ASHGATE
Ashgates renowned multi-volume reprint reference series in law constitute a major resource for law libraries, students and
researchers and are aimed at undergraduate, postgraduate and research student levels.
Each series is edited by a renowned expert in the field who selects the most significant published journal essays in the subject,
and contributes an introduction which presents an overview of the most important issues. The essays are reproduced in full in
their original format using the facsimile method to facilitate easy and correct citation of the original essays.
The unique benefit of these reference volumes is that they bring together the best of previously published research essays and
articles in a specific subject area within the field of law from a wide range of international sources which would otherwise be
time-consuming, difficult and expensive to access. Students are therefore able to study influential essays side-by-side whilst
lecturers are provided with an invaluable one-stop teaching resource.

Justice and Legal Issues

Policy and Governance

Edited by Peter Hodgkinson,

Westminster University, UK

Edited by Peter Hodgkinson,

University of Westminster, UK

This volume provides up-to-date and nuanced analysis

across a wide spectrum of capital punishment issues.
The essays move beyond the conventional legal
approach and propose fresh perspectives, including
a unique critique of the abolition sector. Written by a
range of leading experts with diverse geographical,
methodological and conceptual approaches, the essays
in this volume challenge received wisdom and embrace
a holistic understanding of capital punishment based
on practical experience and empirical data.

This volume provides analyses of a range of subjects

and issues in the death penalty debate, from medicine to
the media. The essays address in particular the personal
complexities of those involved, a fundamental part of the
subject usually overridden by the theoretical and legal
aspects of the debate. Additionally, the international range
of the analysis, enabling disaggregation of country specific
motivations, ensures the complexities of the death penalty
are also considered from a global perspective.

Abolition and Alternatives to

Capital Punishment
Edited by Peter Hodgkinson,
University of Westminster, UK
The essays selected for this volume develop conventional
abolition discourse and explore the conceptual framework
through which abolition is understood and posited. Of
particular interest is the attention given to an integral but
often forgotten element of the abolition debate: alternatives
to capital punishment. The volume also provides an
account of strategies employed by the abolition community
which challenges tired methodologies and offers a level of
transparency previously unseen.

NEW SERIES
The Library of Essays
on Transnational
Crime
Series Editor: David Nelken,
Cardiff University, UK
Crime problems increasingly arise beyond the nation
state and surpass the ability of single states to handle
them. In addition, transnational crime can also be used
as an opportunity or justification for strengthening
state power or control. This series presents classic
research articles on a variety of controversial aspects of
transnational crime so as to problematise the definition of
transnational crime and analyse the potentially conflicting
interests and values at stake. Each volume contains an
introduction by the editor which explores the key issues in
question and all five volumes feature essays that span an
interdisciplinary range of fields including law, criminology,
political science, anthropology and history. This series
constitutes an invaluable reference resource for libraries
and academics in criminology, sociology, social policy,
political science, human rights and international relations.

Human Trafficking

Transnational Financial Crime

Edited by Marie Segrave,

Monash University, Australia

Edited by Nikos Passas, Northeastern University, USA

The essays selected for this volume reflect four key areas
of debate: the transnational organized crime framework;
the data and research landscape; the implementation
of anti-trafficking responses; and the articulation of
alternative responses to human trafficking. These
essays are written by both well-known and more recent
contributors to this field of research. The collection draws
attention to contemporary arguments as well as recent
empirical research, and points to the importance of
contextualizing human trafficking within both the
global and local setting.

Crime, Law and Justice

SERIES
The Library of Essays
in Theoretical
Criminology
Series Editor: Stuart Henry,
San Diego State University, USA
Criminological theory is a rapidly growing field within
the discipline of criminology, which seeks to identify the
causes or etiology of crime. While there are numerous
criminological theories, most can be grouped into
broad theoretical frameworks which are rooted in major
academic disciplines, such as economics, anthropology,
biology, psychology, geography, sociology, politics,
history and philosophy, as well as the more recent
multi-disciplinary fields such as gender studies, critical
race studies and postmodernist social theory. However,
criminological theories are rarely discrete and a major
recent development in criminological theory has been the
emergence of explicitly integrative theoretical approaches
which draw on aspects of other disciplines to strengthen
their explanatory power.
This series is designed to capture the range and depth
of the key theoretical perspectives on crime causation
for an international audience. Each volume is edited by a
renowned criminologist and has as its theme a specific
theoretical approach. The introduction to each volume
provides a context to the history of ideas in the field and
an overview of the papers selected. The series represents
the state-of-the-art in research to better understand and
explain crime and those who commit it, and provides an
invaluable reference resource for libraries.

