TABLE OF CONTENTS
Sealed proposals for the furnishing and delivery F.O.B. Chugach Electric Associations
warehouse No. C located at 5601 Electron Drive, Anchorage, Alaska of material for
Chugach Electric Association will be received by Chugach on or before 4:00 o'clock
P.M., June 30th, 2011 at 5601 Electron Drive, Anchorage, Alaska 99519-6300. Any
proposal received subsequent to the time specified will be promptly returned to the
Bidder unopened.
2.
Material shall be delivered, F.O.B. and off-loaded at Chugach Electric Association, Inc.
Ops Warehouse Bldg. C, located at 5601 Electron Drive, Anchorage, Alaska 99518, no
later than September 9th, 2011. Exceptions to this delivery date shall be noted in the bid.
3.
Proposals and all supporting instruments must be submitted on the forms furnished by
Chugach and must be delivered in a sealed envelope in which the Proposal is submitted.
Proposals must be filled in ink or typewriter. No alterations or interlineations will be
permitted, unless made before submission and initialed and dated.
4.
Prior to the submission of the Proposal, the Bidder shall make and shall be deemed to
have made a careful examination of the Plans and Specifications and forms of Material
Contract, and all other matters, including transportation facilities, that may affect the cost
and the time of completion of the work.
5.
Proposal shall be valid for thirty (30) calendar days after the bid date.
6.
In estimating the lowest cost to Chugach as one of the factors in deciding the award of
the Contract, Chugach will consider, in addition to the price quoted in the Proposal, the
delivery schedule.
7.
The Purchase Order, when issued, shall be deemed to include the entire agreement
between the parties thereto, and the Bidder shall not claim any modification thereof
resulting from any representation or promise made at any time by any officer, agent, or
employee of Chugach or by any other person.
8.
Chugach reserves the right to waive minor irregularities or minor errors in any Proposal if
it appears to Chugach that such irregularities or errors were made through inadvertence.
Any such irregularities or errors so waived must be corrected on the Proposal in which
they occur prior to the execution of any contract which may be awarded thereon.

The prices of material set forth herein shall include the cost of delivery F.O.B.Chugach
Electric Association Warehouse No. C located at 5601 Electron Drive, Anchorage, AK.
Such delivery shall be made as stated above.

This Proposal is made pursuant to the provisions of the Notice and Instruction to Bidders,
if any shall be attached hereto, and the Bidder agrees to the terms and conditions thereof.
4.
The Bidder warrants that this Proposal is made in good faith and without collusion or
connection with any other person or persons bidding for the same work.
5.
The Bidder agrees that, in the event this Proposal is accepted, it will execute a Contract in
the form attached hereto.
6.
The Bidder warrants that the Materials will conform to the performance data and
guarantees which are attached hereto and by this reference made a part hereof.
7.
If, in submitting this Bid, the Bidder has made any change in the form of Bid or General
Conditions furnished by Chugach, the Bidder understands that Chugach may evaluate the
effect of such change as they see fit or they may exclude the Bid from consideration in
determining the award of the Purchase Order.

GENERAL CONDITIONS
WHEREAS, Chugach Electric Association desires to purchase and the Contractor desires to sell
the materials described herein.
NOW THEREFORE, in consideration of the mutual undertakings herein contained, the parties
hereto agree as follows:
Chugach accepts the Bid which is attached hereto and by this reference made a part
hereof, and the parties hereto agree that the Contractor shall sell and deliver to Chugach
and Chugach shall purchase and receive from the Contractor the Materials (hereinafter
called the "Materials") described in the Bid upon the terms and conditions herein stated.
B.
The prices set forth in the Proposal include the cost of delivery F.O.B. Chugach Electric
Associations Inc. Ops warehouse Bld. C located at 5601 Electron Drive, Anchorage,
Alaska 99518.
C.
The prices set forth in the Bid do not include any sums which are or may be payable by
the Contractor on account of taxes imposed by any taxing authority upon the sale,
purchase or use of the Materials hereunder, the amount thereof shall be added to the
purchase price and paid by Chugach.
SECTION 2 - DELIVERY
A.
The Contractor shall deliver the pipe piles as stated in the written order or orders of
Chugach. The time for delivery shall be extended for the period of any reasonable delay
due exclusively to causes beyond the control and without the fault of the Contractor,
including, but not limited to, acts of God, fires, strikes, and floods; provided the
contractor notifies Chugach within seven (7) days of the reason for delay.
SECTION 3 PAYMENT
A.
Upon the shipment of any Material hereunder, the Contractor shall submit to Chugach a
detailed statement of the Material shipped. Chugach shall within 30 days of receipt of the
Material in good order and free from defects, pay the Contractor the contract price of the
Material.
All Materials furnished hereunder shall be subject to the inspection, tests, and approval of
Chugach and the Contractor shall furnish all information required concerning the nature
or source of any Materials and provide adequate facilities for testing and inspecting the
Materials at the plant of the Contractor.
B.
The Materials furnished hereunder shall become the property of Chugach upon delivery,
provided, however, that Chugach, within one year after delivery or within the period for
which the Materials is guaranteed, whichever is longer, may reject any Materials which
does not comply with the Specifications attached hereto and made a part hereof or with
the guarantees, if any, of the Contractor. Upon any such rejection, the Contractor shall
repair or replace such defective Materials within a reasonable time after notice in writing
from Chugach and in the event of failure by the Contractor so to do, Chugach may make
such replacement and the cost and expense thereof shall be paid by and recoverable from
the Contractor.
SECTION 5 - MISCELLANEOUS

