DEFINITION OF TERMS


Articleship Structured practical training which has been approved and endorsed by the Articleship
Committee.

Candidate A person who is registered for the CIFP Programme.

Coursework

CP
Includes project papers, assignments, case studies, essays and simulation.

Collaborative Partners.

External supervisor A representative from the approved organization who is responsible to supervise the Candidate.
INCEIF International Centre for Education in Islamic Finance.

Internal supervisor A representative from INCEIF or any approved organization appointed by INCEIF to supervise
the Candidate.

Misconduct Unethical and unprofessional behavior that includes among others dishonesty, deceit, cheating,
plagiarism etc.

Paper
The courses offered under the CIFP Programme.

An extended essay or report of a practical project that describes in detail about the project
reflecting the experience acquired that has been undertaken by a CIFP Part III Candidate in lieu
of Articleship

2. Scope
These regulations apply to all Candidates registered for the Chartered Islamic Finance Professional (CIFP)
Programme offered by the International Centre for Education in Islamic Finance (INCEIF).

Purpose
The purpose of this document is to lay down the rules and regulations governing the CIFP Programme.


3. Chartered Islamic Finance Professional (CIFP) Programme Structure
The CIFP Programme comprises three (3) parts and Candidates must pass all the following parts in order to
complete the Programme.


CIFP Part I
(Building knowledge)
Candidates must pass the coursework and examination for all required Part I Papers
before proceeding to Part II. Candidates have a maximum period of three (3) years to
complete Part I from the date of registration of this part. The required papers are
indicated in Appendix 1, Part I.


CIFP Part II
(Building skills)
Candidates are allowed to take Papers in Part II and do Articleship concurrently.
Candidates have a maximum of three (3) years to complete Part II from the date of
registration of this part. The required papers are indicated in Appendix 1, Part II.



CIFP Part III
(Articleship)
Candidates must pass all papers in Part I of the Programme before proceeding to Part III.
The Articleship programme will be for a period of six (6) months. Candidates have a
maximum of three (3) years from passing Part II to complete the Articleship as per
INCEIFs Articleship Procedures. For further information, refer to Articleship Procedure
(Appendix 2).
Candidates with at least five (5) years working experience in financial services industry
and/or related industry may apply for exemption from Articleship. In lieu of Articleship,
the Candidates must submit a Professional Practice Paper (PPP). For Candidates where
there is no Islamic financial services industry in the country of residence, these
Candidates, with or without five (5) years working experience will be allowed to undertake
the PPP in lieu of articleship. For further information, refer to Professional Practice Paper
(Appendix 3.)


4. Admission Criteria
i. A Bachelors degree or an equivalent qualification or a professional qualification from institutions recognized by
INCEIF or the Government of Malaysia; or
ii. A Diploma from recognized institutions by INCEIF with at least (five) 5 years of working experience in a related
field;
iii. STPM OR EQUIVALENT (such as A LEVEL, matriculation, etc) who is at least 35 years old and have at least three (3)
years of relevant working experience; and
iii. Proficiency in English language is required.

For any of the above admission criteria, Candidates must produce evidence of his competency in English either in the
test of English as Foreign Language (TOEFL) score of 550 or International English Language Testing System (IELTS)
level 6 or Malaysian University English Test (MUET) Band 5. Exceptions from English Language competency can be
given to those whose medium of study at entry level is ENGLISH.

5. Application for Admission
Application for admission can be made online at www.inceif.org at any time during the year.

5.1 Documentation Requirement
Application for admission must be supported by certified documentary evidence of the following:
i. Academic and / or professional qualifications;
ii. Personal identification; and
iii.Documentary evidence of sponsorship for sponsored Candidates (if applicable).

5.2 Processing Fee
All applications for admissions must be accompanied by a non-refundable processing fee. This can be paid by credit
card or by means of a Bank Demand Draft, payable in Kuala Lumpur.

5.3 INCEIF will issue an offer letter to successful applicants. After which, the applicant becomes a Candidate for the
CIFP programme.


6. Registration

6.1 Registration for Papers and Examination
Candidates may proceed to register online for the CIFP Papers and pay the necessary registration and examination
fees.
For online Candidates, they must register for at least two (2) Papers, in any regular semester and minimum one (1)
Paper in the short semester until all the required Papers in the respective Parts are passed. For full-time Candidates,
they must register for at least four (4) Papers in any regular semester and minimum one (1) Paper in the short
semester.
However, in case of medical or other valid grounds, Candidates may apply for exemption from registration of Papers
for a particular semester, subject to Deferment Policy.

