The purpose of this manual is to present general policy and review and
approval procedures of the Lake Vista Estates POA Design Standards for
homeowners intending to make any changes to, or perform maintenance on,
the exterior of their home or property. The Board of Directors is responsible
for policy formation, implementation and interpretation of these Standards.
The Board of Directors reserves the right, as a representative of the
homeowners, to make policy changes for the benefit of the Association at
any time. These changes will be made to reflect amended policies,
covenants, and procedures consistent with the needs of the Association. As
approved changes occur, documentation reflecting these changes will be
forwarded to all homeowners/residents. The Design Standards are also
intended to serve as a reference for members of the Architectural Control
Committee (the ACC) in the process of reviewing applications for exterior
projects submitted by homeowners. The Design Standards described in this
manual address the most common exterior home improvement tasks that
require the submission of an application for review and approval by the ACC.
This document is not intended to be all-inclusive or -exclusive, but
to serve as a guide for making improvements to, and maintaining
the aesthetic quality and integrity of, the Community. The Design
Standards have been developed as a guide for ensuring this criterion is met
with the following objectives:

1. To increase homeowners'/residents' awareness and understanding of


the Declaration of CC&Rs (the Covenants) of the Association.

2. To maintain focus on all exterior alterations made to the property.

3. To describe the organization and the review and approval procedures


pertaining to the Design Standards established by the Board of
Directors.

4. To illustrate design principles which will aid homeowners in making


exterior improvements that are in harmony with the Community as a
whole.

5. To assist homeowners in preparing and submitting an acceptable


Architectural Review Request to the ACC.

6. To ensure exterior improvements are kept in agreement with the


Design Standards.

7. To provide uniform Design Standards to be used by the ACC in


reviewing Architectural Review Requests based upon the goals set
forth in the Covenants of the Association.

8. To maintain the unique and harmonious appearance of the Community


in order to preserve and improve home values for the benefit of all
members of the Association.

Protective Covenants

The fundamental authority for maintaining the quality of design principles


within the Community is founded in the Covenants, which are a part of the
deed to every property in the Association. The intent of Covenant
enforcement is to assure homeowners that the standards of design quality
will be maintained. This, in turn, protects property values and enhances the
Community's overall environment. Every homeowner received a copy of the
Covenants at settlement. All too frequently this information is not
read/retained by the homeowner. Since these Covenants '"run with the land,
they are binding, whether or not they have been read. They should be
periodically reviewed and fully understood.

Role of the Association and the ACC

The role of the Property Owners Association, of which every homeowner is a


member, is not only to own and maintain their own home, as well as all the
common areas/open space, but to conserve and enhance the resources of
the total Community. The Association accomplishes these functions in a
variety of ways, one of which is by ensuring, through the ACC made up of
volunteer homeowners, the retention of harmonious, though diverse, design
qualities of the Community. Surveys of planned communities show that
providing this insurance as a standard is reflected in the preservation and
enhancement of real estate values and is of prime importance to
homeowners.

The ACC performs its task of ensuring that the aesthetic exterior quality of
the homes and their environment is maintained by monitoring the Design
Standards review process. This involves a

thorough review of all Architectural Review Requests for approval, followed


up by on-site visits to confirm the work stated in the application has been
performed in a manner which meets the intended outcome. The ACC also
performs periodic on-site reviews throughout the Community to identify any
matters of non-compliance with the Design Standards.

Changes that Require ACC Approval

Article 5.06 of the Declaration of CC&Rs explicitly states that all exterior
alterations require the approval of the ACC. It is important to understand that
approval is not only limited to performing major alterations such as building
a deck or installing fencing, but also for changes in paint color of house trim,
doors, shutters, light fixtures, landscaping, and the like. Similarly, prior
approval is also required when an existing exterior element of the home or
landscaping is to be removed. Each application is reviewed on an individual
basis with respect to the following criteria.

If you are not sure that an application for approval is needed for your project,
seek guidance first from the property manager. Do not proceed with your
project until approval has been obtained. Applying for preapproval will avoid

the time and money that you will have to expend to bring any unauthorized
changes into compliance with the Design Standards.

Review Criteria

The ACC evaluates all submissions on the individual merits of the


Architectural Review Request. Besides evaluation of the particular design
alteration proposal, the review includes consideration of the characteristics
of the housing type related to the individual site or the developers
construction or landscaping decisions, since what may be an acceptable
design of an exterior in one instance may not be in another. Design decisions
made by the ACC in reviewing applications are not based on any individual's
personal opinion or taste, as this has been shown to destroy the overall
atmosphere of a community which can contribute to a devaluation of
properties as a whole. Rather, judgments of acceptable design alterations
are based on the following criteria which represent in more specific terms the
general Design Standards of the Covenants.

The review criteria include the following:

1. Validity of Concept. The proposed design alterations must be


appropriate for the surrounding area that it will affect.

2. Design Compatibility and Congruity. The proposed improvement must


be compatible with the architectural characteristics of the applicant's
house, nearby houses, and the neighborhood setting. Compatibility
and congruity is defined as similarity in architectural style, quality of
workmanship, and use of materials, color and construction details, as
defined in the original construction design established by the builder
responsible for construction of your specific home.

3. Location and Impact on Neighbors. The proposed alteration must be in


harmony and congruity with the landscape, the existing structure and
the neighborhood as a whole. The primary concerns are access, view,
amount of sunlight, natural ventilation and drainage. For example,
fences may obstruct views, natural breezes or access to neighboring

properties, while decks or large additions may cause unwanted
shadows on an adjacent patio or infringe on a neighbor's privacy.

4. Scale. The size specifications of all three (3) dimensions (height, width,
and depth) of the proposed alteration must be congruent with adjacent
structures and surroundings.

5. Color. The appearance of color may be used to soften or intensify


visual impact. For instance, elements of an addition that are similar to
the existing house, such as roof and trim, must match the color
established by the developer responsible for construction of your
home.

6. Materials. Continuity is established by use of the same or compatible


materials as those used in the original construction. However, options
that may be considered could be limited by the design and materials
used in the original construction. For example, the horizontal vinyl
siding on the original house should be duplicated in color and means of
installation in any exterior addition.

7. Workmanship. The quality of workmanship should be equal to or better


than that of the home and/or the surrounding properties. Poor
installation practices, besides causing the homeowner problems, can
be visually objectionable to others.

