ANNAMALAI UNIVERSITY
ITS BIRTH AND GROWTH

Annamalai University was founded by Sir Annamalai


Chettiar to spread education of all streams. Annamalai
Chettiar belongs to Kanadukathan Community. The saint
Pattinathar hailed from this community. Patinathar was a
business man having trade connections with countries like
Singapore. Malaya Burma etc. He made enormous money. It
is said that God came to him as his son and gave a note and
disappeared. The note stated Kathu Attra Ussiyum Vaarathu
Kann Kadivazhikke Even a pin broken will not come with
anyone when he goes to the grave. On seeing this Patinathar
took sanayasam. Annamalai Chettiar belongs to the family
of Patinathar. He belonged to the seventh generation of Patinathar family. Sir Muthaia Chettiar, son of Annamalai Cettiar belonged to the 8th generation and MAM.Ramaswamy
belonged to the ninth generation. Sir Annamalai Chettiar
wanted to expand his interest, in spreading education. He
found out in Rt.Hon Srinivasa Sastri as the right person who
could help him to expand the educational interest and Sir.
Annamalai Chettiar found in another person R.V.Krishna
Ayyar who could be with him promoting the purpose. Rt.
Hon. Srinivasa Sastri was lecturer in a Salem College during 1998 -99 and later became the HeadMaster of Hindu
High School , Triplicane,Chennai. These three decided that
Meena kshi College founded by Sir.Annamalai Chetiar could
be converted into an University. Sir.Annamalai Chetiar requested the Governor of Madras Lord Goshen and sought his
permission to get the Annamalai University Act adopted by
the Legislative. Lord Goshen told Annamalai Chettiar The
Legislative Council is in session, will come to an end in a
couple of days and it is difficult to draft the bill, introduce the
bill in the Council and get it passed in the same session. But
there is one man who can do it and he is. R.V.Krishna Ayyar.
Sir.Annamalai Chetiar then requested R.V. Krishna Ayyar
to help him get the Annamalai University bill drafted and

passed by the House. R.V.Krishna Ayyar over night sat and


drafted the Annamalai university bill got the bill introduced
in the Legislative Council and the Annamalai University
bill became an Act and the same day the Governor gave his
assent. This was in the year 1929, the Annamalai University
was established. Rt.Hon. Srinivasa Sastri was appointed the
first Vice-Councillor of the University. R.V.Krishna Ayyar
became a funder/member of the syndicate of the University.
But Rt.Hon.Srinivasa Sastri had to go to London to attend
the First Round Table Conference in 1929 and so he resigned
his post Vice Chancellor. In his place another educationist
Sir. S.E.Ranganathan was appointed the Vice Chancellor
and he served for a period of 6 years. The first convocation
of the University was held in 1931 with the then Governor
Lard Stanley in the Chair. Sir.Annamalai Chettiar was not
known to the public muchBut with Annamalai University of
Annamalai Chettiar came to be know to all.
Soon the Annamalai University attracted the attention
of the public as there were only two Universities in Madras
province then. They were Madras University and Andhra
University.
R.V.Krishna Ayyar made Annamalai University, a residential University just as Benares University, founded by
Pandit Madan Mohan Malavia. Annamalai University then
expanded. Though there was intermediate class at the beginning subsequently this was removed and it came to be one
of the Universities which promoted only graduation. With
the country becoming free, technical education became vital
for the development of the country. Thus, Annamalai University started Engineering courses huge demand for technical
education. The University branched off to Medical education
also. In recent years. This University attracted students from
Srilanka, Malaysia and other countries as well.
By the time the tenure of Sir. S.E.Ranganathan came to an
end, the Round Table Conference at London ended in failure
and RT.HO Sastri was appointed Agent General of South
Africa in 1932. When the three year term lapsed, Government
of India Act, 1935 was adopted by the House of commons providing state autonomy and creating Legislative Assemblies

