theHouseofRepresentativeJosephSouki(Speaker'sMemorandum).Six
membersoftheHousewereappointedtotheSpecialCommittee:Karl
Rhoads,Chair(CommitteeonJudiciaryChair)JohnM.Mizuno(Vice
Speaker)ScottK.Saiki(MajorityLeader)CindyEvans(Majority
FloorLeader)KenIto(MajorityWhip)andBethFukumotoChang
(MinorityLeader).Speaker'sMemorandumincludedsixrulesforthe
conductoftheSpecialCommittee'sproceedings.

Speaker'sMemorandumtaskedtheSpecialCommitteewith
"investigat[ing]thechallenge[toSpeakerEmeritusSay]without
delay."(Speaker'sMemorandum,Rule4)TheSpecialCommitteewas
required"toreviewrelevantwrittendocumentationsubmittedbythe
petitionerandthechallengedmember."TheChairoftheSpecial
Committeewasgiventhediscretiontoconductahearing"wherethe
petitionerandthechallengedmember,ortheirrespectiveattorneys,
shallbeprovidedanopportunitytomakeabriefstatementandanswer

YourSpecialCommitteewaschargedwithinvestigatingachallenge
toSpeakerEmeritusSay'squalificationstoholdofficeasthe
representativeoftheTwentiethRepresentativeDistrict.

TheHouseofRepresentativesandanycommitteesestablishedunder
itareobligatedtooperateunderandapplyapplicableconstitutional
andstatutoryprovisions.Thereareseveralprovisionsparticularly
relevanttothismatter:

EverycitizenoftheUnitedStateswhoshallhave
attainedtheageofeighteenyears,havebeena
residentofthisStatenotlessthanoneyearnext
precedingtheelectionandbeavoterregistered
asprovidedbylaw,shallbequalifiedtovotein
anystateorlocalelection.

ArticleIII,Section12OrganizationDiscipline
RulesProcedure.Eachhouseshallbethejudge
oftheelections,returnsandqualificationsof
itsownmembersandshallhave,formisconduct,
disorderlybehaviororneglectofdutyofany
member,powertopunishsuchmemberbycensureor,
uponatwothirdsvoteofallthememberstowhich
suchhouseisentitled,bysuspensionorexpulsion
ofsuchmember(emphasisadded)

Article III, Section 6 Qualifications of


Members.Nopersonshallbeeligibletoserveas
amemberofthehouseofrepresentativesunless
thepersonhasbeenaresidentoftheStatefor
notlessthanthreeyears,hasattainedtheageof
majorityandis,priortofilingnominationpapers
andthereaftercontinuestobe,aqualifiedvoter
of the representative district from which the

determiningresidency.Forthepurposeofthis
title,therecanbeonlyoneresidenceforan
individual,butindeterminingresidency,aperson
may treat oneself separate from the person's
spouse. The following rules shall determine
residencyforelectionpurposesonly:
(1)Theresidenceofapersonisthatplacein
whichtheperson'shabitationisfixed,andto
which,wheneverthepersonisabsent,theperson
hastheintentiontoreturn
(2) A person does not gain residence in any
precinctintowhichthepersoncomeswithoutthe
present intention of establishing the person's
permanentdwellingplacewithinsuchprecinct
(3)Ifapersonresideswiththeperson'sfamily
inoneplace,anddoesbusinessinanother,the
formeristheperson'splaceofresidencebutany
person having a family, who establishes the
person's dwelling place other than with the
person'sfamily,withtheintentionofremaining
thereshallbeconsideredaresidentwherethe
personhasestablishedsuchdwellingplace
(4)Themereintentiontoacquireanewresidence
withoutphysicalpresenceatsuchplace,doesnot
establishresidency,neitherdoesmerephysical
presencewithouttheconcurrentpresentintention
toestablishsuchplaceastheperson'sresidence
(5)Apersondoesnotgainorlosearesidence
solely by reason of the person's presence or

