EAPCCT / COLIPA COSMETIC FRAME FORMULATIONS FOR EU POISON CENTRES - PREAMBLE -

The EU Cosmetics Directive specifies that Member States may require the provision of safety information to the competent authority (in the majority of cases : Poison Centres) for products marketed in the EU. The purpose of this is to enable the correct medical treatment to be given promptly in the event of an accident, such as a child consuming a cosmetic product. The exact wording given under Article 7 (3) is : Furthermore, a Member State may, for purposes of prompt and appropriate medical treatment in the event of difficulties, require that appropriate and adequate information on substances used in cosmetic products be made available to the competent authority, which shall ensure that the information is used only for the purposes of such treatment. Both industry and the European Association of Poison Centres and Clinical Toxicologists (EAPCCT) were keen to introduce a simple system that is workable and avoids the need to deal with unnecessary detailed paperwork. The concept of Frame Formulations is based on a system developed jointly by the UK Cosmetic, Toiletry and Perfumery Trade Association (CTPA) with the National Poisons Information Service (London), which has been in use for many years. The Frame Formulations detail the type of ingredients and their maximum concentration for most cosmetic products on the European market. If a product fits the Frame Formulation, then only basic information needs to be provided to the competent authorities at national level, a list of which was published in the Official Journal of the European Communities (N C36, 10.02.99). It is planned to update the Frame Formulations on a regular basis - more or less once every two years depending on the product type. Therefore a loose leaf system is foreseen where each Frame Formulation will be identified by its number and the edition date - e.g. 2.12-2000 which means that it is Frame Formulation 2.12 published in the year 2000. More information should be given to Poison Centres upon request. These additional details will be available from the emergency contact mentioned on the declaration form. This person should have access to the qualitative and quantitative composition of the product. The majority of cosmetic products represent a relatively low risk on ingestion. The Frame Formulations system enables rapid identification of a cosmetic product which is unlikely to result in serious effects to health, when ingested or used inappropriately. However, under the Frame Formulations system, some cosmetic products need to be declared in detail or require additional information to be provided.

PRODUCT DECLARATION : 1. 2. 3. If a product complies with a Frame Formulation and additional information is not required, Declaration Form 1 is to be used. If a product complies with a Frame Formulation but additional information is required, Declaration Form 2 is to be used. If a product does not comply with a Frame Formulation or if there is no Frame Formulation for a given product, then formulation details, both qualitative and quantitative, need to be declared individually on Declaration Form 3.

PRODUCTS REQUIRING ADDITIONAL INFORMATION The following products are covered by Frame Formulations, but require additional information to be stated in Declaration Form 2. 1. Products listing ethanol and/or isopropanol in their Frame Formulation The percentage weights of ethanol and/or isopropanol must be specified. A new declaration is required when the content of either ingredient or the sum of both ingredients changes by more than : - 5 if the value declared previously is < 30% - 10 if the value declared previously is 30% If ethanol or isopropanol are mentioned in the frame formulation, but are not present in the cosmetic product, then 0% must be specified. Note : declarations of percentage weights may be rounded to the nearest whole number. Note : if the percentage weight is below 2%, it can be specified as 0%. 2. Antidandruff products The INCI (International Nomenclature for Cosmetic Ingredients) name and concentration of the antidandruff agent(s) must be specified. A new declaration is required when the concentration of the antidandruff agent changes by more than 50% of the value declared previously. 3. Products containing vitamin A and derivatives The exact content ( in I.U./g) of vitamin A or any of its derivatives must be specified if the level exceeds 7 000 I.U. per g of product or if the amount exceeds 300 000 I.U. for the whole product. A new declaration is required when the concentration of vitamin A or derivatives changes by more than 1 000 I.U. per g. 4. Products containing xanthine derivatives (e.g. caffeine, theophylline) Should a product contain more than 0.5% xanthine derivatives, then the INCI name and the exact concentration of the derivative(s) must be specified.

