Upon my arrival, I approached and . is the victim, . I took to a private room, where we could speak more privately. asked if her father could be on the phone on speaker while we talked, I told that if she was more comfortable with them on the phone I was okay with it. told me that on 10/04/2014 she went out to the night club "Rain" with her friend " " said that there were a lot of UF athletes at that club that night, some were smoking and some were drinking. did not specify what they were smoking. said she had a few alcoholic beverages while at the club. At the end of the night, and " " were leaving to return to the Springs Complex and Treon Harris asked for a ride back with them. said " " was driving and Harris and her were in the back seat. said Harris put his hand on her leg but she immediately turned him down, telling him he "was not gonna get laid." When they arrived at the Springs Complex " " said she wanted to get something to eat but and Harris did not want to go. " " asked Harris to walk to her dorm. and Harris went inside the dorm hall and began to go upstairs. said that is when she knew that they were going to his dorm room, since . stated she was fine with that because she was not really tired and did not mind hanging out for a bit. After a while, asked Harris if she could stay over since she was tired. Harris told her she could. took off her earrings and boots and Harris took his shirt and shorts off. said Harris laid on the edge of the bed closest to the wall and she laid on the other side. said suddenly Harris flipped over and was on top of her. said it felt like dead weight and she couldn't really move. said she kept telling him to get off of her and that she did not want to have sex with him. At that point, father cut her off and asked me to leave the room so he could speak to her in private. When I returned to the room, I asked what she wanted to do, as far as pursuing charges. The options were explained to and her father. At that time told me that she was ready to move forward and press charges. The on-call investigator was notified. Due to being cut off in the middle of the story, and calling the on-call investigator, I did not get clarification on some of the things said, or some of the people such as " " or her father's information. Upon my arrival, Ofc. Zarate was speaking with the victim, in a private room. I had a Shands' staff member ask Ofc. Zarate to step out of the room to meet with me. Ofc. Zarate told me that had expressed a wish to have a Sexual Assault Examination regarding an incident that occurred the previous night in the Springs Complex. , was unsure about if she wished to file an official report or just have UFPD hold evidence for a Non-Reporting Sexual Battery. I explained to Ofc. Zarate her best course of actions regarding this case and following UFPD Policy. I then updated Lt. Davis on the details Ofc. Zarate had relayed to me. The victim was moved to another room while I was speaking with Lt. Davis. I then waited outside of this new room, until, I was asked to speak with father on the phone. While on the phone with , I explained the difference between a Sexual Battery report and a Non-Reporting Sexual Battery report. I then explained the same to During this time and previous to this time, I did not speak to . Once Sexual Assault Examination began, I sat with in the hall outside of the room. During this time, and I did not speak about anything regarding this case, other than estimating approximate times regarding the examination and interviewing by Det. Faroni. At the completion of exam, she exited the room and I introduced myself to her. I then asked her if she had eaten this evening and offered to get her food. I took food request and left the hospital to obtain the food; Lt. Davis later took the food to . I then returned to UFPD and stood by with Lt. Davis to assist in notifications. While at UFPD, at approximately 0530 hrs., Det. Faroni turned over a FDLE Sexual Assault Evidence Kit. The kit was in a plastic bag that contained two white envelopes. I placed the kit in UFPD Property as evidence. 10/6/2014 08:44 SUPPLEMENT DAVIS, MATTHEW A 019 MATDAVIS 10/13/2014 15:12 On 10/06/14 at about 0610 hours Officer Rogers, ID#80, and I responded the Springs Residential Complex in order to secure the suspect's room(room 406)and the adjoining room (room 408) for crime scene processing. Upon arrival, I advised the occupants they needed to vacate because the rooms were considered a crime scene in a criminal investigation. I briefly entered the rooms to make sure there was nobody else present and to unhook a door chain to a common bathroom. Officer Rogers remained to maintain the crime scene log. The Crime Scene Log started at 0632 hrs., and ended 1428 hrs. today's date. The Crime Scene Log was scanned into attachments and placed into evidence. Upon arriving on scene, Lt. Daivs (ID#19) briefed me on the information known at the time (see Ofc. Zarate's supplement for details). I was also advised that and were currently in a room in the Emergency Department. Ofc. Roberts (ID#49) and Naomi Phineas, Victim Advocate, were also on scene. At the time, was being examined in reference to completing an FDLE Sexual Assault Evidence Kit. The FDLE Sexual Assault Evidence Kit was completed, and custody of this evidence was transferred to me at 0333 hrs. A Property Control Report was completed and attached to Case Management. After securing the evidence, I conducted an interview with . requested that be present for this interview. , father, was also present via telephone (speaker phone used on cell phone), again at the request of . Due to the nature of the investigation, as well as insistence that the interview not be recorded, no recording was made during this interview. The following are the events that took place on the evening of 10/4/2014 and morning of 10/5/2014 as reported by On 10/04/2014, at approximately 1145 hrs., went to a nightclub named "Rain," located at 7 SW 1st St., Gainesville, FL. While at this establishment, had 2 rum and coke drinks. When "Rain" closed, got a ride home from her friend , . Treon Harris, is an acquaintance of , also got a ride home with and While in the vehicle, Harris touched the leg of and she responded by telling Harris that she was not going to have sexual intercourse with him. Upon arriving at the Springs Complex, dropped and Harris off in front of Buildings 3 and 4. Harris lives on the fourth floor of Building 4. and Harris both went to Harris' room on the fourth floor, Room #406. At the time, there were no lights on in Harris' room, and the only source of light for the room was from a street light outside the window. then became tired, and asked Harris if she could sleep in his room. Harris told her it was alright for her to stay the night, and she removed her earrings and boots and lay down on his bed. At this time, was wearing a shirt, a skirt, a pair of socks, a bra and underwear. Harris then removed his clothes, leaving on only his underwear and an undershirt, and lay down in the bed next to After a time, Harris rolled over and laid on top of described this as Harris being "dead weight" on top of her. told Harris to get off of her and that they were just friends. said for five to seven minutes, Harris remained on top of her, using his body weight to hold her down, while she repeatedly told him to stop. said she specifically told Harris "I don't want to have sex with you." said she remembered hearing her underwear being removed at some point said Harris then put on a condom, and had sexual intercourse with her against her will. said while Harris was engaged in sexual intercourse, she continued to repeatedly tell him to stop and get off of her, and Harris