Ref: Complaint against Optus!
Sir/Madam,
As Author of books in the INSPECTOR-RIKATI series on certain constitutional
and other legal issues I pursue to be accurate about matters so that my readers can have the facts
to determine for themselves if they agree or disagree with what I wrote about.

I last evening Monday 24 October 2016 I yet again discovered to be cut of from the Internet by
Optus and this sage has been going on for most of the year. At times I spend 5 hours or more to
try to get a simcard activated.
On 5 October 2016 I activated 2 mobile broadband WiFis only to discover that instead of 4GB
15 each I was cut down to about 4GB each and then had the problem to c heck my usage because
those who are on the chat tells you one thing but reality is often different.
I today twice asked for the transcript to be sent to me and on both occasions was assured it would
be but yet again it didnt happen. I suspect because of the nonsense they were given me they
20 prefer to avoid the TIO to become aware of what really is going on. Just that they are unaware
that I progressively copy and paste the chat onto a word document as to at least have my own
record. As such, it can be verified that they are giving me a lot of rot.

5 I today at 11.45 am being Tuesday 25 October 20126 was allocated a new internet mobile
broadband number 0478 723 602 and the following image was a screen print at that time to prove
I am correct. Despite this Optus staff as Chat claimed since then that the number was not
allocated neither so the simcard number and by about
10 My screen print shows I copy and paste the chat progressively.

You:Perhaps the system addeda different molbile b roadband number then what it showed on my
screen? Optus useless system is often playing up. I was given the screen that my simcard was preloaded!
Oscar:When I enter the number 0478723602 in my database, it clearly says that No records Found.
You:Do understand that as I activated the sim card I am entitled to its usage irrespective if once again
Optus fails to have it properly provided for internet connection. I am in the process to file a complaint with
the TIO about all this.
Oscar:If the Sim card is activated today, please wait 24 - 48 hours for our system to get updated with the
details which you have provided.

You:24 to 48 hours to wait for activation is in my view absurd and a gross denial of service entitled to.

You:You do not understand my position. I have a mobile broadband number allocated which you claim is
in the identity of someone else. Ity means my simcard might be registered incorrectly by Optus automatic
process to another person, the same was claimed about a week ago by Cindy. As such you got a Stone
Age problem with your system and I urge you to report the matter to Optus management as I am denied
the service I paid for.
You:No use to check in 34to 48 hours and start all over again wasting my precious time! I need to get the
answers now and I recommend you check with your supervisor how to resolve this matter appropriately.
Oscar:Well, like I said earlier, this issue can be fixed ASAP but the number which you have
supplied me is under the different account holders name, the product is mobile general and it is
cancelled several months back.
You:typo errort "34to 48 hours" should be "24 to 48 hours"
Oscar:I was hoping if you could check the mobile number and confirm it with me.
You:Let me clear about this. I am currently typing to you and at the same time checking the view of my
screen that shows 0478723602 as such I copy the number of the screen of what Optus displayed when I
activated my simcard. The fact that the mobile broadband number was used previously doesn't mean
Optus cannot reissue it when it was previously cancelled for usage.
You:May I ask if perhaps you, like Cindy previously, may have incorrectly typed the number and for this
you get a different account holder details?
When I enter the Number 0478723602, In my database it shows as Ceased and it is a normal SIM
card, not the Mobile broadband SIM.
You:That can be so, in the past but this was the number issued to me and accepted when I
activated my sim card 54 15533 52859 8 at 11.55aM ON 25-10-2016.
Oscar:I request you to Change the SIM card please for hassle free activation.
You:Can you activate simcard 54 15533 52859 8 for my mobile broadband as it is paid for preloaded and I am not prepared to lose yet again my monies for this nonsense of Optus.

