    This is the brief submitted to the Appellate Court Second Division, NY State Supreme Court by appellant Mircea Veleanu in March 2011, fraudulently accused by Attorney General Andrew Cuomo of "fraudulent activity", by selling to a woman from Winsted, Connecticut, in his hobby business of antique dealer, of 7 jadeite rosary Tibetan mala. The complainant, Janet Spiridonakos complained to Attorney General that she was "defrauded" by Veleanu in selling the mala that she tested by gemological testing by AGTA Lab that went out of business a few weeks after issuing the gemological reports. Spiridonakos breached the contract of sale that granted lifetime guarantee with intention to extort and blackmail Veleanu. Later on, it was proven that she counterfeited the invoice that was written by her instead the jewelry company who isued the invoice. She committed perjury by submitting false information in her affidavit and gave contradictory statements that impeached her testimony as a witness. The evidence has shown that Attorney General composed and edited her affidavit by revealing intimate information about the case that only Attorney General knew. This is a true story of prosecutorial misconduct, 4 involved judges of the trial court that committed judicial misconduct and fraud upon the court; misconduct of 4 judges of the Appellate Court that failed to review the case for errors, failed to answer the questions posed by the appellant, failed to dismiss the case based on CPLR 5704 for decreeing ex parte judgments and orders by judges of the trial court and most of all, pre-determined decision of affirmation of the order and judgment of judge James Pagones of the trial court, Supreme Court of NY Dutchess County.
