Detective Terry Jones, code #6354, I'm with the Louisville Metro Police Department. This
interview pertains to Case File #08-197, uh, pertaining to a death investigation of victim Max
Gilpin. This interview is being conducted at 5601 Greenwood Road and we are at PRP High
School. Uh, this interview is uh, being, is...is of Mr. David Charles. Uh, also present during this
interview is Sgt. Denny Butler. And his code number is...

Jones Okay. I, uh, if you can uh, re...refer back to


August 20th...20th, 2008, uh, you were
working here as an athletic...assistant athletic
director?

Bobb Yes, I was.

Jones Can you recall the events of that day uh, the
PRP football practice in which you uh, were
here?

Bobb Yes. Uh, myself and Mr. Webb were actually


working the...boy...I'm sorry...girls' soccer
game uh, against Wagner. and we were in
between both fields, sitting on the, the gaiter,
and at approximately 5:15, 5 o'clock, Coach
Webb took the heat index reading uh, it's done
for every, every athletic event. Uhm, and...

Jones ..

Bobb ...and I'm sorry...

Jones ...and what is that reading? What does it do,

how do you receive that re...

Bobb It's a hygrometer, you have the...it's a, it's a


tool, you, you press the button and it gives you
the heat index...or the temperature and
humidity, and it reads it on a chart and it tells
you what the heat index is for the day.

Jones Okay. And you, you...who took that reading?


Your self or...

Bobb Uh, Coach Webb.

Jones Okay.

Bobb No, the athletic director, Craig Webb did.

Jones And it's just a matter of pushin' a button a


getting a digital reading.

Bobb Yes.

Jones Okay.

Bobb You get a digital reading and you follow the


numbers on the chart.

Jones Do you recall what that reading was?

Bobb Yes. It was 94.

Jones Okay. So uh, uh...was anything else going on


besides the soccer game? Was the boys
practicing football?

Bobb Yes. You had the, the one field had the girls'
soccer game, the football had the football team
and you also had Panther youth parents
arriving at that time, too.

Jones Okay. and while you were out on the field, did
you see uh, well, did you have the opportunity
to observe the practice, in general? What was
being done?

Bobb Only thing we saw was...'cause, like I said, our,


our focus was the, the girls' soccer game...we
did see periodic water breaks, because at one
time the concession stand ladies yelled, get off
the field, they're playing a game. They, they
walked across the corner of it, on the, as they
were walkin' to get water...uh, but I could not
tell you how many or when, what time,
because we were...like I said, we were focusin'
on the soccer game more than...

Jones ...When the...

Bobb ...football.

Butler ...Can, can I interrupt you and ask one


question?

Bobb Yes.

Butler This is Butler speaking.

Bobb Um-hmm.

Butler Uh, when, when you're out you're all parked on


the gaiter. Correct? Or you are all sitting on
the gaiter?...

Bobb ...We were at that time. Now we, we're not


always, no, but we were...

Butler That day you were all parked...

Bobb ...That day we were right there by the, in front


of the, the shed or whatever, if you all are
familiar with where we were.

Butler Right.

Bobb But right there between the two fields that we


were facing...

Butler ...At, at...at any point, were you alone there to


watch the soccer game?

Bobb Alone as in me and Coach Webb?

Butler My understanding is Coach Webb may have


come back here to check on his cell phone...
Do you re...recall that at all?

Bobb The only time we were apart before the game


started, I was getting the nets ready for the
soccer game, he...they were transporting some
concrete stones, like a retaining wall stones
that we move them from the side of the, the
soccer field and put 'em over in the storage
facility. And we, I was doing the nets, he was
doing that. After that, we were both on the
gaiter from there on out until the, after the
incident happened.

Butler Sorry.

Jones Okay. Uh, so you...

Bobb (Coughs) Excuse me...

Jones ...you and, and...and Mr. Webb were actually


uh, managing the soccer game?

Bobb Yes.

Jones ...between the girls?

Bobb Yes.

Jones PRP and who were they playin'?

Bobb Uh, Uh, Wagner High School.

Jones Okay. And during that process of the game uh,


you uh, you observed several football players
come over to get water?

Bobb Yes.

Jones And they had actually uh, made contact with


the soccer field and some parents or someone
said...

Bobb ...It was the concession stand ladies told 'em


walk around, make sure you walk around,
because a game was goin' on.

Jones Okay. A game was goin' on.