have it on your system. And if not just allocate a new mobile broadband number for it. Do I have to
manage Optus or has it competent managers to address appropriately this problem?
Oscar:May I know did You receive a SMS confirmation that The SIM card 54 15533 52859 8 is activated.
Oscar:I will try to activate the SIM card, but I am informing you that you will get a different Service
number.
You:Well, considering I am using an old simcard to try to activate the new simcard because Optus denied
me to get on the internet as such it be extremely difficult for me to know what email Optus did or didn't
sent me until I can access my emails. And that remains not possible until Optus is allowed the usage of
the preloaded entitlement. Unless I become involved in some kind of medium that I can read content of
emails without needing internet connection I remain just an ordinary human being needed to use a sim
card for internet connection.
You:Perhaps telepathy with the internet may all together avoid needing to use a internet service provider.

You:Wait 24 hours for what? As my wife already tells me I am in the "doghouse" because she just can't
belief I am not chatting with some chick but with Optus for that long!
Oscar:This is the error I received when I try to activate the SIM card
Activation order blocked, service layer down or temporarily unavailable.
You:Perhaps because the simcard was activated but the Optus Stone Age system can't handle modern
telecommunication equipment?
Oscar:The SIM card is already blocked, that's the reason I was unable to find any records in my
database.
You:Perhaps you may just get the supervisor to authorise the use of my current simcard by loading this
with data, in view that Optus seems to have a computer brain malfunction?
You:That is the mobile broadband number ending 920 you previously added!
Oscar:Well, I can understand.
Oscar:Please allow some couple of more hours on this, we will try again in the next few hours to see if
there is any changes with the services.

You:I suggest Optus gives me a lifetime free Internet access considering the time I am wasting every time
to activate a simcard. At my age this wouldn't be too much as a compensation, as I am in my twilight
years.

At the moment, the SIM card has been blocked and I'm unable to retrieve any info's.
You:Due to a hearing problem, as indicated above I use text only on 0425029944. nature decided to
restrict my hearing but not my mental ability and Optus may just have to understand I am not going to give
up onto this. A lifetime free internet usage may be nothing to Optus but would for sure be a PR to
compensate the time I waste time and time again on Optus activations. Just pass this on to Optus
management. As author of books in the INSPECTOR-RIKATI books I can assure you I will publish this
all.
Oscar:I will certainly take this a feedback and have this passed to our platform leads.
You:Again the supervisor can authorise to add date as to at least let me use my current simcard used
with the mobile broadband ending920 so I can still use the Internet. After all in a few hours or 48 hours
the thing might still not be resolved.
Oscar:My apologies, we do not have any authorisation to proceed with adding data's on your account.
You:Sometimes it takes 5 or more hours to resolve the simcard problem. As such it is ongoing. Too
absurd for a internet provider to conduct matters as such.
You:It has been done in the past! So I know it is possible.

You:Ok at least we are getting somewhere for the moment. I am well aware you are so to say the meat in
the sandwich and cannot be blamed for the problems, but with me it is frustrating and time consuming to
have this time and time again as a problem. In July Optus refunded some monies as it recognised it was
in the wrong. Better is to upgrade the system to avoid the problems in the first place.

may say to wait that is usually the problem that when I wait for more than a week the same remains to be

As shown above at 7.48 pm on Tuesday 25-10-2016 still no usage of my simcard.

While below Cindy claimed As per your email ID and and the number, there is no MyAccount
5 setup. and I see here that 0401085920 is registered in MyAccount with the email address

loisdowell61@gmail.com. the number in fact is on my MyAccount as Oscar finally added it despite that
Cindy claimed it was registered on a different persons name. And Oscar did so now on 25 October 2016
with the 0478723602 mobile broadband number.
And in the past this same rot was claimed with other simcards only in the end to be activated in my name.
As such as I indicated Optus technical system seems to be in the Stone Age and not able to appropriately
deal with activation registrations.

