Alternative Dispute Resolution for Equitable Access to Justice

Background and Purpose of the Assignment


Mainstreaming Alternative Dispute Resolution (ADR) is a two-year initiative of The Asia
Foundation to expand range of partnerships with federal and provincial governments, bar
associations, civil society organizations, and local communities to support key pillars of Vision
2025 of the Government of Pakistan. The project is implemented in partnership with Search for
Common Ground (SFCG) in eight-districts of Punjab and Khyber Pakhtunkhwa (KP) with an aim
to mainstream ADR in settling civil, family, petty criminal, and small business transactions
disputes. This will be achieved by 1) increasing awareness among lawyers and bar associations
about ADR; 2) building the capacity of bar associations, law graduates, Musalihat Anjuman, and
women agents of change to assist the poor and vulnerable, including women, to resolve disputes;
and 3) raise public awareness on the use of ADR to settle civil disputes.
Working directly with the legal community the project will raise bar associations awareness about
the importance of ADR processes, build the capacity of recent law graduates to improve the skills
of lawyers and prosecutors, and ultimately promote ADR in justice sector institutions. The project
will build on existing initiatives such as will work closely with the Musalihat Anjuman,
government recognized Dispute Resolution Councils (DRCs), Local Government Representatives
(LGRs), and potential women to raise public awareness at the community level on the use of
ADR to settle disputes of civil nature.
Research Objective and Scope
This TOR is seeking a service provider to gauge the understanding of project beneficiaries on
legal rights under the Constitution of Government of Pakistan and related supplemental laws,
alternative dispute resolution (ADR) processes, and their current attitudes towards the existing
ADR mechanisms. The overall purpose to set benchmarks for monitoring and evaluation of the
project. The key objectives of the study are:

Identify benchmarks and indicators which can be used for evaluation of the project at the
end.
Provide information for monitoring of project activities during the course of
implementation.
Capture the prevailing knowledge, attitudes, and practices of the project beneficiaries. The
study results will identify beneficiaries knowledge gaps, beliefs, and behavior to identify
critical gaps in ADR demand and supply links. The study will also support in designing
strategic, high impact public awareness campaigns for each targeted group based on
information received from the ground.

Scope of the Study:

The service provider shall familiarize him/herself with the project and other relevant
documents and the cultural context in which the program is being implemented.

Collate socio-economic profile of the targeted districts including demographic data


disaggregated according to gender, age, subsistence strategies, occupation, and communal
existing strategies for resolving disputes.
Sector specific information such as literacy rates, percentage of people who have
knowledge of the ADR, and status of civil cases pending in the courts
Local beliefs and practices of resolving disputes, and locally defined needs, constraints,
and opportunities
Design study methodology in a way that can be used for midterm reviews and final
evaluation.
Make suggestions to develop easy-to-implement participatory monitoring and evaluation
methods/tools and forms (accompanied by guidelines).
Complete data analysis, generate draft report and submit to project team for review and
approval.

The assignment is expected to conclude in four phases:

Phase I: Pre-study preparation (study of existing program documents and relevant


materials, identification of stakeholders, developing methodology and secondary
research)
Phase II: Based on research and stakeholder identification, 8 districts in Punjab and KP
will be selected as target intervention areas
Phase III: Field work and Analysis of data and
Phase IV: Production of report/outputs
Geographic Location: 8 districts in Punjab and Khyber Pakhtunkhwa (KP).
Methodology

The service provider is advised to use a combination of methods in order to facilitate the process
of identification of benchmarks and indicators for project monitoring and evaluation. The
following methods are suggested, however, should not be limited to;

Review of project documents and available information


Structured and semi-structured interviews
Focus Group Discussion with project beneficiaries
Direct observations
Public meetings
Life stories

Deliverables:

Inception report
Summary the findings, triangulate the field data with literature review
Presentation of the key findings and recommendations
Baseline study final report. The report will include KAP assessments from various
stakeholders in all 8 districts

Coordination and Logistical arrangements


The focal person for the Baseline/KAP at The Asia Foundation will be the Team Manager. The
Team Manager will directly manage the consultant and provide him/her with all documentation
and information necessary for the research study. The logistical arrangements for field visits and
provincial level workshop will be the responsibility of consulting firm.

Schedule of Delivery
The duration of the assignment is 25 working days inclusive of submission of final report. The
final payments will be issued after 15 days of receipt of final report.

Facilities to be provided by the Project


The Project will support the service provider by providing office support and facilities, supervision
and advice, documents and materials and by facilitating access to important information and
materials. The service provider will work closely with project team.
Qualifications
Masters degree in social sciences, law, statistics or relevant discipline;
At least 7 years of substantial experiences in research, evaluations and surveys
Good understanding of ADR and justice sector issues, particularly relating to vulnerable
groups, inclusivity, diversity.

Ability to travel extensively throughout the identified districts of the project


Experience in working with local people and community organizations
Good communication, report writing and presentation skills
Excellent command of English

Technical Proposal should include

Examples of at least two similar assignments in the recent past. Please attach the hard
copies with the technical proposal;
CVs of Principal and co consultants to be dedicated to this contract along with letter of
commitment;
Maximum five pages narrative proposal describing the approach to conducting the study.
This should include a detailed timeline for the completion of the study.
