MUNICIPAL RESOLUTION NO. 002-2015

EXTENDING THE PERIOD OF RENEWAL OF TRICYCLE FRANCHISES UNTIL FEBRUARY 15,
2015 WITHOUT THE IMPOSITION OF PENALTIES AND SURCHARGES.

WHEREAS, the period for the renewal of tricycle franchises, without incurring any
penalty/surcharge, ended last January 31, 2015, nevertheless, it has been observed that a number
of tricycle operators were not able to renew their respective franchises primarily due to the difficulty
of raising the necessary funds for the payment of their fees and dues;
WHEREAS, it is the mandate of this august body to regulate the operation of tricycles and
grant franchises for the operation thereof within the jurisdiction of the municipality, subject to the
guidelines of the Department of Transportation and Communication. In view thereof, it is believed
by this august body that providing an extension for the period of renewal until February 15, 2015,
without imposing any penalty/surcharge, is beneficial, put aside the fact that such additional period
is believed to be sufficient and reasonable enough for them to be able to finally renew their
franchises without subjecting them to any surcharge/penalty;
WHEREAS, taking into consideration the difficult times that our tricycle franchise operators
are undergoing and in due recognition of their continuous and unabated rendition of basic
transportation service for the benefit of our constituents in terms of transporting goods and
passengers, liberality in the implementation thereof is gleaned by this august body to be
considerable and understandable;
WHEREFORE, in view of the foregoing premises, be it now:

RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in

session assembled, to extend as it hereby extends the period of renewal of tricycle franchises
until February 15, 20015 without the imposition of penalties and surcharges.
RESOLVED FURTHER, that a copy of this resolution be furnished the Offices of the
Mayor, Guinobatan Tricycle Franchising and Regulatory Committee, Guinobatan Traffic
Management Office, Municipal Treasurer and GUIFTODA, and such other concerned
offices/agencies, for their information and appropriate action.
APPROVED UNANIMOUSLY on motion of Honorable Councilor Rolando P. Palabrica and
duly seconded by the members present this 2 nd day of February, 2015 during their 5 th Regular
Session.