While Optus failed to provided the 10 GB for the $40.00, and neither did refund me the $40.00
the problem is that what is sold might be totally different then what the sim card might be about.
This means a customer as myself goes on what is advertised on display boards and on the
package but Optus with pre-loaded simcards then changes this say from 5GB to a mere 1 GB.
When then one calls\ in one is subjected to all kind of false/misleading claims.
Including that the preloaded simcard only works with as new WiFi. The truth is that when I use a
new WiFi with which the simcard is purchased, as the simcard is sealed in the package, then
clearly it is not the WiFi but the rot with Optus that is the problem. .
On activating a new simcard a new mobile broadband number is provided regardless if one uses
an old WiFi or a new WiFi unit!
Because the package on the outer provides no information what is preloaded on the
simcard that is inside the new WiFi package then as a customer one can only rely upon
what is on the display signs shown.
What I got was a lot of rot (again) by staff of Optus claiming I used up all my entitlements and I
made clear I couldnt have used up 5GB in a mere few days just to deal with emails. And after
many hours it often turns out that they merely had 1GB recorded and not the 5 GB that was
advertised for which it was sold.
When this I consider elaborate swindle/fraud is perpetrated against countless other customers
then this is a financial windfall for Optus. It is because of my record keeping that I am able to
expose it all.
It is really absurd that Optus staff in Chat claim that the simcard/mobile broadband is registered
to someone else and in the end it proves it was all along on my name. Was it not for my own
record keeping of a chat I would be unable to prove the nonsense that goes on. And while Cindy
claimed she had put the mobile broadband number on MyAccount this also proved after 8 days
still not to have happened.
Also for Oscar to claim to wait 24 to 478hoursd after activation (as others before him also did) in
my view is utter and sheer nonsense because if then it still isnt working they will tell you to wait
another 24 to 48 hours and so on.

This was at 11.37 am on Tuesday 25-10-2016 when I first was activating the simcard, but then
after clicking on activate I got the request to start all over again and I did so with so. As such
Optus had apparently a technical problem that somehow its system didnt recognise the first
activation and then having gotten me to activate it again then this clashed with the first
10 activation.
What really is the problem that the simcards are pre-paid and preloaded and still at times Optus
Staff tells me that I should put money to the simcard to be able to use it. As such despite that the
simcard is preloaded with 5 or 4 GB I am told there is nothing on the card. Then I am in hours of
15 battle and finally staff then discover that after all it was preloaded with 5 or 4GB of entitlements.
And well Optus refunding some monies to recent denial of entitlements may underline I was
correct all along. While most people would by long have given up as an author of books in the
INSPECTOR-RIKATI series I dont because then my readers can see that you should stand
up for your rights! If I were to falsely claim entitlements then I could be held liable for fraud, and
20 I view Optus as a corporation should likewise be legally accountable. How it manage its business
it for them to decide as long as it doesnt involve fraudulent conduct. In my view the least Optus
can do is to provide me with as lifetime free internet access as being a senior citizens having
wasted so many, indeed numerous hours, to try to get what I paid for is a gross absurdity.
Optus may not realise but the cost to staff to resolve problems in regard of myself would by far

5 Considering I have got the box and details of the simcard as well as the WiFi that was in the box
and the simcard then it is to me utter and sheer nonsense to claim this simcard is not operating
and I need to use another simcard, as Oscar referred to. No doubt Optus can check back the
numbers and confirm that indeed the box details correspond with my simcard and my WiFi.
10 The following are copies of cheques from Optus towards some refund of recent problems with
simcards.
15 If Telstra can be fined for not providing services then Optus to have done the same more nearly a
year may just have to fork out a lot of money to compensate me for this denial of services.
One major problem Optus has is that tit sells simcards for mobile phones and simcard for mobile
broadband. If then some store sells the WiFs/Modem for broadband when they should only be
for mobile phone then the customer ends up with a huge amount of problems. In reality a
20 simcard for mobile broadband only is cheaper for Optus as it has no call cost associated with it
and for this the entitlement of 4GB or 5Gb is as a compensation compared \perhaps to a same
simcard for a mobile phone usage that because of the calls associated with it may only allow
2GB of internet access.

