Dear Cov. Xean,
This pacXage ia in response to the enclosed e-mail I got
from Dietrich Dieter Snell following my "testimony" before
the 9/11 Commission at your New York office on 3/15/04.
Z put "testimony" in quotes because there was no
stenographer present, nor were my finding? recorded. Mr.
Snail informed me that "ninety-five percent of the fact
gathering w» do via witnesses ia in informal sessions."
This waa in aharp contrast to the image of fact-gathering
by the Commission as evidenced in the recent series of
televised public hearing!, wherein high-level government
officials deliver sworn, testimony under oath.
During my 3/15/04 session Mr. Sneil took notes and told me
that he would write up a report. He would then pass on the
report to appropriate people on the Commission staff.
Based on my own experience and interviews with members ot
the Commieaion staff it's my conclusion that the majority
of witness fact gathering by the Commission is anecdotal.
My session at 26 Federal Plaza was attended by a staff
investigator named Marco Cordero. Mr. Snell followed up
with the enclosed e-mail of 3/17/04 entitled "Our Meeting."

RESPONSE TO MR. SWELL'S REQUEST

My archives of research for 1000 YEARS is made up of 100'a

of pages of documents from the PNP. It would be overly
burdensome for me to produce all of them, but I am
including a series of relevant documents from the PNP.
Re: 1) I'm including both the transcript and the video.
Pleaee note that while Col. Mendoza discussed an initial
disclosure by Murad that Yousefs cell was planning to fly
a email plane into the CIA HQ in Langley, over time, Col.
Mendoza uncovered the details of the VERY plot that was
executed by Yousef'9 uncle on 9/11.
Col. Mandoza revealed to ine how Yousef and Kurad had
planned to hijack "commercial" airliners. He, Murad,
boasted to the Colonel that the plan was for him personally
to fly one of the planes into the WTC and "die for Allah."
Murad also revealed to Col. Mendoza that a number of
Islamic radicals were then training (in 1995) in U.S.
flight schools in order to execute the plot.
To my knowledge, my interview with Col. Mendoza was the
most far reaching ever conducted on the subject of 9/11 and
it puts to lie the myth that circulated for years in
intelligence circles that Ramai Yousef had contemplated
only the small-plane-into-CIA scenario.

This misconception was reported in the New York Times and

The Washington Post as recently as the first anniversary of
the 9/11 attacks and was cited by Eleanor Hill, chief
counsel to the Congressional Joint Inquiry.
My investigation revealed that the 9/11 plot by YoueeJ.
Murad, Khalid Sheikh Mohammad and Wall Khan Amin Shah was
much more elaborate and much further along in the planning
stages in 1994-95 than ever previously reported.
In our 4/19/02 interview, Col. Mendoza confirmed that
three of Yousef '• targets were the CIA, the Pentagon and
an unnamed nuclear facility
Further, I'm attaching an interview done by CNN on 9/18/01
with Rigoberto Bobby Tiglao, a secretary to Philippines
President Ramos. In it, Mr. Tiglao states that the Murad
interrogation also revealed the WTC, and the Trans america
and Seara Towers as targets.
Later in my book, I quoted an A. P. story by John Solomon
that put the number of Islamic pilots training in 1995 in
U.S. flight schools for the Yousef 9/11 plot at "ten."
Further, my book reported a revelation by former FBI asset
Harry Ellen, whose control agent in squad Five, Phoenix was
Special Agent Ken Williams, author of "the Phoenix Memo."
Ellen told me that he had warned Williams about suspicious
Islamic pilots training in Arizona flight schools as early
as the fall of 1996.
Re: 2) I am producing 3 of the 1/20/95 Debriefing Memo's
4 pages. In copying the memo last week in Santa Barbara,
I inadvertently left off the last page which included
paragraph "m." This is the paragraph quoted in my book in
which Col. Mendoza wrote of his initial interrogation of
Abdul Hakim Murad:
"With regards to their plan to dive-crash a commercial
aircraft at the CIA Headquarters,,,, subject alleged that the
idea of doing same came out during his casual conversation
with ABDUL BASIT (Ramzi Yousef) and there is no specific
plan yet for its execution."

