ObjectiveoftheConference:

Theobjectiveoftheconferenceistoprovideaplatformtostudentsofvariouslawschools(under
graduate/postgraduatestudents)tohonetheirskillsofnegotiationanddiplomacy.Wehopethis
conferencegeneratesinterestnotonlyininternationaleventsthatareorganisedaroundtheworldbut
alsodevelopawarenessinInternationalRelationsanditsdynamics.Itwillalsoprovidethestudentsa
chancetointeractwithstudentsofotherlawschools,legalluminariesandthediasporadedicatedto
InternationalLaw.Itisanopportunitytoobservetheintricaciesandnuancesofdiplomatic
negotiationsandbeinvolvedinthemonarsthandbasis.

III.TREATYNEGOTIATIONCOMPETITION(TNC)

Treatiesareaseriouslegalundertakingininternationallaw.Onceinforce,treatiesarelegally
bindingonthepartiesandbecomepartofinternationallaw.Thelawontreatymakingprocessis
governedbytheViennaConventiononLawofTreatieswhosepreambleclearlystipulatesthat
codicationoftreatiespromotethedevelopmentoffriendlyrelationsamongnationsalongwith
internationalpeaceandsecurity.

TheformatofTNCisbasedontheworkingsofvariousbodiesandagenciesofUnitedNationsas
wellasotherindependentorganizationswhichcatertothetreatynegotiationprocessinvarious
globalspheres.ParticipantswillbegivenadraftTreatywhichwillcontaintheissueswhich
necessitatesdeliberationduringtheoralrounds.ThekeyobjectiveofTNCistoinculcatein
participantsthesenseofinnovationalongwithnegotiationskillswhichareessentialineverylawyer.

ThethemeofthecompetitionwillbeGRAINSCONVENTION.

Teamsarerequiredtoprepareframeworkagreementsfortheirrespectivecountries(Rulesand
otherdetailswillbeprovideduponselectionofteams)
Teams[comprisingof2students]willbeallowedtodiscussontheirproposedsubmissions
duringtheoralrounds

SubmissionguidelinesfortheTNC:

FortheTreatyNegotiationCompetition,thefollowingcasestudyhasbeenprovided.Interested
participantsaretosubmitawriteupwithinawordlimitof1000wordsforeachquestion.Onthe
basisofthewriteupfurtherselectionswillbemadeforallotmentofCountrieswhichtheteamswill
representintheOralRounds.Itistobenotedthatthiscasestudyisnotapartoftheactual
materialsfortheTreatyNegotiationCompetition.Itisonlyforthepurposeofselection/scrutinyof
theteamsfortheaforementionedcompetition.Thebackgroundofthetreatyandtherulesforthe
sameshallbeprovidedlater.

Rareearthelement(REE)havebecomevitalcomponentsintheproductionofglasses,petrol,
television,laptops,satellites,energysavinglightbulbs,jetenginesandwindturbines.Itisagroupof
17minerals,somewithunusualnamessuchasgadoliniumandpraseodymium.Productionof
electriccarsandmilitaryhardwaresuchasjetghterelectricalsystem,missileguidancesystemand
satellitepowerandcommunicationsystemdependsonthemwhichinvolveasmanyaseightofthese
REE.Duetoitsincreasingusageinmilitaryhardware,manycountriesbelievethatcontinuous
supplyofREEiscrucialtothenationalsecurity,theglobaldemandforwhichisexpectedtoincrease
thaneverbefore.

AccordingtoaGeologicalsurveyconductedbytheUnitedStatesofAmerica(USA),itisestimated
thatthereare110milliontonsofthesemineralsfoundacrosstheglobe.Asthedistributionisuneven
inearthscrust,somecountieshavemoredepositthanothers.MostreservesarefoundinChina,
whichisestimatedtobe55milliontonsofworldstotalreserve.Thesecondisthecommonwealthof
independentstateswhichismadeupoftwelvecountrieswith19milliontons,but,outofthose
RussiaandKyrgyzstanhavethemostrareearthreserves.USAranksthirdwith13milliontons.Even
thoughthesemineralsarefoundinmanycountriesotherthanthosementionedabove,theirmining
presentsaproblem.Theseelementsarefoundinsuchconcentratedformthatitisdiculttoexploit
themeconomically.