25 And this appears to be the problem with Optus, that perhaps it had wrong simcards packed for
mobile phones with Wifi for broadband.

Obviously a customer who purchase a parcel that is sealed has no way of knowing what is
preloaded on the enclosed simcard. In fact even when I activate the simcard then I have to wait
hours if not weeks before I can find out what is preloaded. When activating via gelephone the
operators tell me they cannot tell me what is preloaded on it.

In my view Optus by not revealing this on the outside of the package as such has a self-inflicted
problem. A customer who purchase something is entitled to rely upon what is advertised with the
item being purchased.

Where for example the advertisement is for 5GB then irrespective what Optus may claim is
preloaded, such as 1GB the customer was advised it was 5GB and so entitled to it. In my view
this is a comprehensive and elaborate fraud/swindle perpetrated by Optus (and I can state some
other internet providers likewise) but I do not accept this as justifying the denial of entitlements.
After all it is because of what is advertised I decide to purchase certain WiFis and their enclosed
simcards!
I may add that it is also utter and sheer nonsense to have that a customer is to be bound by the
purchase when seeking to activate the simcard where the conditions were unknown at the time of
purchase. If Optus doesnt provide the conditions at the time of purchase it cannot afterwards
renege on certain provisions!
Again, a customer has no way to check the simcard that is sealed in a package until having
purchased it and having put it in a WiFi to try to activate it and to hold that the customer having
broken the seal then may lose rights is also lunacy.
It is like with a cart sales person, who make statements/assurances and then afterwards proved to
25 have lied. One then is entitled to compensation, etc. Likewise Optus should be held legally liable
for its conduct.

It should be understood that Foreign authorities such as from the USA has been relied upon by
the High Court of Australia since it was created, albeit one can only do so validly where it is
30 within the provisions of our constitution.
What this means is that Optus/Telstra/Vodafone and a host of other internet/mobile provides as
corporations can be held legally liable as any private citizen.

As a senior citizen I have to try to stretch my monies to the best of my ability and so try to get
the most GBs for the least amount of monies. Hence, I check stores to what is on offer and well
some stores having items close to expiry date then discount their product to clear them. That
doesnt mean that the entitlement advertised is any less for it. Basically what it means is that
those businesses are willing to take less profit then none at all.
And well aware about what I consider the elaborate swindle by Optus I make sure to take photos
of what is on offer so as afterward being able to prove my version of events. However, with the
10 GB for $40.00 with Target that was no discount but a special loading well advertised and still
Optus reneged on it refusing to honour my entitlements because it claimed that it was for a
mobile phone not mobile broadband. And this just underline the absurdity of it because I view
that if this was a real issue then Optus had an onus to make it very clear on the package that the
content is for mobile phone only. Then again why would anyone want to purchase a Wifi with a
simcard for a mobile phone usage when one can insert the simcard directly into the mobile phone
and so do not need the added expense of a WiFi.
One also has to ask why any expiry date? After all one may purchase a mobile phone for
example for emergencies and leave it in a drawer until needed and the last thing one then need is
to find out the simcard is expired long ago. It is in my view highway robbery to prevent a person
to know the expiry date of the simcard until one open the package.

