RE: United States v. Giuseppe Destefano

J.A.M - 8 20~5

(11-ca- -z>o)(~)(~e&)

Honorable Judge Matsumoto,

I am writing your Honorable Court in response to a request that I had made
to Chief Probation Officer, Ms. Eileen Kelly, 147 Pierrpont Street - Brooklyn,
New York 11201-2712 on September 24, 2014. Ms. Kelly advised me that since I was
not currently under her authority she could not take a position to my request,
but directed me to contact my sentencing judge, directly, in order to make the
request.
My projected release date is June of

2017~

My fiancee has scheduled for

our wedding to take place at St. Anthony of Padua, in Elizabeth, New Jersey on
December 31, 2017. The reception will then take place at Nanninas in the park,
also in the State of New Jersey.
I have explained to my fiancee that the scheduled date for our wedding and
reception are 6-months after my scheduled projected release date, at which time
we could then ask the Honorable Court for permission to travel out of State for
the marriage. My fiancee quickly reminded me that nearly ALL wedding arrangements
and receptions require a 2-year advance booking, with a minimum 35% non-refundable
deposit. So unfortunately, reservation and deposit need to be secured shortly.
For this reason, and to make a fiancee who has been patiently and faithfully
awaiting for my return -a happily married woman- I am respectfully asking your

Honors permission to be able to schedule, reserve, and make arrangements for

my travel to the State of New Jersey on December 31, 2017.
My fiancee and I, thank Your Honor in advance for any consideration given
to this request. I have also attached the response letter from USPO, Ms.
Jennifer Connelly, for this Honorable Courts review.
RESPECTFULLY SUBMITTED on this 5th day of January, 2015.

Ocar Mr. Ddtefano,

I have been assigned to your query, although I am not your assigned Probation Officer.
(Assignment happens upon your release.) Nevertheless, I am pleased to make your
acquaintance, and I hope you find the following information to be useful.

It seems that you are asking for permission in advance to travel to New Jersey (for your
wedding) and to the Caribbean (for your honeymoon). Unfortunately, since you have not yet
commenced your term of supervised release, we can neither grant nor deny such a request. If
you so choose, your attorney may petition the Judge for an order to allow travel; however, there
is no guarantee that such a request will be honored.
Jf your request to travel to New Jersey is a same-day trip, it is likely that this request would be
granted, unless you were not in compliance with your terms of supervised release. Of note, the
Judge has ordered a six-month term of home confinement. Therefore, it is advisable that you
plan the wedding for a date at least seven months after the start of supervised release (allowing
time for your equipment to be hooked up).
As to travel to the Caribbean, several countries therein have made it difficult for persons serving
a term of supervised release to enter their borders. It is advisable that you consult with the
consulate of any country you may wish to travel to and obtain documentation from that consulate
indicating that they would allow you to travel while on supervised release. Again, travel is a
privilege that is only granted with compliance with all terms of supervised release.