Feminist Theories of Crime

Edited by Meda Chesney-Lind, University of Hawaii
at Manoa, USA and Merry Morash, Michigan State
University, USA
This collection of essays re-imagines the field of criminology
with insights gleaned from feminist theory. Factors such
as gender, patriarchy and other systems of oppression
such as race and class are highlighted as essential to an
understanding of crime problems and the criminal justice
system. The articles also reflect the feminist concern that
all research should have the crucial goal of producing
knowledge that will promote social justice.

Social Learning Theories

of Crime

Index for each volume can

be viewed online

Edited by Christine S. Sellers, University of South

Florida, USA, L. Thomas Winfree, Jr, New Mexico
State University, USA and Ronald L. Akers,
University of Florida, USA
The readings selected for this volume reveal the historical
development of social learning theory, from its origins to
its further incorporation of social structure as the context
within which criminal behavior is learned. The essays
emphasize the theorys foundations in both symbolic
interactionism and behaviorism and reflect that at its
core the theory remains true to its origins in sociology.
The theory is also shown to be an explanation of the
gamut of deviant behaviors ranging from gang activities

The Library of Essays
on International
Human Rights
Series Editor: Stephanie Farrior,
Vermont Law School, USA

around human rights in the area of international law.
The volumes include a wide range of essays selected
from an international search of print and electronic
content and feature a substantial introduction by the
volume editor which provides an overview of the topic
of each volume. The series includes foundational articles
on the development of international human rights
law, covers issues on the current challenges facing
international human rights lawyers and scholars, the UN
system of rights, regional human rights systems and the
fundamental principles of equality and non-discrimination
under international law.
The five volumes in this series are edited by leading scholars
in the field and taken together provide an invaluable
research tool for scholars and students interested in the
growing field of international human rights.
The five volumes in this series are:

Human Rights

SERIES
The International
Library of Essays
on Rights
Series Editor: Tom D. Campbell, Centre for
Applied Philosophy and Public Ethics,
Charles Sturt University, Australia
Much of contemporary moral, political and legal discourse
is conducted in terms of rights and increasingly in terms
of human rights. Yet there is considerable disagreement
about the nature of rights, their foundations and their
practical implications.
This series brings together essays that exhibit careful
analysis of the concept of rights and detailed knowledge
of specific rights and the variety of systems of rights
articulation, interpretation and enforcement. Each volume
deals with specific issues about rights, taking account of
international human rights, regional rights conventions and
regimes, and domestic bills of rights, as well as the legal,
moral and political literature concerning individual rights.
Each volume editor is chosen for his eminence in the
study of law, politics or philosophy and each volume
represents the editors selection of the most seminal
recent essays on rights in a particular field. An introduction
presents an overview of the issues in that particular area
of rights together with comments on the background and
significance of the selected essays. Essays are reproduced
in full with the original pagination for ease of reference..

Citizenship Rights

Environmental Rights

Edited by Jo Shaw and Igor tiks

both at University of Edinburgh, UK

Edited by Steve Vanderheiden,

University of Colorado at Boulder, USA

This volume presents some of the most important

reflections and studies on citizenship rights, both past
and present. The contributions provide both thorough
description and incisive analysis and place the question
of citizenship rights into a wider historical, social
and political perspective. As such, it offers a timely
introduction to the current debates surrounding the rights
and duties of both citizens and non-citizens alike, with a
focus on the many ways in which citizenship is contested
in the contemporary world.

The essays selected for this volume present critical

viewpoints from the debate about the need to establish
rights on behalf of greater environmental protection. The
volume surveys a range of theories and approaches and
captures the potential for and primary challenges to the
development of rights as instruments for safeguarding
the planets life-support capacities and as an avenue of
recourse against ecological degradation, whether
on behalf of human or nonhuman right holders.

