The Germantown Village Board postponed action Sept. 21 on a rezoning


request that would have allowed for a
190-unit apartment complex.
The motion before the board requested the rezoning of 1.33 acres of land and
a .872 parcel from the B-3 General
Business District to the Rm-2 MultiFamily Zoning District and to create a
Planned Development Overlay District
for a 21.56 acre parcel which is south of
Main Street, east of Castle Drive and
west of Hilbert Lane.
The motion was postponed so village
staff could review a protest petition that
was submitted by adjacent residents.
Village Attorney Brian Sadjak said there
are three conditions under which a
supermajority vote of the Village Board
would be required, with two of those
conditions being if 20 percent of lands
opposite of a right of way or 20 percent
of lands adjacent to the land to be

VILLAGE OF GERMANTOWN
For your convenience the Village Public Works Department is
scheduling a Fall brush pick-up starting the second Monday in October
(October 12, 2015). Although this process will take approximately 2
weeks to complete, we will not be extending the pick-up, or picking up
brush that is put out after Sunday, October 11, 2015.
Limbs shall be no more than 6 foot in length and placed at the curb with
the trunk facing the street for easier handling. Please tie branches 2 or
smaller into bundles no larger than 2 feet in diameter using twine or light
rope. Your cooperation with this will greatly increase the efficiency at
which we can pick up the brush. Brush in containers WILL NOT be
picked up as too often there is yardwaste in the bottom of the
container. Yardwaste and leaves are not included in
the pick-up. We encourage you to take your
yardwaste to the Recycling Center.
Please be aware that raking leaves into the
street area is against Village Ordinance and
the Village of Germantown WILL NOT pick
up such leaves. Again, we encourage you to
take your leaves to the Recycling Center.

If either of those conditions are
met, Sajdak said three-fourths of the
nine-member Village Board would have
to vote for the rezoning for it to be
approved. Sajdak said a petition signed
by 99 residents was submitted to the
village, and staff needs to determine
if those signatures comply with two of
the conditions for requiring a supermajority vote.
During a public hearing, resident
Betsy DeVilbiss said the apartment
complex does not fit with the housing
in the adjacent area.
"Three story buildings? How does a
three-story building fit in cosmetically?" DeVilbiss asked. "We are looking at
a sore thumb sticking out in the middle of everything else. This complex
just doesn't fit."
DeVilbiss, a realtor, said more
affordable
condominiums
with
attached garages are needed in
Germantown.
"We don't need more apartments,
we don't need three-story buildings, we
don't need that high density,"
DeVilbiss said.
She also said the traffic generated
would impact residents along Hilbert
Lane and other neighborhoods.
All 12 residents who spoke during
the public hearing were opposed to the
rezoning. Resident Charles Brown said
he moved into the village because he
wanted to reside in an area that
remained rural.
"The concept of this apartment
complex with 190-units, I am completely against. I am completely
against the rezoning," Brown said.

Resident, village official at odds over zoning definition


A detail in the village's zoning
code became part of the discussion
over a rezoning request at the
Germantown Village Board Sept. 21.
A public hearing was held on a
request to rezone of 1.33 acres of
land and a .872 parcel from the B-3
General Business District to the Rm-2
Multi-Family Zoning District and to
create a Planned Development
Overlay District for a 21.56 acre parcel which is south of Main Street,
east of Castle Drive and west of
Hilbert Lane. The board postponed
final action to allow staff to review a
protest petition.
During a public hearing on the
matter, resident Dan Wing took issue
with the definition of "net acre" that
was used for the request.
"Their density is net acre," Wing
said. Wing stated that in 1978
Germantown's definition of net acre
did not include wetlands.
"That's the code, all the way
through 1988,"Wing said. Changes
were then made in the zoning code
and that definition of net acre disappeared, but Wing said "it never
changed." He cited a situation in
1989 where the definition of net acre
-- the one in which wetlands are not

included -- was used.