remained silent. said she was unable to move. After ejaculating, Harris removed the condom and placed it into a trash can. then got up from the bed and retrieved her earrings and boots. Harris then offered to walk back to her room, which he did. On Sunday, 10/05/2014, received a text message from Harris. showed me the text messages between herself and Harris. At 1936, Harris sent a text message that stated "Don't tell nobody bout nothing." responded with "And don't try me ever again," and "I wouldn't even come near me if I were yu." provided me with a screen shot from her cell phone, which was attached to Case Management. explained that her relationship with Harris could be described as "casual friends," and they had initially met each other at the University of Florida during the Summer 2014 semester. completed a Public Records Exemption From. I provided with a Victim/Witness Rights Form, and a Victim Notification Form was completed. These documents were scanned and attached to Case Management. I then spoke with Lt. Davis, informed him of the accusation made by and decided to secure Harris' room as a crime scene and have the area processed for any forensic evidence. Lt. Davis arranged to have the room and any adjoining rooms secured. I transferred custody of the FDLE Sexual Assault to Ofc. Roberts so it could be secured in Evidence, and a Property Control Report was completed. I then met at and we went to her dorm room, , to retrieve the clothing she had been wearing at the time she was in Harris' room. had placed her clothing in a laundry hamper in her closet with other clothing, but had not washed the items. The bra was wearing was on the ground next to the laundry hamper. I took photographs of this area (attached to Case Management), and collected the items as evidence. The articles of clothing was wearing were collected and packaged separately. The remaining articles of clothing in the hamper which potentially had contacted the items was wearing were packaged together. These items were collected at 0600 hrs. At 0609 hrs, I met with Lt. Davis and Ofc. Rogers (ID#80) in reference to securing Harris' room as a crime scene. Harris resides in Room #406, which is a single room that has a bathroom shared with another single room, Room #408. Quincy Wilson resides in Room #408. Lt. Davis made contact with both Harris and Wilson and informed them that their rooms were being secured as a crime scene. Lt. Davis entered the rooms to ensure there were no other occupants. Ofc. Rogers started a Crime Scene Log at 0632 hrs.(see Ofc. Rogers supplement for details) and remained outside of the rooms to secure the area. I then spoke to Harris, introduced myself as a Detective with the University of Florida Police Department (UFPD), and informed him that an allegation had been made that he had sexually battered a female in his room on the morning of 10/05/2014. I read Harris a Miranda Warning from a Department supplied Miranda Warning form. Harris stated he understood his rights and agreed to speak to me. I asked Harris if he would be willing to speak to me at the UFPD Criminal Investigations Division (CID). Harris was wearing underwear and a UFPD14OFF001997 [ BROBERTS 10/06/2014 05:02 ] Page 32 of 58 UFPD14OFF001997 OFFENSE REPORT UNIVERSITY OF FLORIDA POLICE DEPT Printed On: 10/16/2014 @12:53 t-shirt, and since his room had been secured as a crime scene he was not permitted to enter to remove any additional clothing, as all items in there room were currently potential evidence. Harris said he did not want to leave the dorm area without obtaining more clothing, but would speak to me at the current location. Outside of Harris' room is a kitchen area used by all residents living on the floor, which is a separate room from the hallway. I utilized this area to interview Harris. Before beginning the interview, Harris read and signed a University of Florida Police Department Miranda Warning Form (scanned and attached to Case Management). I informed Harris that I was going to audio record the interview (the recording was attached to Case Management). The recording began at 0636 hrs., and is 54 minutes and 43 seconds in length. Harris said once he and returned to the Springs Complex, told Harris that she wanted to go to his room with him. Harris said they went to his room on the fourth floor, and they started talking and then kissing. Harris said "We were talking, and she did, she start kissing, we kissing each other, and like it just happened." When I asked Harris what he meant when he said "it just happened," he said "We had sex." Harris said he believed he got home to the Springs Complex at "about 2 o'clock." Harris said he was at "Rain" earlier in the evening. Harris said after leaving "Rain," he rode with Brian Poole to Waffle House, but Waffle House was closed when they arrived. Harris said the Waffle House they went to was on Archer Road near the Interstate. They then drove to a Kangaroo gas station. Harris explained that he was not familiar with the city of Gainesville, and wasn't sure exactly where the gas station was, but believed it was somewhere near Archer. Harris explained the location of the gas station to be somewhere near the Walgreen's on Archer Rd. While at the Kangaroo gas station, he got into the car with I then asked Harris about his history with Harris said he first met as Freshmen, and they had several classes together. Harris said they would hang out and together. Harris said the previous Wednesday, 10/1/2014, he and had together. I then asked Harris to explain what happened between him and when they returned to his room at the Springs Complex. Harris said, "Like I said, we were in there talking, she start kissing like kissing me, kissing each other. You know we know each other good, so I ain't know, and like, like I said start touching on me, and then just (inaudible) happened." Again, when I asked Harris what he meant when he said it happened, he replied by saying "We had sex." Harris said started kissing him and rubbing on him. Harris said never told him she didn't want to do anything with him. After having intercourse, Harris said he walked back to her room. Harris said his contact with after they had intercourse involved him calling her shortly after walking her to her room. Harris said he called to make sure she was "alright." Harris said roommate (Later identified as ) sent him a text later that day. Harris said he then texted and told her not tell anyone, because he wanted the fact that they had intercourse to stay private and just between the two of them. Harris said then called him, and she said, "This gonna be between me and you," agreeing with him. Harris stated he understood he could refuse this search, and signed a Waiver of Search and Seizure form. This form was attached to Case Management. Harris said the evening of 10/04/2014, he had consumed one alcoholic drink before going to "Rain," and while at the club only consumed one non-alcoholic Red Bull. Harris said he didn't know if had been drinking at the club, but she didn't seem drunk. Harris said he believed she had a few alcoholic beverages during the evening. Harris said after returning from Tennessee with the football team, he and were in his room together before going to "Rain." Harris explained that he and were alone in his dorm room, at approximately 1800 hrs., and they both watched the Auburn V. LSU football game. After watching the football game, they parted ways, and met later at "Rain." Harris said texted him and told him she was at "Rain." I asked Harris if he would be able to show me, on his personal cell phone, the text messages he had referenced. Harris consented to me entering his dorm room to retrieve his cell phone, which was