INCEIF reserves the right to terminate the registration of any Candidate who is found to have omitted or falsified
relevant facts or information in connection with the application for admission.

6.2 Tutorial
Tutorial sessions for Papers offered in Part I and Part II are optional for registered Candidates.
Candidates opting to attend the tutorials would be charged fees, and would only be allowed to attend the tutorials
upon full payment of the fees.
Tutorials may also be conducted by other training providers approved by INCEIF.

6.3 Pre Examination Seminars
Candidates opting to attend the pre examination seminars will be charged fees and will only be allowed to attend
the seminar upon full payment of the fees.

6.4 Class Attendance
Full-time CIFP Candidates are required to maintain 80% attendance for each Paper registered to be eligible to sit for
final examination.

6.5 Full-Time to Part-Time Conversion
Full-time Candidates may opt to pursue the Programme on part-time basis, subject to the minimum Paper
registration requirement of the online Candidates.

6.6 Dress Code
All CIFP Candidates must be properly attired while in INCEIF premises.

6.7 Other Study Options
INCEIF will send invitations to registered Candidates to attend other study options upon availability of such options.
An attendance fee will be charged to the Candidates on per session basis.

6.8 Examination and Deferment Policy
Registration for examination must be received by INCEIF on or before the closing date which is one month after the
commencement of the semester.

6.81 Deferment Policy
Candidates who are unable to sit for the examination on medical grounds and other valid reasons must furnish
documents to support the application to defer. The following are very exceptional cases which merits deferment:
a) Medical grounds with supporting documents;
b) Unexpected hospitalization due to critical illness/disease or injury due to personal accident;
c) Complications due to pregnancy that may occur at any stage of the pregnancy and required the Candidates
to be hospitalized; or
d) Death of immediate family members or close members or close relatives during or before examination
date.

Candidates who fail to sit for the examination within one year of registration without giving any notification with
valid reasons to INCEIF will not be allowed to continue the Programme and will be required to reapply for
admission and pay the required fees.
Candidates who fail to comply with the above conditions will automatically cease to be a registered Candidate of
INCEIF.
Candidates who fail to sit for an examination due to extraordinary circumstances may be permitted to defer the
examination only up to the following examination session.

A processing fee will be charged for every application for deferment.
In case of deferment, the processing fee, registration fee, examination fee, pre-examination seminar fee and
tutorial fee are non-refundable. However, the examination fee and pre-examination seminar fee can be carried
forward to the next semester, subject to the Deferment Policy.

A refund shall include carrying forward the fees to the next semester or if the Candidate intends to leave the
Programme, a cash refund will be given subject to the Fee Refund Policy.

The details of the Fee Refund Policy shall be as follows:
a) 100% refund within two (2) weeks of the registration date for the examination or PES;
b) 50% refund within four (4) weeks after the closing date of registration;
c) No refund thereafter; and
d) No refund for the short semester.

The following reasons are not to be considered for deferment / refund request:
a) Extensive workload;
b) Commitment for meetings;
c) Change of job appointment; or
d) Outstation duties.

Any application for exceptional cases (with supporting documents) must be approved by Head of CIFP Department.,
subject to clause 6.1.

6.8.2 Barred from Examination
Candidates failing to pay all fees due will not be allowed to sit for the examination.

6.8.3 Examination Venues
Candidates will be notified of their respective examination venues / centres prior to the examination. No Candidate
will be allowed to sit for examination at venues / centres other than those determined by INCEIF.

6.8.4 Student Identification


INCEIF will issue a Statement of Eligibility to sit for the registered Papers of the CIFP examination prior to the
examination. Candidates will be required to bring along their Statement of Eligibility together with their Student ID
to the examination venue in order to be permitted to sit the for the examination.

6.8.5 Examination Schedule
The examination schedule will be posted on the INCEIF website. Candidates are expected to access information
pertaining to the same.

6.8.6 Candidates Requiring Special Assistance
Candidates with physical disability requiring special assistance to sit for the examinations are required to submit
the request at least one month prior to the examination.


7. Grading
Part I and Part II
Candidates are assessed on two main elements: course-work and final examination which carries 20% - 30% and
70% - 80% of the total marks, respectively. The final grade is determined by, the aggregation of marks obtained for
course-work and final examination.

