    CONTEXT: That on January 21, 2013, the Supreme Court issued with finality its decision regarding the almost twenty-year long case filed by the Digitel Employees Union. The Decision affirmed DEU’s right to collectively bargain, as previously acknowledged by the DOLE Secretary and the National Labor Relations Commission’s 2006 directive. The Decision by the highest court of the land confirmed the obligation of PLDT-Digitel to commence CBA negotiations with the DEU, the right of the DEU employees to be reinstated with full back pay and the finding that Digitel was guilty of Unfair Labor Practice. The Decision also upheld that the contractualization Digitel organized in the form of Digiserv, eventually resulting to the termination of 100 employees, was illegal and was done in bad faith. The termination of 100 women employees after the Assumption of Jurisdiction was declared contemptuous. The Supreme Court findings also state that PLDT-Digitel should award each of the illegally dismissed union member-employees the amount of P10,000.00 and P5,000.00 as moral and exemplary damages, respectively. WHEREAS, the League of College Councils establishes its support against the practice of contractualization and its affirmation of the right of the Digitel Employees Union to security of tenure. The LCC affirms the Supreme Court Ruling that Digitel’s action to form Digiserv was illegal on the grounds that it was a labor-only contractor, a set-up expressly prohibited by law. WHEREAS, the League of College Councils upholds the obligation of PLDT-Digitel to commence Collective Bargaining Agreement negotiations with the Digitel Employees Union as stated in the SC Ruling. Furthermore, this was strengthened by DOLE’s resolution stating that the pendency of a petition for cancellation of union registration does not preclude collective bargaining. WHEREAS, the League of College of Councils calls for the immediate acknowledgment by PLDT/Digitel of its duties to its employees as stated in the Supreme Court Decision. As PLDT-Digitel, the country’s market share leader in the telecommunications industry, the company must resolutely take the lead in ensuring fair labor practices in its organization and move to comply with the Ruling issued upon it by the highest court of the land. As students of the premiere state university in the Philippines, the LCC believes that issues such as labor disputes are vital to our understanding as future members of the country’s labor force. Such unjust and unethical practices will never be acceptable, thus our resolution to unite with the members of the DEU in their struggle against contractualization and for their right to tenure, right to organize and right to collectively bargain. WHEREAS, the LEAGUE OF COLLEGE COUNCILS – UNIVERSITY OF THE PHILIPPINES, DILIMAN shall be submitting this resolution to (RESPECTIVE AUTHORITIES). WHEREAS, the LEAGUE OF COLLEGE COUNCILS – UNIVERSITY OF THE PHILIPPINES, DILIMAN shall be engaging in Basic Mass Integrations with the workers on strike. Also, the LCC shall serve as an avenue to disseminate information (such as various fora, round table discussion, and other activities that would popularize the issue to the youth sector) to the youth sector as regards to the status of the campaign. NOW THEREFORE, be it resolved that the LEAGUE OF COLLEGE COUNCILS – UNIVERSITY OF THE PHILIPPINES, DILIMAN adopts and enacts this resolution PROVIDING THE LEAGUE OF COLLEGE COUNCILS – UP DILIMAN’S SUPPORT AGAINST THE UNFAIR LABOR PRACTICES OF PLDT-DIGITEL, effective June 27, 2013.