in British Provinces. So, Rt.Hon. Srinivasa Sastri returned


to India. He was appointed Vice Chancellor of Anamalai
University for second time in 1936. He relinquished office in
1940 During this period, Annamalai University came under
the spell of anti British and pro- non Brahmin students of
the College, Universitystudents joined the freedom movement and the communists influence enlarged. Communists
Manali Kandaswami, Mr.Venkatraman, Bala ----the study
leaders there then, during 1940, Rt.Hon. Srinivasa Sastri
resigned as Vice Chancellor and a search for his successor
was made, Three persons were being examined. They were
S.Sathyamurthy, Divan Bahadur, R.V.Krishna Ayyar and
K.S.Venkat ramani. S.Sathyamurthy was not favoured as he
was a leading Congress leader and a unparallel Parliamentarian. K.S.Venkat ramani was not favoured even though
he was a Tamil writer and a novelist of reputation because
he was not a popular figure. The only person was therefore
R.V.Krishna Ayyar , Rt. Hon. Srinivasa Sastri also recommended R.V.Krishna Ayyar to be made the Vice-Chancellor
after him. But in the prevailing political conditions there was a
great anti -Bramin movement and it was thought that another
Brahmin after Srinivasa Sastri may not be suitable. Further
R.V.Krishna Ayyar was functioning as Additional Secretary
to Government Secretary for Education and Public Health
was not willing to spare R.V.Krishna Ayyar as he wanted
Krishna Ayyar for dealing with Second World War affairs.
Therefore Sir. K.V.Reddi was appointed Vice Chancellor. After the term of the founder Syndicate member came to an end.
R.V. Krishna Ayyar declaimed denomination after serving
it for nearly 15 years. Never he accepted any responsibility
even though Sir. Muthia Chettiar used to meet R.V.Krishna
Ayyar every two months to seek his advice and pleaded with
Krishna Ayyar to join the syndicate again. Even the then
Governor Sir Arthur Hope offered his congratulations to
R.V.Krishna Ayyar on his selection as Vice Chancellor. but the
next day Sir Hope regretted that Annamalai University was
a private University run by Annamalai Chettiar family and
they have now other options about the new Vice Chanceller.
During the time of Sir.Annamalai Chettiar eminent Indian were made Vice chancellors. Sir.Kurma Venkata Reddi
succedded Rt.Ho.Sastri. Prof.M.Ruthnaswamy succedded
Rt.Ho.Sastri Prof. M.Rathna swamy succeeded Reddi,
Manavala Ramanujam succeeded Ruthnaswamy. The other

in 1948. Sir, Muthaia Chettiar became the Pro Chancellor


and he retained the position till his death.
While drafting Annamalai University Act. R.V. Krishna
Ayyar realised that Annamalai University was a foundation of
Annamalai Chettiar and so he made the University the family
property of Annamalai Chettiar and the Pro Chanceller of
the University was a hereditary office of Annamalai Chettiar.
That is how MAM.Ramaswamy became the Pro Chancellor
of the University Under the 1929 Annamalai University
Act, the hold on the University by Annamalai Chettiar was
established. During the British administration in India. The
growth of education was slow and the demand for higher
education was also limited with India becoming free and the
Indian Constitution coming into force in 1951, the demand for
higher education increased. But the available opportunities
was small. Thus there was demand but there were not much
supply. The result was education as a commodity became
dear and the price for education increased. The result was
private technical and medical institutions sprang up. These
who promoted these institutions made admission to technical a medical institutions a business. Thus the system of
capitation fee has come to stay. This capitation fees is outside
the regular fees for education. These capitation fees were
promiting supreme by the promoters and some of them used
the money to expand their educational institutions. In turn,
these expanded institution increased the scope for capitation
fees. There was a cry outside the Legislature and inside the
Legislature to check the collection of capitation fee. But the
attempts and law or rules prohibiting capitation fee has no
effect. I was told that huge amount were called as capitation
fees. The reason that parents were not resisting the demands
for capitation fees but they are willing to pay the capitation
fee to get his son or daughter admitted in to the medical or
technical courses. Unless there is public resistance to the
collection of capitation fee the evil cannot be prevented.
Government efforts to multify the capitation fee will fail
and it has failed.

Mutaia Chettiar
was Pre Chancellor of the University , he took care
to keep the administration under

maswamy took over as the Pro Chancellor of the University.