located on his bed. I entered the dorm room at 0718 hrs., and this was recorded on the Crime Scene Log by Ofc. Rogers. I retrieved Harris' cell phone and returned to his location. Harris confirmed the cell phone was his. Harris showed me the following conversation, which was between him and Harris identified roommate. The message came from the phone number The conversation begins on Sunday, 10/05/2014 at 1920 hrs. and is as follows: Soooo you and my roommate hooked up last night?? Harris: He'll naw Almost hooked?? Something happened I know that.... Something had to happened because I'm hearing something else... Harris: You know I want do nothing with your roommate use your mind I'm just making sure because I'm getting ready to ask her about the lil situation and I don't want to hear nothing about "well Treon did or Treon tried to do this" Harris said he told nothing happened between him and because he didn't want "nobody in my business." Harris then showed me a text conversation between him and the phone number There was no contact name associated with this phone number in Harris' phone. Harris: Don't tell nobody bout nothing And don't try me ever again, I wouldn't even come near me if I were yu. There were no further messages on Harris' phone. At 1939 hrs. on 10/05/2014, Harris had received a call from the phone number This call was 28 seconds in length. Harris said this conversation consisted of him and agreeing to keep the fact that they had intercourse between the two of them. There was also a call made to the phone number at 0328 hrs. on 10/05/2014. This is the call that Harris said he made to after walking her to her dorm room, to make sure she was alright. Harris said he would take screen shots of these conversations and call logs and email the screen shots to me. Harris never emailed me any screenshots. I again asked Harris about the details involving this case. Harris said had previously told him she was going to hang out with him after going to the club. After the two entered the room, Harris said he removed his shoes and pants and lay down in his bed, and took off her shoes and put her purse down and lay down next to him. Harris explained that while the two of them were in the bed kissing, removed her own underwear. Harris and then engaged in intercourse. After finishing, Harris said wanted to spend the night with him, but he was planning on sleeping all day Sunday and did not want to be responsible for that day. The interview ended when Harris requested an attorney. It was apparent Harris received a text message from someone advising him to no longer speak with me. At this time, I considered both the signed Miranda Warning and signed Waiver of Search and Seizure previously signed by Harris revoked. I ended my questioning of Harris and stopped the audio recording. I advised Harris his room and the adjoining room were going to remain under the custody of the UFPD while a Search Warrant was applied for. Ofc. Rogers remained on scene, keeping the room secured. I returned to the UFPD CID and began writing two Search Warrants, one for Harris' cell phone and one for his dorm room. Sgt. Moran (ID#25) began the process of collecting entry log information for the Springs Complex, as well as gathering any video evidence related to UFPD14OFF001997 [ BROBERTS 10/06/2014 05:02 ] Page 35 of 58 UFPD14OFF001997 OFFENSE REPORT UNIVERSITY OF FLORIDA POLICE DEPT Printed On: 10/16/2014 @12:53 this case. See Sgt. Moran's Supplement for details. At approximately 1150 hrs., I met with Sean Brewer, Assistant State Attorney, in reference to completing the Search Warrants. While meeting with Brewer, he received a phone call from Attorney Huntley Johnson, who was representing Harris. Johnson advised that Harris was reinstating his consent to search both his dorm room and cell phone. At approximately 1210 hrs., I spoke with Johnson via telephone, and Johnson told me Harris was giving consent to search his dorm room and cell phone. I informed Johnson that Harris would need to sign a Waiver of Search and Seizure Form for both his cell phone and dorm room. Johnson said Harris would meet me at his dorm to complete this paperwork. Johnson also said he had several individuals that he wanted me to speak with in reference to this case. As I was driving a vehicle during this conversation, I informed Johnson that I would contact him in the future to obtain these individuals names. I requested the Gainesville Police Department (GPD) respond to the Springs Complex to conduct a forensic examination of Harris' dorm room. At approximately 1250 hrs., I met with Harris outside of his dorm room. I explained to Harris that his consent would authorize myself or any other person I designate to search both his dorm room and cell phone, and that any items located with possible evidentiary value would be seized as evidence. Harris stated that he understood, and signed two separate Waiver of Search and Seizure Forms, one for his cell phone and one for his dorm room. Sgt. Moran witnessed Harris granting consent. The forms were attached to Case Management. I took possession of Harris' cell phone so a forensic analysis could be completed, and provided Harris with a Property Control Form. I advised Harris that he should remain on-scene while the search of his room is conducted. Harris declined to remain on-scene, and left the area. At approximately 1327 hrs., Ofc. K. Rosell (ID#823) and PST. B Fruin (ID#6067) from the GPD arrived to conduct a forensic examination of Harris' dorm room. The location and collection of evidence is documented in GPD Case Report #14-19766. I remained on-scene while this was competed. Immediately inside Harris' room, directly across from the main door, is a door-less closet. A twin sized bed is against the wall the entrance door is located on. The wall opposite the one with the bed has a dresser against it. A used condom was located in a trash can near the foot of the bed, by the entrance door. Unused condoms were located in the dresser. At approximately 1428 hrs., when the forensic examination of Harris' room was completed, Harris' room and the adjacent room were released from police control. Ofc. Rogers ended the crime scene log and cleared the scene. At approximately 1338 hrs., I spoke with GPD Sgt. Martin. Sgt. Martin requested that for organizational reasons, the GPD should take custody of the FDLE Sexual Assault Kit and the clothing items retrieved from dorm room. Ofc. K. Rosell and PST B. Fruin met with Sgt. Moran and I at the UFPD CID. Ofc. K. Rosell and PST B. Fruin took possession of these items. Property Control Forms were completed, signed, and attached to Case Management. A preliminary search of Harris' cell phone revealed the messages he had referenced during my interview of him. Also located were two text messages received on Monday, 10/7/2013, at 0729 hrs. from the phone number (954) 558-0692. The contact name for this number is "Quincy Wilson," Harris' roommate. You want a lawyer. Quincy Wilson: Make sure he don't see this This message is the one Harris received during my initial interview of him, when he requested a lawyer. On 10/07/2014, was contacted via telephone, and she agreed to come to the UFPD CID in reference to this case. At approximately 1100 hrs., I contacted Johnson in reference to the individuals he requested I speak with. Johnson provided me with the following names of persons to interview: Latroy Pittman, Ryan Poole, Marcus Maye, Christopher Worton, Keanu Neale, and . I arranged for interviews of these individuals to begin at 1830 hrs. on today's date, excluding as she was already en route to the UFPD CID to be interviewed. At approximately 1155 hrs., met with me at the UFPD CID. was interviewed in