Edited by Manisuli Ssenyonjo, Brunel University, UK

Any library featuring International Law would be
incomplete without this handy collection of insightful
essays by the key academics in the field.
American Society of International Law Newsletter
This collection of seminal papers examines the legal,
conceptual and practical questions relating to the
international legal protection of economic, social and
cultural rights. The volume is divided into three main
parts: human rights obligations for states and non-state
actors; analysis of selected substantive rights; and the
justiciability of these rights in various contexts such as
within the United Nations, Europe, Inter-American, and
African systems, as well as within the domestic system.

questions concerning the rights of minorities and show
the extent to which policy constructs (especially in law)
have begun to pay heed to the need to include minorities
in different domestic settings across the globe. The
essays are organized under six main headings: historical

challenges; fundamental norms of minority protection;
specific rights of minorities; and human rights and
minority rights.

Age and Equality Law

Race and Equality Law

Edited by Michael Selmi,

George Washington Law School, USA

Edited by Angela P. Harris, University of

California Davis, King Hall School of Law, USA

This volume brings together classic articles which explore

the increasingly crucial and relatively recent concept of
age discrimination. Issues relating to an ageing workforce
are now widespread and the essays in this volume explore
the evolution of legislation against age discrimination as
well as the legal structures relating to age discrimination
in the US (where legislation is more advanced), the
European Union, Canada and Australia.

This collection of essays employs an analytic approach

developed in the United States which sheds light on the
workings of race in political-legal systems as diverse as
South Africa, New Zealand, France and Latin and South
America. The essays reveal how legal rules define racism so
narrowly and make racial discrimination so difficult to prove,
that inequality persists despite its symbolic extinction.

reform to advance gender equality. The essays illustrate
the evolution of dominant theoretical approaches
and trace their application to core issues, such as the
meaning of gender, family formation and roles, equality
in the workplace, reproductive rights and violence. The
selections are international in their range and include
recent works that summarize foundational discussions
as well as less well-known articles and essays which
capture defining issues with enduring resonance.

International Law

NEW SERIES
The Library of Essays
on International
Trade Law and Policy
Series Editor: Lorand Bartels,
University of Cambridge, UK
The establishment of the World Trade Organization in 1995
has transformed international trade law and policy from
a niche interest into a core stream of international law.
This is reflected in the stream of high quality academic
writings on the topic, many of which have been influential
in the practice of trade law in government departments
and at the WTO. This series collects the very best of these,
as well as seminal articles from the GATT period which set
the foundation for the modern international trade regime.
The four volumes in this series, each edited by
acknowledged experts in their respective fields, cover the
core aspects of international trade law and policy. Detailed
introductions to each volume highlight the main issues
addressed in the selected contributions, and in addition
explore different perspectives, accompanied by references
to other writings in the field.
This series makes readily available the best writings
on international trade law and policy over the past six
decades. It is an indispensable resource for all those
interested in understanding the intellectual assumptions
on which trade law is predicated, its most important
controversies, and its broader policy implications.
The four volumes in this series are:
Volume I: Institutional Aspects of International
Trade Law
Volume II: The Regulation of Goods
Volume III: The Regulation of Services and Intellectual
Property
Volume IV: The Challenges of Trade Law

The importance of the institutional dimensions to

international trade law over the last decades is brought to
light in this volume of previously published articles. The
collection addresses many diverse and significant issues
and focuses on the World Trade Organization (WTO),
which is revealed here as a dynamic, multi-layered and
complex institutional structure. The combined strengths
of the articles in the collection make this volume of
special importance to students and practitioners of
international trade or international relations.

International rules on trade in services and intellectual

property are new additions to the multilateral trading
system, but both have played an important role in the
system since their entry. Accompanied by a detailed
introduction, this volume contains essays which cover
not only the law and jurisprudence of these controversial
topics but also the underlying economics and politics
behind their incorporation into the multilateral system
and continued prominence.

