Attorney, businessman, and regular PoliticsPA commenter Bob Guzzardi scored quite a
coup this week when he earned enough signatures to make the Republican
gubernatorial primary ballot.
Guzzardis first salvo in his official campaign against the Governor concerns his belief
that the resignation of Sen. Mike Waugh and his elevation to Executive Director of the
Pennsylvania Farm Show was all part of an effort to ensure Rep. Ron Miller would
secure the seat and an advantage over his GOP rival businessman Scott Wagner.
Wagner is still a write-in candidate for the special election and will continue to run in
the primary election (Wagner is also a regular advertiser on PoliticsPA. In fact, his ad is
at the top of this very article).
In response to what he perceives to be an unfair and illegal quid pro quo, Guzzardi has
sent letters to Attorney General Kathleen Kane and U.S. Attorney Peter Smith
requesting an investigation.
I hope for the sake of honest and transparent government, and for fair elections that
the US Attorney and Pennsylvanias independent Attorney General investigates this
corrupt deal, Guzzardi said. From a Governor and Republican leaders, who talked
about cleaning up the corruption in Harrisburg, they seem to be continuing the same old
Bonusgate-style Computergate-style, tactics that landed so many politicians in jail.

Regarding NY-Times Mag Article on Wendy Davis, a perspective from a thinking-lib:
I did not walk away from the article with strong negatives or positives
about Wendy Davis. In some ways, I simply found the direct quotes
from her uninteresting. Clearly, the author does not take a hard line
against the discrepancies in her life's story; but, they are mentioned. He
also questions why she has chosen her personal story as a narrative
rather than accomplishments related to re-development in her district,
which he suggested could be attributed to her efforts.

Is she portrayed as a "legend" in the traditional sense? I don't think so.
His final phrase - "a portrait of herself as a modern-day Supermom, a
woman who existed only in our imagination." To me, that comment
and others in the story suggest that the reporter sees her portrayal as a
stretch. Yet, not completely wrong if you overlook the deviations in
details (I am simply projecting my view of the author's take on her).

In some ways, I think the more interesting point of the very lengthy
article is the discussion about barriers women in politics face with
respect to scrutiny into the impact of their life choices on their
parenting - issues which the author suggest (and I likely would agree) do
not get raised about ambitious men. Bottom line, not clear the article
hurts her; but, I am equally not certain it helps her.

That Guzzardi has called for a probe regarding decisions surrounding York Co. Senate race due to the
possibility that an effort has been promulgated to influence electoral results, this only serves to amplify
his intent to challenge the hegemony of the GOP-Establishment with regard to a panoply of key-issues,
recognizing that his worriment about the looming Fiscal Iceberg triggers him to harbor differences with
Corbett on spending, ObamaCare, taxation, and unionization; he would slash appropriating millions for
billionaires *funding feel-good projects conducted at the rapidly-expanding University of Pennsylvania],
he would not expand Medicaid [because, within a few years, the associated costs would threaten to
break the budget], he would freeze [and then roll-back] taxes, and he would prioritize right-to-work
{respectively}. Quoting from Arthur Miller, Attention must be paid to these trenchant sources of angst,
and the public can depend upon his ability to flash his Edmund Burke mien, as he presses his case.

I read the discovery-documents acquired by Guzzardi, and summarized the situation
thusly, within an article summarizing the activities of the Gubernatorial Candidates:

Attorney, businessman, and regular PoliticsPA commenter Bob Guzzardi scored quite a
coup this week when he earned enough signatures to make the Republican
gubernatorial primary ballot.

Guzzardis first salvo in his official campaign against the Governor concerns his belief
that the resignation of Sen. Mike Waugh and his elevation to Executive Director of the
Pennsylvania Farm Show was all part of an effort to ensure Rep. Ron Miller would
secure the seat and an advantage over his GOP rival businessman Scott Wagner.

Wagner is still a write-in candidate for the special election and will continue to run in
the primary election (Wagner is also a regular advertiser on PoliticsPA. In fact, his ad is
at the top of this very article).

In response to what he perceives to be an unfair and illegal quid pro quo, Guzzardi has
sent letters to Attorney General Kathleen Kane and U.S. Attorney Peter Smith
requesting an investigation.

I hope for the sake of honest and transparent government, and for fair elections that
the US Attorney and Pennsylvanias independent Attorney General investigates this

corrupt deal, Guzzardi said. From a Governor and Republican leaders, who talked
about cleaning up the corruption in Harrisburg, they seem to be continuing the same old
Bonusgate-style Computergate-style, tactics that landed so many politicians in jail.