III.SpecialCommitteeHearingofFebruary13,2015

YourSpecialCommitteeChairdeterminedthatahearingwas
necessarytolearnmorefromthePetitionersaboutthecomplaintand
toprovidetheCommitteeanopportunitytoaskquestionsofthe
PetitionersandSpeakerEmeritusSay,ortheirrespectivecounsel.
CounselforPetitionersandSpeakerEmeritusSaywereconsultedabout
hearingdatesandbothconfirmedtheiravailabilityfortheafternoon
ofFebruary13,2015.OnFebruary6,twodaysaftertheSpecial
Committeewasestablished,anoticeforapublichearingonFebruary
13,at2:00pmattheHawaiiStateCapitolwasissued.(Special
CommitteeHearingNotice021315)

PursuanttoRule4asannouncedinSpeaker'sMemorandum,counsel
wereadvisedthattheywouldeachbeallowedtomakeabriefstatement
oftwentyminutesfollowedbyquestionsfromtheSpecialCommittee
members.Pursuanttostandardpracticesofthelegislature,the
legislature'spublicaccessbroadcastsystem,CapitolTV,was
permitted,ifitchose,tolivebroadcastthehearing,whichitdid.
Thehearingwasalsomadeavailabletothepublicvialive
webstreamingbyOleloCommunityMedia.Inaddition,theChair
determinedthatthehearingshouldbetranscribedbyalegalreporter,
attheHouse'sexpense.

Whilethepartieswereencouragedtosubmitinformationassoon
aspossibletohelpinformtheSpecialCommittee'sunderstanding,they
werenotified,onFebruary6,thatthedeadlineforreceiptofwritten
materialswas5:00pmonFebruary17.Thiswastoallowreasonable
timeforeitherpartytorespond,ifitdesired,toquestionsfromthe
Committeeandargumentsmadebyopposingcounselatthehearing.

Thehearingbeganasscheduledat2:00pmwiththeChair
welcomingthepartiesandthepublic,reviewingtheguidelinesforthe
hearing,andallowingcounselanopportunitytoclarifythe
guidelines.ThenPetitioners'counselpresentedtheirstatement,
utilizingapproximately16ofthe20availableminutes.TheSpecial
CommitteeaskedquestionsofPetitioners'counselfor25to30
minutes.Afterabriefrecessofapproximately5minutes,Speaker
EmeritusSay'scounselpresentedhisstatementforapproximately10of
the20availableminutes,followedbyCommitteemembers'questionsfor

Asspecifiedinthehearingnoticeandrelayedinadvancetothe
parties'counsel,theCommitteedidnotengageindiscussionor
decisionmakingattheconclusionoftheFebruary13thhearing.This
wastoallowtheCommitteetimeforfurtherreviewoftheinformation
presentedasofthehearingaswellasanysubsequentinformation
providedbytheparties.

ItshouldbeemphasizedthatRule1ofSpeaker'sMemorandum
requiresthatinordertofileachallengewiththeHouse,a
petitionermustbearegisteredvoterwholivesinthedistrictofthe
memberbeingchallenged.WhiletwoofthesixPetitionerswerenot
registeredvotersintheTwentiethRepresentativeDistrict,therewere
fourotherPetitionerswhomettherequirementstochallengeSpeaker
EmeritusSayand,consequently,yourCommitteeproceededwithits
investigation.