Examination results are reported as pass with distinction (A), pass (B) or fail (F). The final examination marks
will not be released.

Part III (Articleship)
Candidates will be assessed based on the Final Report and recommendation by External Supervisor. The result will
be reported as Pass or Fail.


8. Exemption from Papers and Articleship
8.1 Candidates may apply for exemption from Papers in Part I, II and Part III (Articleship) and such exemptions
will be at INCEIFs discretion.
8.2 Exemptions for Papers may be allowed on the basis of comparable papers passed with acceptable grade
from recognized institutions.
8.3 Candidates with at least five (5) years working experience in financial services industry and / or related
industry may apply for exemption from Articleship by submitting to INCEIF a written application to the CIFP
Programme Officer along with the required supporting documents. For Candidates where there is no Islamic
financial services industry in the country of residence, these Candidates, with or without five (5) years working
experience can also apply for the exemption from articleship in lieu of which they will be required to
undertake the PPP. For details refer to Professional Practice Paper (Appendix 3).
8.4 All application for exemptions must be supported by certified documentary evidence.


9. Examination Results
9.1 Result Notification
Notification of results will be posted in the e-University system and Candidates must access via e-University to obtain
their own results.

9.2 Certificate of Completion
Candidates will be awarded a Certificate of Completion and a full examination Transcript upon completion of each
part of the CIFP Programme.

9.3 Withholding of all Examination Results
INCEIF reserves the right to withhold all examination results of Candidates who:
i. Fail to settle any fees or monies due to INCEIF; or
ii. are under any investigation for breach of INCEIF regulation or misconduct of any kind.

9.4 Appeal Against Examination Result


All results made are final and there is no provision for appeal.
9.5 Examination misconduct
INCEIF views very seriously any kind of misconduct in examinations and assessments and will take disciplinary
action against Candidates for misconduct. Examples of examination misconduct may include but not limited to the
following:
a. Cheating and/or acting dishonestly in any assignment and examination;
b) assisting other Candidates to cheat or act dishonestly in any manner;
c) seeking assistance to cheat or to act dishonestly in any assignment and examination;
d) plagiarising; i.e. passing off and/or paraphrasing another persons work as his own and without proper
acknowledgement to the author;
e) impersonating another Candidate during examination;
f) an attempt to tamper with examination scripts or coursework after it has been submitted; or
g) other acts deemed as improper academic conduct.

9.6 Misconduct While Undergoing Articleship
INCEIF will take action against Candidates for misconduct while undergoing Articleship. The penalty imposed may
include termination from Articleship.

Misconduct may include but not limited to the following:
9.6.1 Violation of Articleship Procedure. In the event the External Supervisor determines that the Candidates have
violated the professional standards of working practice, and in consultation with the Internal Supervisor, the
Candidates will be terminated from the Articleship. The External and Internal Supervisor will complete the
Termination of Articleship Form.
9.6.2 Other Misconducts
At any time during the course of the Programme, INCEIF reserves the right to request Candidates to withdraw from
the Programme if found guilty of any serious misconduct detrimental to the interest of INCEIF.

10. Use of Candidates Work by INCEIF
10.1 Candidates own the copyright to their works produced as part of their course of studies. Work shall
include project papers, term papers and assignments.

10.2 Under the Malaysian Copyright Act 1987, works shall be protected provided that sufficient effort has been
expended to make the work original in character and the work has been written down, recorded or reduced to
material form. Copyright shall subsist during the life of the author and shall subsist for a period of fifty years after
the death of the author. The Copyright Act 1987 also allows for fair dealing of works for the purposes of research,
private study, criticism or review provided that proper acknowledgement is given to the author.

10.3 Candidates grant INCEIF an irrevocable, royalty-free, non-exclusive licence to use his/her copyright for
INCEIFs teaching and research purposes.

10.4 If any Work is jointly developed by a group of Candidates, the copyright will be jointly owned by the group
of Candidates.

10.5 Please refer to Appendix 5 for sample of the Declaration of Copyright and Authorization To Use. The
Declaration of Copyright and Authorization To Use must be attached to each work produced by the Candidates.

11. Grievance Procedure
Academic Grievances is defined as any event that may impair the Candidates ability to progress academically at
INCEIF. For details, refer to Academic Grievance Procedure, where applicable.