Guzzardis discovery has revealed mucho-data.

It seems the positions @ the Farm Show were createdmuch to the [initial] dismay of
the prior-bosswho then was mollified by a salary-hikeafter contradictions were
smoothed-over regarding whether he would stay for a brief transition over a few
months vs. the plan for him to remain in this position for another year.

Furthermore, these plans were initially hatched during the summer of 12, and then
suddenly modified in December [after the Scott Walker competition arose]; many other
rhetorical contradictions are contained in the documents from the DoAg & the LtG that
suggest the type of electoral-coordination that Guzzardi has alleged.

Perhaps the media will wish to read the primary data and pursue matters with the
powers-that-be?

I might add that there is specific reference [when justifying the Special Election, despite
precedent having been cited that supported holding it on primary day to save $, when a
resignation had occurred @ a comparable time-frame] to the fact that Senate
Leadership felt it to be urgent that the position be filled by an individual who would
support upcoming initiatives by leadership.

Also, there was absolutely no medical justification cited for this sudden switch, as
talking points were being circulated.

Guzzardi, candidly, feels his job has been done by having IDed this problem, for his
focus remains trained on the approaching Fiscal-Iceberg; nevertheless, attention must
be paid to the time-line he has sketched-out [which these e-mails corroborate].

of [the PA State-Senate Candidate] Scott WAGNER.

I guess I have the former individual on-mind, for Guzzardi has praised his book.

The most telling was a January 7 e-mail from Carol Noll to Melanie DePalma Re: Farm
Show Positions: The email from Michael Pechart said this was to occur on January 13,
2014. We CREATED the jobs (i.e., U8752 Executive Director Farm Show Complex and
U8753 Senior Advisor to the Executive Director) and now it is up to the agency to initiate
the transactions to reclassify and submit the SLRs. Thanks.

We dont what agency or what an SLR is, but it is clear that BOTH positions were
CREATED. It appears from other e-mails that Patrick Kerwin did not want to retire until
the end of 2014 [at the same time former Senator Waugh had announced he would
have ended his term]. He did not seem happy.

discovery was provided; furthermore, Sen. Waugh should be requested to provide all
relevant documents, for his conduct is the bottom-line concern.

With regard to HB 76, I think that anyone who is considering supporting bills of this sort
should consider the consequences. Many of us are working extremely hard to combat
the insidious federal takeover of our educational system that our illustrious PA DOE in
Harrisburg AND Governor Corbett have bought into and are cooperating with...AKA

9/11 Pilot

Pilots often claim that the two worst things that can happen to a pilot are: 1) Walking out to the

aircraft knowing this will be your last flight, or (2) Walking out to the aircraft NOT knowing this will be
your last flight. This pilot's story adds another possibility....

The events of September 11, 2001, put two F-16 pilots into the sky with orders to
bring down United Flight 93.

Late on that Tuesday morning of September 11th, Lt. Heather "Lucky" Penney was on
a runway at Andrews Air Force Base and ready to fly. She had her hand on the throttle
of an F-16 and she had her orders, "Bring down United Airlines Flight 93."

The day's fourth hijacked airliner seemed to be hurtling toward Washington. Penney,
one of the first two combat pilots in the air that morning, was told to stop it.

"I genuinely believed that was going to be the last time I took off," says Maj. Heather
"Lucky" Penney, remembering the September 11 attacks and the initial U.S. reaction.

The one thing she didn't have as she roared into the crystalline sky was live
ammunition. Or missiles. Or anything at all to throw at a hostile aircraft. Except her
own plane. So that was the plan.

Because the surprise attacks were unfolding, in that innocent age, faster than they
could arm war planes, Penney and her commanding officer planned to fly their jets
straight into a Boeing 757.

"We wouldn't be shooting it down. We'd be ramming the aircraft," Penney recalls of
her charge that day. "I would essentially be a kamikaze pilot."

For years, Penney, one of the first generation of female combat pilots in the country,
gave no interviews about her experienceson September 11 (which included,
eventually, escorting Air Force One back into Washington's suddenly highly restricted
airspace).

But 10 years later, she is reflecting on one of the lesser-told tales of that endlessly

examined morning: How the first counterpunch the U.S. Military prepared to throw at
the attackers was effectively a suicide mission. "We had to protect the airspace any
way we could," she said last week in her office at Lockheed Martin, where she is a
director in the F-35 program.

Penney, now a major but still a petite blonde with a Colgate grin, is no longer a
combat flier. She flew two tours in Iraq and she serves as a part-time National Guard
pilot, mostly hauling VIPs around in a military Gulfstream.

