In November 2016, April Mathis, a Case Coordinator in the office of the 20th Judicial District
Prosecuting Attorney in Conway, AR, used her official position to obtain sealed, confidential
court records from the State of Montana for her own personal use and benefit.

On or about November 22, 2016, Mathis contacted the office of the District Court Clerk for
Flathead County, Montana by telephone and made an inquiry about obtaining certified copies
of filings in a case that had been heard in that jurisdiction - Jessica Collier vs. Justin Collier, DR-
15-195.

Mathis spoke with Lyndsay Muscutt, an employee of the Flathead Co. District Court Clerks
office at that time. Mathis provided her work email address for Muscutt to send a listing of
case filings so she could determine what documents she needed. Based on information and
belief, Mathis related or implied to Muscutt that she was calling in an official capacity. See
Exhibit 1.

What Mathis failed to disclose to Muscutt was that Jessica Collier, a party in that action, was
now Jessica Mathis who is married to her ex-husband Dustin Mathis. Furthermore, the Office of
the 20th Judicial Prosecuting Attorney had no active investigation or open case regarding Dustin
or Jennifer (Collier) Mathis. And if it did, Mathis would certainly not be involved in that matter
in any fashion. Mathis wanted these sealed, confidential records for her personal use and
benefit.

On December 1, 2016 Mathis sent an email to the Flathead County District Court Clerk, again
using her work email account, requesting certified copies of records from Collier v Collier DR-
15-195. Mathis use of her official tile and office along with the Arkansas State seal clearly gave
the impression that this was an official request for records. See Exhibit 2.

Honoring what was conveyed as an official request, the Flathead County District Court Clerk
sent certified copies of the sealed and confidential records to Mathis at her work address.

On January 4, 2017, Rachel Woods with the Flathead Co. District Court Clerks office sent
Mathis an email asking her to remit payment for the certified documents mailed to her back in
December 2016. See Exhibit 3.

Mathis subsequently remitted a $46.50 payment using a MoneyGram (#20714054122). She

listed her name as A. Mathis and as the firm or company she listed A. Mathis and used her
residence address. The MoneyGram cleared on January 12, 2017. See Exhibit 4.
On March 16, 2017, Mathis was deposed in connection to her own domestic relations case, D.
Mathis v A. Mathis, 23DR-2015-65. Under oath, Mathis denied obtaining the sealed confidential
records concerning her ex-husbands wife using her work email address. See Exhibit 5. Mathis
perjured herself to conceal her unlawful activity in the false assumption that it would never be
discovered.

I believe that a preponderance of the evidence supports a finding by the Commission that April
Mathis violated Arkansas Code Annotated 21-8-304(c) and Arkansas Ethics Commission Rules
on Conflicts 401 - Confidential Information, in that the use or disclosure of confidential
information gained because of her position and the use of such information for her personal gain
or benefit is a violation of those rules and law. Mathis deliberately used resources of her official
position as a public employee to fraudulently obtain sealed confidential court records from the
closed divorce proceedings of Jessica Collins, now Jessica Mathis, the wife of her ex-husband
Dustin Mathis.