Bobb Now I couldn't tell you who it was, how many


it was...that I don't know.

Jones Okay.

Bobb But I do know there was periodic times that


they did do that.

Jones Okay. So uh, and, and what else occurred uh,


while you was here? Did you see, uh, after,
were you able to see the specific drills that the
team was conducting, the football team?

Bobb No. We were at the end of the field closest to

the entrance where you all, where they walk in


and take, and the running was occurring at the
other end of the side of the football field.

Jones Okay. And what time did the game start?

Bobb 5:30, I believe.

Jones Okay. And while the game had already started,


the players were already out on the field
conducting their drills? The football players?

Bobb Yes. Yes, football had already started.

Jones Okay. And you, you're not for sure what


specific drills they were doin'. Correct?

Bobb No. Hu-uh.

Jones Okay. And uh, at any point did you see them
uh, run, uh, conduct running drills?

Bobb I knew they were running because they kept


blowing whistles and I knew they were pro'bly
sprinting, but I don't know.

Jones Okay. And that was around 5:30? Is that when


the game had started, the soccer game had
started?

Bobb The soccer game started at approximately


5:30...

Jones ...Okay...

Bobb ...and then when, when their game starts you


cannot use whistles for practice 'cause it
interferes with the soccer game, and then at
about uh, one of the football coaches walked

over and said he, he came to get a drink of


water and he did mention they were, they were,
at the end of practice they were runnin' their
sprints.

Jones (Inaudible).

Bobb ...But now I don't, I don't know if that was at, if


that was an early practice, 'cause we don't
normally go to football practice.

Jones Okay.

Bobb ...We're just there when there's a...

Butler ...Do you remember which coach that was?

Bobb (Inaudible). I, I believe it was Coach Cook,


but I wouldn't...

Butler Okay.

Bobb ...but he just walked over and said that they


were, you know, gonna start their running, and
they...but I know they run every day 'cause I
got two football players in class. And they, at
the end of practice, they, you know, they run,
but that's comin' from them. I don't...like I
said, we don't see their practice plan every day,
'cause...

Jones right. Okay.

Bobb ...you know, you can't be there every prac...you


know, every sport, every practice, 'cause...

Jones But it's, it's safe to say when, when...before the


game started between the soccer game in
which you and, and Coach...I'm sorry...uh,

Mis...Mr. Webb...were actually managing, a


reading was taken uh, from the hygrometer,
which read 94.

Bobb Yes. Because they wouldn't have...

Jones ...Okay...

Bobb ...the soccer official always checks with


whoever the game manager is to say hey, is it
94, 95...'cause if it's 95, they have to play in
two...or actually, four 20-minute quarters
instead of halves.

Jones Okay.

Bobb And then they give 'em water breaks every 20


minutes.

Jones Okay.

Bobb So that is why the...

Jones Uh, has there, as regarding the hygrometer...

Bobb ...Um-hmm...

Jones ...who was in charge of purchasing the


hygrometer, and who, who is in, in charge of
maintaining that hygrometer?

Bobb The...Mr. Webb, the athletic director, purchases


one, the...

Jones ...Okay...

Bobb ...I think we have three...I don't know if there's


three or four. I'm not sure...

Jones ...Okay.

Bobb And then they're kept...a couple of 'em are in


the shed and then like the football coach has
one and the soccer coaches share one, and
every outside sport, like at the end of the year,
like soft, one will give one to softball...

Jones ...Okay...

Bobb ...we'll give one to baseball...

Jones ...Uh, so at this particular...on this particular


day, uh, the only hygrometer was, was being
worn by Mr. Webb? Was it being worn or was
it in a physical location or...

Bobb No, it's in a physical location.

Jones And where was that physical location?

Bobb In the uh, the shed right there, when you walk
in the practice facility.

Jones Okay.

Bobb There's a shed right there when you walk in


and they keep 'em...

Jones ...Okay...

Bobb Now some coaches, now the charts are hangin'


up, now I do know that sometimes the
(inaudible) will take it home and bring it
back...

Jones ...Okay...

Bobb ...depending on, you know, what day it is.

Jones ...Well, you, are you saying the, the item was in
the shed? I mean was it still, was it in the
shade or was it in the direct sunlight or, or
what?

Bobb I mean the, the shed is in the shade.

Jones Okay.

Bobb But, like I said, some coaches...I don't know if


they do it or not, you'd have to ask them...

