Six new judges to be appointed in
Rajasthan High Court

Lawyers boycott, Judges suggest

speedy trial ways...

As many as six more

judges will join the bench
at the Rajasthan High
Court very soon, newly
appointed Chief Justice
Amitava Roy said here.
In a chat with the media after taking the oath of
office at the Raj Bhawan,
Justice Roy also assured
of early setting up of fast track courts for hearing cases of atrocities
against women.
Governor Margaret Alva administered the oath to Mr Roy.
Justice Roy said presently there are 21 judges against the sanctioned
strength of 40 in the High Court and induction of new judges would help
in reducing pendency of cases.
He said other possible steps would also be taken to speed up disposal of cases.
The Chief Justice said he would accord priority to setting up of fast
track courts for cases pertaining to sexual abuse and other atrocities
against women

Amid lawyers refusing to represent the accused in the gang rapecum-murder case of 23-year-old paramedic, two women judges have come
out with suggestions for effective fast-tracking of the trial.
While Justice Gyan Sudha Misra, a sitting Supreme Court judge, suggested amendments to the Evidence Act to avoid recording of evidence

High Court asks cop to pay maintenance to estranged wife

at multiple stages to cut-short the whole process of trial, former Delhi

High Court judge, Justice Usha Mehra opined that the trial judge should
ensure service of lawyers to accused from the very outset of the trial.
According to Justice Misra, I feel in such cases of heinous crimes
against women, it should be one-to-one between accused and victim as
cases of these natures ultimately hinge on evidence collected by police.
She also added, Evidence recorded by the police from the accused
and the victims side should be recorded before a judicial officer. Why
should the statement of prosecution and defence witnesses be recorded
at multiple stages? Let us bring changes to the Indian Evidence Act.
If the evidence led by the accused and the victim is recorded in
front of a judicial officer, why should there be need for a lawyer to record
evidence the second time in the court, as it is done today.
Justice Misra added, The thing left for courts would be only crossexamination and arguments and that is how fast track courts are also
going to be fast. Recording of evidence a second time in the court gives
rise to manipulations, witnesses turning hostile and in many cases killing
of star witnesses
Justice Mehra, the head of government-appointed one member commission to probe the gangrape case, however, said earlier also, in many
cases, the lawyers had refused to represent the accused and they cannot
be forced to appear on their behalf but the trial judge has the discretion
to provide lawyers to accused either from the legal aid or appoint amicus
curiae to defend them.

Justice Roshan Dalvi was
hearing a petition filed by the
police officer Sainu Virkar
challenging an order passed
by the family court directing him to pay maintenance of Rs 8,000 each
to his wife and children.
Virkar claimed that he was a mere policeman who earns only Rs
15,822 every month and hence cannot afford the maintenance amount.
Virkars salary slip shows his gross pay as Rs 26,278. He, however, told
the court that after deductions and monthly expenditures he is left with
only Rs 15,000.
Virkars estranged wife Shobha, however, refuted the claims made by
her husband and said aside from his income as a police officer, he accepts
bribes and has quantified the bribe amount to Rs 50,000 each month.
Shobha also claimed that her husband has income coming in from
his five acre agricultural land.
Accepting the wifes contentions, Justice Dalvi said, The petitioner
(Sainu) is seen to be living comfortably and is also seen to manipulate
his salary sheet.
According to the court, It may be that proceedings under the Prevention of Corruption Act may or may not be taken against the petitioner, but
upon a specific plea of the wife, and given the nature of public officers
like police officers, who are seen to be corrupt, those statements cannot
be brushed aside.
It also held that the revenue records of Virkars agricultural land
show that onion, cotton, jwar and wheat are grown there. The land is,
therefore, capable of yielding cultivation and consequently income. It is
not fallow land, the court said.
Refusing to quash the family court order, the high court directed Virkar
to pay Rs 16,000 maintenance.