As referenced above, this was a preliminary revelation by

Murad early in his interrogation by Col. Mendoza and later,
Murad confessed to the entire 9/11 plot.
Further, I am enclosing a transcript of the very interview
Col. Mendoza did with Murad in which Muract referenced the
small-plane-into-CIA scenario, so that you can understand
the proper context of this early description of the plot.
The next time I am back in California I will supply the
missing 4*h page from that memo, but my book quote a it
verbatim on p. 278 as Mr. Snell notes in his e-mail.
Prom the transcript and other debriefing memos enclosed
from 1/17/95, 1/30/95 and 2/21/95, we can see how extensive
Murad'a U.S. flight training was.
Many intelligence officials, including former CIA Director
James woolsey, have confused this "third plot" which became
the 9/11 attack with yousefs "BOJINKA" plot.
Bojinka involved smuggling the components of bomb triggers
on the first legs of two-leg U.S. bound jumbo jet flights
from Asia. It was not a suicide-hijacking plot*
Along with the plot to kill Pope John Paul IT on his Manila
visit on 1/12/95, Yousef'a 9/11 planes-aa-mififliles plot was
separate .and distinct from BoJinXa.
As further evidence of Murad's involvement in this third
hijacking-suicide plot, consider his extensive flight
training. There was no reason for a conspirator who was
going to plant a bomb on board a two-leg flight to have
undergone flight training. Yet Murad was a commercial pilot.
Col. Mendoza's interview and the interrogation transcript
show that Murad was going to be the lead pilot and serve in
the role later filled by Mohammed Atta on 9/11/01.
Ret 3) In addition to the above referenced PNF documents
I'm also including reports on Islamic radical activity
in the Southern Philippines during the Christmas 1994-95
holiday along with another report on Yousafs co-
conspirator Wali Khan Amin Shah and an extensive report
by the PNP on Mohammed Jamal Khalifa, Osama Bin Laden'B
brother in law. Khalifa was believed to be the primary
funding source for the Pope, Bojinka and 9/11 plots as
they were conceived in Manila in the fall and winter of
1994-1995,

Re: 4) The 1995 FBI NO/FORM memo is valuable on two fronts.

First, in referencing the CIA, Pentagon and nuclear
targets/ it proves that Col. Mendoza's intelligence on the
Yousef-KSM-Murad-Khan plots had reached the U.S. Justice
Department. Col. Mendoza told me that he had turned over
all of his evidence to the U.S. Embassy in Manila in the
spring of 1995 and this NO/PORK memo confirms that.
But the memo also underscores the FBI's disconnection in
1995. On one had they describe Yousef s cell as evidencing
"a larger threat from Islamic extremists."
But on the other hand, despite the masaive volume of
intelligence in the FBI's New York office on the 1993 wrc
bombing and the "Day of Terror" plot, this nemo refers to
Youeef'§ group aa being separate from the plotters
convicted with blind Sheikh Omar Abdel Rahman.
Although the memo acknowledges that Youaef might have been
getting his funding from Osama bin Laden, it continues to
refer to this tightly integrated al Qaeda cell as being
part of a "loose group of politically committed Muslims."
Given the intelligence furnished by Col. Mendoza it was
frankly astonishing, at that point in 1995, that the U.S.
Justice Department could be so naive with respect to the
al Qaeda-bin Laden-Yousef-Abdel Rahman threat.
As late as 1995 the FBI didn't seem to know what vraa in its
own files in the,Southern District of New York and 26
Federal Plaza, the bin Laden "office of origin."
No excuse of a "wall* can explain their failure to connect
their own internal dots. Gov Kean. But in watching the
latest round of Commission hearings I'm concerned that
you're in danger of making the same mistake.
Ret 5) Mr. Snell asked me about the name of an Assistant
D.A. in Robert Morganthau'g office who had been one of the
prosecutors in the trial of El Sayyid Noaair. Nosair, an
Egyptian, had been on the FBI's radar since July, 1989 when
he was photographed at Calvercon, Long island.
Of those men recorded in dozens of photographs by the FBI'a
Special Operations Groups (SOO) one (Nosair) went on to be
convicted in the murder of Rabbi Meier Kahane in 1990;
three (Abouhalima, Salameh and Ayyad) went on to be
convicted with Youaef in the 1993 WTC bombing conspiracy;

