INSTRUCTION TO BIDDERS

The following shall be considered in the preparation of bids for the


Construction of the PROPOSED TWO-STOREY JAIME HILARIO INTEGRATED
SCHOOL - LA SALLE Banawang, Bagac, Bataan, complete, ready for use.
B.1

DATE AND PLACE OF SUBMISSION OF BIDS


1.1 Pursuant to the Invitation to Bid for the above project, sealed
proposals shall be received until:

1.2 The submittal shall consist of the following:
a. Accomplished Bid Form in triplicate
b. Copy of Instruction to Bidders, General Conditions
Bid Bulletins, Drawings, Specifications and other
contract forms.
Any bid received after the time specified will be promptly
returned to the Bidder unopened. Bids may or may not be
opened in the presence of the Bidders.

B.2

GENERAL DESCRIPTION OF WORK


2.1The work shall consist of furnishing all Scope of Works mentioned to
complete the PROPOSED TWO-STOREY JAIME HILARIO
INTEGRATED SCHOOL - Banawang, Bagac, Bataan.
2.2 The work includes supervision and obtaining the insurance for the
above works.
2.3 The scope of work is described more completely and in detail in the
Plans and Specifications.

B.3

PREPARATION OF BIDS
3.1 Proposals shall be submitted on the forms furnished and attached
hereto, in strict compliance with the requirements of the
Invitation to Bid and this Instruction to Bidders.

3.2 Special care should be exercised in the preparation of bids. All


designation and prices shall be fully and clearly set forth. The
proper blank spaces in the Proposal and Scope of Work shall
be properly filled. In all proposals, numbers and prices in the
Philippine currency shall be written in words and in figures.
3.3 Before preparing and submitting his bid, each bidder shall be
responsible in taking steps to carefully examine and be
thoroughly familiar with all the Contract Documents, to obtain
knowledge of all conditions, local or otherwise, affecting the
carrying out of the Contract Work, and to determine the
facilities available and needed for the project. Failure to do so
shall be at the bidders risk and shall not relieve him of any
obligation with respect to his bid. It shall be the sole
responsibility of each bidder, by such means as he considers
necessary, to determine and to satisfy himself concerning all
matters pertaining to the project or any other factors that may
affect the cost duration and execution of work.
3.4 Erasures or other changes in the proposals must be explained or
noted over the signature of the Bidder.

It shall be the responsibility of each bidder to visit the proposed


location of the project to familiarize himself with the existing
condition before preparation of bid.

INTERPRETATION, AMENDMENTS AND ADDENDA


4.1 Should a bidder find any discrepancy or omission in the Drawings,
Specifications and Contract Documents, or if he has questions
or clarifications regarding interpretation, he should inform,
immediately in writing, the Owner or Architect who may issue
clarifications to all bidders.
4.2 No oral interpretations shall be made to any bidder as to the
meaning of any of the Drawings or the Contract Documents.
Any bulletins issued during the time of bidding shall be covered
in the proposal, and when the contract is close, they shall
become a part thereof.

COMPETENCE OF BIDDERS
5.1 The Owner reserves the right to examine fully, by any means, the
competence and responsibility of a bidder. The bidder must
furnish evidence of such competence when required by the
owner.
5.2 The Owner reserves the right to reject any bid when statements as
to the bidders business and technical organizations, financial
and equipment resources or construction experience has been

found to be false, and in the opinion of the Owner justifies


rejection.
5.3 The Owner, likewise, reserves the right to reject bids from parties
who cannot show reasonable acquaintance and preparation for
the proper performance of the class of work for which the bid is
submitted.

SIGNATURE OF BIDS
6.1

Each proposal must give the full name and business address of
the bidder.

6.2

A proposal submitted by an individual must be signed by said


individual with his usual signature. A proposal submitted by a
partnership must be signed with the firms name followed by
the signature and designation of one of the members of the
partnership or by an authorized representative. A proposal
submitted by a corporation must be signed in the name of the
corporation followed by the signature and designation of the
person authorized to bind the corporation to the Contract.