8. Timing. The alteration authority granted by the ACC through the


submission of an application by the homeowner will be revoked
automatically if the alteration requested has not been completed
within the dates specified on the Jackson County Building Permit, if
applicable, or as specified in the ACC approval letter.

9. Applications. A separate application must be submitted for each


proposal. The application must provide specific information required to
determine the scope and details of the proposal. All applications must
include the signatures of all homeowners who would be directly
affected by the proposal. The signatures of these homeowners
only reflect their awareness of the proposal, not their

approval. Lessees are not permitted to sign any applications
concerning alterations of any kind.

10. Site Plan. A site plan, or plat, is required to be included with most
applications. A site plan is a scaled drawing of your lot (site) which
shows exact dimensions of the property, adjacent properties, if
applicable, and all up-to-date improvements, including those proposed
in the application. Contour lines are required where drainage is a
consideration. The site plan should be developed from the plat
provided to the homeowner at the time of purchase of the home. More
complex applications may require larger scale blowups of the plat of
the Jackson County-approved development site plans in order to clearly
define the proposal.

All information requested on the application as specified in the Design


Standards must be completed. Otherwise, the application will be considered
incomplete and will be disapproved.

Amendments to the Design Standards

The Design Standards may be amended from time to time to provide


clarification or to reflect changes in current conditions or technology. The
ACC will conduct a periodic evaluation of the Design Standards to determine
if amendments are required. Homeowners may submit written requests to
the ACC for changes to the Design Standards at any time. Upon completion
of a review by the ACC in which changes have been made to the existing
Standards, the ACC will submit those changes to the Board of Directors for
approval. Amendments to the Design Standards require final adoption by the
Board of Directors.

Application Review Procedures

Each Architectural Review Request will be reviewed for completeness by the


ACC. If any information pertinent to defining the proposal is not included in
the application, the application will be disapproved. All applications require

signatures of affected homeowners. Applications with signatures of renters
will be disapproved.

If the ACC determines that the application is complete, the review process
begins at that time. The application will be reviewed by a quorum of the ACC
members. The ACC must act upon all applications within sixty (60) calendar
days of receipt. Failure by the ACC to take action within sixty (60) days after
receipt of plans and specifications initially submitted for approval shall be
deemed approval of such plans and specifications. Applicants with special
cases that require further review and interpretation will be notified by the
ACC to be present at the next scheduled ACC meeting to discuss their
application.

An appeals procedure exists for those affected by an ACC decision. The first
appeal is made to the ACC, while a second appeal can be made directly to
the Board of Directors.

To initiate the appeals process, the applicant, or other affected homeowners,


must submit a written request to the ACC via the property manager for an
appeal within ten (10) working days of the applicant receiving the ACC
decision. The ACC has forty-five (45) calendar days to review the appeal.

If the initial appeal is unsuccessful, the applicant, or those affected by the


alteration, may file a second appeal with the Board of Directors if they
believe the ACC did not:

1. Utilize proper procedures during the administration and review


process.

2. Provide the applicant and any other affected residents with a fair
hearing.

3. Issue a rational decision, but made one that was arbitrary and
capricious.

The second and final appeal to the Board of Directors must be initiated within
ten (10) calendar days of the applicant receiving the ACC appeal notification.

Applicants and other interested parties may appear before the Board of
Directors in conjunction with the appeal. The Board of

Directors will issue its decision on the appeal within sixty (60) calendar days
of receipt of the appeal and will provide written notice of its decision to all
affected parties and to the ACC.

Enforcement Procedures

The Covenants require the ACC to ensure the Design Standards are being
adhered to by all homeowners, whether the residences are owner-or renter-
occupied. The following enforcement procedures have been adopted by the
Board of Directors:

1. All matters of non-compliance or deviations from the Design Standards


or other related matters will be confirmed by a site visit by the ACC or
property manager.

2. Initial notification will be in the form of a letter sent via United States
mail or electronic mail. If the occupant is a renter, two (2) letters will
be mailed, one (1) to the residence and one (1) to the owner.

3. If the matter of non-compliance is not resolved within the number of


days stated in the initial notification letter, the violation will be turned
over to the Board of Directors for possible assessment of monetary
sanctions and/or legal action.

A homeowner who does not reside in the Community has the responsibility of
informing the Association of any change of address. If the owner fails to
provide a proper forwarding address or to update any changes to that
address, the mail sent to the residence shall constitute notice for purposes of
enforcing these Covenants.

Property owners are responsible for maintenance of all structures and
grounds on their property. This includes, but is not limited to, such activities
as mowing grass, weeding, trimming shrubbery, removing trash, refurbishing
damaged wood trim, painting faded house trim, and removing stains from
cement porches or walkways, as well as other structural maintenance in a
manner that will ensure the overall appearance of the property is in
compliance with its original design and that of neighboring properties.

Any matter of non-compliance as outlined in the Design Standards is deemed


as a violation of the Covenants.

1. Dwelling and Structures. Homeowners are responsible for maintaining


the exterior of their dwellings and any other structures on their lots,
such as decks, fences, sheds, and playground-type equipment. While it
is sometimes difficult to provide precise criteria for what the
Association deems as unacceptable conditions, the following examples,
though not all-inclusive, represent some of the conditions which would
be considered a violation of the Covenants:

a. Peeling and/or faded paint, dry rot and water damaged wood.
b. House trim, shutters, front door and/or garage door not painted
with authorized color and finish. Playground equipment which is
either broken or in need of repainting/refurbishing.
c. Fences with either broken or missing parts.
d. Fences and/or decks stained with non-approved stain or pigment
that is not authorized.
e. Concrete porches and steps sealed with noncompliant clear or
pigmented sealers.
f. Wooden patios/decks with missing or broken parts, or parts that
are stained with mold, or wood that is rotted, or is dry, cracked
and warped, or is otherwise in need of treatment or re-staining.
g. Sheds which are either in need of repair or painting.
h. Foundations in need of repair.
i. Dented, warped, scraped, broken, loose or missing siding,
window screens, shutters or garage doors.

Most residents would not allow any of the above conditions to exist, as they
seek to preserve and protect their investment in their homes and to limit
their personal liability by keeping all

improvements on their lots in good condition. The Association expects that


homeowners will perform all maintenance necessary to prevent any of the
cited conditions from occurring within the Community.

