A Food Service Worker is any employee who is primarily engaged in the serving of food or beverages to guests, patrons or customers in the hospitality industry, including, but not limited to, wait staff, bartenders, captains and bussing personnel; and who regularly receives tips from such guests, patrons or customers. A Tip Credit the amount of tips earned by an employee that the law allows his/her employer to take as a credit against the minimum wage requirements. A Tip Threshold is the weekly average of tips per hour an employee must collect for their employer to qualify for a tip credit. The Cash Wage is the minimum hourly payment a business must pay an employee who regularly receives tips. So long as the tips earned plus the cash wage equals the required minimun wage. A Fast Food Employee is any person employed or permitted to work at or for a Fast Food Establishment by any employer where such person’s job duties include at least one of the following: customer service, cooking, food or drink preparation, delivery, security, stocking supplies or equipment, cleaning, or routine maintenance. A Fast Food Establishment is any restaurant where patrons order or select items and pay before eating and such items may be consumed on the premises, taken out, or delivered to the customer's location; which offers limited service; which is part of a chain; and which is one of thirty (30) or more establishments nationally. An Exempt Administrative Employee is any employee whose primary duty consists of the management of the enterprise, who customarily and regularly directs the work of two or more other employees, who has the authority to hire or fire other employees or whose suggestions and recommendations as to the hiring or firing and as to the advancement and promotion or any other change of status of other employees will be given particular weight, and who customarily and regularly exercises discretionary powers.