5. Products containing cationic surfactants The concentration of cationic surfactants must be specified if the level of such surfactants exceeds 5%. A new declaration is required when the concentration changes by more than 20% of the value declared previously. 6. Hairspray products containing solvents The INCI name and the concentration of each solvent must be specified for Frame Formulations 2.12 and 2.13. A new declaration is required when the concentration changes by more than 20% of the value declared previously. 7. Permanent and semi-permanent hair colourant products containing solvents The INCI name and the concentration of each solvent must be specified for Frame Formulations 2.25 and 2.26. A new declaration is required when the concentration changes by more than 20% of the value declared previously. 8. Hair bleaches containing persulfates and solvents The INCI name and the concentration of each persulfate and of each solvent must be specified for Frame Formulation 2.29. A new declaration is required when either of these concentrations changes by more than 20% of the value declared previously. 9. Products containing hydrogen peroxide The concentration of hydrogen peroxide must be specified for Frame Formulations 2.17 (Part 1), 2.19, 2.26 (Part 2), 2.29 (Solution A). 10. Nail varnish products containing solvents The INCI name and the concentration of each solvent must be specified for Frame Formulation 11.3. A new declaration is required when the concentration of at least one solvent changes by more than 20% of the value declared previously. 11. Toothpastes and Mouthwashes containing Fluoride compounds The concentration of fluoride compounds, expressed as Fluorine, must be specified for Frame Formulations 8.1 and 8.2. A new declaration is required when the fluorine concentration changes by more than 20% of the value declared previously. If fluoride compounds are not present in the product, then 0% must be specified. 12. Bath salts/cubes containing inorganic sodium salts The total concentration of sodium salts must be specified for Frame Formulation 3.3. A new declaration is required when the total concentration of sodium salts changes by more than 20% of the value declared previously.

13. Products with a pH lower than 3 or higher than 10 The pH of a product, or part of a product, must be specified if it is lower than 3 or higher than 10. A new declaration is required when the limits of the pH range declared previously change by more than 0.5. In the case of multiple parts products, the pH of mixed, ready-for-use product, is to be declared in the pH field; the pH values of the components are to be declared in the Remarks field. 14. Products containing essential oils (including camphor) Except for perfume Frame Formulations, when a manufacturer introduces in a formulation an essential oil (or an essential oil derivative) with a level higher than 0.5%, the manufacturer must state the name and quantity of this essential oil/essential oil derivative on Declaration Form 2. PRODUCTS REQUIRING FULL DECLARATION If a product does not comply with a Frame Formulation or if there is no Frame Formulation for a given product, then formulation details, qualitative and quantitative, need to be declared individually. Also, the following types of cosmetic products should always be declared in detail to Poison Centres : nail cuticle removers, nail strengtheners, nail varnish removers, permanent wave neutralisers in powder form. PLANT EXTRACTS Plant extracts cover aqueous, hydroglycolic solutions, infusions, decoctions, etc. Essential oils are covered under indent 14, above. Aqueous plant extracts would include lavender water, rose water, elderflower water and camomile water commonly called aromatic waters. These are usually obtained by steam distillation of essential oils as opposed to infusion or decoction. ADDITIONAL INGREDIENTS Many Frame Formulations contain the item additional ingredients. This designation covers chemicals which do not contribute significantly to the product formulation and which do not exceed 10% of the formulation. Such chemicals must not contribute in a significant way to the toxicity profile of the cosmetic product. It is always the responsibility of the manufacturer to ensure that any cosmetic ingredient covered by the item additional ingredients does not affect the overall toxicity of the marketed product.

THE COSMETICS DIRECTIVE The EU Cosmetics Directive 76/768/EEC lays down the legal requirements for marketing safe cosmetic products. The Directive has existed since 1976 and it has been regularly updated. The Directive covers the following points : Article 1 : definition of a cosmetic product Article 2 : requirement to market safe products, under normal and reasonably foreseeable conditions of use Articles 3 to 5 : requirement that Member States take all necessary measures to ensure that only cosmetic products that conform to the Directive and its annexes may be put on the market Article 5a : inventory of cosmetic ingredients Article 6 : labelling requirements Article 7 : harmonisation clause Article 7a : requirement to hold information on each marketed product, within the company Articles 8 to 10 : procedures to adapt the Directive on technical points Article 11 : establishment of positive lists Articles 12 and 13 : safeguard clause, enabling measures to be taken at national level in case of hazard to health.