2. Mowing/Yard Care/Planted Beds. See Section X.

3. Lawn and Garden Fertilization. Homeowners need to properly care for


their lawns, plantings, and trees by adequately watering and feeding
them to ensure they are maintained and not overgrown, browned out
or otherwise unattractive. Special care should be taken not to over-
fertilize, or to fertilize lawns and planting beds and the like where
harmful runoff may occur.

4. Trash Removal. Residents are responsible for picking up litter on their


property as well as debris found on common areas/open space which
originated from their property. Removal of trash and debris from all
Community areas accumulating from resident usage will be completed
as necessary. The removal of scattered trash comes at a cost to the
Association, which could potentially increase the dollar amount of
assessments. However, voluntary neighborhood cleanup, in addition to
controlling litter at the source, saves everyone money, and improves
the appearance of our neighborhood, which can result in the reduction
of the potential occurrence of neighborhood criminal activity. Such
attention to keeping the Community free of uncontrolled trash will
exhibit the vigilance of the homeowners who are observant and care
about their property, all of which can result in an overall increase in the
value of Community properties.

5. Erosion Control and Drainage Management. Homeowners are


responsible for ensuring their lots are protected from erosion and
uncontrolled run-off, and that storm drains are not blocked so as to
cause additional erosion problems. Homeowners are also responsible

for maintaining proper drainage through their property, and for not
blocking or hindering natural drainage from adjoining properties

6. Pesticides and Herbicides. Pesticides and herbicides may be applied


according to label instructions for the specified problem or application.
Emphasis should be placed on organic/biodegradable materials to
ensure the least harm to the natural environment and common
areas/open space of our community. Care in application of such
chemicals is extremely important. Avoid the use of pesticides and
herbicides if at all possible, but when necessary, use with caution and
follow instructions.

EXTERIOR ALTERATION DESIGN STANDARDS

As noted above, alterations must be preapproved by the ACC. Alterations are


generally considered to be those which visually alter the exterior of the
existing structure, either by subtraction or addition or other changes from
the original construction Design Standards established by the developer.
Building alterations include, but are not limited to, screened porches, decks
and fences, painting of any exterior surface that deviates from the original
color and finish, and landscaping changes such as tree removal or changing
the existing pattern of shrubbery. It is the homeowner's responsibility to
comply fully with Jackson County Building Codes to include obtaining the
proper building permits and other necessary documents. This material is
required to be submitted with the Architectural Review Request to the ACC
for review and approval.

The design of alterations of any type should not diverge from the original
construction Design Standards established by the developer in scale,
materials and color with the applicant's house and adjacent homes or other
units that may be impacted. The location and type and design of materials to
be used for such alterations should not impair the views or amount of
sunlight and natural ventilation on adjacent properties.

Installation of new windows and doors should not diverge from the original
construction Design Standards established by the developer concerning the

type used in the applicant's house, and should be located in a manner which
will relate well to the location of existing exterior windows and doors.

If changes in grade or other conditions which will affect drainage are


anticipated, they must be specified as such. Approval will be denied if
adjoining properties are adversely affected by changes in drainage.

Construction materials must be stored so that impairment of views from


neighboring properties is minimized. No construction materials are to be
stored on common areas/open spaces. No construction materials or other
debris may be allowed to accumulate during construction. Excess material
should be immediately removed after completion of construction.

Application Contents

Architectural Review Requests are required for all exterior changes to


property or houses that diverge from the original construction design
established by the developer, or that visually alter the exterior appearance
of the property in any substantive manner, consistent with the Design
Standards outlined in this manual. Application forms can be obtained from
the property manager and shall include:

1. Site plan showing location of proposed structure and relationship to


property lines and adjacent houses.

Sections A through JJ below highlight specific Design Standards criteria and


required application contents for various exterior alterations. If required
application content information is not readily defined in the following
sections, please consult the generic Application Contents, Items 1 through 6,
presented above or the property manager. It is highly recommended that
homeowners submit an Architectural Review Request for review and approval
by the ACC before making any exterior improvements, changes or general
upkeep concerning painted surfaces, rails, stoop and stair repairs, fences,
decks, sheds, landscaping, storm doors, changes in house numbers, lighting,
etc; as this may save great expense to the homeowner in returning a
property to a condition that is in compliance with the Design Standards.

A. Fencing and Gates

Application Required

Proper fencing can have a unifying effect upon a neighborhood, whereas


inadequate, poorly constructed fencing can detract from the community's
overall appearance. The preservation of common areas/open space and
natural features of the Community greatly enhances the appeal of the
neighborhood. Fencing carelessly constructed or poorly positioned can
encroach upon adjoining neighbor's property or common areas/open space.
An inconsiderately positioned fence can box in a neighbor or destroy his
view. All fencing must conform to the original construction design. Fencing
must be maintained by repairing missing or broken parts, and/or by power
washing or re-staining all wood surfaces using an approved clear,
translucent/transparent or semitransparent/semisolid stain as needed,
thereby maintaining its general structural integrity. Only those building
materials as described in the Design Standards Criteria below are permitted.
Fencing or screening of any type is not permitted in any front or side yard,
unless otherwise stated. Chain link and vinyl fencing are inconsistent with
the Design Standards and will not be approved under any circumstances.

Design Standard Criteria

Design elements must adhere to those established by the developer. For end
lots, fences will not be allowed to extend forward more than twelve (12) feet
from the back corners of the house.

1. The approved fencing style is a standard eight (8) foot high fence,
alternating 1X4 or 1X8 board-on-board size dictated by conformity with
other fences in your specific area of the neighborhood, with three (3)
2X4 horizontal rails, and 4X4 posts, spaced no more than eight (8) feet
on center, and 1X4 caps.

2. Side yard fences must extend to the rear property line when enclosing
the entire property.

3. No portion of a fence may exceed past the rear of a residence.

4. Rear property line enclosures with a gate measuring a maximum of


3'6" wide by 8' high must match the fence type as described above.

5. Fencing will conform to the existing grade. All fence heights are
measured from the existing grade unless a change in grade is
proposed in the current application.