the UFPD CID interview room. The interview was audio and video recorded, and attached to Case Management. It should be noted that for all interviews recorded at the UFPD CID interview room, the time stamp on the videos will be one hour earlier than the actual time (i.e. if the video shows 1000 hrs, the interview is taking place at 1100 hrs.) I am unsure why this discrepancy exists. Ofc. Boland (ID#77) was also present for this interview. gave the following account of the events taking place on the evening of 10/04/2014 and morning of 10/05/2014: said on 10/04/2014, her and went downtown together at approximately midnight to "Rain." said after being at "Rain" for approximately 30 minutes, she saw and she appeared "drunk." said she knew was intoxicated because she's normally low key, but was "happier" and "not sober." said at approximately 0145 hrs., when the club closed, her and were leaving when noticed was speaking with "Demarcus," who was later identified as Demarcus Robinson. explained that had a prior relationship with Robinson, and knew if something intimate were to happen between and Robinson, that would later regret that decision. said she got away from Robinson, and she saw her , Neal, who was with all of his friends. said the persons present were Neal, Poole, Kelvin Taylor, Matt Jones, Marcus (later determined to be Marcus May), Harris, and Pittman. The group all walked in the same direction towards their parked vehicles. then saw that was walking with and they seemed "just like friends or whatever." Due to the way the different vehicles were parked, arrived at a vehicle other than her own, and her own vehicle was parked further away, in what she believed to be the Downtown Parking Garage. continued talking to with Neal and "the other people in his car," and she asked them if they wanted to go somewhere to eat. said the group planned on going to Steak N' Shake. During this time, was still speaking with . said Pittman, Poole, Harris, and possibly May had drove together to this location. asked if she could bring with them, so and walked to her car in the parking garage. At this time, said she could see her car rocking back and forth. Neal then exited the other vehicle, and asked "why is the car rocking cuz the music's not playing." told him "they're having sex in my car, what do I do?" said her windows are tinted, but not dark enough to prevent someone from seeing inside the vehicle. said and got out of the vehicle, and went into the gas station together (at this location, a gas station is directly North of the Waffle house). said when and return to the car, gets into the other vehicle with Poole. Harris then asked where they were going, and Harris said she was driving to the Springs Complex. Harris asked if he could ride with them back to the Springs Complex, and agreed. Harris then sat in the rear seat with I then asked to clarify part of her story, specifically when they went to the gas station. said when she saw Waffle House was closed, they continued to the gas station, never stopping at Waffle House. now said and were still having intercourse when they stopped at the gas station. also clarified her earlier statement when she said the group was going to Steak N' Shake. said the group had changed their minds and decided to go to Waffle House instead, and it was later confirmed that the Waffle House the group drove to is located at 3919 SW 40th Blvd, Gainesville, FL. continued her story, saying that as she was driving to the Springs Complex with Harris and in the back seat, she said she was still wanted to get food. Harris then asked if could first drop off him and at the Springs Complex before getting food, and agreed. While driving to the Springs Complex, said she heard say, "No, no, I see you as a brother, I see you as just a brother. I don't see you like that." said at the time, she just thought was drunk. Thinking back, said she now thought Harris may have been touching , prompting her response, but could not see into the back seat. said she didn't notice anything else during the drive to the Springs Complex. When they arrived at the Springs Complex, at approximately 0230 hrs., said she thought "wasn't that drunk anymore." asked "are you good? Like can you walk in by yourself?" and said "Yeah, yeah, I'm good." Harris said he would walk in to the building. saw Harris walking in the general direction of building's side entrance. Harris was holding the hand of while they were walking. then left to get food, and when she got back to the Springs Complex she sent a text message to Harris asking if was ok. said Harris called her, and said "Well, uh, I don't know if she's ok, ah, she opened the door and then she shut it again when I was leaving so I don't know if she walked out." said Harris then told her she should probably call said Harris was referencing room door as the door she open and then shut. said she then called and asked her if she was in her room. said replied by saying "Yeah, I could have sworn I said no." asked what she was talking about, and she replied by saying "I think I said no." again thought was simply intoxicated and not making sense, and told she would talk to her UFPD14OFF001997 [ BROBERTS 10/06/2014 05:02 ] Page 38 of 58 UFPD14OFF001997 OFFENSE REPORT UNIVERSITY OF FLORIDA POLICE DEPT Printed On: 10/16/2014 @12:53 in the morning. said sent her a text message in the morning, and said she needed to talk to but needed to talk over the phone and not via text. called , and told her "Yeah, last night I think I had sex with Treon." told that Harris had not walked her to her room, but instead went in through the main door at the Springs Complex and to Harris' room. said she was tired, so she lay down on Harris' bed. continued by saying that told her "and he jumped on top of me, and I just remember repeating, uh, no Treon, I don't see us like that." ended the phone call, and she told she would see her later. and then went and got lunch together. After lunch, and both went to center together. said while she was sitting with received a text message from Harris that said "don't say nothing about nothing." said she believed that at this time, fully realized what had happened between her and Harris. said after receiving the text message, called Harris. said she overheard this conversation, which consisted of saying "I don't appreciate what you did," and Harris replying with "ok." After this phone conversation, and discussed about what they should do about this. and then contacted the heads of their Bible study group, and spoke with them about the sexual battery. then contacted