PRICES QUOTED IN THE PROPOSALS

If a bidder wishes to withdraw his proposal before the opening


of bids, he may do so without prejudice to himself by
communicating his purpose in writing to the Owner. His bid shall
be handed to him or his authorized agent, unread. Negligence
on the part of the bidder in preparing the bid gives him no right
to withdraw his bid after it has been opened.

In the event of discrepancy between the prices quoted in the


proposal in words and those quoted in figures- the words shall
govern. Bid prices shall be for the full cost of the finishing work
inclusive of all profits, contractors tax, overheads, allowances
and all obligations including taxes of all kinds and nature which
under the Contract payable by the Contractor.

ACCEPTANCE OR REJECTION OF PROPOSAL


9.1

The Contract will be awarded to the bidder whose proposal


appears to be most advantageous to the Owner.

9.2

The Owner reserves the right to reject any or all proposals,


without limiting the generality of the foregoing. Any proposal
that is incomplete, obscure or irregular in the price sheet may

be rejected. Any proposal that omits a bid on any one or more


items in the price sheet may be rejected. Any proposal in which
unit prices is omitted, or in which unit prices are obviously
unbalanced may be rejected. Any proposal accompanied by an
insufficient or irregular certified check may be rejected.

EXECUTE

9.3

The Owner also reserves the right to waive any defect or


informality in the proposals received and to disregard the
proposal of any bidder, or any proposal that is obviously
unbalanced or below for which the work can be done. The
Owner reserves the right to reject the proposal of a bidder who
has previously failed to do properly or complete on time some
contracts of similar nature, or the proposal of a bidder who is
not able to perform the work stipulated in the proposed
contract.

9.4

Where bids are not qualified by specified limitations the


Owner reserves the right of awarding all or any of the items
according to its best interest.

9.5

The acceptance of a proposal will be a notice in writing signed


by the Owner and no other act of the Owner shall constitute the
acceptance of a proposal. The acceptance of a proposal shall
bind the successful bidders to execute the Contract and to be
responsible for liquidated damages as provided for in Section B
10.01 and 10.02 of this Instruction to Bidders. The rights and
obligations provided for in the contract shall become effective
and binding upon the parties only with its formal execution.

EXECUTION OF CONTRACT AND DAMAGES FOR FAILURE TO


10.1

The Bidder, whose proposal shall be accepted, will be required


to appear at the office of the Owner in person, or if a firm or
corporation, a duly authorized representative shall so appear,
and to execute the contract within ten (10) days after notice
that the contract has been awarded to him. Failure or neglect to
do so shall constitute a breach of the agreement effected by the
acceptance of the proposal.

10.2

The damages incurred by the Owner for such breach will include
loss from interference with the construction program and other
items whose accurate amount will be difficult to compute the
Bid Bond accompanying the proposal shall be retained by the
Owner as liquidated damages. If the bidder whose proposal has
been accepted shall fail or refuse to execute the Contract as
herein before provided, the Owner may at his opinion,
determine that such bidder has abandoned the contract and
hereupon his proposal and the acceptance hereof shall be null
and void without any further need of judicial declaration and/ or
action and notice to the winning bidder. The Owner shall be
entitled to liquidated damages as above provided.

BID VALIDITY
11.1

Bids shall remain valid and open for acceptance for a period of
____ days after the date of bid opening.

11.2

In exceptional circumstances, before expiry of the original bid


validity period, the Owner may request the bidders for a
specified extension in the period of validity. The request and the
response hereto shall be made in writing or by cable. A bidder
may refuse the request without forfeiting his bid security. A
bidder agreeing to the request will be required to extend the
validity of his bid security correspondingly. The provision
regarding discharge and forfeiture of his bid security shall
continue to apply during the extended period of bid validity.

BID SECURITY
12.1

The Bidder shall furnish, as part of his bid, a Bid Bond


equivalent to five percent (5%) of the total amount in any
accredited bonding company.

12.2

Any bid not accompanied by an acceptable bid security will be


rejected by the Owner as non-responsive.

