Sec. 4 - Supremacy

PROMESA creates an Oversight Board that will have supreme authority over Puerto Rico.
Its decisions will prevail over any territorial law, including Puerto Ricos Constitution and
any local environmental and labor regulation.

Sec. 104 (e) Gifts,


Bequests and Devices

The Oversight Board can legally accept, use and dispose of gifts in the form of services
and properties, fostering corruption and promoting bribery.

Employee Rights

In order to ensure the immediate execution of the Oversight Boards decisions,


PROMESA forbids public sector employees from exercising their right to strike and/or
participate in a lockout. Any employee who partakes in such acts will be subject to
prosecution by the Federal Government.

Sec. 105 Exemption for


Liability for Claims

The Oversight Board Members cannot be held legally responsible for actions taken to
carry out this Act.

Sec. 107 Operational


Costs

The territory of Puerto Rico will cover all the costs of salaries and expenses of the
Oversight Board. The Congressional Budget Office (CBO) estimates that the Oversight
Board will cost Puerto Rican taxpayers $350 million in the first two years alone.

Sec. 209 Duration of


Oversight Board

The Oversight Board will operate in Puerto Rico until the territory has closed four
consecutive fiscal years with balanced budgets, and its members determine that the
territory has achieved good credit, thus its duration is indefinite.

Wage

For any person under the age of 25 employed after the enactment of PROMESA, the
federal minimum wage will be $4.25 for the first 90 days of employment, and can be
extended up to four years at the discretion of the Governor of the territory. This will
exacerbate the emigration crisis and decrease wages across the board.

The Oversight Board may expedite energy projects without the need for public approval
under the pretext of an emergency, and exploit natural resources despite the adverse
effects they may have on the environment.

The Oversight Board can legally privatize or sell essential services of the territory,
including but not limited to electricity, education and water services without consulting
the people.

MYTHS vs REALITY

Myth

Reality

The Oversight Board is going


to audit the debt and arrest
corrupt politicians.

The Act does not contain any component to the effect of an audit, nor does it intend to prosecute
politicians. The Oversight Boards main priority will be ensuring that bondholders receive their
payment.

The Oversight Board is going


to solve Puerto Ricos political
status.
PROMESA has already been
signed into law and theres
nothing we can do about it.

The Act does not provide any tools to solve the territorys political status, nor does it guarantee
that Congress will respect the results of a national referendum.
An educated and informed populace is capable of mobilizing and halting anti-democratic
practices.