Jones ...So it may have been...

Bobb ...they may take it home, they might, lot of


times they'll take it home and bring it back.

Jones Okay. So you, I...

Bobb 'Cause football, I do know...

Jones ...Right...

Bobb ...they take theirs in and out of the, like they'll


take it to the office...

Jones ...Right...

Bobb ...and then take it out to practice.

Jones Okay. But the hygrometer wasn't warn, it was


in a physical location...

Bobb ...Yes...

Jones ...and the physical location...

Jones ...Right...

Bobb ...you know, soccer locker-room first and then


they came out...

Jones ...Right...

Bobb ...that I don't know.

Jones Right. But the reading was taken at what


physical location? That's what I'm askin'.

Bobb In, you go out to the middle of the soccer field.

Jones Okay.

Bobb You go out in the middle of the field, take the


reading and then...

Jones Well, yeah, that's what I was a...I'm sorry...

Bobb ...Oh, sorry. I'm sorry.

Jones ...I'm sorry I confu...yeah, I'm sorry I confused


you.

Bobb No.

Jones But I was uh, alluding to, to where the reading


was actually taken to...

Bobb ...Oh, the reading, you go out to the, you


usually go out to the central location of the
field...

Jones ...Okay..

Bobb ...and if it's practice field or football field...or

you know, playing field...

Jones and the item is kept in the, in the shed.

Bobb Yes.

Jones Okay. As, as well as some others that are


pro'bly...

Bobb ...Yeah...but, like I said, some coaches do take


'em home...

Jones ...Okay. Okay.

Bobb I'm not...

Jones Okay.

Bobb ...I don't know if they do that or..

Jones ...Okay. Okay...Sorry about the confusion.

Bobb ...No, that's fine. No, that's fine.

Jones Okay. Uh, so at any point did uh, at, at, at a


certain point, the teams started running?

Bobb Yes.

Jones In your presence?

Bobb We assumed they were running because...

Jones ...Okay...

Bobb ...I mean you could hear people sayin', you


know...come on, run on...

Jones ...Okay...

Bobb ...I mean you could hear the kids more than
you could...

Jones Okay. And did you physically see 'em running


at any time?

Bobb Yeah.

Jones And were they running length, width of the


field?

Bobb They were running, yeah sideways. They were


going sideline to sideline.

Jones ...From sideline to sideline?

Bobb Yes.

Jones Okay. And at any point did you see any


players attempt to get water?

Bobb Umm, like I said, the only times I saw it was I


couldn't tell you if it was when they were
runnin' or if it was during practice. They came
over a few times...

Jones ...Sure...

Bobb ...a few times during the first half of the soccer
game.

Jones Now those players who had, who had left to go


and, and walk in toward your area...

Bobb ...Um-hmm...

Jones ...they had actually uh, the concession lady told


'em to, don't get on the soccer field?

Bobb Just makes you...right. Makes you walk


around the field.

Jones Was those players able to get water?

Bobb Yes.

Jones Okay. And how many would you estimate that,


that to be?

Bobb Uh, it was, I think it was the group of...I don't


wanna say receivers and linebackers, but I
don't...

Jones ...Okay...

Bobb ...I wouldn't...

Jones ...Do you remember the time that that...that


was?

Bobb I mean between 5:30 and...

Jones Okay.

Bobb ...that's my only timeframe is with the...

Jones ...Okay.

Bobb ...as far as the game and...

Jones ...that's what you can remember? Okay.

Bobb Now they did bring over Antonio Calloway, the


one of the co...uh, a parent escorted him under,
and put him under the water...

Jones Okay. And what was, what was his uh, issue?

Bobb He was havin' trouble, he was uh, it seemed


like he was havin' a asthma attack.

Jones Okay.

Bobb ...is what it sounded like.

Jones Alright.

Bobb And then they, then they escorted him back


over and they put him under the shade tree.

Jones Okay. And was he able to, he was able to be


assisted off the sideline?

Bobb Yes. He was walkin' on his own...

Jones ...Okay. I'm sorry...

Bobb ...but uh, a parent had helped him get over


there just in case.

Jones Okay. Was anyone else uh, did any other


player become ill?

Bobb Other than Antonio, the only other one we saw


was when Max went down.

Jones Okay. Did you see Max when he went down?

Bobb Yes.

Jones Okay. Can you describe it to me, please?