"In fact every planning administrator we had has defined it, that it
doesn't include net acre (that
includes wetlands) until the current
zoning administrator, who changed it
in recent years," Wing said.
Wing said changes in code have to
be made by elected officials. He suggested the village should go back to
determine if elected officials did
change the definition.
In response, Village Attorney
Brian Sajdak said Retzlaff approached
him about the definition about net
acre. Sajdak said the village "(does)
not have a specific definition within
the code" for net acre. As a result, it
could be subject to a challenge in circuit court, and he said the court
would likely interpret to code to favor
the free use of the land.
Retzlaff cited instances were different interpretations of net acre was
used by village staff.
"It's somewhat entertaining to
hear comments that are in my opinion cheery picked from the history of
the archives to support one's position," Retzlaff said.
Retzlaff said the 1978 zoning code
definitions for net density and gross

density, and for net and gross


acreage, "were used sporadically, in
some cases differently, going back to
1978."
According to Retzlaff, a staff
report on the request for the site
from Jason Gallo -- who preceded
Retzlaff in the post -- in which Gallo
indicated that wetlands weren't
excluded from the net acre calculation. Retzlaff quoted Gallo in another staff report as saying "there are no
definitions for net density, it is up to
the Plan Commission to determine if
the project is in compliance with the
zoning code."
"Another example consistent with
how it is being interpreted," Retzlaff
said.
Retzlaff also cited a 1994 report
from then-planning administrator
Henry Elling which used the term
"build-able acres," language which is
not included in the code. Elling recommended that wetlands be excluded
from the density calculation.
Retzlaff said that without a definition, his approach is to be "reasonable" and approach the matter from a
consistency standpoint.

Signs show support for police


Germantown residents are using
signs to show support for their Police
Department.
Signs with the message "We support
our police" and the Germantown Police
Design have appeared outside residences in recent weeks. Residents Barb
and Larry Watters are the ones who
came up with the idea for the signs and
have them printed.

Larry and I like to do something


every fall for the officers," Barb Watters
stated in an email.
"When the time came around this
year we were brainstorming and came
up with involving the community this
time.
Yard signs claiming support just
seemed like the answer."
Barb said they first ordered 50 signs,

which have been followed by two more


orders of 50 signs after the first week.
We are happy so far with the reception the signs have received. The nice
thing about this is it has no expiration
date," she said. "People can leave them
up for a long time or put them out
when the officers need a moral boost.

Changing Lives One Smile At a Time

Local students are getting ready to


test their math skills while raising
funds for local schools.
Mathnasiums TriMathlon contest is
designed encourage kids to engage in
math and to support local schools.
Children at all levels of math ability are
invited to participate. In addition to
winning medals, all students who participate this year will earn money for
local schools with a donation for each
student participating in the event. The
winner at each grade level will be
entered into the Grand Prize
TriMathlon.
The competition, open students in

grades 2 through 5 will be held on

Falls Mathnasium Learning Center at

Participation is free and registration is

"Mathnasiums TriMathlon provides
a wonderful opportunity for kids to
engage in math in a fun way that also
gives back to the community," said
Kevin Carnes, President of Lakeshores

support this event and inspire more
kids to develop a love for math."
The TriMathlon consists of three
events:
Magic Squares, where students are
awarded points for developing their
own math problems.
The Counting Game, which tests
students ability to count from any
number, to any number, by any number.
Mental Math Workout, which asks
students to solve problems without a
pencil and paper in order to show off
their "number sense."
Students do not need to be enrolled
in a Mathnasium center to participate.
Prep materials, including a practice
test, are available on the Mathnasium
TriMathlon website (www.mathnasiumtrimathlon.com), where students
can also register.
Participants will have money donated to local schools on behalf of their
participation. Mathnasium is targeting
an aggregate donation of about
$40,000 throughout the U.S. and
Canada.
The top scorers across all
TriMathlon competitions will be invited
to move on to the Grand Prize

