EXECUTIVE : GENERAL PERSONNEL POLICIES

1. GENERAL

(i) Scope of Coverage

These Rules cover all employees in the executives Group. Probationers will not
normally be entitled to the fringe benefits extended to confirmed employees other
than outpatient medical attention.
An employee serving on a written contract which expressly provided different
conditions on service shall, in as much as the contract does not define, adhere to
the relevant clauses.

(ii) Interpretation

(a) “Company” means the employer Company.


(b) Words importing the masculine gender shall be deemed and taken
to include the feminine gender and singular to include the plural.

(iii) Amendments

All Personal Policies are subject to periodic reviews and changes either by
virtue of changes in the Employment Act/Labour Regulations or as and
when is deemed necessary in the opinion of the Management.

2. PROBATION

(i) A newly engaged employee shall serve a probationary period of 3/6


months (stated in the Offer of Employment) which may be extended as per
Management’s discretion.

(ii) During the probationary period employment may be terminated by either


party giving an advance notice as follows :-

Group I & II - 1 month


Group III - 7 days

3. PROMOTION

(i) An employee who is promoted to a higher post of responsibility shall


serve a probationary period of 3 months.

(ii) The employee who is not confirmed in his new appointment to the higher
post shall revert to his former or similar position and salary.

(iii) The salary of the promoted employee will be adjusted to reflect his higher
post of responsibility.
(iv) Promotional increments are in additional to normal annual increments.
However, annual increment will not be given if the promotional increment
is given 3 months of the annual increment date.

4. WORKING HOURS

The normal working hours shall be set by the respective General Manager of that
Company in accordance to guidelines from Labour Laws.

5. DRESS CODE

An employee is not allowed to wear the purdah while in the office.

6. SALARY SCALES & ANNUAL REVIEW

(i) Salaries will be reviewed once annually and any adjustment made will be
effective from 1st January each year.

(ii) An employee under probation will not be considered for the annual salary
review.

(iii) Annual increment is not automatic and is granted at the absolute discretion
of the Company.

(iv) Recommendation for merit increment of one or more additional


increments on top of annual increment to a deserving employee will be
considered by the Company and such recommendations are to be approved
by the Executive Chairman / Managing Director.

(v) Annual increment will not be given if a staff is given an increment upon
conformation within 3 months of the annual increment date.

7. BONUS

(i) The payment of bonus shall be at the absolute discretion of the Company.

(ii) In the event that the Company decided to pay bonus it shall be on the
following basis:-

(a) an employee on probation shall not be eligible to receive bonus.

(b) bonus shall only be due and payable to an employee who is still in the
service of the Company at the time of payment of the bonus.

8. SECRECY
An employee shall maintain and observe the strictest secrecy in respect of the
Group’s activities throughout his employment.

9. CONFIDENTIAL INFORMATION

The Employee (whether permanent or contract) shall not, either during or after his
employment hereunder, divulge or utilize any confidential information belonging
to the Company or any of its Associated Companies (including confidential
information as to formulae, processes and manufacturing methods, and
confidential information as to the business and affairs of the Company) which
may have come to his knowledge during his employment hereunder or during his
employment under any previous contract of service with the Company or any of
its Associated Companies; and he shall, both during and after his employment
hereunder, take all reasonable precautions to keep all such information secret.

Except so far as may be necessary for the purpose of his duties hereunder, the
employee shall not, without the consent of the Company retain or make originals
or copies of telegrams, letters, maps, reports, drawings, calculations,
specifications, formulae, forms, licences, agreement or other documents of
whatever nature belongs to the Company or any of its Associated Companies, or
notes thereof, nor retain samples or its Associated Companies may be or may have
been interested and which have come into his possession by reason of his
employment hereunder. If on the termination of his employment hereunder he is
possession of any originals or copies of telegrams, letters, maps, reports,
drawings, calculations, specification, formulae, forms, licences, agreements or
other documents of whatever nature belonging to the Company or any of its
Associated Companies, or any notes thereof or any such samples or specimens as
aforesaid, he shall deliver the same to the Company without being asked, except
so far as consent to retain them has been given to him by the Company. Any such
consent shall not by itself relieve him from his obligations.

10. PART TIME WORK

Should an employee wishes to engage in part time work after office hours, prior
written permission must be sought form the Company and not otherwise.

11. TERMINATION OF SERVICE

Either the employee or Company shall be required to give to the other party
written notice of his intention to terminate the contract of service, the date of
termination or pay in lieu of notice as follows:

Group I & II - 3 months


Group III - 2 months
12. INSURANCE

An employee will be covered by the Group Personal Accident insurance with


accordance to the group insurance scheme which will be reviewed annually.