The Directive also has 8 Annexes : Annex I : illustrative list of cosmetic products Annex II : list of banned ingredients Annex III : list of restricted ingredients Annex IV : positive list of cosmetic colorants (exempts hair dyes) Annex V : ingredients regulated at national level (limited to strontium compounds) Annex VI : positive list of preservatives Annex VII : positive list of UV filters Annex VIII : symbol for labelling not indicated on the outer packaging.

EAPCCT / COLIPA COSMETIC FRAME FORMULATIONS FOR EU POISON CENTRES - PREAMBLE -

The EU Cosmetics Directive specifies that Member States may require the provision of safety information to the competent authority (in the majority of cases : Poison Centres) for products marketed in the EU. The purpose of this is to enable the correct medical treatment to be given promptly in the event of an accident, such as a child consuming a cosmetic product. The exact wording given under Article 7 (3) is : Furthermore, a Member State may, for purposes of prompt and appropriate medical treatment in the event of difficulties, require that appropriate and adequate information on substances used in cosmetic products be made available to the competent authority, which shall ensure that the information is used only for the purposes of such treatment. Both industry and the European Association of Poison Centres and Clinical Toxicologists (EAPCCT) were keen to introduce a simple system that is workable and avoids the need to deal with unnecessary detailed paperwork. The concept of Frame Formulations is based on a system developed jointly by the UK Cosmetic, Toiletry and Perfumery Trade Association (CTPA) with the National Poisons Information Service (London), which has been in use for many years. The Frame Formulations detail the type of ingredients and their maximum concentration for most cosmetic products on the European market. If a product fits the Frame Formulation, then only basic information needs to be provided to the competent authorities at national level, a list of which was published in the Official Journal of the European Communities (N C36, 10.02.99). It is planned to update the Frame Formulations on a regular basis - more or less once every two years depending on the product type. Therefore a loose leaf system is foreseen where each Frame Formulation will be identified by its number and the edition date - e.g. 2.12-2000 which means that it is Frame Formulation 2.12 published in the year 2000. More information should be given to Poison Centres upon request. These additional details will be available from the emergency contact mentioned on the declaration form. This person should have access to the qualitative and quantitative composition of the product. The majority of cosmetic products represent a relatively low risk on ingestion. The Frame Formulations system enables rapid identification of a cosmetic product which is unlikely to result in serious effects to health, when ingested or used inappropriately. However, under the Frame Formulations system, some cosmetic products need to be declared in detail or require additional information to be provided.

PRODUCT DECLARATION : 1. 2. 3. If a product complies with a Frame Formulation and additional information is not required, Declaration Form 1 is to be used. If a product complies with a Frame Formulation but additional information is required, Declaration Form 2 is to be used. If a product does not comply with a Frame Formulation or if there is no Frame Formulation for a given product, then formulation details, both qualitative and quantitative, need to be declared individually on Declaration Form 3.

PRODUCTS REQUIRING ADDITIONAL INFORMATION The following products are covered by Frame Formulations, but require additional information to be stated in Declaration Form 2. 1. Products listing ethanol and/or isopropanol in their Frame Formulation The percentage weights of ethanol and/or isopropanol must be specified. A new declaration is required when the content of either ingredient or the sum of both ingredients changes by more than : - 5 if the value declared previously is < 30% - 10 if the value declared previously is 30% If ethanol or isopropanol are mentioned in the frame formulation, but are not present in the cosmetic product, then 0% must be specified. Note : declarations of percentage weights may be rounded to the nearest whole number. Note : if the percentage weight is below 2%, it can be specified as 0%. 2. Antidandruff products The INCI (International Nomenclature for Cosmetic Ingredients) name and concentration of the antidandruff agent(s) must be specified. A new declaration is required when the concentration of the antidandruff agent changes by more than 50% of the value declared previously. 3. Products containing vitamin A and derivatives The exact content ( in I.U./g) of vitamin A or any of its derivatives must be specified if the level exceeds 7 000 I.U. per g of product or if the amount exceeds 300 000 I.U. for the whole product. A new declaration is required when the concentration of vitamin A or derivatives changes by more than 1 000 I.U. per g. 4. Products containing xanthine derivatives (e.g. caffeine, theophylline) Should a product contain more than 0.5% xanthine derivatives, then the INCI name and the exact concentration of the derivative(s) must be specified.

