PART I
PRELIMINARY
Short title
1. This Act may be cited as the Workplace Safety and Health Act.
Application of Act
2. Except as otherwise provided in this Act (but not the regulations), the
provisions of this Act shall apply to all workplaces.
Application of Act to Government
3.(1) Except as provided in subsection (2), this Act shall bind the
Government and shall apply to
(a)
any workplace wholly or partly owned or occupied by the Government;
and
(b)
any premises in which any building operation or any work of engineering
construction is carried on by or on behalf of the Government.
(2) Nothing in this Act shall render the Government liable to prosecution
for an offence.
(3) For the avoidance of doubt, no person shall be immune from
prosecution for any offence under this Act by reason that the person is
engaged to provide services to the Government.

Chapter II Officers
Government inspections.
4. (1) The Commissioner or Health Officer may enter at all reasonable
times upon any place of employment and into any house accommodation
provided by an employer for workers, and put questions concerning the
workers to the employer or to any person who may be in charge of them
or to the workers themselves, and the employer or such person, or any
such worker, shall be legally bound to answer such questions truly to the
best of his ability.
(2) If the Commissioner or Health Officer has reasonable ground for
suspecting that any offence has been committed against a worker, and
whenever any complaint of personal ill-usage or breach of any of the
provisions of this Act is made to the Commissioner or Health Officer, the
Commissioner or Health Officer, as the case may be, may forth with
remove, or cause to be removed, such worker from the place of
employment where he is employed for further inquiry into the matter.
(3) The Commissioner or Health Officer may by order in writing require
any employer to take within a reasonable time in the circumstances such
steps as he considers necessary with a view to remedying defects
observed in plant, layout, working methods, supervision medical or
sanitary provision or other matters at any place or employment which he
may have reasonable cause to believe constitute a threat to the health or
safety of the workers.

In Australia, the Commonwealth, four of the six states and


both territories have enacted and administer harmonised Work
Health and Safety Legislation in accordance with the
Intergovernmental Agreement for Regulatory and Operational
Reform in Occupational Health and Safety. Each of these
jurisdictions has enacted Work Health & Safety legislation and
regulations based on the Commonwealth Work Health and Safety
Act 2011 and common Codes of Practice developed by Safe Work
Australia. Some jurisdictions have also included mine safety under
the model approach, however, most have retained separate
legislation for the time being. Western Australia intends to adopt a
moderated version of the model approach and Victoria has retained
its own regime, although the Model WHS laws themselves drew
heavily on the Victoria approach.

Part 1.1 Introductory Matters
1. 1 Citation
These Regulations may be cited as the Work Health and Safety
Regulations 2011.

2. 2 Commencement
1. (1) These Regulations (except regulation 164) commence on
1 January 2012.
2. (2) Regulation 164 commences on 1 January 2013.

3. 3 Authorising provisions
These Regulations are made under section 276 and Schedule 3 of
the Work Health and Safety Act 2011.