International Law

SERIES
The International Law
of Peace and Security
Series Editor: Nigel D. White,
University of Nottingham, UK
The focus of this four volume series is on the law of peace
and how international law underpins and helps to achieve
the conditions of peace and security between states.
In times of peace the main fear is of sudden attack,
with current concern directed to weapons of mass
destruction and terrorism. The selected essays consider
the applicability of a range of laws such as anti-terrorist
laws, arms control laws and measures to prohibit the use
of force. In post-conflict situations where peace is usually
restored with the involvement of international actors, the
articles reveal a whole host of legal issues in connection
with the applicability of human rights law within unstable
post-conflict states, as well as the principles governing
international intervention and involvement. A thread that
runs through all the areas addressed in this series is the
role, function and importance of the Security Council as
principal guarantor and guardian of international peace
and security.
This four volume series, which focuses on international
laws concerning peace and security, presents a selection
of important articles on key issues written by leading
academics and is an invaluable resource for academics
in the field of international law and political science.
The four volumes in this series are:
Arms Control Law
Counter-Terrorism and International Law
Post-Conflict Building and International Law

Globalization and Common

Responsibilities of States

The International
Library of Essays on
Globalization and Law

Edited by Koen De Feyter,

University of Antwerp, Belgium

Series Editor: Michael K. Addo,

University of Exeter, UK
Economic globalization has so fundamentally affected
the roles and relationships of national and international
actors that conventional rules of law have come under
intense scrutiny. With economic globalization comes
the confirmation of neo-classical economic doctrine
as a dominant theme in policy-making and with it the
diminution of the State and other symbols of sovereignty.
It has also lead to a noticeable empowerment of actors
such as transnational corporations, civil society groups and
intergovernmental economic organizations, and lead to a
rapid development of human rights law. The International
Library of Essays on Globalization and Law brings together
thematic collections of essays which discuss changes
to the role and the relevance of the law which are a
consequence of and response to economic globalization.
The six titles in this series are:
Globalization and Common Responsibilities of States
Globalization and Intellectual Property
Globalization and International Investment
Globalization and International Organizations
Globalization of Criminal Justice

There is a growing awareness that international law

insufficiently protects common global interests and
that States and non-State actors need to work together
to protect global aims. The focus of this book is on
the different fields of international law where global
cooperation is needed and on the legal developments
which have taken place and which reflect a global set of
values and interests independent of the interests of States.

International Organizations
Edited by Edward Kwakwa, World Intellectual

In the context of todays ever-increasing globalization
the traditional role of international organizations has

activities of their members, to that of director of their
own activities. This collection brings together the best
published work by leading authorities in the field on
issues that are affected by this change of role, such as

International Law

SERIES
The Library of Essays
in International
Humanitarian Law
Series Editors: Michael N. Schmitt, US Naval War
College, USA and Wolff Heintschel von Heinegg,
European University Viadrina Frankfurt, Germany
This series brings together the most significant works in
the field of humanitarian law published in the last century.
The selected essays include classics of humanitarian law,
lesser-known articles of exceptional quality and insight
and articles which have become influential as this body
of law develops in the 21st century.
The collection demonstrates the importance of the
work of prior generations of humanitarian lawyers and the
relevance of this work for contemporary debates. Second,
although sometimes criticized as vague and imprecise, this
series shows that humanitarian law can be subjected to
rigorous analysis that clarifies its intent and scope. This sixvolume series reprints the most significant works in the field
published in the last century and enables scholars to better
understand the evolution of humanitarian law; students to
study influential essays side by side and practitioners to
apply the law in national and international tribunals.

The Conduct of Hostilities

in International Humanitarian
Law, Volume I

The Development and

Principles of International
Humanitarian Law

This volume features essays on the legal regime

governing the use of force during armed conflicts,
otherwise known as Hague Law or conduct of hostilities
rules. The articles reflect research into the theoretical and
practical difficulties of maintaining humanitarian laws
delicate balancing of military necessity and humanitarian
considerations in the face of evolving means and methods
of warfare and competing perspectives as to how the
balance is best achieved. Particular attention is paid to
the principle of distinction. Also included are essays on
the law governing warfare at sea and in the air.

This volume of selected reprinted essays considers two

aspects of international humanitarian law. The first is the
development of this law, and articles offer an in-depth
look at its early roots, the continuing relevance of that
body of law despite advances in weapons technology
and the efforts to progressively develop it. The second is
the fundamental principles which underlie international
humanitarian law: humanity and military necessity.