13. ANNUAL LEAVE

(i) On completion of 12 months continuous service an employee shall be


eligible for paid annual leave as follows:-

Group I,II,& III


1 to 5 years’ service - 12 working days
Above 5 years’ service - 16 working days

(ii) Annual leave shall be computed on calendar year basis. The Management
may fix compulsory leave on certain dates.

(iii) Written application for leave shall be submitted at least 1 week before the
commencement of leave.

(iv) Annual leave not taken during the period of entitlement will be forfeited.
Leave may be accumulated only upon written approval of the
Management.

(v) Application for annual leave of more than 5 continuous working days with
intervening weekend or public holidays will not be entertained unless
valid reasons are stated in the application which requires the approval of
Group I Executives.

14. SICK LEAVE

(i) An employee will be granted sick leave with full pay on the
recommendation of the Company’s doctor or in consideration of time and
distance, a registered medical practitioner where no hospitalization is
required subject to the total number of days non-cumulative per calendar
year provided in the Employment Ordinance as follows:

(ii) Where hospitalization is necessary, an employee shall be eligible to 60


days non-cumulative sick leave with full pay per calendar year inclusive
of sick leave under sub-paragraph (i) above.
(iii) The employee or representative must inform his superior of his absence
within 48 hours.

15. SPECIAL LEAVE

(i) Non-cumulative special leave may be granted on compassionate grounds


upon production of an undertaking to produce relevant evidence:-

Employee’s marriage - 3 days

Death of spouse, child, parent, - 3 days


parent-in-law, grand-parent,
grand-parent-in-law, brother or sister

Paternity Leave - 1 day

(ii) If any Saturday or Sunday or Gazetted Public Holiday is included within


period of leave, then such days shall be reckoned as leave for purpose of
this clause except for employee’s marriage leave.

16. EXAMINATION LEAVE

Leave with full pay will normally be granted upon written application for the
purpose of sitting for an examination in a course of study relevant to the
employee’s work with a restriction of 3 full working days on full pay per annum.

17. MATERNITY LEAVE

(i) A female employee will be entitled to a paid maternity leave for a total of
60 days.

(ii) Absence from work due to illness or miscarriage during pregnancy will be
considered as normal sick leave.

(iii) Application for maternity leave must be made at least 1 week before
commencement and supported by a medical certificate.

18. MEDICAL BENEFITS

(i) An employee shall be given free medical attention and treatment by the
Company’s doctor as per list attached up to the maximum amount stated
below. Only medical claims with official receipts from the Company’s
doctor will be entertained. However, the Company will accept medical
certificates from registered medical practitioners not on our list but will
not reimburse these medical claims. Approval of medical claims for
specialist treatment will be allowed only if the Company’s panel doctors
recommend them.
(ii) The maximum amount claimable for general and specialist treatment per
calendar year shall not exceed in aggregate as stated below:

Group I & II - RM600.00


Group III - RM300.00

Where hospitalization is recommended by the Company’s doctor, ward expenses


operation and surgical fees will be covered under the Hospitalization and Surgical
Insurance scheme taken up by the Company up to the maximum amount insured
per annum. Amount insured will be reviewed annually. Any amount not covered
under the insurance scheme will be borne by the staff.

(iv) The Company shall not be liable for the following expenses :-

(a) medical, surgical or other appliances

(b) dentures or dental treatment

(c) spectacles, lenses or optician’s fees.

(d) expenses incurred as a result of pregnancy, confinement, self-


inflicted injury, illness or diseases arising from misconduct or
exposure to any unjustified hazards or hazardous sports.

(e) expenses incurred as a result of attempted suicide or injury arising


from the performance of unlawful acts, provoked assault or breach
of peace.

(f) treatment arising from unlawful use of drugs or narcotics.

(g) treatment of any mental illness

(h) plastic surgery

19. PROLONGED ILLNESS

(i) In the case of prolonged illness resulting from AIDS, tuberculosis, cancer,
polio, leukemia, leprosy, paralysis or any other prolonged illness certified
by the Company’s doctor or the general Hospital at he affected employee
will be granted leave and be paid as follows:-

First 3 months of illness : Full pay


Second 3 months of illness : Half pay
(ii) An employee shall not be entitled to the above unless he has completed 3
continuous years of service.

(iii) If the employee is unable to resume work after 3 months absence due to
prolonged illness, he may be discharged from the Company.

(iv) Where an employee is entitled to compensation for temporary disability


under the Company’s Personal Accident Insurance Scheme, the amount
payable under sub-paragraph (i) shall be reduced by the amount such
compensation.

20. TRANSFER

(i) In the course of your service, you may be assigned to other duties and
location related to the operation of the company any other Company
within the Group.