An upcoming Fire Safety Fair is

the Germantown Fire Department
this fall.
The fire safety fair will be held
from 10 a.m. to 3 p.m. Oct 3. at
the Germantown Fire Station at

National Fire Prevention Week.
Last year more than 800 residents
attend throughout the day. Some
of the programs that will be presented are a residential fire sprinkler demonstration, a vehicle
extraction demonstration, an

Additionally there will be multiple booths providing information,
from groups such as Big Brothers,

while roughly 18,300 more men,
women and children are injured
each year. Cooking accounts for
the greatest percentage of residential fires, followed by arson. Dryer
vent fires are also a big concern.
FEMA says that smoke, rather than
the fire's flames, is responsible for
75 percent of all deaths by fire.
In addition to physical injury
and material damage, fires can
cause a host of problems.
Psychological distress, monetary
damages and loss of pets may
come with fires. Loss of irreplaceable personal items is also a concern. Although fires can be devastating, they're also highly preventable, and smoke alarms and a
home fire safety plan are two precautionary measures everyone
should take.
Creating an evacuation plan
doesn't have to be complicated.
Such a plan can be established in
a few minutes and then reinforced

through practice every so often to


keep everyone fresh on what to
do.
Begin by assessing the layout
of the home. Figure out the two
best exits from the home.
If your home doesn't have
two doors, invest in a fire ladder
so that one of the windows can be
a point of exit.
Know how to gain access to
the exits, including the best path
to take to avoid injury. It's a good
idea to consider a few different
scenarios. A kitchen adjacent to
the upstairs staircase may become
engulfed in flames and make exit
by way of staircase impossible.
Just because you have doors to the
outside doesn't mean they'll present the best type of exit.
Sketch out the layout of the
home and the escape plan. Smoke
can make it difficult to know up
from down. Be sure everyone can
reach the exits even if vision is
obstructed. Try it with your eyes
closed.
Check fire alarms routinely,
and change batteries at least every
year.
Make sure windows can be
easily opened if they are an exit
point.
Make note of who will be
helping children or the elderly out
of the home.

Establish a place where the


family will meet outdoors. This
area should be far enough away
from the home so that everyone
will be safe from smoke, flames
and falling debris. Fires may ignite
fuel explosions, so be sure the
meeting spot is a good deal away.
Children should be instructed
to run to the meeting spot immediately without waiting behind for
anyone to catch up. No one should
reenter the home after arriving at
the meeting spot.
Do a few practice runs so that
everyone will be accustomed to
getting out quickly.
While in most cases it is better to escape and let the firedepartment extinguish a fire, in the
event of a small fire, occupants
may be able to stanch it with a
personal fireextinguisher. Follow
the acronym PASS to properly put
out the fire.
PULL the pin in the extinguisher.
AIM the nozzle or hose at the
base of the flames.
SQUEEZE the trigger.
SWEEP the foam across the
fire base; do not just aim in one
place.
Fire safety is very important.
In conjunction with smoke alarms,
afire safety plan can help everyone
get out alive.

Another option for fire service: Waukesha County exec suggests study
Waukesha County Executive Paul
Farrow has contacted communities in
the northwest portion of Waukesha
County to see if they would be interested in a study to examine the
options of a consolidated fire service
in those areas.
When reached for comment last
week, Farrow said he contacted representatives from 18 communities to
see if they would be interested in
having a study to examine options
for how fire service is provided.

Farrow said the idea came from a


Public Policy Forum study which
examined the option of a consolidated or merged services among fire
departments in the southeast portion
of Milwaukee County. Farrow indicated that any study would examine
options ranging from departments
sharing equipment to a partial merger to a full-merger of some departments.
"All this is, is a study," Farrow
said, indicating that there are no

commitments beyond that.