Detention and Occupation in

International Humanitarian Law
Detention and occupation are two challenging aspects of
international humanitarian law in 21st century warfare.
The essays selected for this volume examine both the
historical foundations of these issues and contemporary
practices surrounding them. The suitability of traditional
detention and occupation law in the face of todays
circumstances is discussed as well as claims that
aspects of humanitarian law are outmoded and must be
reassessed. Also considered is the extent to which other
bodies of law, especially human rights, are influencing
the application of international humanitarian law.

The Scope and Applicability of

International Humanitarian Law
The essays selected for this volume provide a
comprehensive analytical survey of the scope and
applicability of international humanitarian law. Many of the
articles address highly contentious issues relating to the
decision whether to apply international humanitarian law
in lieu of, or in addition to, other bodies of law, such as the
jus ad bellum and international human rights law. Others
consider the applicability of international humanitarian law
in the light of contemporary conflicts, such as whether and
to what extent international humanitarian law provides rules
governing counter-terrorism operations.

University of London, UK

Islamic Law
Series Editor: Mashood A. Baderin, School
of Oriental and African Studies, University of
London, UK
Since 9/11 the increased global attention on Islam has
also triggered an increased interest in Islamic law, and
academic journals far and wide reflect the prolific nature
of scholarly debate in this field. This series of three
volumes brings together the best and most influential
contributions from this debate and in so doing provides
students and researchers with a one-stop resource
to help them navigate their way through the widely
dispersed and varied literature on this subject.
The selected articles address different aspects of
Islamic law and uniquely blend academic perspectives
on the theoretical, substantive and practical elements
of Islamic law in a coherent manner for a holistic
understanding of the Islamic legal system in theory and
practice. Each of the three volumes in the series also
features an introductory overview and a comprehensive
bibliographical list as an additional resource for
further research on the different aspects of Islamic law.
This series represents an indispensable resource for
libraries, students and researchers interested in a better
understanding of Islamic law.

This volume addresses the sources, methods and

Edited by Carrie Menkel-Meadow, Georgetown

University and University of California, USA

This volume brings together leading research articles

in to the theory, research findings and applications of
modern dispute resolution. The articles cover the primary
processes of negotiation, mediation and arbitration, as
well as exploring combinations and hybridization of
those processes. The volume spans both the science and
art of dispute resolution, considers the relationship of
peace to justice and includes both empirical (descriptive)
and normative (prescriptive) assessments of how these
processes of dispute resolution function.

The articles selected for this volume consider how the

process of dispute resolution is altered, challenged and
made more complex by the presence of multiple parties
and/or multiple issues. The selected essays represent the
latest theoretical advances and challenges in the field and
demonstrate attempts to use dispute resolution theory in
a wide variety of settings.

Series Editor: Carrie Menkel-Meadow,

Georgetown University and University of
California, USA
This series collects essays on the development of
foundational dispute resolution theory and practice and
their application to increasingly more complex settings
of conflicts in the world, including multi-party and
multi-issue decision making, and negotiations in political
policy formation and governance, and international
conflict resolution.

volumes feature essays which span an interdisciplinary
range of fields law, political science, game theory,
decision science, economics, social and cognitive
psychology, sociology and anthropology and consider
issues in the uses of informal and private as well as more
formal and public processes. The articles also question
whether the development of universal theoretical insights
about conflict resolution is possible with variable numbers
of parties and issues and in multi-cultural settings.

Law in Asia

SERIES
The Library of Essays
on Law in East Asia
Series Editor: Roman Tomasic,
University of South Australia, Australia
Rapid economic development and political change in
East Asian economies in recent times has brought about
widespread change to the laws and legal systems of
these countries. Institutions such as the courts, the legal
profession, law schools and regulatory bodies in East
Asian countries have grown in size and complexity, many
older laws have been revised, especially in the field of
commercial law, and many new laws have been passed.
This series brings together key essays and articles
selected from academic and scholarly research into
the law and legal change in East Asia. The essays
range from studies of the operation of particular laws
and legal institutions to comparative law studies, and
include analysis of the influences of local culture and
political structures. Several essays critique Western legal
models of legal reform and the effects of globalization
and Americanization on different law reforms and legal
institutional arrangements, whilst others consider
the distinctive features of East Asian laws and legal
institutions, the diversity of market based legal systems
and the problems of implementing legal changes in the
face of the powerful influence of traditional ideas and
political structure in East Asian societies.
The four volumes in the series are edited by leading
East Asian legal scholars, each of whom contributes
an original introduction. Taken together, these
volumes collect the best of legal scholarship from the
debates about the role of law and legal institutions in
increasingly robust East Asian legal systems.
The four volumes in this series are:

