LESSON 1 Strategies for Effective Labor Management Relations and Philippine Policy Statement on Labor Relations

Learning Activity Explain the following briefly but substantially 1. What are labor relations? 2. Explain the Philippine laws that regulate labor relations in the Philippines. 3. What is a Labor Union? How can a labor union be a positive factor for the god of the entire business organization?

ANSWER (query 1) Labor relations refer to the interactions between employer and employees or their representatives and the mechanism by which the standards and other terms or conditions of employment are negotiated, adjusted and enforced. ANSWER (query 2) As in political democracy the crux o labor relations is the process and substance of employee participation, that is; how rights and duties are exercised, how arguments are reached, and Module V page 1

how relationship is enhanced. The Philippine laws promote free trade unionism as an instrument for the enhancement of democracy and the promotion of social justice and development. So, the Philippine laws promotes for the betterment of the greater mankind. ANSWER (query 3) Labor or trade union is a combination of workmen organized for the ultimate purpose of securing through united action the most favorable conditions as regards wages, hours of labor, conditions of employment, etc., for its members. The union is the recognized instrumentality and mouthpiece of the laborers. However, the labor union may help in lessening the disputes among the employers and employees at the same time the union is not allowed to control the business of the employer in matters not affecting the terms of their own hiring.

LESSON 2 Procedures for Registration of Labor Unions, Collective Bargaining Agreements, Strikes, Lockouts and Compulsory Arbitration

ANSWER (query 1) The basic urge which leads workers to organize, the spark which gave unions life and the power of growth under favorable conditions, is the human drive toward self-advancement. Under the Labor Code, Title IV, Chapter I, Article 234, any applicant labor organization, association or group of unions or workers shall acquire legal personality and shall be entitled to the rights and privileges granted by law to legitimate labor organizations upon issuance of the certificate of registration based on the requirements mentioned under the law. ANSWER (query 2) Collective bargaining or negotiations towards collective agreement is a democratic framework to stabilize the relation between labor and management to create a climate of sound and stable industrial peace. It is a mutual responsibility of the employer and the union and is their legal obligation. Since it is a mutual responsibility the management of a certain corporation can get a grievance team that will coordinate to the labor unions pertaining to the collective bargaining. Thus, it would be a lessen burden for the executives of the corporation in creating a grievance team.