one (Hampton-El) vent on to be convicted in the

"Day of Terror" plot along with Shiekh Abdel Rahman and
their leader, Ali Mohaimed, went on to train bin Laden1 B
personal bodyguards in Xhoat, Afghanistan in 1996 and
personally survey the African Embassies for the 1998
bombing that killed 234 and injured 5000.
ALL OF THESE INDIVIDUALS were known to the FBI ae far back
as 12 years before the 9/11 attacks and all of them were
members of a tightly organized al Qaeda cell funded
DIRECTLY by Osama bin Laden.
Noaair was an early "al Qaeda martyr," beloved of bin
Laden. In the infamous video fatwa two weeks before the
October 2000 Cole bombing, bin Laden, brandishing a
dagger, had Sheikh Rahman's son by his side who said,
"go to the spilling of blood for your Sheikh" and
"remember El Sayyid (Hosair)."
In order to fully understand the road to 9/11 you have to
go back at least, to 1989 and examine the FBI's four-weekend
surveillance of those ME'i (Middle Eastern men) shooting
automatic weapons &t Calverton, Long island.
You have to follow the through line of how Egyptian
radicals, surrounding bin Laden, helped him take over the
MAK Office of Services Network which morphed into al Qaeda,
You have to see that the first al Qaeda blood spilled on
U.S. soil was that of Rabbi Kahane on 11/5/90.
You have to appreciate how bin Laden had contributed to
NOBair's defense because he was part of an al Qaeda cell
that had set up a brick and mortar outpost in Brooklyn as
early ae February, 1991 with the murder of Mustafa Shalabi.
Yet in published reports following your CIA and DOJ
hearings last week Commissioner Jaime S. Gorelick was
quoted as aaying (paraphrasing) that the Commission is
"focusing on the years from 1998 forward."

Further, you are making a mistake in utilizing people like

Dieter Snell to ask the question of witnesses like ma.

I was very complimentary to Mr. Snell in my book, Be has

had an exemplary record of service as an attorney on the
federal and state level.
But how can the Commission objectively evaluate whether
the Justice Department and th« FBI ignored KEY INTELLIGENCE
regarding the incipient 9/11 plot in 1995 when, Dieter
Snell, one of your senior counsels was the co-prosecutor
of Yousef, Murad and Wali Khan in the Bojinka ease?
in my book, I made the point that the Bojinka caae
prosecutors went out of their way to avoid any references
to the 9/11 plot that Col. Mendoza had uncovered.
Even though he had the most extensive knowledge of Murad's
revelations. Col. Mendoza was not invited to testify at the
trial in the Southern District of New York, This, despite
the fact that 11 other PNP officials wade the trip.
Further, an FBI agent (Frank Pellegrino) and a PNP official
(Major Alberto Ferro) were allowed by Mr. Snsll and AUSA
Mike Garcia to give misleading testimony at trial that
prevented the jury for understanding the full dimensions of
the post Bojinka plot that Yousef and his uncle Khalid
Shaikh Mohammed had in store for America.
As referenced in my book, Maj. rerro testified that he did
not remember the names of Murad's interrogators, even
though he was at Col. Mendoza'» side for much of the
interrogation (as my enclosed transcript shows).
And agent Pellegrino testified under oath that he was
unaware that Murad was being interrogated at camp Crane,
in Manila until mid March of 1995, even though he had
traveled to Manila and was present at that very Camp from
mid January of 1995 two months earlier.
Further, unlike it'a approach to capturing Yousef, which
involved a global hue and cry with Yousefs want poster on
tens of thousands matchbooks worldwide, the hunt for Khalid
Shaikh Mohaiwned was carried out largely in secret by the
FBI and the DOJ.
First XSM was secretly indicted with Yousef in 1996, yat
the indictment wasn't even unsealed until January of 1998
where it was barely mentioned in the New York Time a
coverage of Yousef's sentencing.

