AFAD condemns the disappearance and arbitrary arrest and detention of Wildan Saputra For nine days, the Saputra family searched for their son Wildan Saputra who was disappeared by unknown men. According to witnesses, Wildan Saputra was forcibly taken by four unidentified men in plain clothes in a front of a store in Wedana Alley, Maphar Sub-district Taman Sari, West Jakarta on 18 December 2012. He was searched by unidentified men and was taken to a brown Kijang car parked in front of a K-24 drugstore. After hearing the incident, Saputras family immediately searched for him in various police stations starting from the Jati Baru Police Station (Gambir Police Sector) but the police denied arresting and detaining Saputra. He was found detained at the Tanah Abang Police Sector in Central Jakarta on 27 December after a witness connected the family to a member of the Rush Assault team (Buser) which in turn confirmed that Saputra was arrested for narcotics use. While there was no evidence of physical torture, Saputra disclosed that he was severely threatened to be shot and was forced to admit the use of narcotics. He remains under detention. No arrest warrant was issued when Saputra was apprehended by the police. The Asian Federation Against Involuntary Disappearances (AFAD) condemns the enforced disappearance, arbitrary arrest, detention and psychological torture and intimidation committed against Wildan Saputra. As a signatory of the International Convention for the Protection of All Persons from Enforced Disappearances (ICPAPED), the Indonesian government must adhere to the principles espoused in the Convention which specifically recognizes that no person shall be subjected to enforced disappearances under any circumstances. Further protection against enforced disappearance is reflected in the Indonesian Law No. 39/1999 states the Human Rights article 33 paragraph 2 that, Every person has the right to be free from enforced disappearances and taken life by force. The Indonesian government must remain sincere in its efforts to stop enforced disappearances and to prevent possible cases from occurring by being steadfast in its domestic and international obligations. The case of Wildan Saputra is an indication of clear lapses in the implementation of

such obligations. The incident is a complete manifestation of the Indonesian police force complete disregard for a persons right not to be subjected to enforced disappearance, right not to be subjected to arbitrary arrest and detention, right to liberty, right to recognition as a person before the law and right to be free from torture. Finally, to fully ensure respect of the right not to be subjected to enforced disappearances, AFAD reiterates its call on the Indonesian government to once and for all, fulfill its promise to ratify the International Convention for the Protection of All Persons from Enforced Disappearance and to recognize the competence of the Committee on Enforced Disappearances.