Bobb We were sittin' on the gaiter and then...like I


said, we knew they were runnin' 'cause we
heard 'em...and it was gettin' towards the end of
the game, or the first half, and then we saw

some kids were helpin' Max to the huddle, so


we figured they were done runnin', 'cause they
were all meetin' up to the, by the shade tree,
and then he collapsed. I mean it looked like he
was havin' trouble walkin' but he was walkin'
on his own, and then he collapsed and I looked
at Coach Webb and said, that's not normal.

Jones ...And what did y'all do at that point?...

Bobb ...And then we drove the gaiter over to the uh,


where he had collapsed, and then within 30
seconds or a minute...I don't know if there was
two parents, I be...I don't know their
names...came up, they scooped him up, they
said it was a fireman's cradle...scooped him up,
put him in the front of the gaiter, and then we
took, they took him over and started, putting
water on his, they took the hose off and were
sprayin' directly on his neck, and uh, they had
ice bags under...I believe it was under his arms,
I think...

Jones Did Max Gilpin ever regain consciousness?

Bobb There was a grunting sound, but no, he never...

Jones He was breathing?

Bobb Yes. He was breathing, yes.

Jones Uh, but uh, what about his eyes?

Bobb I, actually, when they got him on there,


Antonio, the gentleman that went earlier, when
they got the gaiter over there, he walked over
and he sat on the back and I was tryin' to get
him to go down with, I went and sent...I sent
uh, one of the seniors, I said, go get the ice

bucket off the soccer, the bench, 'cause I knew


there was a little one. And then I was tryin' to
put ice on his neck, calm him down, get him
water, so after that, I don't...Max was...Max
was facing the opposite way I was. I had
Antonio and Max, all I could see was is the
back of his head. In the back.

Jones Okay. And who uh, who was able to call an


ambulance, if you can recall? Or was an
ambulance called?

Bobb Yes. I believe it was Coach Deacon, but I


would not swear to that, because when I got
Antonio there, from then to the ambulance, it's
a blur, I couldn't tell you if it was five minutes,
ten minutes, because I was more worried about
Antonio 'cause there was four or five people
workin' on Max, and I was tryin' to get Antonio
calmed down. He couldn't, he had trouble
breathin', couldn't catch his breath...

Jones Okay.

Bobb ...and I was more concerned about him, 'cause


they had, they had Max.

Jones Let me pause, give me a second, let me check


the status of our...

Bobb ...Okay...

Butler I do have one question.

Butler When you all drive out to Max...

Bobb ...Yes...

Butler ...you all having collapsed, the players move


away from him...

Bobb They were...they, they tried to pick him up...I


believe they picked him up once and then he
just was kinda there, and then we drove over
and then when we got there, I believe Coach
Webb said, it might not have been Coach
Webb, said back up, give us room. And then...

Butler Do you, do you remember if there were any


coaches around at that point?

Bobb I believe Deacon...Coach Deacon was there...

Butler Steve or...there's two. Right? Steve and


Bobby?

Bobb Yeah.

Butler Okay.

Bobb It was, it's the one that works security.

Butler Okay.

Bobb I think it's Bobby.

Butler I think it is Bobby.

Bobb Yeah, Bobby. And I believe Coach Donnelly


was around, standing in the general area, but,
and then I just remember one of the parents
came out...like I said, I don't remember who he
was...and said fireman's cradle will be

easier...we scooped...they scooped him up...put


him on there, and then we got him over to the,
to the water.

Butler Okay. Earlier you had mentioned some players


goin' over, gettin' some water, and bein' told to
stay off the field...

Bobb Yes, from the...

Butler ...soccer field...and then you have Antonio


comin' over, gettin' water, put on his neck at
some point. Right?

Bobb Yes. They put him under the water. Yes.

Butler Was the players that were told to walk around


the soccer field, was that before or after
Antonio was taken over?

Bobb I believe it was before.

Butler Okay. Do, just roughly kinda guesstimate how


soon before Antonio?...

Bobb I, I don't know. I couldn't, I mean, I'm...15, 20


minutes, but I don't...I'm guessin'.

Butler Okay.

Bobb I mean that's...

Butler Okay. Fair enough. That's all I have.

Jones Uh, Mr. Bobb, can you tell me how long the
team have been uh, running sprints while you
were out there?

Bobb I don't have any, I have, I have no idea. Uhm...

players refused water?

Bobb No, I did not.

Jones Okay. I don't think we have anything else. Uh,