I requested that take screen shots of the text message conversations between her and and email me copies. said she would do this as soon as possible. I then reviewed story with her. I asked why, if she was able to see and kissing and then having sex in the back seat after leaving "Rain," she would be unable to see what was happening when Harris and were in the back seat while she was driving to the Springs Complex. now said "I never looked in the back, I didn't even know they were making out until I heard them." said because she is short, she would be unable to see anything below a back seat passengers shoulders. did explain that is usually open with her about private things, including her sexual partners. said that due to this, she had no reason to doubt allegation that Harris had sexually battered her. After I completed my interview with , Sgt. Moran advised me that the FDLE office in Jacksonville, FL, who was going to complete the forensic examination of Harris' cell phone, stated they were unable to complete the examination without a Search Warrant. I contacted Brewer and informed him of the need to move forward with a Search Warrant for Harris' cell phone. Brewer said he would contact me tomorrow when the Search Warrant was ready for my signature. In reference to the Supplement to this report added by Sgt. Ausgood, involving an anonymous person stating that had performed oral sex on Harris in the backseat of the vehicle being driven by there has been no evidence presented to support this claim. None of the three people in the vehicle ( and Harris) have made any statements supporting this anonymous tip, and it is considered to be unreliable. UFPD14OFF001997 [ BROBERTS 10/06/2014 05:02 ] Page 39 of 58 UFPD14OFF001997 OFFENSE REPORT UNIVERSITY OF FLORIDA POLICE DEPT Printed On: 10/16/2014 @12:53 At approximately 1900 hrs, Worton, Poole, Maye, Neal, and Pittman arrived at the UFPD CID. All five individuals were interviewed separately in the UFPD CID interview room. The interviews were audio and video recorded, and attached to Case Management. I first spoke with Worton. Worton provided no information relevant to this investigation, was not present with either Harris or on the evening of 10/04/2014 or morning of 10/05/2014, and I am unsure why Johnson requested I speak with him. Next, I interviewed Poole. Poole explained that on the morning of 10/05/2014, Poole, Harris, Maye, and Neal had gone to the club "Rain" together, leaving at approximately 0030 hrs., in Poole's black Chevrolet Camaro. Poole said they met with Neal while at "Rain." Poole said he saw at "Rain," and that she did not appear to be intoxicated. After leaving the club at closing time, approximately 0150 hrs., a group of approximately 7-8 people remained in the parking lot talking until approximately 0215 hrs. This group included . The group made plans to go to Waffle House. Poole said and Pittman started talking. Pittman left the area with and and Poole left with Harris, Neal, and Maye. The group then drove to Waffle House, which was closed. Poole said he arrived first at Waffle House, so they waited for to arrive with and . Poole said when vehicle arrived, he observed that and were engaged in sexual intercourse in the rear seat. exited her vehicle, and and remained in the back seat, having intercourse, lying down in the rear seat. While at the Waffle House, Neal arranged for another mode of transportation, and left the group. From Waffle House, Poole said Harris asked to be taken to Gainesville Place Apartments (2800 SW 35th Place, Gainesville FL), where his girlfriend lived. While Poole was driving to Gainesville Place Apartments, Maye stuck his head out of the car window, causing his hat to blow off his head. Poole said this occurred near the Kangaroo gas station. It was later determined that this Kangaroo gas station is located at 3525 SW 34th St, Gainesville, FL. Poole said he pulled into this gas station and parked so Maye could retrieve his hat. When they stopped at the gas station, , and Pittman pulled in behind them and parked nearby. Poole said Harris exited his vehicle and walked into the gas station, and followed Harris into the store. Poole said "grabbed" Harris, and said "You're supposed to be coming back with me" to Harris. , Harris, and left this gas station in car. Poole parted ways with Harris, , and and did not have any additional contact with them. Poole did state that he saw at on Sunday afternoon, and was wearing the hat had worn when the group went to "Rain." Poole first became aware of the alleged sexual battery on Monday, 10/06/2014, when his coach spoke with him about it. I then spoke with Maye. Maye gave an account of the chain of events from the evening which was the same as Poole's account. Maye said the group went to "Rain," and after the club closed the group was in the parking lot discussing where to go to get something to eat. Maye said Pittman, and eft in one vehicle and Maye, Poole, Neal, and Harris left in Poole's vehicle. The two groups traveled to Waffle House, which was closed. While at Waffle House, Maye said pulled up in her vehicle, and and were in the back seat having sexual intercourse in vehicle. Maye said the group left the Waffle House to drive Harris to Gainesville Place Apartments, but while en route his hat fell out of the window near the Kangaroo gas station. Maye was unsure why had been following them, as they had parted ways at Waffle House. Maye said and exited the back seat of vehicle, and walked over to the black Camaro and spoke with Poole. Maye said and Harris walked into the gas station either holding hands or with their arms around each other. Maye said Harris, , and left together in vehicle. Maye did not see or Harris again this morning. Maye also said he saw wearing hat when he saw her at Sunday afternoon. Maye said he did not speak with when he saw her. Maye first became aware of the alleged sexual battery on Monday, 10/06/2014, while he was in the locker room.
I then interviewed Neal. Neal also gave an account of the chain of events from the evening of 10/04/2014 and morning of 10/05/2014 consistent with what Poole and Maye had explained. Neal went to "Rain" with his roommates, who are not involved in this investigation. When "Rain" closed, Neal arranged to ride with Poole, Harris, and Maye to Waffle House. Neal said , , and followed them in vehicle. While en route to Waffle House, Neal contacted an unidentified person to pick him up from Waffle House. Neal said Waffle House was closed when they arrived, and arrived shortly after them. Neal said he observed and having sex in vehicle. Neal got picked up by the unidentified person, and had no further involvement with Harris or this morning. Neal first became aware of the alleged sexual battery when he met with Johnson. I explained to Neal that I had no further questions to ask him in reference to this case, and Neal stated that "supposedly there's a video of them having sex." Neal said the person who gave him this information wanted to remain anonymous, but was a Neal said the anonymous female told him she overheard and talking about the tape existing. Neal is the only person to mention the possibility of this video existing, and I have been unable to locate any evidence that this video exists. Finally, I interviewed Pittman. Pittman also gave a chain of events from the evening of 10/04/2014 and morning of 10/05/2014 which was consistent with what Poole, Maye, and Neal had told me. Pittman went to "Rain" with his roommates, who are not involved in this investigation. When "Rain" closed, Pittman left and with the group, which included Poole, Harris, Maye, Neal, , and . the group decided to go to Waffle House to get food, and he was going to ride in vehicle.
