theGeneralAgreementonTariffsandTrade(GATT).TheURAArestoredcopyrightinforeignworksthatasof1January1996hadfallenintothe

publicdomainintheUSbecauseofafailuretocomplywithUSformalities.OneoftheauthorsoftheworkhadtobeanonUScitizenorresident,

theworkcouldnothavebeenpublishedintheUSwithin30daysafteritspublicationabroad,andtheworkneededtostillbeincopyrightinthe

countryofpublication.SuchworkshaveacopyrighttermequivalenttothatofanAmericanworkthathadfollowedalloftheformalities.Formore

"unpublished"intheUS,andhencehavethesamecopyrighttermasunpublishedworks.ThedecisionhasbeenharshlycriticizedinNimmeron

Copyright,theleadingtreatiseoncopyright,asbeingincompatiblewithpreviousdecisionsandtheintentofCongresswhenitrestoredforeign

copyrights.TheCopyrightOfficeaswellignorestheTwinBooksdecisioninitscircularonrestoredcopyrights.Nevertheless,thedecisionis

currentlyapplicableinallofthe9thJudicialCircuit(Alaska,Arizona,California,Hawaii,Idaho,Montana,Nevada,Oregon,Washington,andGuam

andtheNorthernMarianaIslands),anditmayapplyintherestofthecountry.
