vacant government lands through dubious means. Despite the land-grabbers encroaching upon the
government lands and building multi-storey buildings upon them, the Mysore Urban Development uthority
!MUD" and Mysore #ity #orporation !M##" authorities are sitting tongue-tied and hands tied, $hich has
further emboldened the land grabbers $ho are hand in glove $ith some unscrupulous officials to create fake
records.
%t has come to light of late that fake documents $ere created for t$o MUD sites in #hikkaharadanahalli
!ravindanagar" &irst 'tage at #hamara(a Mohalla, on $hich a four-storey building $ith )* apartments have
been constructed and all of them are occupied no$.
+he alleged fraud came to light after an ,+% activist -... .agendra, resident of /adavagiri in city, sought
information about the building from the MUD.
+he t$o sites measuring 01281 ft in ravindanagar are close to 3uvempunagar. MUD had formed the
layout during )488-84. t that time, 'ites .o. 511 and 51) in #hikkaharadanahalli &irst 'tage $ere not
allotted to anyone.
%n reply to the .agendra6s 7uery under the ,+% provisions, the MUD 8ublic %nformation 9fficer replied that
MUD had no records or documents to say that the said t$o sites $ere not allotted to anyone.
+he sites $ere formed during )488-84 and the building on it is eight years old. 'o, does it mean that the
MUD authorities $ere blind to the encroachment all these years: 9r, is it that they are not a$are that the
sites belong to the MUD: 9r, does it imply that they are involved $ith the land-grabber:
+he MUD does not have records of allotment, possession certificate, sale deed, 3hata-revenue letter or

3hata and revenue have been fi2ed based on this document alone. +he building $as constructed by getting
the building plan approved in the names of Mahadevamma and #hikkathayamma. +he four-storied building
is named as 'hashank 8aradise.
+he site and building $as inspected this morning by MUD 'uperintending Angineer 'hivakumar, Bonal
9fficer of Bone-) -haskar and other MUD officials. +he )* families residing in the flats are no$ an an2ious
lot after realising that they have been cheated and they do not possess relevant documents for the flats
they purchased.
'ome of the residents of the building $hom '9M spoke to said that they had purchased the apartments
based on sale agreements and paid ,s. *0 to ,s. =0 lakhs in advance. +hey confessed that the lo$ prices
lured them to buy the apartments as the actual price in that area $as much higher. Aach apartment has a
master-bedroom, another smaller room, a living room, pu(a room, kitchen and a toilet.
Mean$hile, MUD #ommissioner '. 8alaiah told '9M that he $ill investigate the matter and take suitable

=#)'> Act which brought to light the alleged irregularity.
#esponse to M5A ?asu@s letter: 6hamarajanagar M5A ?asu had written a letter to Urban Development
Minister ?inay (umar &ora$e% urging him to probe the irregularities in sites allotment% suspecting the
involvement of some MUDA officials.
)he Minister directed the Urban Development Department &ecretary to probe the matter% who in turn
as$ed the MUDA 6ommissioner to submit a report regarding the allegations. A directive was issued to the
D6 too to probe the matter% following which a complaint was lodged against the -ousing &ociety

Bid to usurp MUDA corner site using fake
documents

With the real estate prices in city skyrocketing, efforts to usurp sites and government land by hook or by
crook are on too, despite several precautionary measures taken up by the MUDA.
Here is an incident of a person trying to acquire a corner site in ayalakshmipuram, measuring !!"#!$"
ft, by not paying a single paisa to MUDA but by merely paying %s. $&,'(" in an auction. )he matter came
to light *hen a citi+en named ,.-. -agendra applied for information under the %ight )o .nformation /%).0
Act. .t is said that he took interest in digging out information about the site after an acquaintance of his
disclosed about the fraudulent deal.
)hanks to the efforts of MUDA 1ecretary ,asavara2u *ho made meticulous investigations of the
documents, the MUDA property *orth several crores *as saved from being usurped.
)he site is in ayalakshmipuram, *hich *as formed about (" years ago. .t is a corner site off the road
leading to )he 3reen Hotel on Hunsur road. )he site bears the number $45A, having site number $4
to*ards the east, another site on the north and roads on the *estern and southern sides.
)he fraud *as committed by %a2u, 6", a resident of 7aduvarahalli $nd Main, Door -o. '(. He is said to
have forged the signature of MUDA 8one ( 1pecial )ahasildar Devara2 and also used a duplicate rubber
stamp for the fake documents.
)he truth is that no auction *as held for site no. $45A. Ho*ever, the accused %a2u is said to have created
fake documents that claimed that he had purchased the site in an auction for %s. $&,'(" on an. 4, !9&9.

1pecial )ahasildar Devara2 to the 1ub:%egistrar to get the site registered *as also forged.
1oon after the fraudulent deal came to the fore, MUDA 1ecretary ,asavara2u placed a signboard at the
site four days ago, stating that the land belonged to the MUDA. A complaint *as lodged at the
?akshmipuram 7olice 1tation yesterday.
.t is surprising that the title:deed for the site *as prepared despite any auction conducted by the MUDA,
no application submitted, no notes *ritten by the officials concerned and no entry made about cash
payment. )he 7olice have launched a hunt for the accused *ho is at large.