V.Discussion

Achallengetoasittinglegislator'squalificationsisamatter
offirstimpressionfortheHouse.Assuch,yourSpecialCommittee
researchedotherstatelegislatures'handlingofsimilarqualification
challenges.TheSpecialCommittee'sprocessinhandlingthis
challengeisconsistentwiththeproceduresemployedbyother
legislatures.Utah,forexample,consideredchallengestothree
representativesonitsopeningdaywherebriefswerereadandoral
argumentsmadesothattherewasa"thoroughairingofthe
challenges."Statev.Evans,735P.2d29,32(Utah1987).Iowa's
legislaturelikewiseresolvedachallengeonopeningday,wherea
memberaboutwhomallegationsthathewasnotqualifiedweremade
duringhiscampaignwasseatedonopeningdayafteroneofthe
credentialscommitteememberspresentedhisresearchontheissueand
thenthebodydebatedanamendmenttothecredentialcommittee's
reporttonotseatthechallengedmember.Turnerv.Scott,269N.W.2d
828(Iowa1978).SeealsoBondv.Floyd,385U.S.116(1966)
Wheatleyv.CommonwealthofMassachusetts,792N.E.2d645(Mass.

YourSpecialCommitteewasresponsibleforfulfillingthe
directiveofSpeaker'sMemorandumtoinvestigatePetitioners'
allegationsthatSpeakerEmeritusSayisnotqualifiedtoserveasthe
RepresentativeoftheTwentiethDistrict.Indoingso,theCommittee
wasboundtoapplyapplicableconstitutionalprovisions,statutory
provisions,andHouseinternalprocedures.PursuanttoRule5,only
"compellingevidenceshallbesufficientfortheHousetoconsider
findingthatthememberdoesnothavetherequisitequalificationsto
serve."

Whilethelegalquestionsinthepriorchallengesarenotexactly
thesameasthosereferredtoyourSpecialCommittee,theunderlying
factsaresimilar.Additionally,theCommitteefindsthatamajority
oftheevidencesubmittedbyPetitionerswaspreviouslypresentedas
partoftheabovereferencedpriorchallengesandhadbeenvettedby
theOfficeofElectionsfortheStateofHawaii,theCityClerkfor
theCityandCountyofHonolulu,andtheBoardofRegistrationforthe
CityandCountyofHonolulu.

OurStateConstitutionsetsthreequalificationstobeamember
oftheHouseofRepresentatives:1)bearesidentoftheStatefornot
lessthanthreeyears2)haveattainedtheageofmajorityand3)be
aqualifiedvoteroftherepresentativedistrictfromwhichtheperson
seekstobeelectedpriortofilingnominationpapersandcontinuing
thereafter.Art.III,Section6.Thefirsttwocriteriawerenot
contestedinPetitioners'challenge.Regardingthethirdcriterion,
thatSpeakerEmeritusSaywasandremainsaqualifiedvoterofthe
TwentiethRepresentativeDistrict,yourCommitteefindsthatSpeaker
EmeritusSayhasmetthequalification.Aperson"qualifiedtovote"
isacitizenwhoiseighteenyearsofage,hasbeenaresidentof
Hawaiiforatleastoneyearpriortotheelection,andisavoter
"registeredasprovidedbylaw."ArticleII,Section1.

YourSpecialCommitteefindsthatsimilartotheotherbodies
thathaveconsideredthefactualquestionsathand,SpeakerEmeritus
SaywasandisaqualifiedvoteroftheTwentiethRepresentative
District.Residency,forelectionpurposes,reliesupontwofactors,
physicalpresenceandpresentintent.Section1113(4),Hawaii
RevisedStatutes("mereintentiontoacquireanewresidencewithout
physicalpresenceatsuchplace,doesnotestablishresidency,neither
doesmerephysicalpresencewithouttheconcurrentpresentintention
toestablishsuchplaceastheperson'sresidence").Therewasno

compellingevidencebroughttotheattentionoftheCommittee,
presentedatthehearing,nordiscoveredbytheCommitteeduringits
investigationofthematterthatpersuadedtheCommitteetoconclude
thatSpeakerEmeritusSaywasnotaresidentoftheTwentieth
RepresentativeDistrict.

Therefore,yourSpecialCommitteefindsthatSpeakerEmeritusSay
isqualifiedtositasthememberrepresentingtheTwentiethDistrict.
Nofurtheractionisrecommended.
