Village of Fleischmanns Public Hearing May 23, 2013

The Village of Fleischmanns Board of Trustees held a Public Hearing on Thursday, May 23, 2013 at the Skene Memorial Library at 3:45 p.m. Present were: Mayor Todd Pascarella, Benjamin Fenton & Harriet L. Grossman. Trustees Kathleen Rostad Miles and David Yates were absent. Mayor Pascarella opened the Public Hearing on proposed Local Law # 2 of 2013 a local law authorizing the Village of Fleischmanns to Undertake Various Actions in Connection with a Proposed Extension to the Village Sewerage System. Trustee Harriet Grossman addressed a request from Synthia Garcia from NYCDEP in connection with todays hearing. According to Village Attorney, Fairbairn, III, Esq. Ms. Garcia was confirming that if the Village conducted a SEQRA DEP would like to partake. John Fairbairn, III, Esq. advised that Tom Stalter of the DEP had advised that while the potential lease agreement between the Village of Fleischmanns & the CWC which will result in the construction of sewer lines to convey wastewater from Fleischmanns Heights to the Fleischmanns WWTP, the agreement does not preclude the Village from providing wastewater treatment services to properties outside the Designated Service Area or for entering into lease arrangements for sewer lines. A lease payment for a sewer line is not an eligible O&M expense under the Agreement with DEP. DEP believes that it is important for the Village to be fully aware that such lease payments would not be eligible for O&M reimbursement as it considers sewer connections. Mayor Todd Pascarella signed the Short Environmental Assessment Form for the Fleischmanns Heights Sewer Extension & also, the Village of Fleischmanns as lead agency has determined that the proposed action to extend the Village of Fleischmanns Sewer Treatment Collection System to the southern side of NYS Route 28 and connect an existing mixed-use residence/commercial structure to the system for appropriate sewage disposal. The Reasons Supporting this Determination: This is unlisted action to extend a public sewer system to include a single new structure into the system and avoid a failure of the existing septic system currently utilized by the structure. No adverse impact on water quality, air quality, vegetation near project or other environmental impact. John Brust of Delaware Engineering advised that he had spoke with Craig England of DOT in Binghamton today & we have an approval of the permit. We dont have the paperwork in hand, but we are good to go. All we need is for Hubbell Bros., Inc. to submit a form for Workers Comp and Disability to DOT.
