Had a good conversation with Sen. Reid today, as you know. Yes, the new appointees to the
DC circuit were important!
I'm asking Jessica Almond to send you the NCTA letter since I'm at 35,000 feet.
Not sure where privacy stands on a vote count. Today's decision should help, however.

Huge congratulations.

Guess Senator Reid changing the filibuster rules really does matter. Not sure the old DC Circuit would have ruled
the same way.
He said you called him which is really nice of you.

Btw. Please send me the letter you said you had from Kyle McSlarrow on set-tops. Michael Powell is trashing you
to no end. I want to show the letter to guys like Michael Willner.
Also, am told Sen Reid is sending you a letter on set-tops. It exclusively addresses the content providers and
protecting them. Nothing about MVPD's.
And, please let me know where Jessica is lately on privacy. I've been sending her messages. Not sure if anything is
getting through.

you have great reason to be proud of yourself and your agency. In the annals of all agency decisions (not just FCC)
in the DC circuit this is one of the biggest victories ever.
Thanks to your boldness and frankly your brilliant lawyers you now can speak for the public interest with respect to
the most important medium of communication and information ever invented. That's a big deal.
The alternative was that your commission would be put out of business and the agency would represent another
failure of government to serve the people.