Perhaps Sir. Muthaia Chettiar was at the initial stage of the
Annamalai University and had seen its growth. But Ramaswamy has not been associated with the University from its
start and the various stages of its evolution. It is my impression that Ramaswamy did not keep the same interest which
Muthaia Chettiar had in the University. He trusted persons.
Further the University has expanded to a great extant and
Ramaswamy has to depend on others. After Ramaswamy
became the Pro Chancheller the University has expanded.
There were internal conflicts among University staff and even
murder took place within the campus of the University. The
staff associations have become strong. There was a demand
that the University has to be taken over by the government. As
the 1929 Annamalai University Act has made the University a
family educational foundation. The government has no other
option than to repeal the 1929 Annamalai University Act and
enact the new Annamalai University act 2013.
I feel that, instead of repealing the 1929 Act. the government should have amended the Annamalai University Act of
1929, to assume the university for a period of 5 years while
keeping alone the Pro Chancellor Post . The Government can
setup a managing Committee for the University withal persons
like A.X.Alexander, former Director General of Police and
a couple of eminent men, to set matters right and then return
the institution to the founders. The Hon. Chief Minister of
Tamil Nadu Dr.Jayalalitha is noble and is keenly interested
in importing quality education to the younger generation.
She has taken interest in the welfare of the students. She has
provided books and note books to students, she has provided
laptops to all students She has arranged free mid day meals
started by late CM KAmarajar to all students in rural areas.
to reach the school in time and return home in time. She has
provided uniforms to students she has provided cycles to all
students. This cycle is very useful to students in rural areas.
She is keen that quality education should be provided to
students in higher courses and wants to support and encourage private sector to open more educational institutions. She
has also schemes to send abroad students for future studies
. I have great respect and regard for Puratchi Thalaivi Dr.
Jayalalitha similarly she has respect and regard for me. Nationalisation of Annamalai University requires a rethink. It
is always better to have social central of institutions against
which complaints of mismanagement and irregularities are
made. Taking over any institution cannot be a solution to the
complaint of mismanagement and irregularities. I suggest that
the government should bring an Education Act to assume
power to take over any institution for a specified period get
the mismanagement and irregularities removed and hand over
the institutions to the funders. The government should set up
Committees of management leaded by any officer holding
the rank of Chief Secretary. This step will ensure fear in the
management and the staff will be careful.
The affairs in the Annamalai University and theconsequent
government action will serve as a warning to other private
institutions also.

Necessity Of Granting Emergency Leave


to the PRISONERS

Are the prisoners ordinary or emergency leave days


counted as sentence period?
The Supreme Court held in several verdicts that the
temporary release period is treated only as suspension of sentence and the prison authority does not add
the same towards the sentence period imposed by the
court of law. Rule 239(1) of the Tamil Nadu Prison
Rules says that in the following cases, the period spent
by prisoners outside the prison shall not count towards
sentence i.e., escape from prison, bail, suspended period of sentence including emergency leave, unauthorized extension of temporary release, Suspended period
of sentence if directed by the Court, Suspension of
sentence for police investigation, any violation of conditional release and Extradition. The Full Bench of
Madras High Court held in The State represented by
the Home Secretary and others -Vs- Yesu @ Velaiyan
and others reported in 2011 (4) MLJ Crl 359), that
in the State of Tamil Nadu, as of now, since there is
no statute or administrative rule or regulation, to grant
temporary release on parole, such release of prisoners
granted hitherto shall be treated only as suspension of
sentence and therefore the same shall not be counted
towards the sentence period.
One day emergency leave for prisoners who already
exhausted the maximum leave:
In exercise of the powers conferred by sub-section
(5) of section 432 of the Code of Criminal Procedure,
1973 the Governor of Tamil Nadu made an amendment to the Rule 13 of the Tamil Nadu Suspension of
Sentence Rules, 1982 for Grant of one day Additional
Emergency Leave for the convict prisoners to attend
the funeral ceremony of their relatives. According to
the government order issued by the Home (Prison-V)

Department, the Superintendent of Prisons or the Inspector General of Prisons may grant one day emergency leave to a prisoner who had already exhausted the
maximum eligible period of emergency leave. The one
day leave will be to attend the funeral of the prisoners
spouse, father, mother, son, daughter, brother or sister,
on each occasion. (G.O.MS.734 dated 24.09.2013).
No rule for granting emergency leave to the remand
prisoners:
There is no rule for granting emergency leave to the
remand prisoners in our state. If the remand prisoners meet with any emergency situation they have to
obtain interim bail from the concerned court or from
the Honble High Court as emergency leave under the
Article 226 of the Constitution of India or under 482 of
Criminal Procedure Code. The Honble Madras High
Court considered number of interim bails and emergency leave petitions taking in to account considering
the extraordinary situations such as death, marriage,
illness of health. In a special sitting on Saturday the
Honble High Court Bench, Madurai granted interim
bail to a remand prisoner to perform his fathers final
rites. (G.Surendar-Vs-State represented by the Inspector of Police, Kodaikanal and another in W.P.(MD).No:
9725 of 2014). Furthermore there is no rule framed by
the Government for granting emergency leave to the
prisoners detained under the Tamil Nadu Prevention of
Dangerous Activities of Bootleggers, Drug offenders,
Forest Offenders, Goondas, Immoral Traffic offenders, Sand offenders, Slum Grabbers and Video Pirates
Act, 1982 (Tamilnadu Act 14 of 1982).