12. Graduation
Candidates will be awarded with the Certificate of Completion of the Chartered Islamic Finance Professional (CIFP)
upon successful completion of all parts of the CIFP Programme.

13. The Right to Make Decisions
13.1 INCEIF RESERVES THE RIGHT TO AMEND THESE REGULATIONS AS IT DEEMS NECESSARY FOR THE INTEREST
OF THE PROGRAMME.
13.2 INCEIF reserves the right to waive and vary the clauses in these Regulations at any time and Candidates will be
notified of any such variation and/or amendments.

14. Disclaimer
INCEIF is not responsible for any consequences arising from the Candidates failure to comply with these regulations,
procedures, deadlines or instructions.

15. Effective Date of the Regulations
The above regulations will be effective for Candidates registered from January 2009.

Articleship Committee The Articleship Committee comprises President & Chief Executive Offcer or his
nominee, as Chairman, Heads of Department, Head of CIFP Programme, Head of
Admission and Student Affairs Department and other members from the Islamic
Financial Services industry deemed necessary.
Articleship Agreement An agreement for an articleship between approved organisation and CIFP
candidate.
Approved Organisation Organisation approved by the Articleship Committee.
Candidate A registered CIFP candidate undergoing an articleship with an approved
organisation.
Competency Standards The competency standards and assessment guidelines endorsed by Professional
Development Panel (PDP).

Purpose
The purpose of this document is to outline the articleship procedure for the Chartered Islamic Finance Professional
(CIFP) programme.

Scope
This procedure is applicable to all candidates who have taken and passed CIFP Parts I and II.

Amendment of Procedure
Any amendments to the procedure shall be recommended to the Articleship Committee for approval.

Objectives of Articleship
The objective of Articleship is to evaluate the candidates ability to apply their knowledge and skills in a workplace
environment.
To provide opportunities for candidates to use the workplace as an active learning environment;
To provide opportunities for candidates to further develop their competencies in Islamic Finance; and
To fulfll the partial requirements for a full CIFP qualifcation.
Articleship Modus Operandi
Articleship offers candidates the opportunity to work in the Islamic fnancial institution or other Islamic fnance related
institutions. The candidate will be under the supervision of an External Supervisor from the approved organisation. The
External Supervisor will train and evaluate the performance of the candidate. The candidate will also work together with
an academic member (Internal Supervisor) in INCEIF or a resource person appointed and agreed by INCEIF to blend the
academic and industry experiences. A complete report must be prepared and submitted by the candidate to the Internal
Supervisor in INCEIF at the end of the Articleship period.

Eligibility for Articleship
A candidate must successfully complete the articleship programme within 3 years of passing Part II and must fulfll all
of the following to be eligible for articleship:
6.1 Passed all Papers in Parts I of the CIFP programme;
6.2 Secure a place for articleship training approved by INCEIF;
6.3 To undertake articleship in any discipline related to Islamic Finance;
6.4 Provide a signed Articleship Agreement with any approved organisation;
6.5 Settle all fees and dues to INCEIF ; and
6.6 Maintain his or her status as registered candidate with INCEIF.
Duration of Articleship
The duration of the articleship is six (6) months.

Validity Period
The validity period of the articleship is three (3) years after passing CIFP Part II. Under extenuating circumstances e.g.
medical grounds, the period of articleship may be extended. The Articleship committee has full authority to determine
the circumstances and the period of articleship to be extended.

Progress Report
During the articleship period, candidates are required to:
9.1 Keep a daily e-log book to record their activities and learning;
9.2 Be in contact with the Internal Supervisor at least three (3) times during the articleship period to discuss their
progress; and
9.3 Attend progress evaluation meeting required by Internal and External supervisors anytime during the articleship
period.
Final Report
10.1 A candidate must prepare a Final Report containing all the learning outcomes including the required skills and
competencies that have been acquired.
10.2 An integration of theory and practice needs to be demonstrated in the Final Report. The Final Report must be
submitted to the Internal Supervisor in a double spacing format within two (2) weeks upon completion of the
articleship. The length of the Final Report is to be between 2500 - 3000 words.
10.3 The format of the Final Report will be as follows:
i. detail description of project(s) and/or assignment(s) undertaken;
ii. specifc learning outcomes, competencies and skills acquired; and
iii. description of his experience in applying theoretical knowledge in undertaking project(s) and/or assignment(s).
Assessment of the Articleship
Assessment of the Articleship will be decided by the Articleship Committee, and will comprise the following:
11.1 Final Report by CIFP candidate
11.2 Report and Recommendation by External Supervisor
11.3 Report and Recommendation by Internal Supervisor
Final Result
12.1 A candidate will be assessed on the Final Report and the recommendation of the external supervisor.
12.2 Final result will be reported as Pass or Fail.
12.3 In determining the grades, the Articleship Committee may require candidates to do any or all of the following:
i) attend an interview with the Articleship Committee;
ii) resubmit Final Report;
iii) extend the articleship period.

