The NHA Supports House Bill No. 130 introduced by Rep. Gus S. Tambunting and House Bill No.

157
introduced by Rep. Jose Christopher Y. Belmonte. However, we have comments on certain Sections
of House Bill No. 130:

SECTION 7. par. 4. Investigate motu proprio or upon complaint by any party, any violation of
the provisions of Section 28 of RA 7279 or its implementing rules and regulations;

Will there be no conflict on the part of Presidential Commission for the Urban Poor (PCUP),
considering that they are one of the parties involved in the Demolition process?

SECTION 7, par. 5. File motu proprio or by way of assistance to any aggrieved party, the
appropriate criminal, civil or administrative case against any person or persons found to
have violated the provisions of Section 28 of RA 7279 or its implementing rules and
regulations.

Section 45 of RA 7279 speaks of the Penalty Clause in case of violations of ANY of its provisions.
Therefore, what we need is a sunset review of RA 7279.

IN GENERAL, some of the provisions of this House Bill No. 130 already exist in RA 7279 and there is
no need to pass a new law with regard to the Demolition and Eviction. What we need is an
amendment of some of the provisions of RA 7279 specifically Section 28 in order to ensure proper
practice of eviction and demolition.
