PETITION

THE PETITIONER, by the undersigned counsel and

unto this Honorable Court most respectfully avers:

1. Petitioner is a Filipino citizen, of legal age, sister of the

decedent and a resident of Unit 23B, Mark Laya
Condominium, Andres Bonificio Avenue, Iligan City and
named as executor in the will of the decedent;

2. On October 20, 2016, deceased ARTEMIS MEOW UY

died, having previously executed a notarial will, in
accordance with the formalities of law, and in a
language known to him, at his last known residence, at
Purok 8B, Brgy. Santiago, Iligan City. A copy of the will
is attached as ANNEX A;

3. That the authenticity and due execution thereof have
been attested to by the attesting witnesses, namely,
RICKY A. DELA CRUZ, of legal age, single, Filipino
and a resident of Room 3, PRP Condominium, Rik
Torres Avenue, Iligan City; RICH B. DELA CERNA, of
legal age, single, Filipino and a resident of Phase 4,
Block 3, Lot 8, Livin Lavida Loca Subdivision, Iligan
City; and RON C. DELA VICTORIA , of legal age,
single, Filipino and a resident of Phase 2, Block 4, Lot
15, Jejemon Village, Iligan City;

4. The names, ages and residences of the heirs, legatees

and devisees of said decedent are as follows:

PATRICE MAE W. UY 22 years old Iligan
City

5. That the property left by the decedent consists of real

and personal property, estimated to have the gross
value of FIFTY MILLION PESOS
(Php50,000,000.00) more or less;

6. That the testator, at the time of the execution of the

said will, was 55 years old, widow, of sound and
disposing mind, and not acting under duress, fraud, or
undue influence and was in every respect capacitated
to dispose of his estate by will.

7. Petitioner, as named executor, moves and prays that

letters testamentary be issued to her; that he is
competent to serve as executor and is ready to give a
bond as required by the Rules of Court.

 PRAYER

Wherefore, premises considered, it is respectfully

prayed upon this Honorable Court that judgment be
rendered declaring that:

(a) Upon proper notice, publication and hearing, the

abovementioned will of deceased ARTEMIS MEOW
UY be approved, allowed and admitted to probate;
(b) Letters testamentary (or of administration) be
issued to herein petitioner, without bond;
(c) Such other relief be granted as shall be deemed
just and equitable in the premises.

therein are true and correct of my personal knowledge
and/or on the basis of copies of documents and records
in my possession;

4. I have not commenced any other action or

proceeding involving the same issues in the Supreme
Court, the Court of Appeals, or any other tribunal or
agency;

5. To the best of my knowledge and belief, no such

action or proceeding is pending in the Supreme Court,
the Court of Appeals, or any other tribunal or agency;

6. If I should thereafter learn that a similar action or

proceeding has been filed or is pending before the
Supreme Court, the Court of Appeals, or any other
tribunal or agency, I undertake to report that fact
within five (5) days therefrom to this Honorable Court.