Expenses
All expenses and expenditure incurred during the articleship will be borne by the candidates.

Placement for Articleship
The validity period of the articleship is three (3) years after passing CIFP Part II. Under extenuating circumstances e.g.
medical grounds, the period of articleship may be extended. The Articleship committee has full authority to determine
the circumstances and the period of articleship to be extended.
14.1 A candidate is advised to secure a place for articleship before the end of the CIFP Part II of the programme;
14.2 The organisation selected for articleship must be approved by the Articleship Committee; and
14.3 A candidate requiring assistance to secure a place for articleship, should contact INCEIF by writing to
admission@inceif.org prior to completing the CIFP Part II.

Exemption from Articleship
15.1 A candidate with at least fve (5) years working experience in fnancial services industry and/or related industry
such as accounting, consultancy, legal, public sector, government and other relevant institutions
approved by INCEIF may apply for exemption from articleship by submitting a written application and
proposal demonstrating his ability to apply the theoretical knowledge and skills on Islamic fnance in his work
environment to INCEIF.
15.2 A candidate must submit within six (6) months the Profesional Practice project paper of between 5000 to 7500 words
for evaluation by the supervisor appointed by Articleship Committee; and
15.3 The Chairman of Exemption Committee will make a fnal decision on the application for exemption.

Termination from Articleship programme
Candidates will be terminated from Articleship if they are found guilty of the following :
16.1 Violation of Professional Code of conduct and any other unprofessional conduct.
16.2 Violation of training organizations rules and regulation
16.3 Failure to fulfll 90% of total attendance during the articleship;

Right of Appeal
Any candidate who has received notice of termination may appeal within fourteen (14) days by writing to President/
Chief Executive Offcer at the following address:

1. INTRODUCTION
A Professional Practice Paper (PPP) is an extended essay or report of a practical project that
describesindetailabouttheprojectthathasbeenundertakenbyaCIFPPartIIIcandidate(The
Candidate)tobringouttheexperience,competencyandlessonsthatheorshehaslearned.The
candidatemustclearlydemonstratetheexperienceandcompetencythathehasacquiredandis
abletodrawlessonsfromsuchexperience.
2. OBJECTIVESOFTHEPPP
The objectives of introducing PPP is to allow CIFP candidates who have completed Part I of the
CIFPprogrammeandhasworkedinafinancialservicesindustryforaminimumoffiveyears
2.1 towriteanessaythatdescribesindetailhisorherexperienceinaparticularsubject
area which is relevant to the financial services industry at the same time
demonstrating skills that he has acquired and the lessons he has drawn from such
experience;
2.2 to exempt the candidate from having to undergo an internship programme of six
monthsinafinancialorrelatedinstitutionasafulfillmentoftheCIFPPartIII;and
2.3 to allow such candidates to commence writing the PPP immediately after
completingPartIofCIFPinsteadofhavingtocompletePartIIofCIFP;and
2.4 to reduce the total duration of the programme in order to be an attractive and
competitiveprofessionalqualification.

3. REQUIREMENTSTOQUALIFYTOWRITETHEPPP
ThecandidatemustfulfillthefollowingrequirementsbeforebeingallowedtowriteaPPP:
3.1 ThecandidatemusthavecompletedPartIofCIFPprogramme;and

4. APPLICATIONFOREXEMPTIONFROMARTICLESHIP
4.1 If the candidate has fulfilled the above requirements, he/she need to apply for
exemption on the required Exemption Form available from the CIFP Programme
Officer,alongwiththerequiredsupportingdocuments.
4.2 The application will be reviewed by the CIFP Programme Officer and recommended
bytheCIFPHead.Thefinalapproval/rejectiondecisionwillbemadebyChairmanof
ExemptionCommittee.

