The true names or capacities, whether individual, corporate, governmental or associate, of the defendants named herein as DOE are unknown to plaintiff, who therefore sues said defendants by such fictitious names. Plaintiff prays leave to amend this Complaint to show their truc names, capacities, or basis of liability when the same have finally been determined. 2. Plaintiffis informed and believes, and upon such information and belief alleges, that each of the defendants designated herein as Doe is negligently or otherwise legally responsible in some manner for the events and happenings herein referred to, and negligently or COMPLAINT FOR DAMAGES -CASENO wea awa n © ° otherwise caused injury and damages proximately thereby to plaintiff, as hereinafter alleged. 3. _Atall times herein mentioned, each and every of the defendants was the agent, servant, employee, partner, joint venturer, alter ego, affiliate, and/or franchisee of each of the other defendants, and each was at all times acting within the scope of such agency, service, partnership, employment, joint venture, affiliation and/or franchise. 4, Atall times herein mentioned, defendants UBER TECHNOLOGIES, INC., RASIER LLC and RASIER-CA LLC were business organizations, the nature and form of which are unknown to plaintiffs at this time, and plaintiffs pray leave to amend this complaint when the same is finally ascertained. At all times herein mentioned, the aforesaid defendants conduct business in the State of California and had their principal place of business in the City and County of San Francisco, California. 5. Atal times herein mentioned, STEVEN ERNEST ELIAS and DOES ONE through ‘TEN, and each of them, were owners of a certain Toyota Camry, bearing California State vehicle license number 6PWW465 which said vehicle was being operated by the defendants STEVEN ERNEST ELIAS and DOES ONE through TWENTY, and each of them, with the permission and consent of the defendants, and each of them. 6. tall times herein mentioned, defendant STEVEN ERNEST ELIAS was a driver for defendants UBER TECHNOLOGIES, INC., and/or RASIER LLC and RASIER-CA LLC. 7. Onor about August 22, 2015, at or around 4:30 PM of said day, plaintiff AMANDA LAMB was a pedestrian crossing Webster Street at its intersection with McAllister Street in the City and County of San Francisco, State of California. She was walking from west to cast in the designated crosswalk. Plaintiff was lawfully crossing the street, obeying all laws and regulations pertaining to being a pedestrian under the circumstances. 8. At said time and place, the defendants, and each of them, were driving the above described vehicle on Webster Street, entering the intersection with McAllister Street. 9. Asa direct and legal result of the negligence and carelessness of the defendants, and each of them, plaintiff AMANDA LAMB sustained injuries and damages, including injury to her left leg, including a fracture of her tibial plateau, head injuries including a concussion, dizziness, abrasions, bruising, swelling, soft tissue injuries, emotional distress, and other injuries presently undiagnosed, Plaintiff is informed and believes, and therefore alleges upon such information and belief, that certain of said injuries will be permanent in nature, the extent of said permanent injuries being at this time unknown to plaintiff. 11. By reason of the premises, it became necessary for plaintiff AMANDA LAMB to incur expenses for medical care and treatment and related costs and expenses required in the care and treatment of said injuries, and plaintifPs damage in this respect is ongoing and presently unascertained. Plaintiff prays leave to insert the elements of damage in this respect when the same are fully determined. 12. By reason of the premises, plaintiff AMANDA LAMB has been unable at times to follow her regular employment, to her special damage in a presently unascertained sum as said loss is not yet finally determined, and plaintiff prays leave to amend this complaint and insert the elements of damage in this respect when the same are finally determined. 13. By reason of the premises plaintiff AMANDA LAMB has been generally damaged ina sum in excess of the jurisdictional minimum of this court.