Judiciary and Emergency Leave


In most of the circumstances, the
Prison authorities fail to implement
the emergency leave to the prisoners
even in the event of death, marriage
or illness. Some Superintendents of
Prison grant emergency leave considering humanitarian grounds. But
extraordinary situations are not taken into consideration by the prison authorities and do not execute the
powers under the Tamil Nadu Suspension of Sentence
Rules, 1982 for granting emergency leave. Judiciary
has been granting emergency leave even on nonworking days considering the case under humanitarian
grounds. The Honble Madurai Bench of Madras High
Court ruled that the minimum requirement stipulated
under Rule 22 of Tamil Nadu Suspension of Sentence
Rules, 1982, would not apply for emergency leave.
The prison superintendent has to verify the genuineness of the enclosed documents through the Probation
Officer or police station concerned. In case of emergency, such as attending a funeral, the verification can
be made over phone. On receipt of leave applications,
the superintendents are bound to dispose them as per
the rules and cannot keep them pending without passing any orders. (G. Vellaiammal Vs- The State of
Tamil Nadu represented by its Home Secretary (CDJ
2009 MHC 2146).
Judiciary defined and interpreted the term death
subsequent to the cremation of the body. The Honble
Mr. Justice V.Ramasubramanian interpreted death
as including the ceremonies as per religious customs
after cremation of the body. His lordship gives definition to death in his order Para No-7, the words appearing in Rule 6 Viz, death serious illness and
wedding cannot be given ordinary literal meaning. The
word death would certainly include within the fold, the
ceremonies that a person is obliged to perform, if he
happens to be a believer. Otherwise if a plain and literal interpretation is given to the word death; even a
father, mother, son, daughter or brother would be able
only to pay last respects like a stranger to the family.
The intention of Rule 6 cannot be understood to be reducing the role of a father, son, mother or daughter to
that of a mere visitor paying last respects to a departed
soul. Therefore, I am of the view that the word death
appearing in Rule denotes to obligations imposed by
the personal law of the party or custom, so that the
purpose of grant of leave is satisfied. Finally, the
Honble Judge directed the prison authorities to allow
the prisoner to attend the 40th day fathitha ceremonial
of his deceased mother. (Mohamed Iliyas Usmani -VsThe Superintendent of Central Prison, Palayamkottai

Furthermore, in the same order the
Honble judge has given landmark
ruling regarding repeated objections
raised by prison authorities for granting emergency leave in Para No:10,
One more objection raised by the
respondent is that the appeal filed by
the petitioner against his conviction in the Coimbatore
bomb blast case is pending before the Supreme Court.
But there is no rule or regulation which prohibits the
grant of emergency leave merely on the ground that
an appeal filed by him is pending in a forum. The appeal filed by the petitioner may result only in either of
the three things viz., his getting acquittal or his sentence getting reduced or getting confirmed. In extraordinary cases, it may result in enhancement of penalty. The grant of emergency leave will not certainly
have a bearing upon any of the above results which are
possible to come out of the appeal pending on the file
of the Supreme Court. Therefore all the objections are
over ruled. Later, in S.Damotharan Vs- The Superintendent of Jail in W.P.(MD)No.4170 of 2013), the
division bench of Madras High Court Madurai bench
upheld the same and affirmed in its order that a pending appeal before Supreme Court cannot be a bar to
entertain an application for emergency leave.
Prison authorities should act speedily
No one is born a criminal in this society. Circumstances create wrongdoers in the society. Offender must be
brought to book and made to learn lessons but during
incarceration, the prisoners also should be allowed to
avail emergency leave for purposes such as attending
the final rites in case of death of their parents, relatives, friends and attending wedding ceremonies of
their own children and for treatment for their health
or their spouse or childrens health. The supervision
of prisons in our country is regulated by the Prisons
Act, 1894, and Prison Manuals/Regulations framed
by various States. Prisons have been included at Entry No. 4 (Prison Reformatories, Borstal Institutions
and other institutions of like nature and persons detained therein; institutions) in the State List (List II)
of the Seventh Schedule to the Constitution of India.
Thus, States have all the responsibilities/competence
to bring about any change which may be required in
the current prison law to address any inadequacies in
the prison management system. Therefore the State
Government has to make legislations with respect to
quick emergency leave sanction system for remand
prisoners and convicts. Prison authorities should act
swiftly in case of requisition for emergency leave to
the prisoners on humanitarian grounds as per existing