MUDA employees booked for forgery, cheating

Mysore Urban Development Authorities (MUDA) have filed a police complaint against one

1he commissioner said the title deed of the said site obtained by Nagara has been cancelled

)he ;overnor@s green signal to the A$rama &a$rama :ill may bring cheer to thousands of property
owners in the city. )he property owners may now be able to regularise their building byelaw deviations%
specifically deviations in setbac$ and floor area ratio.
As per the (arnata$a )own and 6ountry 7lanning =()67> And 6ertain "ther 5aws =Amendment> Act%
+,,3% and the amended (arnata$a Municipal 6orporations Act% *340% residential property owners will be
able to regularise deviations up to a maJimum of /, per cent and for the commercial buildings% the
maJimum deviations allowed is up to +/ per cent.
)his will apply to buildings constructed before December .% +,,3.
:ruhat :angalore Mahanagara 7ali$e =::M7> M. 5a$shminarayan told The Hindu that around 8, per
cent of the *0 la$h properties in the city have one or the other form of deviation. -e said that the building
byelaw violations are common and most citiBens deviate from the sanctioned plan. )his could be for a
variety of reasons% including vaastu. )he ::M7 only allows five per cent violations.
-e said that the largest beneficiaries of this scheme will be large apartment compleJes and big
commercial buildings% who have accrued the violations. K'ndividual% small property owners may not be in
large numbers% neither will the deviations be huge.L
Mr. 5as$hminarayan said the ::M7 had not yet assessed the revenue that it will get from this one-time
payment to regularise their deviations. K-owever% the ::M7 will not compromise on safety aspects.

:A<;A5"#D: (arnata$a government has planned to introduce an amendment to the (arnata$a 5and
#evenue Act *30!% to regularise unauthorised constructions of dwelling houses in government lands in
urban areas% official sources said.
)he amendment :ill would see$ to insert a new section 3! 66 in the Act% providing for grant of land in the
case of unauthorised construction of dwelling houses in government land in urban areas.
;overnor - # :hardwaj had returned the (arnata$a 5and #evenue =&econd Amendment> :ill% +,*+%
passed in both the -ouses of the 5egislature during the previous :27 government on the ground that Mthe
amendment does not serve any public good or social cause. "n the other hand% it may lead to illegal
grabbing of government land.M
A team of advocates is studying the points raised by the ;overnor. (eeping in mind public interest% the
government would draft the :ill again and introduce it in the Assembly.

promise by enacting the (arnata$a )own and 6ountry 7lanning =()67> and certain others =Amendment>
Act% +,,! in giving 3, days for regularisation of four types of irregularities.
Eollowing this% the A$rama-&a$rama scheme was launched in &eptember +,,4 after rules% fiJing fees for
regularisation% depending upon type of violation% were framed.
)hen% the :ruhat :angalore Mahanagara 7ali$e =::M7>% with much fanfare% issued a boo$let with
application forms for regularising four types of irregularities N plot in unauthorised layout/sub-divided
landO building with land use violationO set bac$ violation =up to /, per cent for residential and +/ per cent
for commercial>O and floor area violation N between &eptember */ and December *!% +,,4.
-owever% the scheme was put on hold after the owners of unauthorised structures/sites rose in protest%
terming the regularisation fee as eJorbitant% and the government agreed to revise the fee. At the same
time% the (arnata$a -igh 6ourt was moved by some citiBens 1uestioning the legality of the scheme% while
a few property owners 1uestioned the high fee.
Meanwhile% the ::M7 refunded about #s. +8 crore collected from about !%,,, applicants.
5ater% the :27 government during +,,8-*,% approved an "rdinance initially and later passed an amended
:ill to facilitate re-launching of A$rama-&a$rama scheme while reducing the regularisation fee by about
/, per cent.
:ut% both the attempts were shot down by ;overnor -.#. :hardwaj who said that the challenge to the
+,,4 amendment was pending before the -igh 6ourt.
't is election time again and some political parties have revived their promise on the issue.
9hile the 2anata Dal=&> has made a categorical promise to implement the scheme in its manifesto% the
:27 has given an assurance to issue $hatas for revenue site owners% besides legalising illegal occupancy
of buildings in towns and cities.
-owever% the 6ongress manifesto is silent on this issue.
:ut a cross section of residents and legal eJperts say that the aim of such schemes should be to prevent
recurrence of such illegality in future while regularising the eJisting violations as a one-time measure.
:ut unfortunately% the sole objective of the scheme is to ma$e it a revenue generator for ta$ing up
development wor$s as promised by the parties in their manifestos. 'n the process% the property owners
are painted as Klaw-brea$ersL% though the politically well-connected developers are responsible as they
are on the ones who formed these unauthorised layouts and sold the sites to the gullible buyers. K9hy
should only the purchasers of land pay penaltiesF 9hy is no penalty levied on developers who actually
violated the law while forming layouts% and the officials who did not stop illegal formation of layouts and
failed to protect the interest of the purchasers of sites%L said #amesh (% a resident of &ai 5ayout. -e also
said that even ban$s had failed to protect the interest of borrowers as many people had purchased sites
only after ban$s approved loan following a perusal of land documents.

illegal land use in the Municipal 6orporation of Delhi area would be the best eJample to implement in
:angalore as it does not allow use of illegally built commercial structure in a residential area. As far as
formation of unauthorised layouts are concerned% it is the developers of these layouts and the officials
who deserve more penalty% though buyers too have to legally own up responsibility% says 6ol. Mathew.

the allotments in (arunanidhi@s tenure have violated the rule boo$. Many bureaucrats and their relatives
have been given plots or flats under the category of Ksocial wor$erL. &ome of these last did social wor$
when they were in collegeO many of them claim to be volunteers in such routine activity as helping in
blood donation or eye camps. Many have issued certificates to themselvesO some have ac1uired letters
from the 5ions and #otary 6lubs with vague endorsements. 'n other violations% the rules say that no one
who has any other land or property in )amil <adu or any other capital city% in either their own or spouse or
minor children@s name% can apply for ;DT allotments. )D-D5(A found this is routinely violated.

accused <agaraj has created fa$e documents about the site and made the authorities believe that he had