4.3 If the application for exemption is approved by the Exemption Committee, the
candidatecanproceedtoregisterforPartIIIofCIFP.
4.4 TheCIFPDepartmentwillallocateasupervisorforthecandidateafterdiscussionwith
theFacultyMembers.
4.5 Thereafterthecandidatewilldiscusstheproposalwiththesupervisorandcommence
writingthePPP.
4.6 The candidate need not complete the Part II of CIFP in order to commence writing
thePPP.

5. AREAOFSUBJECTMATTER
The candidate can choose any subject related to the financial services industry which includes,
interalia,banking,takaful,capitalandmoneymarket,treasurymanagement,auditing,corporate
finance, underwriting in takaful, project appraisals, product development, fiscal policies, wealth
planningandmanagementissues,accountingissues,legalorshariahissues,etc.
6. LENGTHOFTHEPAPER
TheProfessionalPracticePapermustbebetween5,000to7,500wordsorabout20to30pages
ofA4doublespacing.
7. APPROVALOFTHEPROPOSAL
TheproposalofthePPPintermsoftopic,areatobecovered,theproblemsorissuestoberaised
and the experience and competency to be extracted must be approved by INCEIF. Specifically,
INCEIF will be appointing an academician from among the Faculty to supervise the candidate. If
needbe,anappropriatepersonnelfromtheinstitutionthecandidateiswritingaboutwillalsobe
selected to cosupervise the candidate. The candidate will not start writing without getting a
formalapprovalfromthesupervisorandcosupervisor,ifappropriate.
8. DURATIONOFTHEEXERCISE
The candidate is given six months to complete the write up from the time he or she registers
withINCEIFtoundertakethePPP
9. EVALUATION
The candidate may be required to make a formal presentation of the PPP to the supervisor and
cosupervisor(ifapplicable).Thesupervisormayinviteotherstoattendthepresentation.
10. RESULTOFTHEPPP
Thecandidatewillbeawardedanyofthefollowinggrades:

INCEIFSTUDENTDISCIPLINARYPOLICY


Student Misconduct means behaviour that breaches any codified or explicitly stated rules
and regulations of INCEIF.

Student Examination Misconduct shall include but not limited to the following:
a) Cheating and/or acting dishonestly in any assignment and examination;
b) assisting other students to cheat or act dishonestly in any manner;
c) seeking assistance to cheat or to act dishonestly in any assignment and examination;
d) plagiarising; i.e. passing off and/or paraphrasing another persons work as his own
and without proper acknowledgement to the author;
e) impersonating another student during examination;
f) an attempt to tamper with examination scripts or coursework after it has been
submitted;
g) other acts deemed as improper academic conduct.

Student Non-Academic Misconduct shall include but not limited to the following:
a) conduct in violation of any rules and regulations of INCEIF;
b) acting dishonestly in relation to an application for admission to INCEIF;
c) prejudicing the good name of INCEIF;
d) breach of confidentiality and privacy requirements or obligations in respect of INCEIF
or its staff, students or other relevant parties;
e) interfering with the freedom of other persons to pursue their studies, carry out their
functions or participate in the life at INCEIF;
f) harassing or engaging in other improper or discriminatory conduct towards another
student, officer of INCEIF, visitor or any other person whilst pursuing his/her activity
related to INCEIF; must harassment shall not be limited to race, ethnic or national
origin, gender, marital status, sexual preference, disability, age, political conviction or
religious belief;
g) removing from the examination room without authority any stationery supplied by
INCEIF;
h) offering a bride in whatever form to an invigilator, examiner or other person
connected with assessment;
i) accessing or using another students academic work by theft or other unauthorised
means;
j) furnishing false or misleading information to INCEIF staff;
k) theft, malicious destruction, damage or injury to property of INCEIF;
l) possession, use or distribution of any alcohol or drugs which is prohibited by law;
m) possession or distribution of obscene materials, within or outside INCEIF premises;
n) breach of student visa requirements (for foreign students only);
o) gambling; and
p) unauthorised entry into, or use of INCEIF facilities.

INCEIFSTUDENTDISCIPLINARYPOLICY

1 PURPOSE

1.1 To implement rules and procedures in relation to student conduct including


procedures for suspension and expulsion. This is to ensure discipline and good
behaviourofthestudents.