She takes the stick of her own vintage 1941 Taylor craft tail-dragger whenever she
can.

But none of her thousands of hours in the air quite compare with the urgent rush of
launching on what was supposed to be a one-way flight to a midair collision. First of
her kind!

She was a rookie in the autumn of 2001, the first female F-16 pilot they'd ever had at
the 121st Fighter Squadron of the D.C. Air National Guard. She had grown up smelling
jet fuel. Her father flew jets in Vietnam and still races them. Penney got her pilot's
license when she was a literature major at Purdue. She planned to be a teacher. But
during a graduate program in American studies, Congress opened up combat aviation
to women and Penney was nearly first in line. "I signed up immediately," she says. "I
wanted to be a fighter pilot like my dad."

On that Tuesday, they had just finished two weeks of air combat training in Nevada.
They were sitting around a briefing table when someone looked in to say a plane had
hit the World Trade Center in New York. When it happened once, they assumed it
was some yahoo in a Cessna. When it happened again, they knew it was war.

But the surprise was complete. In the monumental confusion of those first hours, it
was impossible to get clear orders. Nothing was ready. The jets were still equipped
with dummy bullets from the training mission. As remarkable as it seems now, there
were no armed aircraft standing by and no system in place to scramble them over
Washington. Before that morning, all eyes were looking outward, still scanning the
old Cold War threat paths for planes and missiles coming over the polar ice cap.

"There was no perceived threat at the time, especially one coming from the homeland
like that," says Col. George Degnon, vice commander of the 113th Wing at Andrews.
"It was a little bit of a helpless feeling, but we did everything humanly possible to get
the aircraft armed and in the air. It was amazing to see people react."

Things are different today, Degnon says. At least two "hot-cocked" planes are ready at
all times, their pilots never more than yards from the cockpit.

A third plane hit the Pentagon, and almost at once came word that a fourth plane
could be on the way, maybe more. The jets would be armed within an hour, but
somebody had to fly now, weapons or no weapons.

"Lucky, you're coming with me," barked Col. Marc Sasseville. They were gearing up in
the pre-flight life-support area when Sasseville, struggling into his flight suit, met her
eye. "I'm going to go for the cockpit," Sasseville said.

She replied without hesitating, "I'll take the tail." It was a plan. And a pact. 'Let's go!'

Penney had never scrambled a jet before. Normally the pre-flight is a half-hour or so
of methodical checks. She automatically started going down the list.

"Lucky, what are you doing? Get your butt up there and let's go!" Sasseville shouted.

She climbed in, rushed to power up the engine, screamed for her ground crew to pull
the chocks. The crew chief still had his headphones plugged into the fuselage as she
nudged the throttle forward. He ran along pulling safety pins from the jet as it moved
forward. She muttered a fighter pilot's prayer - "God, don't let me screw up"- and
followed Sasseville into the sky.

They screamed over the smoldering Pentagon, heading northwest at more than 400
mph, flying low and scanning the clear horizon. Her commander had time to think
about the best place to hit the enemy. "We don't train to bring down airliners," said

Sasseville, now stationed at the Pentagon. "If you just hit the engine, it could still glide
and you could guide it to a target. My thought was the cockpit or the wing."

He also thought about his ejection seat. Would there be an instant just before
impact? "I was hoping to do both at the same time," he says. "It probably wasn't
going to work, but that's what I was hoping."

Penney worried about missing the target if she tried to bail out. "If you eject and your
jet soars through without impact..." she trails off, the thought of failing more dreadful
than the thought of dying.

But she didn't have to die. She didn't have to knock down an airliner full of kids and
salesmen and girlfriends. They did that themselves. It would be hours before Penney
and Sasseville learned that United 93 had already gone down in Pennsylvania, an
insurrection by hostages willing to do just what the two Guard pilots had been willing
to do: Anything, and everything.

"The real heroes are the passengers on Flight 93 who were willing to sacrifice
themselves," Penney says. "I was just an accidental witness to history."

She and Sasseville flew the rest of the day, clearing the airspace, escorting the
president, looking down onto a city that would soon be sending them to war.

She's a single mom. She still loves to fly. And she still thinks often of that
extraordinary ride down the runway a decade ago.

"I genuinely believed that was going to be the last time I took off," she says.