then remained in the vehicle with , re-entered the car, and the group then left the Waffle House. Pittman said then drove to the Kangaroo gas station. Once at the gas station, Pittman said he exited vehicle and walked over to Poole's vehicle. Harris exited Poole's vehicle, and exited vehicle. Pittman said he went into the gas station to use the bathroom, and when he walked towards the bathroom he saw Harris and inside the store. Pittman said Harris and were close together in the store, but wasn't sure if they were in physical contact with each other. When Pittman left the store, he saw another one of his teammates, Jabari Gorman, at the gas station. Pittman got in Gorman's vehicle, and he and Gorman went to the Waffle House on Newberry Road near Interstate 75. Pittman said Poole later met with Gorman and him at this Waffle House, and Pittman got a female friend of his to pick him up. Pittman said this female was named "Shay" Brown, however he believed the name "Shay" was a nickname and was not sure of her legal first name. It was later determined that "Shay's" full name is Shanndore C. Brown. Pittman said while he was in the vehicle with Brown, Pittman received a text message from Harris asking "where you at?" Pittman told Harris he was with Brown, and Harris requested they pick him up. Pittman and Brown picked up Harris on campus, but wasn't sure if it was at the Springs Complex or the Keys Complex. From there, Pittman, Brown, and Harris go to Browns apartment, which is located at the Reserve at Kanapaha (4440 SW Archer Rd, Gainesville, FL). Pittman explained that Harris had a romantic interest in Brown, and Pittman had a romantic interest in Brown's roommate. Pittman said he and Harris spent the night at this apartment, and Harris slept on the couch. Pittman said when he woke up, at approximately 1115 hrs., he was informed that Harris had gotten a ride to his dorm room from Brown at approximately 0800 hrs. Pittman said he first became aware of the alleged sexual battery on Monday, 10/06/2014, in a meeting with George Wynn and Johnson. Pittman said on Sunday, after waking up, he received a "SnapChat" from , which consisted of a photograph of wearing Pittman's hat and sunglasses. This picture prompted the text message conversation that Pittman brought with him. Pittman provided me a print out of a text message conversation, and explained that the conversation took place on Sunday, 10/05/2014, beginning at 1234 hrs. This document, consisting of five pages, was scanned and attached to Case Management. The conversation contained many emoticons (a digital icon or a sequence of keyboard symbols that serves to represent a facial expression, as :-) for a smiling face, and are used in a digital message or text to convey the writers emotions or clarify intent), which I am unable to reproduce in this narrative. See the attached document for details. Since Pittman stated with on the morning of 10/05/2014, prior to the alleged sexual battery by Harris, and had completed an FDLE Sexual Assault Evidence Kit, I requested I collected two separate cheek swab samples, utilizing a Buccal Swab Collection Kit. The samples were sealed in the Buccal Swab Collection Kit, then entered into Evidence. The video footage recovered by Sgt. Moran from the Kangaroo gas station supports the information reported by Poole, Maye, Neal, and Pittman. On 10/08/2014, Deputy Chief Baxley (ID#3) provided the name Baxley advised is possibly the individual that drove to the Shands Emergency Department. were contacted by phone, and interviews were arranged. Wilson was left a voicemail requesting an interview. I then met with Michael Becker, Assistant State Attorney, at the State Attorney's Office in reference to obtain a Search Warrant for Harris' cell phone. The Search Warrant was reviewed, sworn as accurate, and signed by myself. The Search Warrant Application and Search Warrant were signed by the Honorable Judge Mark. M. Moseley. The Search Warrant Application and Search Warrant were scanned and attached to Case Management. At approximately 1615 hrs., arrived at the UFPD. All three individuals were interviewed in the UFPD CID interview room. The interviews were audio and video recorded, and attached to Case Management. I first spoke with explained that she first became aware of accusation when she was contacted via phone by , sometime between 0000 and 0030 hrs. had called from the Shands Emergency Department, after and had arrived. I asked to explain to me what had spoken to her about, specifically in reference to the alleged sexual battery. explained to me what had initially reported ( was present in the hospital room when I initially spoke with ). I gave several options for dealing with any threats, and encouraged her to contact the UFPD immediately if she ever felt her or someone else's safety was in danger. On 10/09/2014, at 0909 hrs., I served the Search Warrant for Harris' cell phone. As the Search Warrant was for an item currently being stored in the UFPD Evidence Vault, I read the Search Warrant, aloud, to the evidence locker. A copy of the Search Warrant was left with Harris' cell phone. Ofc. Beerbower (ID#60), Evidence Custodian, advised he would transfer the cell phone to the FDLE on today's date to begin a forensic analysis. I spoke with Ofc. Boland, and requested she contact Harris and cell phone service providers with preservation letters, to ensure any data relevant to this investigation would be saved and available in the future. Ofc. Boland informed me that she spoke to Wilson's attorney, David Kubiliun, in reference to the request for an interview with Wilson. Kubiliun said Wilson would meet with me at 1300 hrs. to be interviewed in reference to this case, and Kubilun would be present via conference call. Wilson arrived at the UFPD CID at approximately 1320 hrs. Wilson contacted Kubilun via phone, and Kubiliun was on speaker phone for the interview. Wilson said on 10/04/2014, after arriving back to Gainesville from Tennessee at approximately 1830 hrs., he and Harris watched television in Wilson's room for approximately one hour. Wilson and Harris went to get dinner, then returned to Wilson's room. At approximately 2130 hrs., Harris said "I'll be back," and Wilson did not see Harris again that evening. Wilson said he remained home the entire evening, and at approximately 0200 hrs. on 10/05/2014, he heard the door to Harris' room closing. Wilson said he did not hear anyone talking in Harris' room. Later that morning, Wilson said he spoke briefly with Harris, and Harris had told Wilson that had come to Harris' room with him and that they had sexual intercourse. Wilson said he only spoke to Harris in passing on the morning of 10/06/2014, immediately after I had interviewed Harris. This interview was audio and video recorded, and attached to Case Management. At approximately 1424 hrs., Ofc. Boland received a phone call from . Ofc. Boland informed me that had stated she wished to complete a complaint withdrawal. At 1633 hrs., a Complaint Withdrawal Form was signed by and notarized. signed the form and indicated that "I understand the suspect in this case is Treon Harris and I do not wish to prosecute." and "I understand that I may sign a complaint/affidavit if I desire to prosecute at a later date." On 10/10/2014, Ofc. Boland contacted to schedule interviews with when advised that she had been sexually battered. Upon reviewing the recorded interviews, I noticed that the recorded copy of the interview I conducted with Pittman on 10/07/2014 was divided into two separate files. Brown said she would contact me on the morning of 10/13/2014, and would be available for an interview during that same time. At approximately 1600 hrs., Ofc. Boland informed me she had received a response from and that five individuals who were present at would be available to be interviewed, and said they would be at the UFPD CID shortly all arrived at the UFPD CID at approximately 1635 hrs. At approximately 1215 hrs., I met with Brown at the UFPD CID. Brown was interviewed in the UFPD CID interview room, the interview was audio and video recorded, and attached to Case Management. I asked Brown to explain to me any contact she had with either Harris or Pittman on the night of 10/04/2014 and morning of 10/05/2014. Brown said she had been at "Rain" that evening, and then left when the club closed. Brown later called Pittman, Pittman didn't initially answer, then Pittman called Brown at approximately 0245 hrs. Pittman told Brown he was at the Waffle House on Newberry Road. Pittman asked Brown to come pick him up from this location, and she did. After picking up Pittman, Harris called Pittman and asked to be picked up. At approximately 0330 hrs., Brown and Pittman picked up Harris at the Springs Complex. Brown then drove herself, Pittman, and Harris to her apartment at the