pndtw0\charscalex104 The Reseller shall not advertise the Product for a price lo
wer than the Minimum \line\tab \up0 \expndtw-3\charscalex100 Advertised Price (M
AP) set by Theradome. The MAP for Theradome is the consumer \line \tab \up0 \exp
ndtw0\charscalex100 price on the Order Page at www.theradome.com. The MAP is not
applicable to any \line \tab \up0 \expndtw0\charscalex105 in-store advertising
that is displayed only in the store and not distributed to any \line \tab \up0 \
expndtw0\charscalex100 customers by the Reseller. The MAP applies only to advert
ised prices and does not \line \tab \up0 \expndtw0\charscalex100 apply to the pr
ice at which the Product can be actually sold or offered for sale to an \line \t
ab \up0 \expndtw-3\charscalex100 individual customer by the Reseller. The Resell
er shall be liable to ensure compliance \line \tab \up0 \expndtw0\charscalex100
with the MAP by its customers in any subsequent sale of the Product, and shall b
e \line \tab \up0 \expndtw-1\charscalex100 liable for any breach of the MAP by i
ts customers. This clause has been unilaterally \line \tab \up0 \expndtw-2\chars
calex100 established by Theradome to protect its legacy and reputation

of its name and \line \tab \up0 \expndtw0\charscalex100 products. In addition

to this, this clause is also designed to ensure resellers have the \line \tab \
up0 \expndtw-2\charscalex100 incentive to invest resources into services for The
radome\u8217?s customers. In case of any \line \tab \up0 \expndtw-1\charscalex10
0 violation of MAP by the Reseller, Theradome, in its sole discretion, may revie
w the \line \tab \up0 \expndtw-4\charscalex100 Agreement with the Reseller and c
ease supplying further Product to the Reseller, after \line \tab \up0 \expndtw-4
\charscalex100 or without providing written notification about MAP violation to

shall be allowed to offer any money-back guarantee to its customers but \line\ta

to incur any liability or required to \line \tab \up0 \expndtw0\charscalex100 s
upport any such money back guarantee offered by the Reseller. The Reseller shall
\line \tab \up0 \expndtw-2\charscalex100 not issue any warranty or guaranty wit
h respect to the Product to any person or party \line \tab \up0 \expndtw0\charsc
alex103 which may in any way obligate or purport to obligate Theradome, in any m
anner \line \tab \up0 \expndtw-4\charscalex100 whatsoever, to any such person or
party. \up0 \expndtw-4\charscalex100 For all purposes herein, the Reseller shal

regarded as an independent contractor and not as the employee or age

used and owned by Theradome (hereinafter \line \tab \up0 \expndtw0\charscalex10
0 \u8220?Trademarks\u8221?). The Reseller further acknowledge that its use of th
e Trademarks is \line \tab \up0 \expndtw0\charscalex104 under leave and license
of Theradome and the said use creates in the Reseller no \line \tab \up0 \expndt
w-2\charscalex100 rights in the Trademarks, and that all use of the Trademarks b
y the Reseller inures to \line \tab \up0 \expndtw0\charscalex102 the benefit of
Theradome. The Reseller further acknowledges that any trademark, \line \tab \up0
\expndtw-3\charscalex100 company name, domain name or any other applicat
ion/registration featuring the \line \tab \up0 \expndtw-2\charscalex100 Tradem
arks or any other trademark similar thereto shall be transferred to Theradome \l
ine \tab \up0 \expndtw-4\charscalex100 upon termination of this Agreement. The R
eseller further acknowledges ownership by \line \tab \up0 \expndtw-5\charscalex1
00 Theradome in the intellectual property rights \up0 \expndtw-5\charscalex