The shift of economic gravity towards East Asia requires a

critical examination of laws role in the Asian Century. This
collection of research articles explores the diverse scholarly
perspectives on laws role in the economic rise of East
Asia and moves from general debates, such as whether
law enjoys primacy over culture, state intervention or free
markets in East Asian capitalism, to specific case studies
looking at the nature of law in East Asian negotiations,
contracts, trade policy and corporate governance.

The massive and complex process of change in East Asia

over recent decades has brought about a transformation
in the nature of law and legal institutions in the region.
This volume brings together a selection of the most
important writings on East Asia of researchers in recent
years, and shows the broad range of questions which
researchers have been addressing about the effect of
law reform and legal change in societies dominated by
traditional values and political forces, and at a time of
massive economic change.

The Citizen and the

Chinese State

Obligations and Property

Rights in China

The Library of Essays

on Chinese Law

Edited by Perry Keller, Kings College London, UK

Edited by Perry Keller, Kings College London, UK

This volume addresses several core questions regarding

the nature of law in China and its future development.
Articles shed light on whether the rule of law is
commensurable with government based on the Chinese
Communist Party and whether Chinas legal system,
if eschewing formalised human rights, is developing a
capacity to protect fundamental human dignity.

This volume concerns the rights and obligations of

the individual regarding employment relations, family
relations and the ownership of immovable property.
Articles illustrate the shift away from close state control
towards greater freedom, as shown by beneficial new
legislation such as Employment Contract Law and
Property Rights Law, alongside the Communist Partys
continued reluctance to allow empowerment of the
individual to threaten its political and economic goals.

Series Editor: Perry Keller,

Kings College London, UK
This major three volume series on Chinese law brings
together leading current research on the structure and
operation of law in China and the nature of the Chinese
legal system.
Chinas legal system has developed at great speed
since the Communist Party embarked on its path of
economic reform in 1979. Whilst this legal system reflects
contemporary Chinas vibrant, market based economy
and fast changing society it also undoubtedly reflects
the Partys ubiquitous networks and influence and the
continued domination of the economy by state owned
enterprises. In the face of this overwhelming Party
and state power, domestic and foreign reformers have
advocated a deepening of the rule of law, constitutionalism
and good governance. Yet, law in China is nonetheless
finding its own trajectory, which is plainly not towards any
simple emulation of western liberal democracy.
This collection of previously published articles provides
a broad survey of the key issues and developments in
the field of Chinese law and is an invaluable resource
for academics, researchers and libraries in this rapidly
expanding field.
The three volumes in this series are:
The Citizen and the Chinese State

Deterrence

Retribution

Edited by Thom Brooks, University of Durham, UK

Edited by Thom Brooks, University of Durham, UK

Crime and Punishment:

Critical Essays in
Legal Philosophy

Deterrence is a theory which claims that punishment

is justified through preventing future crimes, and is
one of the oldest and most powerful theories about
punishment. This volume brings together the leading
work on deterrence from the dominant international
figures in the field. Deterrence is examined from various
critical perspectives including: its diversity, relation with
desert, the relation of deterrence with incapacitation and
prevention, the role deterrence has played in debates over
the death penalty and deterrence and corporate crime.

Retribution is perhaps the most popular contemporary

theory about punishment and in this volume retributivism
is examined from various critical perspectives, including
its diversity, relation with desert, the link between desert
and proportionality, retributivist emotions and the idea of
mercy. The theory of retribution has been the subject of a
revival of interest in recent years and the essays selected
for this volume are the leading works on retribution from
the dominant international figures in the field.

Series Editor: Thom Brooks,

University of Newcastle, UK
Crime and punishment are emotive issues which raise
important and challenging questions. Can punishment

Which practices best cohere with this purpose? These
and many other questions are addressed by this series of
five volumes which bring together classic articles written
by leading international figures in the field. Each volume
is organized thematically with a general introduction to
provide an accessible overview of the latest research.