6. All fence materials will either be cedar, pressure-treated (P/T) #2 pine,


or a better grade. Fencing boards must be finished on both sides.
Fencing may be left to weather naturally or treated with an approved
clear, translucent/transparent or semitransparent/semisolid stain only.
The wood treatment stain must allow the wood grain to remain visible.
Fencing shall not be painted. Opaque and solid finishes of any type are
prohibited.

7. Gates should be constructed with material compatible with fencing,


and be maintained using the same method as that for fencing.

sheds, etc., other appropriate sections of the Design Standards should be
considered during the completion of the Architectural Review Request. Each
design proposal requires a separate application. Decks must be maintained
by repairing missing or broken wood and/or hardware, cracked brickwork or
cement and/or by reapplying approved staining as needed, if not left to
weather naturally.

Decks and wood patios will either be cedar, pressure-treated (P/T) #2 pine,
or a better grade. All patio and decks will conform to existing grade and
slope. All deck heights are measured from the existing grade unless a
change in grade is proposed in the current application, Wood patios and
decking must be left to weather naturally or treated with an approved clear,
translucent/transparent or semitransparent/semisolid stain only. The wood
treatment stain must allow the wood grain to remain visible. Decks shall not
be painted. Opaque or solid finishes of any type are prohibited.

1. Ground Level Decks and Patios. Patios and ground-level decks will only
be permitted in rear yards, and may be constructed of poured
concrete, bricks, stone (flagstone/slate) or commercial paver tiles. Use
of gravel of any size or color is prohibited. Proper workmanship to
assure sound construction and attractive appearance is required.

A ground-level deck is specified as that of a height of twenty-four (24)


inches or less in elevation. Ground-level decks do not require
guardrails.

Compliance with Jackson County code is mandatory.

2. Elevated Decks. All elevated decks higher than twenty-four (24) inches
at the highest point above grade require guardrails. Guardrail height
which is measured from the deck floor shall be between thirty-six (36)
inches and forty-two (42) inches, with vertical pickets in addition to the
top rail.

Compliance with Jackson County code is mandatory.

2. Specification as to whether or not the under-deck area will be used for


storage. If so, the visual impact must be kept in mind. Elevated decks
include an under-deck area which has a visual impact on adjacent and
nearby areas. Storage must be maintained so as to present a neat and
uncluttered appearance. Indicate whether trellis work or solid walls will
be used. Solid walls must be treated as an exterior storage enclosure.
Approval must be obtained for under-deck storage

3. A description of material to be used. This description must include all


materials for ground level decks and patios, grading and drainage
changes. The owner must certify that drainage will not be adversely
affected by the installation of a patio.

4. Dimensions of railings, posts, stairs, benches, privacy lattice and other


details are required to clearly describe the proposal. Details of trellis
work and/or solid walls are required when applying for under-deck
storage. The application must include the deck, guardrail, and privacy
lattice styles.

5. Proposed treatment, whether transparent or semitransparent color of


stain, and manufacturer, if not allowed to weather naturally.

6. Estimated start and completion dates.

regardless of type must only be mounted to the rear side of roofs. They may
be flush or elevated, but either placement must not extend above the roof
peak or roof edges in order to prevent them from being visible from the
yards or facing houses across streets or pipe stems.

No other mounting locations are permitted without the prior written approval
of the ACC and the Board of Directors. If an owner seeks to install any solar
energy collection devices in a manner that is not consistent with these
Design Standards, the Association reserves the right to require the owner
applicant to have their solar installation expert attend any hearings before
the Board or ACC for the purpose of discussing the proposed application and
to answer any questions that may be posed by the Committee or Board
regarding the application. The applicant owner shall be responsible for any
costs associated with having their solar installation expert attend any
hearings before the Committee or Board.

property. An inconsiderately positioned or poorly designed enclosures can
have a negative effect on an otherwise desirable residential area. Therefore,

it is important to remember in choosing the type and determining the
location of an enclosure, there are requirements other than storage that
must be considered.

Design Standard Criteria

Storage containers or sheds must be positioned in rear yards in locations


which are the least visible from the street or other houses. Storage sheds or
containers shall be prefabricated and made of only metal, plastic, or wood
material. Prefabricated materials shall be neutral or earth-tone (excluding
white and orange tones) in color. A homeowner may build their own storage
container or shed; however, the outer walls and roofing shall match the
existing home in color and materials.

Storage containers shall be no greater than 12'X10'X8' in size. No portion of


the containers walls shall be higher than the privacy fence. In yards without
a fence, the storage container shall be placed in the least visible location
from the street and other houses.

Metal sheds or storage containers shall be maintained in order to prevent


rust. Containers in disrepair are not permitted and must be removed.

E. Greenhouses and Screened Enclosures

Application Required

Greenhouses and screened enclosures are only permitted in the rear ground-
level of a Residence. Architectural drawings are required for all greenhouses
and enclosures.

Architectural Review Requests for attached and detached greenhouses will


be reviewed with consideration to size, design, placement and materials.
Applications for attached greenhouses, screened enclosures or under-deck
screened areas will be reviewed as additions. Upper level screened
enclosures are not permitted.

An application will not be approved if the construction of any structure would


have a negative impact or effect on the Residence itself, or on adjacent
properties, or the Community.

Spas and hot tubs will only be permitted in rear yards and must be no closer
than five (5) feet to the rear property line. Spas and hot tubs cannot occupy

installed.

Design Standard Criteria

Recreational and play equipment must be placed in rear yards only and in
locations which are the least visible from the street and other houses.
Equipment such as badminton, volleyball nets, and trampolines shall be
stored when not in use. No permanently installed basketball backboards and
poles are permitted. Portable basketball hoops/goals must be stored in the
garage or rear yard when not in use and may not be visible from ground-
level view from any direction outside of the property. A playhouse must
conform to the same criteria as a shed. A playhouse is defined as a structure
with solid walls (with or without windows) and a solid roof. Recreation and
play equipment shall not be placed in the street or on community common
areas/open space.

H. Portable Window Air Conditioning Units and Exterior
Compressor Units

Application Required

Portable window air conditioning units extending from windows or


protruding from the existing structure are prohibited.

Additional exterior compressor units, which are typically installed on a level


pad on the ground, or the relocation of existing compressor units, may be
considered so long as they are also placed on a level pad on the ground near
existing units and do not have an adverse audible or visual impact on
adjoining lots or common areas/open space.