In any case, the purpose of Tuesdays all-nighter has been satisfied, for I have completed
the process of shuttling all relevant data to Guzzardis attorney; here is a summary of
the details of what has been accomplished, as we have grappled with myriad systems of
numbering the petitions to comply with both the DoS [Department of State] and Corbett
[which became the template that has now been consolidated, to minimize ambiguity]:

Guzzardi submitted 2894 petitions from 39 counties; per Corbetts complaint,
signatures from four counties have been challenged [158 MD 2014] line-by-line,
including wholesale-rejections of two DelCo petitions [details not yet divulged];
two other objections have been raised, one of which was cured immediately
yesterday-a.m. after Guzzardi hand-delivered his complete Financial Statement
to the Ethics Commission, after having downloaded his filing from the DoS site
[c/o Kinkos]. The other reflects pure-desperation; citing a minority view within an
unpublished opinion, Corbett charged Guzzardi with misrepresentation [at least!]
when circulating petitions that stated [per his inactive licensure-status] that his
profession is a semi-retired businessman and lawyer. This is consistent with all
that Ive observed close-up; he simply never/ever solicits legal business].

Claims [@ the end of the complaint on pages 21-27, citing abbreviations on page 28]
necessitate Guzzardis prevailing by preserving relatively few entries in two of the four
relevant counties [Cumberland, Delaware, Lebanon and Northumberland]; as predicted,
there was no effort to diminish the total to <2000 but, particularly due to the victory of
Scott Wagner, they will work vigorously to deny Guzzardi a position on the ballot. Thus,
to initiate this analysis, I had to open each county-filing to unearth the petitions from
Cumberland County, which were scattered about [e.g., MontCo, sheets 11-12], although
the other three counties were cited sequentially by Corbetts *eight, Im told+ lawyers;
this mini-glitch in its automatic-sorter was fed-back to the DoS [albeit having received a
tepid reaction from the receptionist who wouldnt let me talk directly with Donna+.
Regardless, the task at-hand was distilled; to ensure we continued to meet the criterion
of at least 10 counties with at least 100 signatures, it is necessary to undo challenges
[citing the complaint] to a minimum of petition-signatures per this distilled tabulation:
17/28 [Cumberland], 10/92 [Delaware], 6/53 [Lebanon] and 14/41 [Northumberland].

I gave Guzzardi my hard-copy set of petition-filings, but the database is at the DoS site
[http://www.dos.state.pa.us/portal/server.pt/community/department_of_state/12405]
and Guzzardis county-specific entries are in the 2014 Candidate Database. *BTW,
apparently, the sequential petition-numbering system employed was somewhat useful

although, citing prior discussion, the DoS provides data by having sorted the petitions
(automatically, using bar-code and SPARQ-box) by county.] In any case, by noting the
number of signatures on each petition, I was able to reconstruct the objections.

Disclaimer: The legibility of the copies is variable, so it may be necessary to vet
this detail-work by noting the originals; also, although its unclear whether this
concern need be raised, it is unclear whether a valid signature from a different
county can be rehabbed legally because of the underlying intent of courts to
honor signatures if they otherwise appear valid, lest anyone feel disenfranchised.
Also, when vetting signatures, its unclear whether we need go to the county
courthouse vs. whether we may simply chat with DoS personnel [who can have
acquired a secured-fax of the signature from the county courthouse]. I suppose it
could be possible to bring the actual signers to court to ask them to validate their
effort although, obviously, this is a labor-intensive approach thatit is hoped
would be obviated by simply undermining Corbett by analyzing the database.

Sometimes, it appeared that, when Corbetts reviewers may have felt close to striking
[due to not having registered, which usually prevailed], they were tempted to create
other allegations [e.g., in-the-hand-of-another] to exceed the targeted-threshold. Also,
additional searches were conducted to detect a name [sometimes using the Internet],
even @ a different address, for it may be desirable to ask signers to show they moved;
illustrating their intensity is their having occasionally alleged duplicates, suggesting they
must have entered each signature into a database, quite a laborious task. In any case,
recognize that I feel those designated **+ should be reversed.

Cumberland petitions were culled and correlated with how the challenge had
been organized [lines 75 & 156-167 & 202-203 & 210-241]; the title column
reflects the on-line location of the relevant two-page document (c/o the DoS).
{This approach recalls how one solves the x-word puzzle published each Sunday
in the NY-Times Magazine, when one often has to conjure both the answer to a
given query and the (sometimes truly-stunning, often humorous, always gripping)

My involvement in the legal analysis of the database ended with the aforementioned
due-diligence effort generated by a private citizen; indeed, I just finished providing
feedback to an attorney for the DoS who provided additional refinements to my
appreciation of the administrative process, such as the need to involve the counties
when judicial proceedings prompt rectifying whether a given signature is real/bogus.
[DD, a Dem-blogger, should note his preliminary swipes @ Guzzardis petitions *which

The first question I will ask Richard Tems [who knows Guzzardi and