The FBI failed to capture KSM at the bin Laden controlled

Sue Caaa Guesthouse in February, 1995. In fact, he even
gave an interview to TIME magazine at the tine using his
own name/ but the Feds missed him.
When former FBI Director ?reeh testified under oath at your
recent hearing that the FBI arrested Yousef at that time,
he was wrong. The arrest was affected by agents of the
State Department's Diplomatic Security Service and the DBA.
But beyond losing KSM, the FBI failed to put him on any
public lists of wanted terrorists until AFTER he had
executed his nephew Ramzi's plot on 9/11.
Based on my investigation, this suggests an apparent effort
by the Justice Department to suppress any evidence of the
Yousef -KSM broader conspiracy that culminated on 9/11.
The Question it WHIT? And why did the Justice Department
ignore the profound evidence of this incipient 9/11 plot
which was supplied to them bv Col. Mondosa in April of 1995?
Those are the two moat important unanswered questions
resulting from my research.
Yet, after you read my book and invited me to testify before
the Commission to share my findings who did staff director
Phillip zelikow assign to question me?
Dietrich Dieter Snell, one of the two prosecutors on the
Bojinka case/ who was apparently a party to the DOJ decision
to ignore Col. Mendoza'a evidence of the emerging 9/11 plot.
if you really want to get at the truth, Mr. Snell should be
A WITNESS before the 9/11 Commission, not one of its lead
INTERROGATORS. I told him this to his face during my
"testimony" on 3/15/04.
Being a congenial man, all he could do was smile.
But because I fear a conflict of interest with Mr. Snell,
I am forwarding the evidence to you at Drew University.
Governor Kaan, I am well aware of how difficult your job is
as chairman of this commission.

I'm also grateful for the fact that you took the time to
read 1000 YEARS FOR REVENGE and recently cited the book in
an interview on C-Span.
But apparently I haven't persuaded you. In response to a
question about the first WTC borabing trial you said.'
"There's a book by Peter Lance called 1000 YEARS for
Revenge in which he actually tries to link that main bomber
in the WTC One as the visionary for what happened on 9/11."
The fact that you said that I "tried" to link both attacks
suggests to me that you are not convinced.
I believe that my book PROVES Yousefa involvement, by at
least a civil standard (praponderanca of the evidence).
Yet in the recent 9/11 hearings in your questions and those
of the other caxnmiaaioners, none of you seem to have
accepted the overwhelming evidence which shows that:
-Osama bin Laden had an al Qaeda cell in New York City from
February, 1991;
-that he directly funded the original WTC bombing and wae
directly responsible for the 9/11 attacks which were both
hatched in the brilliant but deadly mind of Ramzi Yousef;
-that the second attack was' set into motion as early as
1994 by Yousef and executed by hie uncle Khalid. Shaikh
Mohammed.
Once you embrace that line of evidence and understand the
full impact of bin Laden's jihad directed at our country/
the Commission will be in a better position to craft
proposals for dealing with the future threat.
The truth behind 9/11 is that apart from the Islamic
radicals who perpetrated the plot, there was profound
negligence on the part of three separate U.S.
administrations Crom George Herbert Walker Bush, through
President Bill Clinton to the current President.
Further, the 9/11 attacks not only represented the greatest
intelligence failure since the Trojan Horse, they
represented the greatest failure in Defense since our
nation was founded - given the Bush Administration's
response on "the day of."

I have several sources on the Commission staff and

referencing back to question NO. 5 about the "Noialr
prosecutor" I vaa told months ago by an investigator that
he had recoirenended to hii colleagues in Washington that
they call David Greenbaum the Nosair Assistant D.A. in an
effort to shed light on the early days of OBL's conspiracy.
But the word to this investigator was "we're not interested
in going back that far."
If you don't go back that far, Gov. Keen, I fear that you
will Be presenting an incomplete picture.

In this case getting a part of the truth isn't enough. You
have to understand the full 12 year road to Sept. 11th if
'your want to interdict the next series of attacks on our
icountry which will surely come.