Duringthe1980s,withChinaseconomicmodernizationrising,itsgovernmentrecognizedthe
importanceofthismarketandinvestedheavilyinmachineryandlabourtrainingforminingREE.
CheaplaborandsoftenvironmentallawprovedtobeeconomicadvantageousincomparisontoUSA.
TheimpactofthisisprominentasChinahasincreaseditsshareofglobalproductionfrom27%to
95%overthelasttwodecades.ThisentryofChinahasledtoasharpfallintheglobalpricesofREE,
inturnforcingmajorrivalsoutoftheproduction.

NowChinahasalmostabsolutemonopolyoverthesupplyofREE.Further,italsodominatesthe
fourstepsofthesupplychainandistheonlyexporterofcommercialquantitiesofrareearthmetals.
Moreover,thereisarequirementoftheseelementsinmanyoftheproductsthatitmanufactures.
Additionaly,ChinesecompanieshavestartedinvestinginothercoutriesforREEproduction.

Inordertoregulatethemarketandmaintainsustainabilityinproduction,Chinesegovernmenthas
increasedtheexportfrom25%to30%andfurtherloweredtheexportquotafrom28417to7976
metrictons.

ThisChinesenearmonopolycoupledwithincreaseddemandaswellastheprotectionistpolicies
usedbyChinafortheseelementshasraisedconcernsaboutthesecurityonREEsupplychain
especiallyonaccountofthosecountrieswhicharecompletelydependentonChinaforitssupplyof
REE.

AnotherfactortobetakenintoaccountisthattheproductionofREEsbyChinaresultedinahuge
aftereectintheformofpollutantsgeneration.Theoutputgeneratedalongwithitselfdoublethe
amountofpollutionwhichdirectlyaectsthewaterbodies.Suchbodiestraversethroughdierent
nationscausingfurthertransboundaryharm.Theriverswouldquicklyturnblack.Chemical
indicatorsofwaterqualityshowedthatthewaterscontainedheavyamountofchemicalsmakingthe
wateruntforconsumptionandgeneratingalgalbloom.Chemicalsreleasedintheprocessalso
contributedtoatmosphericdepositiononthelayersofwatersources.Severaldeadzoneshave

contributedtoatmosphericdepositiononthelayersofwatersources.Severaldeadzoneshave
resultedduetosuchconditions.Suchproductsalsoseepintotheadjacentlandareasthusdestroying
thefertilityoftheselandsundermininganyeconomicbenetsthatthenationscouldderive.Amajor
hurdleisthatthesearemostlyagrariannations.

Provisionalmeasures(atemporaryproscriptiononthemanufactureofsuchREEs)directedtobe
implementedbyChinaweredisregarded.

USAandJapanhaveraisedstrongobjectionsthatChinaspoliciesareinviolationofW.T.Orulesof
fairtrade.China,however,contendsthattheseexportquotasarejustiedbecausethesemeasures
ensurethatthereisnoexcessiveenvironmentaldegradation.Moreovercertainmeasureshavealso
betakenbythenationallegislaturetoensurethatthedomesticproducersdonotoverexploitthe
naturalresourcebuttheeectivenessofsuchdomesticlawishighlydoubted.In2010,USAalong
withJapanandothernationsincludingChinasneighboringcountrieshaveledaformalcomplaint
withtheWTOagainstChinasprotectionistpoliciesaswellforeconomicandenvironmentaldamage.
ASpecialEnvironmentalChamberwasconstitutedbytheICJtodealwiththeprospectiveissue.

IsitgoinginfavourofChina?WhetherornotChinachoosestofollowtheverdict?

Noconclusionhasbeenreachedsince2010.

ongeneralprinciplesofinternationallaw.