5. Products containing cationic surfactants The concentration of cationic surfactants must be specified if the level of such surfactants exceeds 5%. A new declaration is required when the concentration changes by more than 20% of the value declared previously. 6. Hairspray products containing solvents The INCI name and the concentration of each solvent must be specified for Frame Formulations 2.12 and 2.13. A new declaration is required when the concentration changes by more than 20% of the value declared previously. 7. Permanent and semi-permanent hair colourant products containing solvents The INCI name and the concentration of each solvent must be specified for Frame Formulations 2.25 and 2.26. A new declaration is required when the concentration changes by more than 20% of the value declared previously. 8. Hair bleaches containing persulfates and solvents The INCI name and the concentration of each persulfate and of each solvent must be specified for Frame Formulation 2.29. A new declaration is required when either of these concentrations changes by more than 20% of the value declared previously. 9. Products containing hydrogen peroxide The concentration of hydrogen peroxide must be specified for Frame Formulations 2.17 (Part 1), 2.19, 2.26 (Part 2), 2.29 (Solution A). 10. Nail varnish products containing solvents The INCI name and the concentration of each solvent must be specified for Frame Formulation 11.3. A new declaration is required when the concentration of at least one solvent changes by more than 20% of the value declared previously. 11. Toothpastes and Mouthwashes containing Fluoride compounds The concentration of fluoride compounds, expressed as Fluorine, must be specified for Frame Formulations 8.1 and 8.2. A new declaration is required when the fluorine concentration changes by more than 20% of the value declared previously. If fluoride compounds are not present in the product, then 0% must be specified. 12. Bath salts/cubes containing inorganic sodium salts The total concentration of sodium salts must be specified for Frame Formulation 3.3. A new declaration is required when the total concentration of sodium salts changes by more than 20% of the value declared previously.

13. Products with a pH lower than 3 or higher than 10 The pH of a product, or part of a product, must be specified if it is lower than 3 or higher than 10. A new declaration is required when the limits of the pH range declared previously change by more than 0.5. In the case of multiple parts products, the pH of mixed, ready-for-use product, is to be declared in the pH field; the pH values of the components are to be declared in the Remarks field. 14. Products containing essential oils (including camphor) Except for perfume Frame Formulations, when a manufacturer introduces in a formulation an essential oil (or an essential oil derivative) with a level higher than 0.5%, the manufacturer must state the name and quantity of this essential oil/essential oil derivative on Declaration Form 2. PRODUCTS REQUIRING FULL DECLARATION If a product does not comply with a Frame Formulation or if there is no Frame Formulation for a given product, then formulation details, qualitative and quantitative, need to be declared individually. Also, the following types of cosmetic products should always be declared in detail to Poison Centres : nail cuticle removers, nail strengtheners, nail varnish removers, permanent wave neutralisers in powder form. PLANT EXTRACTS Plant extracts cover aqueous, hydroglycolic solutions, infusions, decoctions, etc. Essential oils are covered under indent 14, above. Aqueous plant extracts would include lavender water, rose water, elderflower water and camomile water commonly called aromatic waters. These are usually obtained by steam distillation of essential oils as opposed to infusion or decoction. ADDITIONAL INGREDIENTS Many Frame Formulations contain the item additional ingredients. This designation covers chemicals which do not contribute significantly to the product formulation and which do not exceed 10% of the formulation. Such chemicals must not contribute in a significant way to the toxicity profile of the cosmetic product. It is always the responsibility of the manufacturer to ensure that any cosmetic ingredient covered by the item additional ingredients does not affect the overall toxicity of the marketed product.

THE COSMETICS DIRECTIVE The EU Cosmetics Directive 76/768/EEC lays down the legal requirements for marketing safe cosmetic products. The Directive has existed since 1976 and it has been regularly updated. The Directive covers the following points : Article 1 : definition of a cosmetic product Article 2 : requirement to market safe products, under normal and reasonably foreseeable conditions of use Articles 3 to 5 : requirement that Member States take all necessary measures to ensure that only cosmetic products that conform to the Directive and its annexes may be put on the market Article 5a : inventory of cosmetic ingredients Article 6 : labelling requirements Article 7 : harmonisation clause Article 7a : requirement to hold information on each marketed product, within the company Articles 8 to 10 : procedures to adapt the Directive on technical points Article 11 : establishment of positive lists Articles 12 and 13 : safeguard clause, enabling measures to be taken at national level in case of hazard to health.
