the early and untimely passing of the son of Rabbi Chanina for his having cut down a fig tree before its time. The NY Times approximately a month ago, featured a story regarding Sheya Weider of Brooklyn who to expand his home incorporated the mulberry tree as part of his expanded home. The chinuch in his explanation of this mitzvah writes it is likewise included in this precept not to cause any damage or loss; for instance to set fire, tear clothing or break a vessel for no purpose. The Rosh in his commentary in the above gemorah writes if one needs the location of the tree the destruction is permissible. Our compliments to Shaya Weider for performing a Kiddush Hashem. But was it halachically necessary or Lifnim MSuras Ha-Din?