12.3

The bid securities of unsuccessful bidders will be


discharged/returned as promptly as possible, but not later than
thirty (30) days after the expiration of the period of bid validity
prescribed by the Owner.

12.4

The bid security of the successful bidder shall be discharged


when the bidder has signed the Agreement and furnished the
required performance security.

TIME COMPLETION
13.1

The Contractor shall commence the work herein contracted to


be done within Two Hundred Forty(240) calendar days and
day one will be five (5) calendar days from receipt of Notice to
Proceed from the Owner. The rate of progress of his work shall
be such as will ensure completion within the specified time. If
the contractor undertakes actual construction of the proposed
work including the delivery of equipment or materials or the
performance of any other kind of work whatsoever before he
receives a copy of the duly executed contract, he does so at his
personal risk.

13.2

It is understood that time is an essential feature of the Contract


and that upon failure to complete the said Contract within the
time stipulated, the Contractor will be required to pay the

Owner the sum of one-tenth (1/10) of one percent (1%) of


the Contract Price, in Philippine currency, per day for each
day of delay (Sundays and legal holidays included) in the
completion of the Contract. The said payment shall be made as
liquidated damages and not by way of penalty, and the Owner
may deduct from any sum due or shall become due to the
Contractor the amount accruing for liquidated damages as
herein stated.
B.14

MANNER OF SUBMITTING BIDS


Bids and all supporting instruments must be submitted on the
forms furnished by the Architect, and must be delivered in a
sealed envelope addressed to the Owner. The name and
address of the Bidder, his national license number and the date
and hour of opening bids must be filled in ink or typewritten. No
alterations will be permitted, unless made before submission,
and initialed and dated.

FAMILIARITY WITH CONDITIONS


Prior to the submission of the bid, the Bidder shall make and
shall be deemed to have made a careful examination of the site
of the project, the specifications, and the construction drawings.
He shall become informed as to the location and nature of the
proposed construction, the transportation facilities, the kind of
facility required before and during the construction of the
project, general local conditions, and all other matters that may
affect the cost and the time of completion of the project.
Bidders will be required to comply with all applicable statutes,
regulations, and others including those pertaining to the
licensing of contractors.

PERFORMANCE AND PAYMENT BOND

The successful Bidder, after written notification of acceptance of


bid by the Owner, shall furnish a performance bond equal to
fifteen percent (15%) of the contract amount for the
faithful performance of his work, and fifteen percent (15%)
payment bond covering payments and obligations
arising from defects in workmanship. Such bonds shall be
in the form of securities as approved by the Owner. Such bonds
shall be effectively enforced within a period of one (1) year
after due acceptance of the work by the Owner or his
duly authorized representative.
FAILURE TO FURNISH PERFORMANCE AND PAYMENT BONDS
Should the successful Bidder fail or refuse to execute such
counterparts to furnish a Performance Bond and Payment Bond
within fifteen (15) days after written notification of the

acceptance of the bid by the Owner, the Bidder will be


considered to have abandoned the bid. In such events, the
Owner shall be entitled to negotiate with the next Bidder aside
from resorting to the remedies available in paragraph B.10
hereof and those under the law.
B.18

CONTRACT IS ENTIRE AGREEMENT


The contract to be effected upon the acceptance of the bid as
well as the bid shall be deemed to include the entire agreement
between the parties thereto, and the Bidder shall not claim any
modification thereof resulting from any representation or
promise made at any time by any officer, agent or employee of
the Owner, or by any other person.

B. 19 MINOR IRREGULARITIES
The Owner reserves the right to waive minor irregularities or
minor errors in any bid. If it appears to the Owner that such
irregularities or errors were made through inadvertence, any
such irregularities or errors so waived must be corrected on the
bid which they occur prior to the acceptance thereof by the
Owner.

OWNERS OPTION
DE LA SALLE PHILIPPINES reserves the right to reject any or all
bids.

B.21

CONTRACTORS LICENSE LAW


The Bidder warrants that he is completely familiar with Republic
Act No. 4566 entitled Contractors License Law which is
hereby made a part of this contract.