The Contractor shall hold harmless and indemnify Chugach from any and all claims,
suits, and proceedings for infringement of any patent or patents covering Materials
purchased hereunder.
C.
Each and all of the covenants and agreements herein contained shall extend to and be
binding upon the successors and assigns of the parties hereto; provided, however, that the
Contractor shall not assign this Purchase Order or any part thereof or enter into any
contract with any person, firm, or corporation for the performance of the Contractor's
obligations hereunder, or any part thereof, without the approval in writing of Chugach.
TECHNICAL SPECIFICATIONS
1.00 GENERAL
1.01
GENERAL
A. This section covers data which the Contractor shall submit to Chugach for design
information or review after award of the contract. As stipulated below, compliance or
review with the specified schedule for data submittal is essential to the scheduled
progress and completion of the transmission line and is of the essence of this Contract.
1.02
A. The Contractor shall furnish three copies of specified reports to Chugach within seven (7)
calendar days after the date the test was performed.
B. The Contractor shall give Chugach and its designated representative free access to his
work, and whenever requested shall furnish full information as to the progress of the
work in its various parts.
C. Chugach reserves the right to determine conformity to the quality specified herein by any
inspection method. Materials not conforming to the requirements of these specifications
shall be repaired or replaced at the Contractor's expense. Chugach reserves the right to
inspect the work either at the place of fabrication or at the job. In either case, the
Contractor shall not be relieved of any responsibility for the quality of material and
workmanship or the correctness of detail and dimensions; and any adjustments, changes,
or repairs, which may be found necessary after the delivery of material, including all
additional handling and shipping charges, shall be paid for by the Contractor.
D. The failure of Chugach to inspect the work, to require testing of materials, or to reject any
unsatisfactory materials or workmanship shall not relieve Contractor of his responsibility
for the work.

Submittals

Certified copies of mill test reports for physical, chemical, and impact tests for
pipe material.

Affidavits of compliance.

Load, unload, and haul pipe in a manner that will not cause damage to any part of
the pipe section.

Handle pipe sections with double belt slings or other suitable devices. Use
handling devices of adequate width that will provide uniform bearing and that will
not have metal contact with the pipe sections.

Do not drag pipe sections along the ground. If pipe sections are rolled, roll on
skids or on ground prepared for such purpose.

Materials for pipe shall conform to ASTM or API 5L specifications using steel
material with minimum 50 ksi yield strength (Fy). Material shall offer good
weldability characteristics.

Furnish pipe ends as specified in the Bid Schedule. Remove all burrs at ends of
pipe.
Pile Shoes

Pile shoes shall be Versabite open ended inside flange cutting shoe, or approved
equal. Shoes shall be attached onto piles with a minimum effective PJP groove
weld all around.

Furnish pipe in straight pieces of lengths specified in the Bid Schedule. Length
tolerance: plus 12, minus 6.
Finish
1.
The finished pipe shall not contain imperfections in such number or of such
character as to render the pipe unsuitable for pipe piles.
2.
Surface imperfections, the depth of which exceeds 25% of the nominal wall
thickness shall be considered defects. Repair of defects by welding will be
permitted when the depth of defect does not exceed one third of the nominal wall
thickness.