The communities that were
included were the village of Sussex
and the town of LIsbon west to
Delafield, North Prairie, Dousman,
Oconomowoc and Oconomowoc Lakes.
He added that communities that
are interested contribute $1,000 to
$2,000 toward the study. If several
communities are interested in the
study, Farrow indicated he could see
them meeting in October to plan a
timeline under which an entity is

selected to conduct the study over six


months and get back to the communities by summer of next year.
Farrow said the idea is targeted for
a geographic area in the county
where it may make sense to share or
merge equipment and personnel.
Sussex Village Administrator
Jeremy Smith said the village has
indicated it would be interested in
the study.

Fire service in Menomonee Falls, Lannon

OCTOBER 4-10

Change that has been in the


works for several years for fire protection service in Menomonee Falls
-- and Lannon -- is now complete.
The Menomonee Falls Fire
Department has a total of 128
members,
which
fluctuates
throughout the year, according to
Assistant Fire Chief James Mollet.
There are 15 full-time members, 57
part-time members and 56 "paid on
premise" members. The command
staff is comprised of Mollet,
Deputy Chief Don Umhoefer,
Battalion Chief Jim Taylor,
Battalion Chief Kevin Rokenbrodt,

Battalion Chief Aaron Harvey,


Battalion Chief Patrick Curtis with
support staff of Office Coordinator
Donna Schneider and Clerk Jessi
Coon.
Curtis is part of the staff that
came from the Lannon Fire
Department. At the start of this
year, the Lannon Fire Department
was consolidated into the
Menomonee Falls Fire Department,
with

Department staff coming on board
with the combined department.

construction of a new Menomonee

Falls/Lannon Fire station at the


southwest corner of Main Street
and Menomonee Avenue, which
replaced the Menomonee Falls Fire
station 1 on Appleton Avenue.
Menomonee Falls also constructed
a new fire station along Silver
Spring Drive in Menomonee Falls to
serve the southwest portion of the
community. A dedication of both
facilities was held Aug. 6. As part
of the change, 10 to 11 members of
the Lannon Fire Department are
now part of Menomonee Falls Fire
Department. Both news stations
are fully staffed on a 24-7 basis.
"That is not a trivial matter,"
Menomonee Falls Village Manager
Mark Fitzgerald said of Lannon
being included in the name of the
Fire station. He said the name is
meant to verify the partnership
between the villages. He noted
that with the combined department, Menomonee Falls "gained
significant manpower and equipment from Lannon that helped
make this all work."
The last "tone out" for the
Appleton Avenue station occurred
Aug. 1.
An open house was held at the
new stations last weekend. In addition, Mollet said the department
will be participating in their annual fire safety visits to participating
schools in Menomonee Falls.

Family Pet Clinic provides top-quality care


Family Pet Clinic in Menomonee Falls has been
providing top-quality veterinary care to a strong base
of loyal and satisfied clients for more than 23 years.
I wanted to be a veterinarian since I was a kid; its
all I ever wanted to be, said Dr. Scott Fellenz who
opened the clinic in 1992. The clinic features four
experienced doctors and a knowledgeable staff of
receptionists and veterinary assistants.
Fellenz is a 1987 graduate of the University of
Wisconsin-Madison, which was the charter class of the
new veterinary school. The doctor practiced in
Marshfield, Menomonee Falls and New Berlin before
deciding to open his own clinic. A Falls resident for the
past 25 years, he lives with his wife Arlo, daughters
Alexis and Ashtyn, and their family pets.
The other doctors are Dr. Kemberlie Anderson, Dr.
Erin Greuel and Dr. Dara Morrison-Sorgenfrei.
Fellenz says his own pets are like my kidsthey
have greatly enriched my life and the clinic prides
itself on protecting the cherished bond between animal
and human.
Animals are so much more than just pets these
days; they bring so many benefits and positive results
to owners, and they are often used in hospitals for therapy, said assistant practice manager Jackie Helland.
We want our clients to understand that we know how
important their pets are to them. They are a member of
the family and we give them the same care a human
would receive from a doctor.
The clinic also makes convenience a priority by
offering on-site services such as affordable dentistry,
digital X-rays, Ultrasounds, chemotherapy for cancer

patients and board certified consultations.