Philosophy and Theory of Law

SERIES
The Library of Essays
on Justice
Series Editor: Tom D.Campbell, Centre
for Applied Philosophy and Public Ethics,
Charles Sturt University, Australia
Justice is one of the most enduring and central concepts
within applied philosophy, and generates a vast and
varied literature. In recent decades several topics within
the field have undergone significant development and
this six-volume series, which brings together the best
and most important contemporary articles on justice,
constitutes a much needed update on the current state
of research in this field.
The series includes articles relating to the general
theory of justice, where renewed attention has been
given to the notion of desert and procedural justice,
along with constitutional law and distributive justice,
where important recent work on egalitarianism has
emerged. More recently, the discourse of justice has also
become entwined with political debate and the series
includes articles relating to the application of justice to
areas such as global institutions, and to ideals such as
equality, reciprocity, humanity and rights.
The editors of each volume have been selected for their
eminence in the study of law, politics and philosophy and
their specially commissioned introductions present an
overview of the issues in that particular volume together
with comments on the background and significance of
their selection. The essays are reproduced in full with the
original pagination for ease of reference and citation.
The six volumes in this series are:
Distributive Justice
Global Justice

This collection of essays brings together the very best
philosophical and legal writings on procedural justice
over the last half century. The articles analyze values such
as transparency, predictability, and even-handedness in
law-making, law-enforcement and adjudication; discuss
core concepts in Anglo-American jurisprudence such as
equal protection, due process and the rule of law; and
deal with the distinctive branch of justice that involves
norms and processes of applying law to citizens.

Theories of Justice

Intergenerational Justice

Edited by Tom Campbell, Charles Sturt University,

Australia and Alejandra Mancilla, Australian
National University, Australia

Edited by Lukas H. Meyer, University of Graz, Austria

Relations between people who are alive today with people
who may exist in the future and people now deceased
raise new conceptual, logical and substantive questions
and have become a major subject of philosophical
research. The essays selected for this volume explore a
range of philosophical and legal issues raised by these
relations and discuss their relevance to current policy
areas such as reparations for historical injustice and
climate change and its consequences.

This volume of essays provides a general overview of

the main strands in contemporary justice theorising and
features the most important and influential theories of
justice from the post Rawlsian era. Also included is
the critique of the Rawlsian paradigm, especially from
feminist perspectives and from the growing strand of
non-ideal theory, as well as consideration of more
recent developments and methodological issues.

Philosophy and Theory of Law

SERIES
Philosophers and Law
Series Editor: Tom D. Campbell, Centre
for Applied Philosophy and Public Ethics,
Charles Sturt University, Australia
This series is concerned with the group of philosophers,
such as Aristotle, Kant and Hegel, whose names are not
immediately or primarily associated with law, but who
nevertheless, have had a profound influence on legal
thought. Each volume in the series deals with a major
philosopher whose work has been taken up and applied
to the study and critique of law and legal systems. The
essays, which have been previously published in law,
philosophy and politics journals and books, are selected
and introduced by an editor with a special interest in the
philosophers in question. The essays chosen represent
the most important and influential contributions to the
interpretation of the philosophers concerned and to
the awareness of the relevance of their work to current
legal issues.

Aquinas and Modern Law

Foucault and Law

Edited by Richard O. Brooks, Vermont Law School,

USA and James Bernard Murphy, Dartmouth
College, USA

Edited by Ben Golder, University of New South

Wales, Australia and Peter Fitzpatrick, Birkbeck,
University of London, UK

This volume collects some of the best recent writings

on St. Thomass philosophy of law. It includes a critical
examination of Aquinass theory of the relation between
law and morality, his natural law theory, as well as
the modern reformulation of his approach to natural
rights. The volume shows how Aquinas understood
the importance of positive law and demonstrates the
modern relevance of his writings. The introduction places
Aquinas writings in the context of modern jurisprudence
and the volume features an extensive bibliography.

This selection of published articles about Michel Foucaults

work reflects the diverse and contested impact of his
work on theorizing law as well as on the wide range of
intellectual fields that it has so conspicuously influenced.