As the simcards are sold in sleeves with one or two dots and so in numerous stores, then it cannot
be held that I as merely making some errors, in particular where the sleeves that have been
reproduced above to not support the staff members claim.
Because it is a phone call to Optus it means no record are available for the customer (the caller)
to prove what was said by Optus staff.
However, even when using Chat (https://www.optus.com.au/shop/welcome?defaultTab=2),
where a transcript of communication is made available on request that is, then it can be shown
that as I view it Optus simply defrauds me as a customer of my entitlements. As shown/set out
below I had 2GB on 14-4-2016 for 0434 625 184 My Prepaid Mobile Broadband and requested
this to be transferred to 0423 949 642 My Prepaid Mobile Broadband, to discover that the 2GB
was changed to 2MB and then a 2MB was recorded this as to pretend that the 2MB was used
even so no simcard was used at all for this. And 0423 949 642 shows no such transfer
eventuated, and as result on 26 April 2016 I was cut off from internet (broadband) services. And
this besides the fact that simcard 0423 949 642 was sold with a WiFi to provide 5GB of usage for
12 month which Optus initially cut back to 1GB for 1 week, but after complaining it made it
2GB for 1 month.
A major problem is the denial of communication using emails. As result Chat is time consuming,
At times many hours without resolve. And phone calls are useless without records for the
customer to prove what an Optus staff stated.
While I spoke to the manager regarding Optus, and he made clear that 3GB was shown on
MyAccount, reality is that it showed no such 3GB and as such something is drastically wrong
when Optus claims to have one set of data, whereas my screenprints shows/proves otherwise and
I am denied internet access as result. Despite asking for transcripts to be sent to me, in fact
various times asked for this I now find that the transcripts were not sent at all. While in regard of
1 transcript it was claimed they only can sent it while the chat is on but they do keep a copy on
file, they refused to send this copy to me as well as the other transcript.
More than likely because the transcripts can prove that the manger was not correct in his claims
they may have held better refuse to provide me with transcripts as then I can prove my version of
events. Well, I am the type of guy who expected this and made numerous screen prints of the
CHAT and as such can put together the transcript based on what was shown on the screen. Optus
therefore undermine its own credibility by this kind of conduct. While it may get away with this
kind of what I consider fraudulent conduct/swindle with me they just have taken on the wrong
person!

Here it shows that I purchased 2 at special discount rate of only $14 each.
Simply as a senior citizen being on a pension I look for when stores are overstocked or want to
clear out old stock before the item expires and so purchase often at huge discount prices. This
however is merely that the store forgo certain profits but doesnt affect the entitlements of the
5 product.
Stores, as to attract customers often do provide for special discounts, such as Coles, for a week,
and then one can purchase even mobile phones at heavily discounted prices.
Obviously a store faced with a huge stock of items about to expire or soon enough rather sells the
stock at reduced prices and still make some profit then no profit at all.
10 K-mart was selling $2.00 simcards for merely $0.05 (5 cent each) to clear stock. I then purchased
57 of them! All they had!
The mere fact that a promotor (store/merchant) sells items at discount prices doesnt deprive a
customer of the entitlements. Just that as I do I mark the items for expiry date where this is
recorded on the product.
15 As a customer I obviously accept that the short period of time before the item expires remains
applicable, hence the marking of the expiry date. However, nothing is to alter the entitlements!
Just for explanation.

My wife authorized someone to remotely use her computer (she is learning to use the internet),
20 which turned out to be a scam. I use for this different WiFis and different simcards, so that it
cannot affect my computers. As such purchasing different WiFi without any real added cost on
special lower prizes means saving a lot of money and a void scammers to get the details because
of ongoing changing of WiFi and simcard.

With the Federal Government being busy with an election in recent times the usual 6 months it
take at least to attend to my writings likely be a lot longer, but I will not give up.
I view this must be investigated and Optus and others needs to improve their service to avoid this
20 ongoing problematic conduct of them.
I purchased entitlements and Optus failed to deliver and so I am entitled to a daily compensation
from the time they failed to provide the service to me. That to me is the only like manner they
will learn a lesson not to engage in unconscious conduct.
Beyond doubt compiling the information has been very time consuming, as I have an archive of
25 hundreds of pictures ab out it, and so considering also the gross denial of services and the blatant
deception time and time again that somehow items are registered with someone elsewhere in the
end it proves never was, surely entitles me on a worthy compensation even if called an
exemplary damage issue.