Reserve at Kanapaha apartment complex. Brown said once at her apartment, her and Harris sat on her couch, watched T.V. and talked about random subjects. Brown said her and Harris never spoke about what Harris had done that night. Brown and Harris left and picked up some food from McDonald's and then returned to her apartment. Brown said her and Harris fell asleep on the couch, and at approximately 0530 she woke up and went to her room. Harris remained sleeping on the couch. At approximately 0830 hrs, Brown woke up, and then woke up Harris. Brown drove Harris back to the Springs Complex and dropped him off. Brown did not have any further contact with Harris after dropping him off at his dorm. Brown said she would have her roommate, Rebecca De La Rosa, contact me to arrange an interview. At approximately 1300 hrs., returned my phone call. said who had been present and had not yet been interviewed, , would be available Wednesday, 10/15/2014, for an interview. said was not present at . I stressed to the importance of completing these interviews as soon as possible, and requested that anyone available come to the UFPD CID office today. said she would contact and inform them of my request. I asked to update me after she spoke with these three individuals. At approximately 1355 hrs., De La Rosa contacted me and said she could meet with me for an interview. At approximately 1410 hrs., De La Rosa met with me at the UFPD CID in reference to this case. De La Rosa was interviewed in the UFPD CID Interview room, the interview was audio and video recorded, and attached to Case Management. De La Rosa said on the night of 10/04/2014 and morning of 10/05/2014, she was present at her apartment when Harris and Pittman arrived. De La Rosa said she had no direct contact with Harris, and remained in her bedroom the entire time he was at her apartment. On 10/14/2014, after receiving no response from the previous day, I attempted to contact directly. I left voicemail messages for I was able to speak with and I explained that I wished to speak with her in reference to this case, and that it should not take more that 15 minutes of her time. said she was busy all day today, and would not be available at any time. I asked if she would be available tomorrow (10/15/2014), and she advised she would have to check her schedule and call me back. At this time, these are the only three individuals I am waiting to interview in reference to this case. At approximately 1025 hrs., returned my call and stated she would attempt to stop by the UFPD CID today in reference to this case. never contacted me again on this day. I created DVD copies of all interviews conducted to date, containing audio and video of each interview, and entered these DVDs into Evidence. At 1733 hrs., eft me a voicemail message which stated "We were trying to get over to see you guys this afternoon, but it appears you guys have left." Normal business hours for the UFPD CID are 0800-1600, Monday- Friday. I did not receive this message until the morning of 10/15/2014. On 10/15/2014, at approximately 0815 hrs, I returned phone call. At approximately 1730 hrs., arrived at the UFPD CID. The interviews were audio and video recorded, and attached to Case Management. Y'all don't even know the whole truth." also said that explained that while she was in the room with Harris, he kissed her. said she asked if she kissed Harris back, and responded "Yeah, I think so." The individual providing the information wished to remain anonymous. The anonymous person advised that they had received some information from an individual who had been with during the night of October 4, 2014 and morning of October 5, 2014. The anonymous person advised that was at club "Rain" celebrating with many football players on their victory against Tennessee and had made several statements about wanting to have sex with Treon Harris and other UF football players. It was explained that appeared to be highly intoxicated. The anonymous person also stated that performed oral sex on Harris in the backseat of a vehicle while en route to the UF campus after leaving club "Rain." The interview was scheduled for 10/07/14 at 1200 hours. On 10/07/14 at approximately 1100 hours, called Detective Justin Faroni #48 to advise that she would not be able to make it to the scheduled interview at 1200 hours due to her and her parents meeting with several University of Florida officials, but that she would be available at 1400 hours. Kubiliun advised that Wilson would be available for an interview on 10/09/14 at 1300 hours and that he wanted to be present via phone conference for the interview. At 1320 hours, I was present in the Investigations office and video monitored the interview with Quincy Wilson that was conducted by Detective Faroni. (See his investigative narrative) On 10/09/14 at 1300 hours, I faxed a preservation request letter to Verizon and Sprint to preserve the information on and Harris phones. The letters are attached to this report in case management. On 10/09/14 at 1424 hours, I received a phone call from advising that after speaking to her parents and she decided that she does not want to press charges against T. Harris. I advised that we would need a signed complaint withdrawal form and asked when she would be available to do that. asked if it could be emailed to her due to her being home in provided an email address and I sent her the form at 1510 hours. In the email, I requested that have her signature notarized due to an officer not being present for her signing. At 1633 hours, the signed, notarized complaint withdrawal form was returned to me via email. The form has been attached to this report in case management. On 10/10/14 at 1246 hours, I called to set up a time for to come to UFPD to be interviewed. advised that she was told that a complaint withdrawal had been done and she did not know why had to come in. She also stated that did not want to be interviewed without their parents or an attorney present. (See his investigative narrative) 10/10/2014 12:20 SUPPLEMENT MORAN, JEFFREY D 025 JDMORAN 10/14/2014 15:06 On 10/6/14, I was contacted by DC Baxley and made aware of the recently reported sexual battery case. He directed me to make contact with Det. Faroni, who was actively investigating the matter. Upon making contact with Det. Faroni, he informed me he recently interviewed both victim, and suspect, Treon Harris, in this case and was en-route to UFPD CID. Upon arriving at UFPD CID, Det. Faroni briefed me on the case details and the information he gathered. Det. Faroni began the process of drafting a search warrant for Harris dormitory room (at the Springs complex) and his personal cellular phone. I contacted Mr. Azfar Mian, at the University of Florida Housing Office, and requested a copy of the entry log for the time period of 12am and 5am on 10/05/14, to verify when Harris and arrived back at the complex. I proceeded the Springs complex to obtain the directions needed for the search warrant of the Harris residence. While at the Springs complex, I conducted a canvas of the neighboring residents of Harris (406) for any information they may have related to the incident. Contact was made with the following residents: Room 404 (adjacent to 406) - Nick Kersey advised that he arrived at his room late, around 2am and was there the remainder of the night. When asked if he ever heard any loud talking or suspicious sounds coming from room 406 he stated no. I asked him if he could ever hear anything (talking) through the walls and he said no, only if the room door was open. Kerseys roommate, Samuel Hinkes was not present to speak to. Room 409 (around the corner from 406) - Drue DeAngleo and Vanessa Wilt stated they got home