2 ACADEMICREGULATION

2.1 ThisprocedureshallbereadtogetherwiththeAcademicRegulation.

3. ENFORCEMENT

3.1 The Chief Academic Officer (CAO) shall have the power to take any disciplinary
actionagainstanyStudentforamisconductunderthispolicy.

3.1 TheCAOmayappointanyofficerofINCEIFtoexerciseanyofallofhisduties,powers
orresponsibilitiesunderthispolicy,andsuchappointedofficerhastheobligationto
report to the CAO on the exercise of duties, powers or responsibilities under this
policy.

4. STUDENTDISCIPLINARYPROCEDURE

4.1 OFFENCESRELATEDTOEXAMINATIONMISCONDUCT

4.1.1 ThefollowingprocedureshallapplytoanExaminationMisconduct.

i) WhereanallegationisofExaminationMisconduct,anyfacultymemberwho
discovers such misconduct in any student assignment, coursework and/or
examination script may report to the Head of Department (HOD) of the
particularsubject.

ii) ThatHODshallthenfileanofficialwrittencomplaintwiththeCAO.TheCAO
shall then nominate a faculty member to undertake an investigation and
makeafinding.

iii) The CAO shall determine whether there is sufficient cause, based on the
evidence compiled, to call the Student to answer the allegation. The CAO
may dismiss the allegation without any record in the Students file or
presenttheallegationtotheStudentconcernedandgiveanopportunityto
theStudenttoanswertheallegation.

iv) The Student shall then be notified at least five (5) working days before the
date of the interview. The Student may be accompanied by a friend or
representative. The interview shall be conducted by the CAO and Head of

Department (the Panel). The Panel may adjourn the interview to seek
other evidence and to make its decision. Having interviewed the Student,
theCAOmaydecide:

(a)ifallegationisnotproven,theCAOshalldirectthatnofurtheractionbe
taken against the Student and no record of such allegation be entered into
theStudentsrecords;or

(b)iftheallegationisproven,theCAOhasthepowertoimposeoneormore
ofthefollowingpenalties:

1.awardtheStudentzeromarks,eitherfortheassessedworkorthewhole
coursewiththerighttoresubmitorresitatthefollowingsitting;
2.awardthe Studentzero markseitherforthe assessedworkorthewhole
coursewithouttherighttheresubmitorresit;
3.expulsionoftheStudent;
4.iftheplagiarism
4.causearecordtobemadeintheStudentsfile.

v) The Student shall be informed in writing of the decision within seven (7)
daysoftheinterview.

vi) TheStudentshallhavetherighttoappealagainsttheCAOsdecisionwithin
seven (7) days after receipt of the decision. Any appeal must be in writing
andsenttothePresident&ChiefExecutiveOfficer(PCEO).

vii) It will be the sole discretion of the PCEO to determine whether to reopen
the matter. The PCEO may decide to direct a new interview, in which case
the CAO and Head of Department involved in the first interview will be
excluded; or reduce the penalties imposed by the CAO or dismisses the
appeal.

viii) Iftheappealisdismissed,acompletionofprocedureletterwillbeissuedto
the Student. Any Student who intends to further appeal may take his/her
casetotheMinisterofHigherEducation,Malaysia.

4.2 NONACADEMICMISCONDUCT

4.2.1 These procedures shall apply to allegations of misconduct other than plagiarism
againstanystudent.

i) AnymemberofINCEIFmaylodgeacomplaintagainstanystudentforanalleged
misconduct.Thecomplaint,givingdetailsoftheallegedmisconduct,mustbein
writingandaddressedtotheCAO.

ii) The CAO, upon examining the evidence, may immediately instruct that the
StudentbesuspendedanddenieduseofanyINCEIFfacilities.

iii) The CAO may dismiss the complaint if he/she believes that there is no case for
the Student to answer or if the complaint is not dismissed, to refer the case to
theStudentDisciplinaryCommittee.

iv) AnyactiontakenbytheCAOshallbecommunicatedinwritingtotheStudentby
theofficeoftheCAOwithinthree(3)days.

v) If the case is referred to the Student Disciplinary Committee, the chairman of


the Student Disciplinary Committee shall call for a hearing. Members of the
Student Disciplinary Committee shall comprise: the CAO (Chairman), Head of
Admission and Student Affairs Department, Head of Governance and two (2)
facultymembers.

vi) Prior to the hearing, the Chairman shall appoint an investigating officer from
among the faculty members who will conduct an investigation and prepare a
writtenfindingonthecasewithinseven(7)days.

vii) TheStudentshallbe givenseven(7)dayswrittennoticeofthedateof hearing.