Application Required

For visually aesthetic purposes, the recommended location for antennas and
satellite dishes is on the rear roof of the house with its highest point below
the peak of the roofline. Note that installers are notorious for telling
homeowners that a certain location is essential for good reception which is
usually a location near the ground, thus making it easier/faster for the

installer to complete the work. If you insist on a location that may be more
aesthetically pleasing for you and your neighbors, and is in compliance with
the Design Standards, installers will generally comply, but will always opt for
the "easiest, most accessible" location under the pretense of ensuring better
reception. The Association has found that a "roof' location is often not
favored by the installer due to the difficulty it presents.

All wiring for antennas and satellite dishes must be properly secured. Wiring
must not be readily visible from public areas outside the residence,
otherwise, it may be required to be concealed. It is the homeowners
responsibility to ensure the provider of cable television service takes
appropriate action to bury/conceal underground cables. This includes cables
that run from connection boxes in common areas/open space to inside the
homeowner's property line.

J. Attic Ventilators and Metal Flues

Application Required

Attic ventilators and turbines are permitted. However, they must be similar
to the color of the siding or trim on the house if mounted on a gable end, or
they must match the roof color if placed on a roof and should not extend
above the roofline. Roof location shall be on the least visible side of the roof
peak. Large metal flues and any vent through the roof must be similar to the
roof color if placed on the roof.

K. Chimneys

Application Required

Chimneys may be masonry or enclosed. Chimney caps must be painted, and


all venting through the roof must match the roof color. Enclosed chimneys
must be made of the same materials and same color as the house siding.

L. Clotheslines and Airing of Laundry

No exterior clotheslines or other exterior clothes drying apparatus shall be


permitted on any lot. No clothing, laundry or fabric household items shall be
aired or dried on any portion of any lot to include decks, fencing, railings,
and steps.

M. Compost Piles and Containers

Compost piles and containers are prohibited.

N. Pets

All pets must be kept under the control of their owner at all times, and when
outdoors are not allowed to wander onto other homeowners' property for any
reason, whether or not the dog is on a leash. Such disregard in respecting
other people's property will not be tolerated. Pet-related activity can destroy
grass, shrubbery and bedding.

O. Dog Houses and Dog Runs

Dog houses and dog runs are prohibited.

P. Beekeeping

Beekeeping, whether as a recreational activity or commercial occupation or


otherwise, is prohibited within the Community.

Q. Exterior Decorative Objects

Application Required

The Design Standards for exterior decorative objects include those that are
both seasonal and non-seasonal. Objects will be judged based on, but not
limited to, type, size, color, location, and aesthetics in relation to the house
and surrounding properties. Approval is required for all exterior decorative
objects, including both natural and man-made. Exterior decorative objects
include, but are not limited to, plaques, bird baths, wagon wheels,
sculptures, window boxes, fountains, pools, stumps, driftwood piles,
boulders, free standing poles of all types, and items attached to approved
structures.

Reasonable holiday decorations and those used for other observances are
exempt from these requirements. The Association encourages the display of
such decorations that make the neighborhood appear friendly and festive.
These decorations do not require an application, but must be removed no
later than fifteen (15) calendar days after the holiday/observance.

Items located within an enclosed side and/or rear yard will be allowed and do
not generally require prior approval unless they may be viewed from any
ground level view outside the property.

An application is required for use of exterior carpets which are permitted only
on patios and decks. The only colors permitted are those of a natural earth or
medium to light brown, or shades of green. It should be noted that brightly

R. Exterior Lighting and Electronic Insect Traps

Application Required

Replacement of porch or entryway lighting on the front of a home must


substantially match the original construction design established by the
developer.

Walkway, garden, or other ground-level lights must be unobtrusive in nature,


with a black or dark green finish. Lighting in the front or rear yard must be
placed so that the light does not shine outside the property in a manner
which could disturb neighbors. In particular, care must be taken in arranging
the angle of a spotlight. Sodium or mercury vapor lights/lamps are prohibited
unless they are approved by the ACC or the Board of Directors for areas
requiring extra security for Community residents.

Flood/spot lights are not allowed in front of homes. Rear and side installation
is allowed but must be placed so that light does not shine outside the
property in a manner which could disturb neighbors. By exception,

wooded areas or Community property to enhance security of the overall
Community.

Electronic insect traps will be regulated based on the same criteria as


exterior lighting. In addition, no device shall be installed or maintained in
such a way as to cause discomfort from noise to adjacent homeowners.
These devices may be operated only during those times when the residents
and/or their guests occupy the immediate area protected by the trap.

S. House Numbers

Application Required

House numbers may only be replaced with the current style and size or
substantially similar to those installed by the builder. The only authorized
colors for house numbers are black or brass. Changes to the product type of
street numbers must be preapproved by the ACC. House numbers which are
displayed as written numbers as opposed to numerals are not permitted.
House numbers must be in full view from the street.

T. Exterior Painting

Application Required

It is the homeowner's responsibility to ensure the construction paint color


and paint scheme established by the Association is adhered to. This includes
front and rear doors, all wood trim, shutters, garage doors. Permissible colors
include whites or natural earth tones. Exterior colors shall be in harmony and
compatible with the Community. If a homeowner is performing upkeep of the
residence and applies the exact color and type of paint already established,
no prior approval by the ACC is required.

Use of any other type and/or color of paint including attempts to match the
compliant color professionally or by "guess," could result in a poor match and
may result in the homeowner having to repaint the areas of non-compliant
color with the approved type and color of paint at the homeowner's expense.

No cement steps, sidewalks or driveways may be painted unless specifically


authorized by the ACC to repair a construction defect. Concrete stoop and
step sealing can only be performed if the sealant is clear or the solid color is
approved by the ACC. Any clear product can be used. However; the
homeowner must submit a completed Architectural Review Request for
approval by the ACC.

For durability and maintenance of the initial appearance of the applied


product, an application of epoxy sealer is recommended after curing.

An application is required for all changes in exterior colors from the original
color. In addition, applications for color changes also apply, but are not
limited to, vinyl siding, doors, shutters, trim, decks, and any other exterior
appurtenant structures. Change of exterior color must match the
environmental structure of the home in order to be approved by the ACC.
Doors, shutters, and trim may be repainted colors other than original as long
as the change is preapproved and the proposed color matches existing colors
already established by the ACC. Concrete front stoops and stairs, rear slabs,
sidewalks, and driveways may not be painted.

