ORDER

This matter came before the court on Plaintiffs Motion for a Temporary Restraining
Order and Preliminary Injunction. Prior to the hearing, the undersigned informed the parties
that there was a potential conflict of interest in that Governor Robert J. Bentley, the party
plaintiff, appointed the undersigned to this position on or about January 17, 2017. On the
record, the parties who were present, agreed to waive any potential conflict and asked that the
court proceed with the hearing. At the conclusion of the hearing, the undersigned informed the
parties that he would: 1) contact the Judicial Inquiry Commission and provide the information
about the potential conflict of interest, and 2) seek input from them prior to entering any rulings
in this matter.

The Judicial Inquiry Commission has informed the undersigned that the conflict of
interest announced to the parties is not waivable, and that recusal is required. Accordingly, the
undersigned does hereby recuse himself from presiding over this case and submits this matter to
the Circuit Clerk for reassignment.