The articles in this volume reveal the contribution
which St. Augustine made to the history of jurisprudence.
Topics covered include Augustines valuable discussion
of church/state relations, the law of just wars, the proper
role and limits of coercion, the procreative dimensions of
marriage and highlight the little recognized Augustinian
contributions to the field of modern hermeneutics. The
volume also features a definitive bibliography of works

Hume and Law

This volume is the first collection of essays in English to
focus on Humes legal ideas and it celebrates the diversity
of Humes contributions to jurisprudence. Topics are as
varied as legal causation, theories of punishment and of
property, contract, and legal obligation. Humes notorious
assertion of the artificiality of justice is discussed and the
articles are supplemented by a bibliography of law-related
articles on Hume. The juxtaposing of these topics brings
out the coherence of the theory that underlies them,
anchoring law firmly in Humes overall epistemology
and empiricist methodology.

Cartels and Anti-Competitive

Agreements

Mergers and Acquisitions

The Library of Essays

on Antitrust and
Competition Law

Volume I

Edited by Jonathan Galloway, Newcastle University, UK

Series Editors: Rosa Greaves, University of

Glasgow, UK and University of Oslo, Norway,
Sandra Marco Colino, Chinese University of
Hong Kong, S.A.R. Peoples Republic of China
and Jonathan Galloway, University
of Newcastle, UK
Antitrust and competition law have grown dramatically
in importance and significance over the last fifty
years. US antitrust law has been the principal source
of inspiration for jurisdictions wishing to introduce
regulation to control cartels and monopolization, and
antitrust regulation has now been adopted in more than
120 countries. The significance of this new field of law
continues to grow as more and more antitrust cases are
brought to the courts in Europe and the US, and with
operators becoming increasingly inventive.
Each of the three volumes in this series focuses on a
distinct area of economic activity affected by antitrust
law: cartels and anti-competitive agreements; dominance
and monopolization; and mergers and acquisitions. The
selected essays cover the legal, economic and policy
issues relating to attempts to regulate competition and
provide insight into legal issues which have proven to be
particularly relevant and contentious over the years.
This series brings together the best of the extensive
literature that has been published in this fast-moving
field in recent years, and is an invaluable resource for
both students and lecturers.

This volume brings together leading articles on the
regulation of joint conduct under competition law on
both sides of the Atlantic. The articles discuss the general
theoretical framework that has influenced the evolution
of the law and policy; cover the most relevant practical
developments; provide contrasting doctrinal views and
pay particular attention to the main schools of thought
that have influenced antitrust in the US and the EU; and
are representative of the leading discussions in the course
of antitrust history.

Volume III
This volume explores the competition concerns arising
out of mergers and acquisitions, the reasons for merger
control and the fundamental options that face all
jurisdictions intent on implementing an effective merger
control regime. The chosen articles mainly, but not
exclusively, focus on the US and EU, and several adopt a
cross-disciplinary approach encompassing law, political
science and economics. The volume acts as a guide
through the development of merger control law, policy
and scholarly thought and includes commentary on each
of the key stages of any effective merger control regime.

Dominance and Monopolization

Volume II
Edited by Rosa Greaves, University of Glasgow, UK

This volume selects articles on antitrust and competition
law as tools for understanding how this law is applied
to unilateral conduct which is harmful to the consumer
and to the competitiveness of the market. The articles
examine the meaning of dominance and monopolisation;

...a remarkable tour de force.
Journal of Intellectual Property Law & Practice
This series examines how the law of copyright developed as
an instrument of political control and individual expression.
The first volume discusses how proprietary notions
increasingly dominated copyright legal principles,
with consequences for information dissemination in
modern times. It covers the period to 1850, and begins
with extracts from Roman law and early Christian and
medieval teaching on ownership.
The second volume reproduces writings of figures as
diverse as Karl Marx, Victor Hugo, Charles Dickens
and Mark Twain, and bodies such as the US Congress.
Extracted material charts the development of an
international system of copyright regulation, and the
growth, in the 20th century, of copyright industries
benefitting from new copyright laws.
The third and final volume shows how, since 1950, the
growth of copyright regulation has followed, and enabled,
the extraordinary economic growth of the entertainment,
broadcasting, software and communications industries.
The articles focus principally on the digital age, examining
how copyright regulation is likely to affect goals of
dissemination and access.
The three volumes in this series are:
Volume I: The Scope and Historical Context
Volume II: Application to Creative Industries
in the 20th Century