Application Contents

U. Firewood

Storage of a reasonable amount of firewood does not require approval so


long as it is not visible from any ground-level location surrounding the
property. A stack measuring two (2) feet wide by six (6) feet long by four (4)
feet high is considered reasonable.

Firewood stored on property without a rear fence or visible from a ground-


level location surrounding the property requires approval by the ACC. The
application for storage of firewood in this situation must designate the
location on the property plat and shall have the signature of two (2)
neighbors possibly impacted by the storage.

Firewood shall be kept neatly stacked and located in the rear of the
residence, within the homeowners property lines. Under no circumstances
shall firewood be stored on common areas/open space. Piles longer than six
(6) feet should be a minimum of two (2) rows deep. Firewood piles must
contain only stacked firewood. Stacks of firewood can attract pests and must
be frequently inspected by the homeowner/resident. Firewood with clear
evidence of ants, termites, and/or other pests to include rodents must be
removed immediately. If the condition of the firewood is deemed safe, then
immediate corrective action must be taken by the homeowner/resident to
eliminate the possibility of the return of like pests in and around the
firewood. In all cases the location of stacked firewood should be in such a
manner as to minimize its visibility. In certain instances, (e.g., where the

fencing of the rear property may be required. Firewood cannot be used to
create a fence or barrier between properties.

V. Flagpoles

No permanent, free-standing flagpoles shall be permitted within the


Community. Temporary flagpole staffs, which do not exceed six (6) feet in
length and are attached at an angle to the front of a dwelling within three (3)
feet of the front entrance, do not require prior approval by the ACC.

W. Gutters and Downspouts

All homes must have gutters and downspouts installed that match the color
and design of those in existence within the Community and must not
adversely affect drainage on adjacent properties or common areas/open
space. Drainage must flow away from the house.

X. Shutters

All windows with adequate space on the front of a home shall have shutters
installed that are of a harmonious color with the homes exterior color and of
a design that matches those in existence within the Community.

Y. Maintenance of Landscaping, Grass, Bedding, and General Yard


Care

Maintenance of all landscaping requires continuous upkeep. This includes,


but is not limited to, grass, ground cover, planting beds, trees, shrubs,
plants, and borders.

Grass areas need to be mowed at regular intervals to ensure that a neat


aesthetic appearance is
maintained. The height of grass exceeding six (6) inches is not permitted.
Dead turf or bare areas must be reseeded or replaced with new turf. Yards
must be free of weeds, twigs, leaves, tree/shrubbery clippings, and tall grass

clippings resulting from weed eating or mowing. Front and side yards are to
remain as grass or grass with plant bedding.

Planting Beds must be well maintained and kept in a neat, orderly manner,
including removal of weeds, dead plantings, twigs, leaves, unused stakes,
trellises, and the like. Dead and damaged plantings should be replaced with
the same or similar plantings. If mulch is used, only earth-tone (excluding
white and orange tones) colors, to include red-tone cedar mulch, are
permitted. An application is not required for replacement of the same or
similar mulch.

Trees, Shrubs and Plants must be pruned to maintain a neat and orderly
appearance. Trees and shrubs are not to infringe on adjacent properties by
extending over property lines, or common areas/open space. In addition, tree
limbs must not interfere with sidewalk use in which branches hang too low to
impede normal passage of foot traffic. With respect to trees planted in front
yards, it is important to keep the limbs trimmed to ensure clear visibility of
house numbers that may otherwise be hidden from view from the street.
Emergency responders must be able to easily read house numbers when
responding to an emergency situation.

No healthy tree shall be removed from any lot without prior written approval
by the ACC. Dead trees, shrubs, and stumps must be removed and replaced
with the same or similar plantings. An application is not required for shrub
plantings that replace existing shrubs with similar types of plants. Planting of
all new trees must be approved by the ACC since the root systems of some
trees can damage foundations, sidewalks, sewage, and home drainage
systems, thereby impacting the Community as a whole. Consideration should
be exercised in determining the location of the planting and maintenance of
trees and shrubs to prevent obstruction of sight lines for vehicular traffic,
pedestrian use of sidewalks, and neighboring property. The views of
neighboring units and shade patterns of larger trees should always be taken
into account.

Vine Growth and Other "Runner" Ground Cover of any kind are not permitted
to grow on houses,

downspouts, railings, sidewalks, stoops, or common fence sections to include
those adjacent to common areas/open space. Non-invasive ground cover
may be placed in landscaping areas, but ground cover cannot, under any
circumstances, replace lawns. Property owners are responsible for the
selection and use of proper ground cover and grasses. In no instances shall
harmful, invasive ground cover be used on any property or in common
areas/open space. This includes, but is not limited to, ivy, bamboo, creeping
Saint Johns wort, periwinkle, and vegetable garden vines.

Borders of any type require an Architectural Review Request and ACC


preapproval with respect to front and side yards. Borders are limited to a
single row of bricks or pre-formed landscape masonry, metal or hard plastic
edging specifically designed for landscape use. Authorized colors permitted
for borders include those of earth-tone (excluding white and orange tones)
color palettes and dark green. Installation of rear yard borders when the yard
is not totally enclosed by a fence with a gate requires an application. This
includes a border extending the length of the rear property line.

Application Required

An Architectural Review Request is required for major landscape design


changes to any home. This includes, but is not limited to:

1. Changing the shape of the planting beds, expanding or decreasing the


size of the planting beds.

2. Changing the ground-cover of the beds or turf.

3. The planting of more than three (3) "new' shrubs or plants. A "new'
shrub is defined as a shrub that has been added to a site that is not
replacing previously approved shrubs already on site as discussed
above.

4. The planting of a tree in the front, side, or back of a yard.

5. The removal of a dead or alive tree.

structures, fences, or screens, and as part of other applications where
required.

7. Landscape materials to include, but not limited to, trees, shrubs, or


plantings which form a wall or border over a height of twelve (12)
inches or at a length of eight (8) or more feet.

A completed application is required and must include:

1. Site plan showing relation of proposed landscaping to adjacent


property lines, applicant's house and adjacent houses.

