EnElSalvador,elmedioambienteesttuteladodesdelaperspectivaconstitucionalen
elart.117denuestracartamagnaendondeseestablece:EsdeberdelEstadoproteger
los recursos naturales, as como la diversidad e integridad del medio ambiente, para
garantizareldesarrollosostenible.
Se declara de inters social la proteccin, conservacin, aprovechamiento racional,
restauracin o sustitucin de los recursos naturales, en los trminos que establezca la
Ley.
Se prohbe la introduccin al territorio nacional de residuos nucleares y desechos
txicos.
Elart.117delaConstitucinreguladosaspectosqueson:a)Laobligacindelestado
decrearlosincentivoseconmicosyproporcionarlaasistenciatcnicanecesariaparael
desarrollo de programas adecuados a la proteccin, restauracin, desarrollo y
aprovechamiento de los recursos naturales, lo cual debe entenderse como un
complementoa laobligacinprescritaenelart.101 inc.2.Cn,endondeseestablece
que los recursos naturales no slo el Estado puede disponer de ellos, sino
principalmente los particulares. b) La remisin del legislador secundario para que
desarrolle un marco normativo relacionado con el medio ambiente a travs de leyes
especialesyreglamentos.Estaesunamanifestacintpicadelcarcterconcentradode
los mandatos constitucionales, ya que en el mismo , la Constitucin determina las
directricesyloslineamientosbsicosparaeldesarrollodeunapolticaestatalrelativaa
los recursos naturales y el medio ambiente, que han dado lugar a una regulacin
infraconstitucionaldesarrolladaenlaLeydelMedioAmbiente,vigentedesde1998.