We do all these things right here in the
clinic instead of having to send the client to a
specialist, Helland said. Dr. Fellenz is excited about offering new diagnostic procedures
such as rhinoscopy to evaluate nasal cavity
problems in dogs and digital dental x-rays.
Other services and products offered
include: an on-site pharmacy; senior wellness
care; prescription food such as Iams,
Eukanuba, Hills Science Diet and Waltham;
ACL repairs; and microchipping. Also, pet
grooming is now available.
The continuous pursuit of education by the
doctors and staff is another way the clinic
stays on the cutting-edge of the field. This
enables them to provide a better quality of
care to their patients, Helland said.
Our doctors attend veterinary seminars
and symposiums every year to expand their knowledge base and be able to give clients the most current
information, said Helland.
And community involvement is key, Helland noted,
sharing how the clinic participates in the villages annual pet fair and assists with the high schools Reality
Check business class, teaching students the costs and
care involved with owning a pet. The clinic also makes
regular contributions to the Companion Animal Fund
which funds research into diseases such as cancer.
Staying involved in the community is very important to us, said Helland, adding that 23 years makes
a statement that no verbal proclamation can.

Germantown found itself trailing
Grafton Sept. 18 after the first three
minutes of the game, as Germantown
fumbled on its opening drive and the
Blackhawks responded with a threeplay drive to lead 7-0 after Jarred
Kettenhoven and Luke Benzschawel
connected on a 3-yard pass play.
Grafton wouldn't score again, as
Germantown won 33-7.
"We wanted to push the line up
front and dominate the line of scrimmage, and that's what our guys up
front work to do," Germantown Coach
Jake Davis said afterward.
Germantown responded to the
opening drive by Grafton with a drive
that ended with a 21-yard pass play
from Nate Seymour to Connor
Edmonds. Grafton still held a 7-6 lead
as the extra point kick failed.
The Warhawks scored twice on
running plays in the second quarter,
as Shon Pratcher scored on a 3-yard
run at the 11:24 mark while Seymour
scored on a 1-yard run with three
seconds left before halftime.
Germantown held a 19-7 lead as a
two-point attempt failed.
Germantown scored two more
times, as Chase Callawaert scored on
a 7-yard run with 3:22 left in the
third quarter while Seymour scored
on another 1-yard run with 9:17 left
in the game. Seymour completed 6 of
14 passes for 118 yards and one
touchdown while Pratcher was the
leading rusher, getting 95 yards on
15 carries. Edmonds caught thee
passes for 50 yards and one touchdown.
Davis noted his team played one
game where rain was falling (against
Catholic Memorial three weeks earli-

er) and sought to establish the run


while still continuing to succeed in
the passing aspect of the offense.
"We did some of that tonight as
well, so that's good," Davis said.
The win came a week after
Germantown rallied to upset border
rival Homestead. Davis said his team
knew how to avoid a possible letdown.
"It's the North Shore Conference,
we've got to go. We know how it
goes, week in and week out it's a title
fight," Davis said. We're on that
road, to get to a conference championship that's eluded us for so long.
We've got to continue to go, we want
the whole thing .We got a piece of it
last year, but we've got to continue
to roll and try to get it. That's a good
focus for our kids to have."
Menomonee Falls 13, Hamilton

The Hamilton girls volleyball team
won four matches at the Pewaukee
tournament Sept. 19. The Chargers
opened the day with a 25-23, 25-23 win
over New Berlin West and followed that
with wins over Oconomowoc (25-21, 2511), Greendale Martin Luther (25-17,

27-25) and Hartford (25-20, 25-22).

The Germantown girls cross country
team placed second in the Franklin
Saber Invitational at Grant Park in
South Milwaukee Sept. 19.