2. Photograph and/or sketch of proposed landscaping

3. Dimensions of landscaping site.

4. Description of proposed landscaping materials.

6. Signatures of property owners most affected by the proposal.

Rock Gardens are prohibited as a form of landscaping in front, side of rear


yards. An Architectural Review Request must be submitted for collections of
rocks and single rocks exceeding a single measurement of twenty-four (24)
inches, whether measured by length, width, or height in the rear area of a
home. All rocks shall be left in their natural earth-tone color.

Vegetable Gardens are prohibited in both front and side yards. Vegetable
gardens are permitted in the rear of the unit without prior approval provided
they meet the following criteria:

1. They are located inside the physical rear property line of the house.

2. Its size does not exceed 1/4 of the area inside the physical boundaries
of the rear yard.

3. Watering and the resulting drainage does not damage other properties
as a result of the direction of the flow of water.

4. The plants do not exceed the height of any adjacent fence or grow into
neighboring property or open space/common areas.

Application Required

An Architectural Review Request is required for any style and/or type of


vegetable garden that does not meet the above described criteria.

Dumping of debris or lawn clippings on open space/common areas is


prohibited.

Garden Hoses when not in use must either be kept in the garage, rolled up
around its containment device or must be rolled up and placed next to the
house foundation.

Unattended, Loose Objects including, but not limited to, toys, bikes, brooms,
rakes, shovels, barbeque equipment, patio equipment, patio furniture, lawn
chairs, garbage cans, and recycling bins must not be left or stored in front or
side yards when not in use. The use of interior furniture, particularly
overstuffed furniture, on patios, decks, stoops, and in yards is prohibited.

Z. Barbecue Grills, Barbecue Pits, Chiminea, Fire Pits, and Patio


Heaters

Permanent BBQ Grills and Barbecue Pits are prohibited.

Propane fueled BBQ grills greater than 40,000 BTU and 1,300 BTU
side burners are prohibited.

BBQ Grills when used on wood decks, must be placed on a flame-retardant
grill mat measuring a minimum of forty-four (44) inches by thirty (30) inches.
This practice is required to protect not only your home, but also adjacent
homes, from the possibility of fire. When not in use, all BBQ grills must be
covered.

Chiminea made only of cast aluminum, wood or charcoal-burning equipment


is permissible. Use is limited to ground-level patios or ground-level decks.
Chiminea must not exceed forty-eight (48) inches in height and twenty-one
(21) inches in width, and must include a safety screen and safety door. Any
Chiminea must be placed on a flame-retardant grill mat measuring a
minimum of forty-four (44) inches by thirty (30) inches.

Fire pits are only allowed in the rear yard and considerations will include, but
are not limited to material, design, size, and proximity to neighboring
properties. A minimum of ten (10) feet from any structure or combustion
source is required as is a minimum of five (5) feet from any property line.

Patio Heaters

Portable patio heaters with a heat capacity greater than 41,000


BTUs are prohibited.

Portable propane patio heaters shall only be used in well-ventilated outdoor


areas on stable, level ground. They shall be kept clear of overhead coverings,
such as awnings and shade sails. Clearance shall be at least eighteen (18)
inches from any ceiling/overhang and twenty-four (24) inches from any wall.
Heaters will not be used underneath any upper deck. Heat coverage will not
exceed a ten to twelve (10-12) foot diameter, a six to seven (6-7) foot radius,
and a total height not to exceed eighty-seven (87) inches. Only models with
electric starters and anti-tilt shut-off devices are permitted, because they
allow the flow of gas to be cut off immediately if the heater is knocked or
blown over.

No signage of any type shall be displayed on common areas/open space
without prior written approval by the ACC. Signage displayed for public view
on lots shall be limited to real estate signs, security system signs, and
garage sale signs. Signage announcing events shall be removed in a timely
manner at the end of such event. Care must be provided to ensure signage is
secure and does not become litter.

AB. Pathways and Walkways

Application Required

Pathways/walkways made of slate, flagstone or concrete pavers are


permitted. Pathways/walkways are required to be set back at least two (2)
feet from the property line and are to be installed flush with the ground.
Pathways/walkways will not exceed twenty (20) inches in width at any given
point.

The use of loose stones, gravel, concrete, asphalt or mulch as a


pathway/walkway is prohibited.

Pavers other than natural color will not be approved by the ACC. Resurfacing
or realigning of existing walkways requires an application.

Application Contents

A completed application is required and must include:

1. Site plan showing the exact location of the pathway/walkway in


relation to the location of the lot, existing sidewalks, driveway, bedding
and all other exterior physical elements of the property to include
those that may impede construction.

2. Description of the type of materials to include color(s) to be used. If


using brick, the color should match the brick on the house if the house
is constructed of brick. If not, the color should be congruent with its
natural landscape surroundings.

AC. Storage of Boats, Trailers, Campers, Mobile Homes,


Recreational/Commercial Vehicles, Automotive Equipment, and
Parts.

Recreational Vehicles

No recreational vehicle may be parked or stored in open view on residential


property, streets, or on common areas/open space. A "recreational vehicle" is
defined as:

1. Any boat or boat trailer.

2. Any motor home or other self-contained camper.

3. Any camper slip-ons not mounted on the vehicle.

4. Any mobile home, trailer or fifth-wheel trailer.

5. Any pop-up camp/tent trailer or other similar recreation-oriented


portable or transportable facility or conveyance.

6. Any other vehicle not defined above which could not normally or
regularly be used for daily transportation, including, but not limited to,
dune buggies, non-operative automobile collections, or other
automotive equipment or parts not licensed for use on roadways in the
State of Georgia.

7. If a truck-mounted camper is to be a homeowner's primary means of


transportation, it shall not be considered a recreational vehicle,

providing it meets the following conditions: (a) it is parked within a
garage or driveway; and (b) if the camper is removed, it shall be stored
in an area screened from all surrounding property.

Commercial Vehicles

No commercial vehicle may be parked or stored in open view on residential


property, streets, or on common areas/open space except as provided
herein. A "commercial vehicle" is defined as:

1. Any vehicle defined as a commercial vehicle by Jackson County Code.

2. Any vehicle that has commercial signage or advertising or visible


commercial equipment, excluding public service vehicles.