around 1am and was there the remainder of the night. Whitaker stated he was in Tallahassee all weekend and his roommate, Jake Pagano was in Miami all weekend. Room 403 (opposite end of hall from 406) - Nicholas Polk and his roommate Matthew Staples advised they were in their room, but did not recall anything. The residents of the following rooms were not present to speak with: 405,407,408,411. I later received an email from Mr. Mian with the requested building entry log. Based on that information, it revealed that Harris entered the main entrance of the Springs building #4 at 2:53am (10-6-14). At 2:54am he entered the 4th floor area where his room is located. At 3:19am, accessed the where her room is located. At 3:21am, accessed the stairwell door . At 3:21am Harris accessed the 4th floor area for the last time. This data will be submitted into evidence and attached to CASE MANAGEMENT. Information Det. Faroni obtained revealed that Harris and were riding with friends from the downtown Gainesville area to a Waffle House, then to a Kangaroo gas station, before arriving at the Springs complex. On 10/7/14, I went to the Waffle House located at 3919 SW 40th Blvd. to canvas that area, since Harris had mentioned going there after the club. That Waffle House location was closed for renovations. This confirmed what Harris told Det. Faroni during his interview. I went into the Kangaroo Express, located at 3901 SW Archer Rd. to inquire about the video surveillance. This store is located directly next to the Waffle House previously mentioned. I was told the Manager was unavailable. I left my business card and asked the clerk to provide it to another supervisor that could assist me with the video. I then proceeded to the Kangaroo located at 3525 SW 34th St., based on the information obtained through the interviews conducted. There, I met with the manager, Dave Gonzalez. He advised me that I could get a copy of the video surveillance for that store, however he could not burn it to a DVD, I would have to bring a thumb drive for the data to be transferred. Mr. Gonzalez also provided me with Managers email address from the previous store I was at, so I could notify them of my request. On 10/8/14, I went to the Kangaroo store #6146 (SW 34th St.) and met with Mr. Gonzalez. I provided him with an empty thumb drive and he transferred the stores surveillance videos I requested, both interior and exterior views. Mr. Gonzalez signed a UF Police Property Control form, relinquishing the evidence over to me Upon arriving at the UFPD CID, I reviewed the video files on the thumb drive. I discovered 9 separate files (interior and exterior views) that showed Harris and together at that store. Unfortunately, the exact time stamps for each video was not available in the format the videos were obtained. However, when I requested the video from Mr. Gonzalez, I advised him I was looking for the time period of 1:45am to 3am on 10/5/14. The names of the drivers were obtained from interviews conducted by Det. Faroni. A dark colored car pulls into the Kangaroo parking lot, closest to 34th and the 35th Place intersection. This car was being driven by Brian Poole and Harris was a passenger. Close behind the dark colored car was a light colored car that pulls in and parks beside it. This light colored car was being driven by with and located in the backseats. emerges from the back seat of car. Then Harris and emerge from the other side of car and walk towards the Kangaroo store entrance. They are walking very close to each other, with their arms around each other. After Harris and enter the store, Mr. Pittman walks across the parking lot and enters the store. After Harris and enter the store, they proceed to the back of the store where the restrooms are located. enters the womens restroom while Harris waits outside of the door. After had entered the restroom, Harris opened the restroom door three separate times and it appeared from the video he was having a conversation with her. exits the restroom and the two of them walk towards the front of the store. While they are headed towards the front, Mr. Pittman enters the store and walks towards the restroom. According to the video, it appeared that Harris and were conversing with Mr. Pittman. Mr. Pittman is seen walking towards the restroom, but never enters, then walks with Harris and as they exit the store. After Harris, and Mr. Pittman exit the store, Harris and are walking with their arms around each other as Mr. Pittman walks nearby. Harris and get into the backseat of car and it departs from the parking lot. Mr. Pittman gets a ride from Jabari Gorman and he leaves the parking lot. The 9 files found showing the suspect and the victim together were copied and saved on a separate DVD disc. I placed both, the thumb drive and the DVD, in evidence. I attached the 9 videos to CASE MANAGEMENT. On 10/9/14, Sgt. Spurlin and I canvassed the area of downtown Gainesville near the night club establishment, Rain, for evidence of security cameras. There were no obvious signs of any cameras that would provide us with any potential video evidence from that location. We also checked in/around the area of the Wells Fargo Bank and its adjoining garage (downtown) for additional video footage, where the parties involved parked their cars. We met with the bank manager, Sebastien Fethiere, who showed us the views of their video system. The angles and views were not at a vantage point to capture any footage that would be beneficial to this case. At approximately 11:30am, I met with Mrs. Cristol Schofield, the manager at the Kangaroo Express Store #1302. Mrs. Schofield assisted me with viewing the security video at that store. I was able to view all exterior cameras. Only one camera was able to capture a partial glimpse of the dark colored car as it passed by that Harris was supposedly a passenger in. The parking lot area where the cars were allegedly parked was in a location where there is no video coverage. I asked Mrs. Schofield to provide me with the video for the time period of 2:15am until 2:45am on 10/5/14. She agreed and stated she would contact me once the recording was complete. Mrs. Schofield contacted me later and advised the requested DVD was ready. I retrieved this DVD at approximately 1:42pm and she signed the UF Property Control form. I submitted this DVD into evidence. Based on information obtained during interviews conducted by Det. Faroni, called sometime during the latter part of Sunday evening (10/5/14). Moran and I went to the Springs for a follow up investigation on the fourth floor where a sexual battery had been reported. I made contact with Sara Kurtovic who resides in room 412 of the Springs Complex. She indicated that she did not and was awake during this time frame. She also said that her roommate, Alyssa Skryd, was awake and present during this time frame. Ms. Skryd was not present when I initially contacted Ms. Kurtovic. I have been unable to speak directly to Ms. Skryd. I attempted to leave a message for her to call me but her voice mail was not set up. I asked Ms. Kurtovic to relay a message to Ms. Skryd that I'd like to speak to her directly. I've not heard from Ms. Skryd as of this report. Ms. Kurtovic assured me that Ms. Skryd would say that she heard no disturbance on the night in question because they were both awake. I also made contact with Stephen Zelin. He resides in room 401 of the Springs Complex. He indicated that on 10/05/14, he came into his room at approximately 0430 hrs. He was not in his room at the time and Harris were in Harris' room. His roommate, Shaun Blalack was asleep during the time frame in question. He said that he heard nothing unusual and was not awakened by anything.