The Student shall also be given a written statement of the charges. Failure to
attend shall result in an immediate dismissal of the Student from INCEIF. The
Student Disciplinary Committee shall have the power to conduct the hearing in
theabsenceofanyperson(s)entitledtoattend.

viii) Atthehearing,thefollowingprocedureshallbeapplied:

a. The Chairman shall explain to the student of the nature of the alleged
misconductandcallupontheaccusedStudentforhis/herplea.

b. IftheStudentpleadsguilty,theChairmanshallexplainthefactsofthecase
and the consequences of his/her plea. If the Student understood the facts
andconsequencesofhis/herplea,theStudentDisciplinaryCommitteeshall
pronouncetheStudentguiltyoftheoffenceandthepenaltyimposed.

c. If the Student pleads not guilty, the Student Disciplinary Committee shall
conductthehearing.Eachpartytothehearingshall beentitledtomake an
opening statement, give evidence, call witnesses, question any witness
concerning any relevant evidence and to address the Student Disciplinary
Committeeatthecloseofthehearing.

d. At the close of the hearing, the Student Disciplinary Committee shall


determine, in consideration of the evidence, whether a misconduct has
beencommitted.

e. if the Student Disciplinary Committee is satisfied that the Student has not
committedamisconductitwillinstructthatthecaseisclosedandnofurther
noticetobeenteredintotheStudentsfile.However,afterafindingofguilt,
itcantakeoneormoreofthefollowingcoursesofaction:

I. issue a written warning to the student indicating the consequences


offuturemisconduct,tobeenteredintothestudentsfile;

II. require the student to compensate for or make good any damage
causedtothepropertyofINCEIF;

III. withholdingofexamresultsordenialofdegree;

IV. suspend for a specified period of time or exclude the student with
immediateeffectfromINCEIFpremisesand/orprogrammes;

V. expulsionfromINCEIF;

VI. in the case of a sponsored student, a letter shall be sent to the


sponsoringorganisation;or

VII. any other penalty as deemed fit by the Student Disciplinary


Committee.

4.3 On completion of the hearing, the student will be sent a written notice stating the
outcomeofthehearing,thereasonsforthatoutcome,summaryoftheallegedfacts
on which the disciplinary action is based and any penalty imposed. The notice will
alsoincludeaclearstatementoftherighttoseekareviewofthedecision.

4.4 If the misconduct is committed by a student who is situated abroad, the above
procedureshallbeconductedviaanexchangeofdocuments.

5. REVIEWOFTHEOUTCOMEOFTHEHEARING

5.1 A student may request a review by the President & Chief Executive Officer (PCEO)
againstadecisionorpenaltyimposedbytheDisciplinaryCommittee.Sucharequest
for areview mustbe submittedinwritingtothePCEOwithin seven(7)daysof any
decisionorpenaltybeingimposed.

5.2 TheStudentmuststateclearlyhis/hergroundsofappeal.

5.3 ThePCEOmaycallforthenotesofhearinginrespectofwhichthenoticeofappealis
given.

5.4 ThePCEOmay,rejectorconfirmthedecisionoftheStudentDisciplinaryCommittee,
orimposealesserorhigherpenalty,asthePCEOdeemsfit.

5.5 ThePCEOsdecisionshallbefinal.

6. SUSPENSIONANDEXCLUSIONPENDINGAHEARING

6.1 TheCAOmaysuspendorexcludeastudentpendingahearing,wherethestudentis
thesubjectofadisciplinaryproceedingandthereisacriminalchargependingoran
ongoingpoliceinvestigation.Writtenreasonsforthedecisionshallberecordedand
madeavailabletothestudent.

6.2 Otherthaninexceptionalcircumstances,noStudentshallbesuspendedorexcluded
unless given an opportunity to make representations in person or in writing to the
CAO.

6.3 A decision to suspend or exclude from academic activities associated with the
students programme of study, shall be subject to review, at the request of the
student,whereitisinplaceforacontinuousperiodoffourweeks,orlonger.

7. AMENDMENTS

7.1 The CAO may make amendments and variations to this policy and any such
amendments and/or variation shall be subject to the endorsement of the
ProfessionalDevelopmentPanel(PDP)ofINCEIF.