3. Any private, school or church buses.

4. Any oversized vehicle, including, but not limited to, box trucks, tow
trucks, moving vans, semi-tractors and trailers, equipment trailers,
stake trucks, flatbed trucks, vehicles with ladder racks/equipment
racks on the top/sides, and construction vehicles.

Commercial vehicles are permitted to be parked in the Community if the


vehicle resembles residential automobiles, SUV's, and pick-up trucks that are
used for daily transportation of their owners and whose signage remains
covered.

Motor Vehicles

No portion of a homeowner's property or Community common areas/open


space property shall be used to facilitate the repair and/or storage of motor
vehicles of any kind. Motor vehicles, including motorcycles, may be parked
only on designated paved parking areas. All motor vehicles including, but not
limited to, trail bikes, motorcycles, dune buggies, ATVs, and golf carts shall
be driven only upon paved streets and parking lots. No motor vehicles shall
be driven on sidewalks, pathways, or common areas/open space except such
vehicles that are authorized by the Association as needed to maintain,

repair, or improve the Community's common areas/open space. A motor
vehicle shall only be allowed on the common area/open space by the lake for
the purposes of loading and unloading a boat.

AD. Storm Doors

Application Required

Storm doors require prior approval by the ACC.

Front and side storm doors must be full-view doors with clear, uncolored
glass. Doors must be without ornamentation such as, but not limited to,
stained or etched glass, scrolls, imitation gate hinges, ornamental grillwork
or scallops. Simple etched borders, metal inlays and trim are acceptable. The
color of front and side storm doors must match the color of the surrounding
exterior door trim, or be the same color as the entry door behind it. Rear
storm doors are not required to meet these criteria if the rear yard is
enclosed by a fence and the door is not visible at ground level. However, if
the rear yard is not enclosed, the rear storm door must either be a half-view
door or full-view door depending upon the specifics in construction of the
rear door for that particular residence. In this case, the color of the rear
storm door must match the color of the surrounding rear door trim. Simple
etched borders, metal inlays and trim are acceptable. Security doors,
incorporating bars or ornamentation such as scallops and scrolls, are
prohibited.

AE. Awnings, Canopies and other Sun-Control Devices

Application Required

Sun-control devices require preapproval by the ACC. Reflective materials, tin


foil, and tinting on windows is prohibited. The manner in which sun-control is
implemented can have a significant effect on the exterior appearance of a
residence and the desirable benefits of sun exposure in the spring, fall, and
winter. Sun-control devices must be compatible with the architectural
character of the house in terms of style, color, and materials. Trellises should
be consistent with the design of the houses to which they are attached. The
location of any trellis must not adversely affect views, light, winter sun or
natural ventilation of adjacent properties. Solid colors are required. Trellis
work must match the trim or deck if part of the deck, or match the dominant
color of the applicant's house.

Fixed position awnings are prohibited.

Retractable awnings are permissible if the application demonstrates that the


awning shall be clearly compatible with the Design Standards and the
congruousness of the home. The retractable awning must meet the following
criteria:

1. The awning is located in the rear yard as part of a deck or patio design.

2. The awning is of a plain design without decorative features.

3. The awning's color is compatible with the color scheme of the house.

4. The awning must be consistent with the visual scale of the house to
which the awning is attached.

Application Contents

A completed application is required and must include:

1. Site plan showing location of sun-control device, trellis and/or


retractable awning.

2. Sketch and/or photograph of house and adjacent properties affected by


your device.

3. Sketch, photograph, or manufacturer's product information of proposed


sun-control device including dimensions, construction details showing
how the retractable awning or trellis is attached to the house,
materials, and color. In the case of retractable fabric awnings,
submissions of the material and color must be included.

4. Estimated start and completion dates.

5. Signatures of property owners most affected by the proposal.

AF. Trash Cans and Recycling Bins

Only trash containers with lids or recycle bins are permitted. Trash and
recyclables shall not be placed at the curb for pickup prior to 6:00 p.m. or
dusk, whichever comes first, the evening before the day of collection.
Cardboard boxes, which are too large to be placed inside a trash can, must
be broken down to lay flat. Newspapers, magazines, flattened boxes and the
like need to be stacked. Contact your trash collection company for details
regarding pick-up of oversized and bulk items. Emptied trash cans and
recycle bins must be removed from the location of trash/recycle collection no
later than the evening of trash day. Storage of trash cans and recycle bins
are not permitted to be stored at any time in front or side yards.

No accumulation or storage of items such as trash, new or used building
materials, appliances, furniture or other items, shall be permitted on any lot.
Every resident is responsible for picking up litter on their property. Similarly,
every resident is also responsible for preventing wind-blown or otherwise
scattered debris that has originated from their property or from the location
where they place their trash/recyclables on designated trash pickup days to
be left for others to pick up. This includes trash that has been scattered due
to foraging wildlife (raccoons, crows, etc.).

AG. Tree Removal

Application Required

Approval is required from the ACC prior to removing any tree with a trunk
diameter of over two (2) inches. This rule applies unless the tree poses a risk
to others or any other residences home (e.g., a storm-damaged tree leaning
toward a sidewalk or home.)

Residents are advised to consult with Jackson County for compliance


with county ordinances on tree cutting.

Dead trees may only be replaced with the same or similar type of tree as the
original trees planted. A tree of reasonable size must be planted.

Any deviation must be preapproved by the ACC.

AH. Use of Common Areas/Open Space

In accordance with the established Covenants, an application is required for


any use of common areas/open space to include use of land for the
temporary storage of construction materials, yard sale, cookout, community
activity, etc.

AI. Windows and Patio Doors

Property owners are responsible for the maintenance and upkeep of all
windows, to include window screens and patio doors. This includes, but is not
limited to, repair of torn, stressed, broken or bent frames, as well as
replacement of missing or damaged glass and screens. Any replacement
window or patio door or any screens that do not substantially match the
original developer design must be preapproved by the ACC prior to
installation.

If in doubt, homeowners should seek the ACCs advice and approval before
replacing windows and screens. This action will avoid costly changes in
bringing non-conforming replacements into compliance.

II. Portable-on-Demand Storage Units (PODS)

PODS are not allowed to be used for storage on any part of a homeowners
property. However, temporary placement while loading or unloading of the
container is permissible with prior approval from the ACC. All such requests,
if approved, will be for a period of five (5) consecutive days.
